Kim Zolciak and her rental home: was she evicted or is she leaving on her own accord?

Kim Zolciak can’t escape the drama – not even from her own residence. And it’s being stoked on Twitter and TMZ.

She and Falcons player Kroy Biermann last year moved into a spacious Roswell home owned by former NBA player Antonio Davis and his wife Kendra. But they are having some tenant-landlord issues.

Zolciak during the “Real Housewives of Atlanta” reunion taped in March and aired in April, said they were planning to buy the home.

But Zolciak now says the house came in far below the $3.25 million asking price the Davises wanted.

She explained in a Tweet at about 3 p.m. EST:

Due to a horrible inspection report with many defaults, & an appraisal done that came in 1.25m less then asking price Kroy & I didn’t buy the Roswell house its that’s simple #notstupidwithourmoney

So she said they put in notice that they were moving out. Kendra Davis said on  Twitter that the reality show couple is squatting and wants them out pronto. A sample Tweet today from @iamkendradavis:

“oh mother goose is getting more and more creative. Stop squatting & start trotting!”

Early last year, Zolciak and Biermann began renting the 11,000-square-foot mansion, the site of their marriage last October. The pending marriage is the focal point of their current Bravo show “Don’t Be Tardy for the Wedding.” During this past Thursday’s episode, they show her wedding security team shooing Antonio Davis away, as if he were an intruder and not the landlord. Zolciak acted all irritated.

Kendra Davis has appeared on both “The Real Housewives of Atlanta” and the spinoff as Zolciak’s “interior designer.” Zolciak has said they were friends. It doesn’t appear to be the case anymore.

Davis gave the lease agreement and emails related to it to TMZ, which has been splashing the back and forth all over the site. (Some skeptics think this whole incident is a publicity stunt to help ratings of “Don’t Be Tardy for the Wedding.”) Kroy sent an email March 29, 2012 saying they were moving out May 30. As of June 5, they were still at the house and being charged $600 in penalties per day. If they don’t move out, the Davises will sue in court.

Zolciak has denied being evicted, that they are leaving on their own accord and have paid their rent.

“Initially, things were fine,” Davis told TMZ live. “I used to think she was more dumb than she was devious. Now, I’m not so sure.”

Davis said she has asked to vacate the property and is proceeding legally to get them out.

Just because you have autistic children doesn’t mean you can use the word or the condition in a demeaning manner. Your comment did not at all come across the way you responded to Speakup. It’s true they do not make the best choices, but that is a limitation of the condition, not because he’s with that loser Kim. Apparently his autism is not enough to keep him from doing normal everyday things so that just might not have anything to do with his poor decision to marry the tramp. Be a little bit more sensitive and don’t throw that word out for articles that are meaningless to everyday people.

I feel so sorry for Kroy. He seems to be from a good family. His parents looked ashamed of him and his situation. They were embarrassed by the horrible display of excess. You can tell they are just normal people. I am sure they wanted better for their son. Kim is just using him for the show. Someone needs to rescue him. I agree-once the money is gone and his career is over-Kim will be gone.

Not sure where you would even report those gifts? Each individual is eligible to gift up to $13,000 per year (in 2012) per person per IRS regulations. You could receive $13,000 from 100 different people and none of it would be reportable income. You obviously need a new CPA!

My house is within a mile from where Sheree is building here house in Sandy Springs. When I bought the house an Estate Sale purchase my Realtor, and everyone thought we were getting a real deal, then came the inspection. We had to swap out closing costs and I ended up paying an additional 1/2 point to cover the closing costs to get it to appraise. The appraiser used houses over a 1.5 miles away. He would only give me a $10,000 boost for converting the carport into a garage, changing out the porch to make it more upto date and much larger, replace the 1965 bay window. Then when we asked him to take it out he said it would make no difference. But Fulton County want’s to illegally raise my taxes based on a value $215,000 more than I paid. In todays world of appraisals to buy a house a gunnite pool is only worth an additional $5,000 in value to your house, but the minimum to install the basic gunnite pool is $55,000.

Long and short my closing had to be delayed 3 times due to the appraisal. Then we almost didn’t close because the owner didn’t want to sign off on papers that lowered the sales price by $5,000 and put the difference in closing costs paid by me in a 1/2% added on to my loan. All she could say was she had the house appraised three months earlier for 26K more. Both Realtors had to tell her over and over that was irrelavent the bank wasn’t going to do the loan for that, and she hadn’t had a better offer than mine in 1 1/2 years.

My big question is why aren’t the Davis’s living in the house? What about the fake Interior Designer Kendra Davis ( Is she registered ??? it is the law to call your self an Interior Designer in Georgia. I have not seen that she has the required BA or BS in Interior Design or Architecture to even get a license in Ga. Then she is going to tell Kim it was $15,000 to Decorate her own house, then next she bills her over $48,000 for services.

I would suggest that Kim check with the State Board of Architects and Interior Designer’s to see if Ms. Kendra Davis is a licensed Interior Designer. If not, she should file charges with the board and they will prosecute Ms. Davis, for impersenating an Interior Designer. By the way Kim, I do have a license and $48K is way out of line for what I saw her do, because i am sure that you or Bravo bought the furniture. A real designer would either charge you an hourly rate of between $50-150 hr depending on who in their firn does the work, or 10% of the cost of the furnishings. The 10% is ussually more than made up in the discounts that your interior designer obtains for you in purchasing the furniture and accessories. So for a $48,000 fee that would have to be $480,000 worth of furniture that I did not see. Also, since this was Ms. Davis house, she as the landlord should have paid for any paint and materials like that which will remain improvements. You should also replace back any lighting fixtures which were in the house when you moved in and take the ones you bought. I would clearly have Bravo and you document the house, as the Davis’ have shown what thy are.

I’m not a fan of Kim Z; never met her but Kim, you made a excellent decision. I would disregard the comments being made here. I’m not sure how many of these people have purchased homes but you certainly don’t do an appraisal until you are ready to buy a house. Since Kim was renting there was no need to do an appraisal. She would be a foolish person (in fact a complete fool) to buy a house for considerably more than the appraised value. The fact that she is “squatting” in my view is irrelevant. I’m sure that allowances have been made in the lease agreement to cover that. She’s given the notice to vacate and I’m sure she will. Things happen and she’s been delayed (so what? – big deal) The fact is, she is paying for the days that she stays over in the property; apparently $600/day. Friendship is friendship and business is business, you don’t pay $3.5M for a house that’s appraised for $2M. You’d have to be a complete fool.

Question: Why didn’t Kroy and Kim just buy a house last year instead of renting one? I can understand that property values are down all over the US and a report recently stated that over 54% of Atlanta homeowners are underwater on their mortgages and then add in the number of foreclosures and brand new houses sitting empty, it really begs the question of why they didnt buy a home in the first place. Something smells fishy with Kim and Kroy.

I must say that this discussion board has been very entertaining for me but I do believe a lot of us are missing the point. A lot of people are angry with Kim because she’s a compulsive, self-centered liar. She stated previously during the reunion taping that they decided to purchase the home and was actually in the closing stages.  Bottom line, she flat out lied about purchasing the home to make Marlo look like a liar, which isn’t that hard to do. I have purchased three properties so far and you don’t reach the “CLOSING” stages until the purchase agreement, appraisal, inspections, etc., have been completed and both parties are in agreement. I feel sorry for all of them, mainly the kids. Nothing’s wrong with making it big and having nice things but when you turn your back on your own mother, that’s pretty low! I truly hope that Kroy can instill positive changes in Kim soon and hopefully her daughters do not follow her nasty ways.

The owners was at the house, because Kim & Kory didn’t get their approval to have the wedding at the house. They didn’t find out until they received an invitation. Mr. Davis, wanted to see what the construction was about. He wanted to make sure the house wasn’t being damage. A renter should have the approval of the owner of a home, before they have a party with 200+ guest. The owner would have to make sure that their homeowner insurance will cover in case of an accident.

1 — An inspection is paid for by the purchaser and the house is “inspected” for any defects or things that might require repair. Most contracts carry a contingency based on the home inspection findings.
2 — An appraisal is done by comparing comparable properties with recent sales and giving it’s value based on those comps. (totally different from an inspection)
3 — Many houses are put on the market above appraisal price (especially really expensive homes) — if they are buying the house with cash they lose and they may never recoup their money — or if they are getting any type of loan banks will not lend above appraisal.7
4 — Buying a home above appraisal is not smart
5 — More than likely the person selling the home has it priced to high because they owe more than it is worth and don’t want to pay the difference once it is sold. A lot of people are upside down in their homes due to the housing crash.
6 — It would be even dumber if you are an NFL player to buy a house above appraised value. You can be relocated at anytime and may not stay anywhere long, so the chances of being there long enough to re-sale the home without losing your shirt is slim.

Anyway, the point here is we don’t know all the details and unless you know how real estate works you don’t need to make ignorant comments.

I happen to think Kim is a trip and Kroy is the dream husband. They are lucky to have eachother and I wish them the best!

To Bottom Line — Actually, once an offer to purchase has been made and accepted most would call it the “closing stage” The purchase contract would have specifics as far as how many days they are given to close. This date is set to allow time for the inspection, appraisal, etc. The house is no longer considered on the market once an offer to purchase has been made and accepted, so I think this would mean it is in the closing stages. Contracts often fall apart prior to closing because of inpections and appraisals. I think Kim’s point on the show was that they had a contract on the house and were planning to buy. The owner’s are probably upset because the inspection was not up to par (meaning they weren’t willing to pay for repairs and the sellers weren’t will to take it as is) and their house came in below what they needed to break even on the house.
