Brian Kemp rejects birthers, declares Barack Obama will remain on ballot

Secretary of State Brian Kemp has put to bed – finally, we hope — the birther challenge to Democratic incumbent Barack Obama’s place on the March 6 presidential primary ballot. From the just-issued press release:

Secretary Kemp stated, “After careful consideration of Administrative Law Judge Michael Malihi’s initial decision and all record evidence based on the criteria set forth in this process, I find that the Respondent, President Barack Obama, meets the State of Georgia’s eligibility requirements. President Barack Obama’s name shall remain on the Democratic Party’s 2012 Presidential Preference Primary ballot.”

It feels odd to congratulate Kemp for doing the sane and obvious thing, but there you go.

Thank God that Secretary Kemp did the right thing. These birthers, if you read their blogs and Facebook pages, are incensed, insane and increasingly using violent rhetoric. I hope that Secretary Kemp and Judge Malihi will take smart precautions for their wellbeing, and that of their families and staff.

As many of you can guess, celebration on this matter will always be premature until the Supreme Court rules on it. Thank Mahili and Kemp for their decision if it makes you feel better. What they did that was valuable was recognize the standing of the persons who brought the case. This ensured that the case can be appealed to the Supreme Court.

As for whether or not their decision was “the sane and obvious thing”, it’s too bad Congress didn’t get the memo before they tried to change the NBC requirement 24 times since it’s inception.

Time for a new Secretary of State! Come on people if there wasn’t anything to hide do you think that it would be an issue.. After Obama gets out of office (Hopefully sooner than later) they need to make sure that this issue never happens again. The Candidate MUST prove his eligibility beyond the shadow of a doubt before he can run… No more secret stuff…For now lets think about how to replace Brian Kemp.

All of my well educated conservative friends think Obama is not qualified to be President. He is being protected by those in power in Washington. The real truth will come out after he leaves office and it will prove his birth certificate is a forgery.We have survived three years so maybe we will be able to survive one more year.

here’s what will happen. Now that the SoS has issued it’s final decision, the birthers will now be free to challenge the decision in a judicial court, not an administrative law hearing.

This challenge will be thrown out like all 99 of the previous attempts.

These birthers would be funny if they were not so pathetic. And yes if there was any way, one iota of a chance, any grain of doubt Kemp would have grabbed at it. So rest assured President Obama has every right to be president as anyone else. The main thing that is hurting him with the birthers is the color of his skin and the fact he is holding “their” position.

George, this has been brought to the Supreme Court several times. The Court has always ruled against the plaintiffs. Always.

According to Secretary Kemp’s Director of Media Relations, Matt Carrothers, Secretary Kemp will have no comment to the media outside of the published statement located here:

Carrothers stated that since the issue is open to appeal to the Fulton County Superior Court, it will be treated as an open legal matter. Secretary Kemp will revisit requests for interviews at an unknown future time.

When asked if Secretary Kemp regrets informing President Obama’s legal team that their lack of participation would be “at their peril” Carrothers referred to the issued statement and said there would be no further comment.

I suppose if anyone out there becomes curious enough about this decision by Kemp, the Georgia open records laws will shed some light. From the same website:

PBO’s already in office, has a birth certificate from Hawaii; what else could be done? He’s not going to win Georgia anyway, didn’t win it the first time.
As for “Bliss” above, if conservatives are “not educated,” what does that make you? When’s the stimulus going to take effect–in Biden’s second term? Is that “education?” We’re three years into PBO’s nirvana; where’s the beef? It must be at Wendys–it sure as h— isn’t coming from any Dims.

The political crazies in the country were wandering around homeless, lost and abandoned until the Tea Party and the “birther” movement came along and oftered them a comfortable and secure home under their tent.

Now they can dress up like clowns and their spew their contempt for the president and the political process that put him into office.

They boast of their devotion to the Consitution, but gleefully tread it underfoot when it collides with their political persuasions.

They display their patriotism in the public square, but disparage the President of the United States, the Commander in Chief and the duly elected leader of the Republic.

This is more than disent, it is the awakening of ugly feelings, emotions and convictions I thought were long buried as this country moved forward into the 21st century.

It’s really sad to see this regression.

Think with your head and not with your mouth. For the record, Mitt Romeny’s dad was born in Mexico. Based on the comments by Ms. Taitz and others “Natural Born” means both parents are born in the US. Last time I check Mexico wasn’t in the USA. So does that mean Richy Romeny is not a “Natural Born citizen”?

IMO, there’s no need for regrets. I think Kemp’s warning to Jablonski was fairly standard procedure, informing him that if he did not show up he stood the risk of not being able to respond to the complainants’ evidence and arguments. I think he had an obligation to make that clear.

But Jablonski was willing to take that risk, knowing as he did that there wouldn’t even be a prima facie case for him to oppose. And Malihi’s ruling completely vindicated his decision, saying that the entirety of the case had no merit and could be cleanly denied even in the absence of opposition. Today Kemp endorsed that decision. I think that, for all the fretting, it went as it should have gone.

I am not a birther and Obama is a citizen of the United States. Those are facts but the case brought before this judge did bring up one legitimate and constitutional question. What does the term “Natural born citizen” mean as far as it relates to the qualifications of becoming President or Vice President of the United States? There is varying opinions from several lower courts and government agencies but that question has never been answered by the SCOTUS. Until it is answered then the question of Obama’s eligibility to be President is a legitimate issue. The rest of the stuff they brought up is garbage.

Gingrich? His birth name (Newton Leroy McPherson) isn’t even close to the name under which he’s run for office. He was legally adopted by the man who married his mother, so his original birth certificate would be under seal.

In addition to that, he was born in Pennsylvania. That means he would get a very, very brief computer generated birth certificate form. That form doesn’t even list the city of birth – just the county. I’ve seen some versions that don’t even list the parents’ names, although I think they do that now that it’s required for passports.

Here’s an example:

It meets all the requirements for obtaining a US passport. It’s got the date filed, the parents’ names, and probably has an embossed seal somewhere. I’m not sure how enforceable that message at the bottom about it being illegal to photograph the document is.

Assuming that
SCOTUS accepts the case (not likely)
Rules that Obama is not a natural born citizen (very unlikely)
Rules that Obama’s Presidency be void and nulllified (unfathomable)

Then, were I a cop or fireman, I would make damned sure to call in sick the day that decision is rendered.
