Think this Congress couldn’t be worse — or farther out? Sunday’s interview with Cynthia McKinney is a reminder that, had she remained in Congress, she’d be important now.
Despite Atlanta’s financial woes, politicians should not be tempted to try the solution that Birmingham embraces: An occupational tax of just under one-half of 1 percent. The mountains and the sea are the first obstacles to job flight.
No question, home schooling should be treated with the same respect accorded other educational choices parents make. Allowing them to participate in the prestigious Governor’s Honors Program, as directed by the General Assembly, is an overdue acknowledgment of parity with public and private schooling.
Appropriate, too, are the $1.4 million in federal grants to help support new charter schools. The feds should have no more than a tiny, tiny role in k-12 education, the responsibility of state and local governments. Funding new educational models is one of them. Four schools got grants ranging from $200,000 to $400,000.
Yes, there is opposition to privatization of public services in Georgia’s largest city south of Dunwoody. No surprise that Mayor Shirley Franklin’s administration “has seen no great reformation,” as AJC reporter D.L. Bennett found. Exceedingly rare is the elected official who can get past the constant naysayers, unions and bureaucrats to turn talk into action. Talk’s cheap.
The future is seen in a photo in Sunday’s AJC. It consists of four women “chanting in support of health care reform at U.S. Rep. David Scott’s town hall meeting.” Three are wearing T-shirts promoting AFSCME — the American Federation of State, County and Municipal Employees — and three are carrying mass-produced signs that have, on a dime, shifted debate from “health care reform” to “health insurance reform.” The quick change was to demonize insurance companies. Few trust government to run health care. But public employee unions and politicians? A combination to be feared.
Another glimpse of the future: Smokers, rebelling against a 62-cents per pack increase in the tobacco tax, to $1.01 per pack, are beginning to grow their own. It’s a cottage industry now, for sure. But taxpayers do react to onerous taxes. They change behaviors. They quit. Or they beat the system, as with Prohibition. Taxation is the power to destroy and the tool to create crooks or new undesirable behaviors.
The Troy Anthony Davis case is an example of how public opinion can be manipulated, even at the top of the judiciary. Justice Antonin Scalia nailed it: Even though “every judicial and executive body that has examined petitioner’ stale claim of innocence has been unpersuaded,” the majority of justices directed a district court judge to hear his claim of new evidence in the murder of Savannah policeman Mark MacPhail. That, said Scalia, amounts to sending a federal judge “on a fool’s errand” without meaningful guidance. There’s less to the recanted testimony and “new evidence” than is routinely implied. Pity the poor MacPhail family. A headline captured his mother’s hurt: “Never-ending anguish is aftermath of son’s killing.”
The federal government that can’t process “Cash for Clunkers” rebates to dealers is proposing to run the nation’s health-care system. Half the 425 dealers in the Greater New York [City] Automobile Dealers Association is pulling out of the program because they’re not getting paid. Don’t want the same suspense for my body parts.
No fools here. Officials at the Georgia World Congress Center step up efforts to recruit conventions in industries that are getting federal “stimulus” money. Transportation and alternative energy are among them. Industries without access to free, borrowed, tax-the-unborn tax dollars aren’t spending on non-essentials. Those with access to the public’s money are.

The toxic substance was found in every fish sampled, a finding that underscores how widespread mercury pollution has become.

Dropout crisis is statewide problem

A few weeks ago, the AJC’s front page story was “State’s high school graduation rate a crisis.” It reported that Georgia has one of the lowest graduation rates in the country. I
In fact, Georgia is in the bottom five states. But the focus was solely on the Department of Education and schools. Are they really the only ones to blame? Are they the only entities that should be held accountable?
This is a statewide crisis — not an Atlanta crisis, not an urban crisis, not a poor crisis, not a North Georgia crisis, not an African-American crisis — a Georgia crisis.
Most of our Georgia students attend a school where graduating is not the norm. Most of the districts that we live in have low levels of graduation rates at our neighborhood high schools.
With over 20,000 Georgia dropouts annually, the graduation rate is a crisis in every community throughout Georgia. And every community needs to take responsibility for its schools and recognize that this is a community issue. We must all play a part in the solution.

The Supreme Court issued a 3 page decision in the Troy Davis case which Wooten is too dumb to find and read which called Scalia a board certified moron for trying to kill someone who didn’t commit a crime. Time for the aholes in this case on the prosecution side to get out and find the real killer. Pity for the MacPhiail family has nothing to do with Troy Davis but people who bring the stupid to what they write think that it does.
The majority rebuked Scalia and his stupid mute at oral arguments puppy dog Thomas severly and in public. It also for the first time in the history of hte court had to include either Roberts or Alito who until now, have never voted for a criminal defendant in any case, including execution stays.

More than three out of every four Americans feel it is important to have a “choice” between a government-run health care insurance option and private coverage, according to a public opinion poll released on Thursday.
A new study by SurveyUSA puts support for a public option at a robust 77 percent, one percentage point higher than where it stood in June.
But the numbers tell another story, as well.
Earlier in the week, after pollsters for NBC dropped the word “choice” from their question on a public option, they found that only 43 percent of the public were in favor of “creating a public health care plan administered by the federal government that would compete directly with private health insurance companies.”
Opponents of the president’s agenda jumped on the findings as evidence that backing for the public option was dropping. Proponents responded by arguing that NBC’s tinkering with the language of the question (which it had also done in its July survey) had contributed to the drop in favorability for a public plan.
SurveyUSA’s poll, which was commissioned by the progressive group MoveOn.org, a proponent of the public plan, gives credence to those critiques. While arguments about what type of language best describe the public option persist –”choice” is considered a trigger word that everyone naturally supports — it seems clear that the framing of the provision goes a long way toward determining its popularity.

If Troy Anthony Davis is truly innocent, what was the incriminating evidence found in his house by police and suppressed by the judge in his original trial?? Was it the murder weapon???
Why is nobody talking about what the police found in Davis’ house? See the Georgia Supreme Court opinion from 1991 in State v. Davis, 261 Ga. 225 (1991). Would it refute his claim of “actual innocence”?

Troy Davis didn’t kill the cop. The hick ass witnesses lied. Maybe you’d like to take his place. He’s spent 20 years in the slam for something he didn’t do. District courts and the Eleventh Circuit are hicks like you and they make mistakes all the time. They didn’t hear the evidence, and the Supreme Court told them to put it where the sun don’t shine. Now the evidence must be heard. And if and when it goes to the Supreme Court again, it isn’t going up the ladder in the JawJaw appellate system ’cause it’s done out of JawJaws white bread biased hands, the wise Latina will vote. She voted the other night to spare someone in a death penalty appeal and she has a long line of very proprosecutorial votes.

Stevens said that the District judge may have authority to act, perhaps finding that AEDPA’s limits do not apply to “original” habeas writs of the kind the Justices acted on on Monday, or do not apply to a habeas claim of “actual innocence.” In addition, Stevens said, there may be an argument that AEDPA’s habeas limits are unconstitutional if they barred court review of such a claim. Finally, Stevens said, it can be argued that it would be a federal constitutional violation to execute an innocent person.
All of those issues, presumably, will be canvassed initially by the federal District judge, with further review likely in both the Eleventh Circuit and, potentially, the Supreme Court with the new addition of the wise Latina woman.

I admit the Troy Anthony Davis case troubles me. I am troubled first for the family of the slain police officer, who has no appeal, no chance of pardon or commutation. Secondly, I troubled by the fact that there is a possibility that an innocent man might have been convicted. One more look see should not hurt. But, Jim, quite honestly, what disturbs me the most is that, to my knowledge, not one, NO NOT ONE, of the “birds” who changed their testimony over the years has been prosecuted for perjury in the first trial! What is that all about?!?

Although I wish you well in retirement, I also wish that you would have remained a conservative, rather than a republican newspaper writer.
Your column this morning is a good example. You cite a correct example of democrats demonizing the health care debate by trying to focus on the greedy insurance providers.
What would you call the attempt to focus the health care proposal on “death panels”, illegal immigrants, abortion and euthanasia?
Demonizing your opponent for political gain is a very effective tactic. The republicans are winning the health care debate with this tactic when they probably could do so by sticking with legitimate issues.
Representative Linder is a great example of this. At his recent town hall meeting, he stayed away from these demonizing issues and stuck to the central issues of cost and probable effectivenes of the proposed plan. Of course, if you do this, you don’t create any nifty “sound bites” that get you on television or that excite your political base.
What’s that you say? Democrats are no better? Of course they aren’t and if you think I am oblivous to their use of this sorid tactic, you are missing my point.
Remember when President Bush made his feeble attempt at Social Security reform? Democrats immediately ignored legitimate debate and went straight to their tried and true tactic of scaring the elderly (almost always successfuly) by demonizing republicans as those who want to take away your Social Security check.
I think republicans are making a silly mistake (wishful thinking?) in thinking that all the anger (mostly legitimate) being expressed at town hall meeting will translate into republican votes. Why? We tried that party for the last eight years and what did we get? Massive “borrow and spend” fiscal management. One very questionable attempt at nation building in the Middle East. Eight budgets of increasing deficits that included more than 40,000 earmarks. Remember these “borrow and spend” republicans that are now calling for responsible fiscal management are the same group took us from a budget surplus to a $1,000,000,000,000 debt.
What I would like to read and hear are more independent writers and radio/tv commentators and fewer republican and democrat commentators (as well as more independent members of the judiciary and fewer democrat and republican judges (what do you think? – four democrat Supreme Court justices, four republican justices and one independent).

The so-called educated integrationist Negroes absolutely refuse to be responsible. Everyone should be advised that there is no white racism in the United States. White institutions feed, clothe, shelter, educate, and employ Negroes. And they aren’t obligated. White institutions service 99.9% of the basic needs of Negroes. And taking care of Negroes isn’t their God given right or duty. God Almighty has specifically charged Negroes with the responsibility for the survival of their own people. But for whatever reason, white people use their institutions to sustain the lives of Negroes. And in pity, the Negroes spend the entirety of their lives whining and complaining if white institutions aren’t living up to their expectations. What the hell!
There are approximately forty million Negroes within the confines of the United States. And it’s essential that each person has food, clothing, shelter, employment, healthcare, and education. It is the responsibility of the so-called educated integrationist Negro professionals, or able Negroes in general, to build the institutions that common Negroes need to survive in the world. No other people are obligated. In an effort to shirk their responsibilities, the so-called educated Negroes have subscribed to the philosophy of integration. It supposedly absolves them of any responsibility to the common people of their race. lol That being said, any blind person is able to see that if there is racism in the United States, it is no more or less than black racism directed against average black people.
Reason dictates that whenever another race of people is meeting the basic needs of people outside of their racial group, they inherit the power and right to determine that individual’s and or group’s fate. Therefore, if real Americans should decide that Troy Anthony Davis should die, then he should be put to death. And if real Americans should decide that Troy Anthony Davis should live, then he should live. Undoubtedly, other people have earned the right to control the destiny and fate of Negroes. And anyone who believes that a self imposed institution-less, therefore, powerless people, namely Negroes, have standing to voice any opinion in a world controlled by institutionally power driven people the world over is deluded, clownish.

Liberals have been fighting the death penalty for 50 years. Frankly, there is no issue that better reminds me why I am not a liberal. I like to see justice and like to see people held accountable for their evil deeds. If you have not noticed, liberals don’t like being called liberals. They want to be known as “progressives”. Obama has greatly expanded the department that investigates and prosecutes Medicare/Medicaid fraud, not that you would have read about it in the new FOXified AJC. Too bad Bush never believed in regulation.
If you want to see why polls show different amounts of support for proposals, read the questions. When asked if you would like a public option and private options to choose from, 3/4 say yes. If asked whether you support a public option, less than half say yes. Moveon did pay for the poll by SurveyUSA but the result was the same as WSJ/NBC polls when the question was worded the same.
Why do conservatives want to deny me the freedom to choose a public option if I want? Why do conservatives think Americans are too stupid or corrupt to run a government? Those horrible government bureaucrats are your neighbors after all. Why do conservatives admit they have such poor reading comprehension they can’t understand the health care bill which I read in under 3 hours? It is 1000 pages because of the huge type and wide margins and much easier to read and understand than your private insurance policy. Try it, you’ll see. I have received much better service at the DMV than from Comcast. Does that mean all government is always better than all private industry – of course not. Only a fool would make… never mind.

I can let you know who my earthly leaders aren’t. The so-called educated integrationist Negroes are not my leaders.
Our philosophy in life is separatism. Negroes should have the institutions i.e. the power to feed, clothe shelter, educate, and employ, etc the common Negroes and hopefully some white people too.
If we live in a representative democracy, we should remain a representative democracy. But the founding fathers might challenge the idea of a representative democracy in the United States.
It stands to reason that separatism would afford Negroes with the dignity and power to become real Americans. And a chance of becoming a minor shot caller in America. As it stands today, Negroes are no more than so-called educated sophisticated slaves. Believe it or not, the plight of most Negroes during the years of segregation was infinitely better than that of common Negroes of today. I’m not advocating a return to segregation. I am advocating separatism.
The mongrels can remain integrated.

About ending Mrs. McPhail’s grief over her son by executing his (perhaps wrongfully) convicted killer…does she really believe that her grief will be even slightly assuaged by putting Troy Davis to death (either guilty or worse, innocent)? As a fiscal conservative, I’m surprised Jim would espouse the death penalty. A life sentence with no possibility of parole costs the taxpayers of this country approximately $1.5 million over the average inmate’s lifetime. Death penalty appeals, the average running roughly 14.2 years, costs taxpayers approximately $20 million from the filing of the first appeal to the ultimate solution, should that occur. Killing a guilty man isn’t going to bring back the dead. It’s blood lust. It does not assuage grief. Suing a doctor for millions for wrongful death isn’t going to bring a dead child back – was that child’s life measurable in money? Will it ease the pain of that child’s loss? I don’t think so. What if Troy Davis really IS innocent? Black men are disproportionately represented in our nation’s prisons, especially in the south. Only the wealthy get out of serious legal penalties in America. Most criminal defendants don’t fit that profile and most black men accused of capital crimes aren’t OJ Simpson. They are black, poor and have no resources to hire $750 an hour attorneys with multitudes of associates and paralegals. They get a relatively inexperienced public defender with 40 cases on his or her desk who makes $30,000 a year to work a 70 hour week. Our justice system was originally designed to protect the ONE innocent person – which, collaterally also protects the thousands of guilty as well. The Justice Project gets a good number of men and women out of prison, sometimes with life and death sentences based on DNA evidence that shows undeniably that the convicted person could not have possibly committed the crime. What if DNA evidence did not exist (as it did not 30 years ago) and those innocent men had been put to death, which happened frequently back then? Do we just shrug and say “oh, well…”? Our appellate system is set up to avoid that outcome because we are a nation founded on principles of justice for EVERYONE, even “integrated Negroes”. Perhaps Jim would prefer the Chinese legal system. You get a quick trial, have no due process or habeas corpus rights and once the verdict is announced (and it’s usually guilty since you’re allowed no witnesses in your defense) there is no appeal – they take you out to the public square and execute you in front of thousands with a bullet to the brain. It’s quick, it’s cheap and it’s a horrendous violation of human rights. If it were you that had been wrongfully convicted on circumstantial evidence (happens all the time, believe me) or based solely on testimony made by others who had something to gain by pointing the finger at you (like saving their own lives with a plea bargain), which system would you rather be judged by? The one we enjoy here or the one the Chinese government has been using for centuries?
We need to stop wasting millions of taxpayer dollars which the imposition of the death penalty causes, put guilty persons in prison for life where they’ll never get out, and spend those funds on more important things that could stop a lot of crime in the first place; the war on poverty would be a good place to start.
And, Charles (let’s hope you really ARE original and there aren’t any more people out there like you, though I suspect, sadly, there are), after reading your blog entries, I feel truly sorry for you. I’m afraid to find out what you consider a “real American” to be. I hope God feels sorry for you too when your time to leave this planet comes for your sake. Perhaps He will have more compassion for you than you do for others.

Oh, Jim you’re so sly with your comments on the slowness of the “clunker” rebates. When I get a rebate from a private company, i.e., Verizon, Best Buy, Home Depot, etc. the wait time is a customary 4-6 weeks, so what’s new here? As with any start-up program the administration did not anticipate the popularity (and success by the way) of the program. In the end everyone who qualifies will get paid.
I find your comments about the GWC amusing. Yes, they are being smart to attract “stimulus” customers. It is stimulus that is keeping GA afloat, and many other states and businesses. I know you don’t like it, but take a poll of those whose jobs have been preserved, and those who are being re-hired or hired because of stimulus funds and see if they think it’s a boondoggle.
Many of the objectors to all this probably owe their living to government funds, i.e. medicare recipients, Social Security recipients, businesses and individuals who take tax deductions for all sorts of things, States (like GA) who receive stimulus dollars… yes, it’s always that big bad government which is to fault for everything that goes wrong.
This all leads up to my question, if Republicans (so-called conservatives) are so good why is GA’s unemployment rate above the national average, why after 8 years of Bush was not the federal budget balanced, why has there been little headway on reforming health care, Social Security, transportation, etc. Your answer will probably be, it’s all the liberals and Democrats fault. Sound familiar.

They are not interested in your ability to choose for yourself because you just might choose an option (pick your subject) that they disagree with. A key example of this is our Governor, Sonny Perdue, who won’t let citizens vote to decide whether or not liquor can be purchased on Sunday’s. His reasoning is he doesn’t believe it should be allowed. Another example is the GA legislature won’t allow voters to decide whether or not to tax themselves on a local or regional basis for transportation. It also has to do with power. The cash for clunkers program is almost over and dealerships STILL haven’t been paid for the money they had to shell OUT OF POCKET. Auto repair shops around this nation are going to go out of business because this program destroys older cars, many of which still run fine and economically like older Nissans, Hondas, and Toyotas. Biden says we need to “spend our way out of this recession” and many people who bought new cars under this program will default on their loans – the only good thing out of it is business for Mr. Repo Man.
So, the bottom line is that the WOTUS Party feels it was given a mandate for “change” and the majority of Americans are now rejecting said “change.” Of course, the ubiquitous stoic response from the liberals is “Blame Republicans!”

I think it is time to educate some on the word “option”. From the Random House Dictionary of the English Language (1968), 1. the power or right of choosing. 2. something that may be or is chosen; choice. 3. the act of choosing. 4. a privilege of demanding, within a specified time, the carrying out of a transaction upon stipulated terms (example: a stock option). Other than definition #4 there is nothing that compels one to choose. As I have listened and read those who oppose the health care reform public option, it seems that many believe that the word option is being misinterpreted as compulsive. There is also a belief that since the public option is one of the options that everyone will choose it. Medicare is an option and many choose not to use it. Medicare is a government program and the majority of persons who choose it seem satisfied but, again, not everyone chooses it for their own personal reasons.

I attended a town hall meeting with David Scott, Mr. Wooten. A black constituent asked Congressman Scott three times if he would be willing to go on the government’s healthcare plan. All three times Congressman Scott refused to commit. Unions and politicians won’t give up their gold-plated cadillac healthcare. They’re too good for what they hope to foist upon the rest of us.

Re. the arrests by Israel:
Q: You’ve said the Israeli navy attacked your party. Why would they just out and out attack you?
A: Well, I think you would have to speak to the Israelis to find out why they would do such a thing.
Q: Then tell me about this last trip in July when you were arrested and taken into custody by the Israeli navy.
A: Basically, there were 21 of us aboard the Spirit of Humanity, and again we were trying to deliver humanitarian assistance to the people of Gaza … school supplies to the children. And again, while we were in international waters, the Israelis surrounded our boat, boarded it, then took us not to our destination, which was Gaza, but to Israel, and we were incarcerated for seven days.

Free Troy Davis and Execute Judge Sharon Keller
An ignorant vindictive witch with no common sense is being removed from the Texas Supreme Court. Sharon Keller, a Supreme Court Justice had an absoltue mandate to follow US Supreme Court rulings, particular on mornings of executions. The Supreme Court had already stayed all executions in the US until it could rule on the mechanisms of carrying out the death penalty. Yet because this witch wanted to leave early, she refused to accept the appeal based on the Supreme Court ruling and an execution took place because of her stupidity. Now she is being removed from the bench. She says she would do the same thing again. She should be executed.
An Unfit Judge Judge
Sharon Keller, the Texas appellate court judge who closed the clerk’s office before a death row inmate could file a last-minute appeal, is fighting to keep her job. At a hearing on Wednesday, she said in a crowded courtroom that if she had it to do again, she would do the same thing. That testimony is further proof of why Judge Keller needs to be removed from the bench.
On Sept. 25, 2007, Michael Richard’s lawyers called the court clerk’s office to say they were running late in delivering the papers for his appeal. The Supreme Court had unexpectedly issued an order in another death penalty case that they believed provided grounds for putting off his execution. When the request to keep the office open reached Judge Keller, she insisted it would close promptly at 5 p.m. The appeal was not filed, and Mr. Richard was executed hours later.
Judge Keller is now facing five counts of judicial misconduct and a possible recommendation that the state judicial system remove her from the bench.
In court this week, Judge Keller lashed out at the condemned man’s lawyers, blaming them for the controversy. She argued that Mr. Richard could still have filed his appeal by seeking out another judge, but that misses the point. She did not follow appropriate procedures. And clearly, under any interpretation of the rules, given that a life lay in the balance, the clerk’s office should have stayed open.
Judge Keller’s profound lack of appreciation for the seriousness of taking a life — and the obligations it places on the state — is similar to the disturbing dissent that Justices Antonin Scalia and Clarence Thomas delivered this week in the Troy Davis case. They suggested there was no constitutional problem with executing a man who could prove he was innocent.
We believe the death penalty is in all cases wrong. But people who support it should still insist that it be carried out only after a prisoner has been given every reasonable chance to make his case. Judge Keller’s callous indifference in a case where the stakes could not have been higher makes her unfit for office.

Even fans of the President should be hesitant to give the government powers over our health care. The Obama plan may be passed with great intentions, but Obama will not be President forever. Worse men may come to power and use increased government control of health care to enforce their will.
The road to hell is paved with [great] intentions. Let us not stumble over one another to get there faster.

Even the Oracle of Omaha Warren Buffett an Obumer supporter says, the growing mountain of U.S. debt could turn the country into a banana republic.
“Unchecked carbon emissions will likely cause icebergs to melt,” Buffett writes in The New York Times.
“Unchecked greenback emissions will certainly cause the purchasing power of currency to melt.”
The U.S. economy appears to be on a slow path to recovery, Buffett notes, but “enormous dosages of monetary medicine continue to be administered,” creating an annual deficit more than twice any since 1920 aside from war-impacted years of 1942-1946.
Most of the effects of this are still invisible, but “their threat may be as ominous as that posed by the financial crisis itself.”
Congress, Buffett says, must end the rise in the debt-to-GDP ratio and bring U.S. growth in obligations back in line with U.S. growth in resources.

Joseph A, Sestak, retired United States Navy Rear Admiral and currently a Democratic member of the United States House of Representatives, representing Pennsylvania’s 7th congressional district (map) since 2007.
He thinks abortion should not return to the days where it was illegal, dangerous and often deadly.
He’s been endorsed by the Sierra Club.
He supports gun control and has a 100% rating from the Brady Campaign to Prevent Gun Violence and an “F” rating from the National Rifle Association. He also has called for the reinstatement of the federal ban on military style assault weapons.
Too bad, so sad, conned.

But gqwd knows you’ve got to be getting used to it by now.
After all, much as you want desperately to forget completely about it, that scintillating 6% winning percentage in the past two national elections is just a harbinger of more suffering to come for you in the imploding, rudderless GOP…

Pennsylvania: Poll Has Toomey Leading Specter, Sestak
Pennsylvania Sen. Arlen Specter switched parties this spring mainly because he felt he would lose to former Rep. Pat Toomey in a Republican primary.
But a Rasmussen Reports poll conducted Tuesday shows that the Republican-turned-Democratic senator would lose to Toomey by a double-digit margin if the November 2010 general election were held today.
Toomey holds a 48 percent to 36 percent lead over Specter in the survey, which also gives Toomey a 43 percent to 35 percent lead over Rep. Joe Sestak, who is Specter’s chief challenger in the Democratic primary…
CQ Politics assigned an initial rating of Leans Democratic to the 2010 Pennsylvania Senate race, though this survey and other information could lead to a change in that rating.
