ATHENS -–The UGA Athletic Association board of directors’ executive committee this morning approved a settlement that will pay departing athletics director Damon Evans three months salary as severance, plus a $100,000 longevity bonus earned under his previous contract.
UGA President Michael Adams told the board that Evans submitted his resignation, “which I have accepted,” on Sunday.
The meeting, by teleconference, lasted about 15 minutes, most of that in executive — closed — session.
“As I said on Thursday morning, when I first learned of the situation, this is not an example of the kind of leadership that I expect our senior administrators to set,” Adams told the committee.
“We acknowledge the many positive accomplishments of [Evans'] tenure, including an increased focus on the academic success of student-athletes, the overall financial strength of the athletic department and the hiring of many very good people as head coaches and senior leaders in the athletic department.”
Adams said he would not answer questions from the media about the matter and the future leadership of the athletics department until a 2 p.m. news conference on Tuesday.
According to the separation agreement signed by Evans and Adams on Sunday, the Athletic Association agreed to continue to pay Evans his salary for the next three months, totaling about $137,500. In addition, he is to be paid a $100,000 longevity bonus called for in his previous contract on Aug. 1.
In the agreement, Evans “releases and forever discharges” the university, the Athletic Association and the state “from any and all claims.” He also agreed to a confidentiality provision regarding “all matters leading up to this Release Agreement,” and both parties — Evans and UGA — agreed to make “no statements . . . which are disparaging, critical or negative toward each other or any of their agents, employees or students.”
The agreement also stipulates that Evans “will receive a reference mutually agreed-to by the President of the University and Evans.”

Reality Check: Evans responded to success by excessive drinking and apparent womanizing. As Lincoln said, your character is most shown by how you respond to success – not to failure. NOW that he has failed in response to success is a chance to respond to failure – as you said. Time for a dose of correction and a lesson that will lead to better character. University. In the AJC article this morning it implied that Evans would be negotiate a seperation
settlement with the University. My question is why is there any negotiations? Will the university

I wonder if they’ll discuss other candidates today also. There are a some quality, competent people currently on the administration staff – Arthur Johnson, who’s worked at Texas and Cal, is well thought of across the country as an up and comer and Carla Williams is well credentialed and has a steady unflappable demeanor. There are others in the administration that are not very well qualified for their current positions and really need to go.
Damon, maybe at Adam’s behest, let some talented people go when he took over from Coach Dooley. No doubt there was some dead wood there at the time, primarily because of Coach Dooley’s loyality to folks who’d been around awhile but Damon’s cuts went beyond that. There hasn’t been a lot of independent thinking in the Butts-Mehre building for some time now and I think that’s exactly how President Adams wants it.
I’ve had to interact with President Adams directly from time to time and his arrogance is overwhelming. It’s easy for some to trot out the “you only care about sports not academics” line but that is not the case. My wife and I, as well as two of our children, are alums and proud of the progress UGA has made academically. We support athletics financially but we also give significant money to the Terry College of Business (which is doing an outstanding job of educating students). The academic progress at UGA is more a product of the HOPE scholarship than Michael Adams, though he and the “yes men” on his staff would never admit that.
I have friends on the Board of Regents but I just don’t understand their support of Adams. He is a detriment, not an asset, to UGA. You can rest assured the next AD will be someone Adams thinks he can control.
One last point, the recent AJC article about how much (or how little) is spent on football at UGA should be telling. There is almost an animosity between the administration and the football program. Our coaches salaries are competitive but we are spendthrifts in so many other things like lack of clerical support for coaches. New assistant coaches are shocked when they get here to find out the entire staff must share one administrative assistant.

UGA fans should feel more disrespected about that press confernce than anything. It is proof that the sex drive in humans is indeed strong when in the midst of the Tiger Woods’ situation (and Evans resembles Woods) to say nothing of all the other recent and past sexual scandals, that a well educated, well paid man such as Evans would fall to such poor decision making. That said, there is simply no excuse for a grown man making such a “mistake.”

The University of Georgia, sadly, has fallen almost irretrievably beyond hope. The salaciousness of the charges against Evans are a sad embarrassment to all that is the University of Georgia. Stanford University wins the NACDA Director’s Cup every single year, with scholar-athletes, while the University of Georgia comes in, at best, number 17-18, or so. And Stanford is NOT engaged in all the sordid affairs, as UGA is. This is a sad moment and I sorely pray the University can somehow move beyond this. However, this will take leadership which I believe is sorely lacking!

This is actually a cheap escape for the University- we could have spent more than this on legal fees if he had dug in and played the race card.
“A man of wisdom”- Stanford wins the NCAA Director’s Cup because of the NUMBER of sports teams that they field compared to other schools- not because of a great level of success. A lot of their “points” are defaults because less prosperous schools aren’t fielding teams in water polo, field hockey, etc.
As a postscript, I hope this will cause the Regents and the AA to look inward at the public way that several of the members disparage the institution with their lifestyles.

I cannot even come close to containing how much I hate FUGA, and I constantly expect this “quality of character” from a high school that only copies what others have done (logo comes from Green Bay, song is a hymn, etc). The people that come to mind are “The Runaway Bride”, the guy that ran “up the down escalator” and shut down Atlanta airport, the guy with TB that caused an international scare when he uld boarded a plane, and I could go on but the subject discusts and bores me. This is indeed a sad story; however, let me explain who it is sad for. It is sad for Evans’ wife and daughters, who must deal with the ramifications of their dad’s “DOG” gone wild for many more years to come. I am sad for Bulldog Nation and the thousands of fans who accepted Evans and were very supportive of the job he was doing. I am sorry for my African American community. Over the last few years, we’ve seen the likes of McNair, Tiger, and now Evans, all share something so morally and irresponsibly incomprehensible: An inability (and arrogant unwillingness) to separate right from wrong. Unfortunately, it cost McNair his life; it will ultimately cost Tiger millions of dollars; and it has now cost Evans a lucrative job and most likely a wonderful and supportive wife. Say what you will, but too often we make excuses for this type of behavior, just as Evans did that night. I will not do that. It is an insult to all of us. YES, Evans must go. As when I myself was an impressionable young college students, we looked for those in leadership positions to serve as an example of what “NOT” to do. Nobody expected Evans to be perfect, but we did expect him to heed his own words: “You drink and drive, you lose!” Well, that makes him a loser. Thank God that he only killed his career and family that night, and no innocent drivers on the road. As a happily married mother, I will not blame the young lady with the red panties. She too fell prey to the appeal of an older well-paid guy with “clout” in the community. They will both pay dearly for their decisions that night, but let us not forget that she is not obligated to a spouse or university. And that is why Evans is the biggest loser! So long, to another young, promising brother who has disappointed us all.

I think the thing that strikes me the most is how easily you can lose your job by doing something stupid in your personal life. It’s unfortunate that he worked for a college where we are supposed to be teaching our young people good morals as well as teaching them to use their full potential in life. But somewhere in the back of his head, he should have known that he did not work for an accounting firm or a law firm or some other private company where an episode like this probably wouldn’t cost you your job (much less end up in the news). I think we can all agree Damon did a good job as AD. However, looking back on when he got the job several years ago his resume was paper thin and no one disputes this. There were certainly many white men with far greater credentials as candidates for the job. But do I have a problem with Damon getting the job to begin with over them? Absolutely not. Why? Because one can always make an argument that there is someone more qualified of a different race.
Damon was selected because he was a Georgia man, Vince handpicked him and had confidence in him, and he seemed particularly bright which can compensate greatly for a resume that may be lacking. In any event fair or not the man had personal connections to important people at UGA and race really doesn’t matter in many cases. Its who you know that matters and black or white in this case it was who Damon knew that got him in. Not affirmative action and not his resume. A lot of people both black and white seem to forget this and that most jobs are landed through one’s network and not through a newspaper ad or blind application.

P.S…..I was in Tampa this weekend…and being there made me proud by the communities response to a horrible tragedy…for two white cops were murdered in cold blood by a black man…and the white community did not come out in “hate” for the black race for the act of one evil man…no…the community of both blacks and whites came together to defeat evil…and hate. And the African-American community was mostly wonderful in its condemnation of the killer and support for the murdered cops family and the entire Tampa community as a whole. And I was exceptionally proud of the Tampa police force…that exhibited pure professionalism and emotional control in a time of immense pain and emotion. Mind controlling emotion….the way it should be. Maybe we are making progress still….at least in Tampa, Florida, they are still….

I didn’t give all the information on the Laffer quote. His statement was made in reference to the economic policy and actions that have come out of Washington, DC in the last 3 years. Tampa that is the DIFF between White and Black in GA where we have had Black culture force-feed to us and both Black and White in Ga are just sick of it. I wish it was different, but blacks blame white for everything that is wrong in their lives and whites blame blacks for not doing anything better than being lazy and robbing people. Our 2 communities in Ga. rarely come together on many issues. It does happen but the actions that bring us together never seem to get the attention that the Dividing Issues do.

But, he erred in my opinion by letting UGA off so easy. I really believe they would have paid him $500,000 to $1,000,000 to leave versus the $237,500 or so he got. Just saying.

You’re probably right, and if UGA wanted to fight it they’d likely win in court. But then it’d be all drawn out and continue to create negative publicity. Even with a “morality clause” in a contract, it’s hard to fire someone for cause.
It’s far better for all concerned to reach an agreement, which lets both sides save a little face. If Damon had fought it in court, then his career would be OVER…even if he won the lawsuit. (And frankly, I don’t think he’d have had a chance.) At least now he can make a big production of going to a rehab clinic, say the right things, etc. (Pull a Tiger Woods, in other words) Then…in a few years…maybe he’s got a shot at another assistant AD position somewhere. Perhaps a smaller school, where his contacts might be worth them taking a chance on him?
I can’t say that he was my choice originally, but I have to admit that he’s done a good job for the university. Sad situation for both sides.

I know that from a commonsensical perspective, $237,500 seems like an eye-popping sum of money–it certainly does to me too–but those who think he made off like a bandit from this need to consider the situation in relative terms, taking into consideration the customs, norms, conventions and financial realities that obtain at that level of compensation and executive institutional power.
Relative to his existing $420,000 annual compensation and the attendant lifestyle, it’s not much. Any possible litigation he undertakes for the DUI is likely to cost significantly more money than it would for an average person, even just to negotiate a plea; just by the very nature of his position and financial profile, someone like him would use more boutique versions of the same legal resources that ordinary people would, perhaps out of necessity vis-a-vis privacy and so on. Exuberant prosecutors may wish to make a public tough-on-celebrity-crime spectacle of him and not offer him the same plea deals–or any plea deals–so he might have to fight harder to effect the same ends.
Any divorce at this point is purely speculative and not based in any publicly available evidence, but if assumed, decent divorce litigation for someone with an income and asset situation as complex as his is likely to be can be well over $100,000. On top of that, his wife may be entitled to more than half of marital assets in a fault divorce (his presumed adultery), not to mention child support and alimony, especially if she has no significant income of her own. How much of that $237,500 is going to be left over? 50 cents? He better have some decent savings or investments or other substantial assets to leverage, or he’s deeply screwed.
I’m not saying everyone should cry for poor Damon — whether you are sympathetic to him or not in this situation on a spiritual or practical level is a matter of personal choice, obviously. I’m just pointing out that in the language of the prevalent practices “up high,” this settlement offer from UGA should be understood to be a high-falutin’ version of a middle finger.

As numerous articles in the press about the elements of his contract that give UGA grounds for unilateral termination have pointed out, he can be dismissed for committing a felony, which a DUI is not. He is also expected to behave himself [in a manner consistent with the expressed ethical and moral standards of the institution he represents] and whatnot, but the profoundly subjective nature of that determination is open ground for dispute. From a pedestrian perspective, it may seem kind of obvious that his actions meet whatever standard of “you’ve been naughty” the contract contemplates, but from a litigious one, it is not at all obvious. He could allege discrimination since others with morality/ethics clauses have received DUIs without being fired, while arguing that the woman issue is unrelated to the substance of the alleged breach and is a personal matter. He may not win, but the point is that it could easily cost UGA a whole lot to fight it out.
The confidentiality/nondisclosure element of his settlement suggests that the $237,500 also bought his silence on any improprieties and/or “dirt” he may have on the administration, or anything else he can use as a chip. That’s fully expected and completely standard, but I would think the price would be significantly higher than $237,500 for someone foregoing more than ~$2.5m in compensation.

It is obvious that not many people commenting on here have ever been involved in having to release someone from an organization. Whenever severance is involved the receiving party executes a confidentiality agreement agreeing, among other things not to sue, make disparaging statements, etc. It is common that if the person is high enough in an organization that the agreement binds both parties. I am actually surprised that the severance wasn’t higher. UGA wanted this over and done. Move on to hiring a new AD.

I also agree with your general viewpoint on litigation and legal costs. Doing something embarrassing, politically inconvenient, or laughingstock-worthy is not in itself necessarily grounds for losing your job — there are technicalities that govern that. Well, an unfortunate and sad chapter now closes at UGA; from what I heard he did a good job as athletic director but we are judged by the standards du jour. So unless you are self employed a successful man had better watch his back, because the system is not through with him. The next hurdle for him is settling up with his current wife who will probably strip him down to the bone like a piranha; his productive life is over and he might find a job at one of the historically black colleges when the recession is over but his Division 1 viability is done for; hell they might even have to bring back Vince Dooley and then everyone can be vindicated on all sides.
