Democrats to boycott effort to remove Barack Obama from Georgia ballot

Democrats, including the attorney representing President Barack Obama, have made a last-minute decision to boycott the Thursday hearing to consider a “birther” effort to remove Obama from the March 6 presidential primary ballot.

“They can tilt at windmills on their own,” said state Democratic spokesman Eric Gray on Wednesday night.

Last week, in a surprise ruling, a Georgia state administrative judge declined to quash a subpoena directing Obama to attend a hearing Thursday at the Fulton County courthouse on a challenge to strike him from the Georgia ballot this fall on claims he is not a natural born U.S. citizen. Among tomorrow’s no-shows will be Michael Jablonski, the Atlanta attorney serving as counsel to Obama. He’s written a letter to Secretary of State Brian Kemp, a Republican, asking him to intervene and bring the circus to a halt.

Among those pressing the action is state Rep. Mark Hatfield, R-Waycross. But many ranking Republicans are doing their best to keep their distance.

Here’s the statement just released by Mike Berlon, chairman of the state Democratic party:

“Several lawsuits were recently filed against President Obama questioning whether he is an American citizen in an attempt to remove him from the Georgia primary ballot. Despite the fact that these issues have been thoroughly litigated, a hearing has been scheduled in these cases for Thursday, January 26, 2012. The Democratic Party of Georgia is not a party to any of these lawsuits.

“This afternoon we received a letter from counsel for the President directed to the Georgia Secretary of State asking him to intervene in these lawsuits and bring them to a halt, because it is well established that there is no issue here – a fact validated time and again by courts in this country.

“In the letter, counsel also indicated that they had no interest in continuing to appear or participate further in the litigation and have suspended their involvement.

“We respect the President’s position and urge the Secretary of State to bring this matter to a conclusion. We also believe that each political party has the absolute legal right to determine who should appear on their primary and general election ballots according to their own rules without interference from outside parties.

“In light of these developments the Democratic Party of Georgia has no plans to continue to be involved in these baseless cases. Furthermore the Democratic Party of Georgia will cooperate with the President and his campaign in any way requested to make sure that his name appears on the primary and general election ballots for 2012.”

Here is a link to an Amicus Brief filed in this case. I dare anyone to read the entire thing and say that it is not without cause for consideration. The fact is that the term “natural born citizen” has been clearly defined by the Supreme Court. Whether you believe President Obama meets that criteria or not, the law must be upheld because no one man is above it. Wonder what would happen if all defendants were to boycott proceedings when they didn’t feel like the case brought against them had merit. Isn’t that why we HAVE a judicial process? To determine those things? Wow.

I have no position on the case itself, but a “boycott” shows a total disdain for the rule of law in this country. Then again, after signing the NDAA which allows for detention of American citizens on American soil indefinitely without charge or trial…and after assassinating two American citizens who weren’t actually charged with any wrong doing…does this really come as any big surprise? Complete contempt for the Constitution and for the judicial branch.

I read the whole amicus brief. It is a pretzel-logic attempt to make “born in the United States” and “natural born” in the United States, which are one and the same thing to any common-sense person who has a firm grasp of the English language, become jus soli and jus sanguinis, because, according to Mr. Donofrio, holding to the 14th amendment definition requires devoting onself to Christ (I’m not making this up). That’s not the only novel idea in there.

To reiterate: I read the whole darn thing, and not only does he indulge in leaps of logic, he shoots himself in the foot three times (but I’m not saying where–I’ll leave that to Obama’s attorneys). I mean, he presents material that turns the case into a slam-dunk for the defendant.

Look, I don’t know where the guy was born and don’t particularly care. I have no reason to believe the birth certificate isn’t legitimate, and he is ALREADY president. However, I do believe that the Court needs to determine what constitutes “natural-born” citizenship given that a legitimate challenge was raised. But never mind all of that…it will never happen, so who cares about all of that? My gripe is with anyone who has such an utter contempt towards the judicial system as to simply determine that they don’t have to respond. Should the president have to show up? Probably not, but his attorney should show up and go through the same motions that every other defendant in this country has to go through when frivolous lawsuits are filed. If you were to sue me for the dry cleaning of a suit I spilled soda on, I would have to appear or a default judgment would be entered. Are we really saying that political office places one above the law entirely? To the extent one can simply just ignore it if they want to? Is that really where we want to go with all this?

John McCain was born at Gorgas Hospital in the Canal Zone (a United States territory) until Jimmy Carter gave it away in 1979. The American flag flew over the territory. Gorgas Hospital was called the Walter Reed of the South and only Americans (soldiers and American citizens) were born there. Now go back to your history books and learn about the Canal Zone (not Panama). That’s why no one question Mr. McCain’s birthright. Daaaah.

This is to Real News. My mother was born in 1964 IN MISSISSIPPI and her birth certificate says African American. Personally I have never been a fan of the “natural born citizen” clause. As long as a person is a citizen and has lived in the States an X number of years they he/she should be allowed to run for president. Plus just getting on the ballot doesn’t guarantee victory, its still up to the people to decide if they want to elect him president!

It doesn’t matter who Obama’s father is or where he was born. His mother was from Kansas, one of our states. End of story.

Based on the GOP’s logic, Mitt Romney, who was born in Mexico, isn’t a citizen and shouldn’t be president. But his parents are Americans. John McCain was born in a Naval Medical facility in Panama; however, because his parents were American citizens, he is an American citizen.

I have two cousins who were born in France when my uncle was stationed with the Army in France. They have citizenship both countries, though they have lived in the U.S for the vast majority of their lives.

This is an insane issue. There are too many REAL problems facing our country than some wild goose chase like this.

I don’t believe Obama is going to obey the order to appear before Deputy Chief Judge Michael Malihi to determine if he is a natural born citizen, qualified to be on the Georgia ballot, and eligible to President of the United States. If Americans haven’t heard, the politicians in Washington DC are globalist and they abide by international law that’s administered by the United Nations.

On the other hand, the overwhelming majority of Americans are nationalist. They honor the Bill of Rights and the Constitution of the United States. But in the minds of the globalists, international law trumps national law. And as a result, Obama and the democrat party believe they have the legal authority to ignore any proceedings initiated by the “outdated” supreme law of our land.

The Supreme Court has ruled 3 times that Obama is a natural born citizen.

And for the record they also ruled that McCain is a natural born citizen.

Those cases clear the 2008 election and any future presidential elections any of the two enter.

None of the court hearings mentioned by Obama lawyer Jablonsky dealt with the basic issues; they were all dismissed on technicalities. I’ve read most of the volleys back and forth here this evening, and some of the reasoning is just pathetic. For the record, I’m a white native Georgian and proud to be a Southerner. Well, most of the time. We had what seemed to be a goofy rodeo clown from Texas in the White House for 8 years. He meant well, I’m sure, but was clearly in way over his head. His policies (which he didn’t write, only signed off on) very nearly destroyed the economic fabric of this nation. In 2008, I proudly voted for the black guy and will do it again in 10 months without hesitation. He was then- and remains- the best man for the job. Do I agree with him all the time? Of course, not. But he’s sharp, thoughtful, forward-thinking and articulate. He doesn’t speak with my Southern accent, but W did, and look where that got us. He has proven without a doubt that he was born in Hawaii, and like it or not, he is and always has been a citizen of the United States. He’s done a very solid job under horrendous circumstances, and the country gets better and grows stronger every day. Will he win? Don’t know, but he’ll get my vote, along with those of a whole lot of other folks I hang out with up here in North Georgia. I’m totally proud of the man, and I don’t care what color he is. And I’ll just have to live with his lack of a Southern accent….

The posters here that are against the eligibility hearing do not deserve the privilege of voting. There should be an aptitude test to see if one knows enough about the issues to vote. Article II of our Constitution excepts those citizens at the time the Constitution was drafted (George, Adam, et al.) from the “Natural Born” requirement because they were the new Nation’s first citizens, so their parents couldn’t be citizens of the US at the time of their birth.

BO’s Kenyan father disqualifies him from “Natural Born” status and hence he is ineligible to be VP or President. And understand that you need to differentiate between “Natural Born” and plain old “citizen” (naturalized or native) when considering this issue. So many posters wrongly interchange “Natural Born Citizen” and plain “Citizen.” Marco Rubio also is not “Natural Born.” His Cuban parents were not (naturalized) citizens at the time of his birth in the US. He too cannot ever become VP or President! Get it? This isn’t about race. But it IS about someone who knows, as a Constitutional law lecturer at one of the best colleges in the country– University of Chicago– that he is not eligible and pulls a fast one on the sheeple anyhow!

The onus is now on BO to prove that he is eligible. No one in State or Federal government challenged him on this in 2008 out of fear of being labeled racist by those who throw that word around wholesale. This is long overdue and should never happen again.

This is our Constitution, folks. If one can ignore it, then we have corruption (now more than ever) and chaos (more of that real soon). Believe me, that won’t be pretty. And we’ll lose many more liberties in the process.

It is true that all cases filed in The Federal Courts have been dismissed for lack of standing.

Any Georgia voter has legal standing in State Court to challenge the qualifications of any candidate, as provided by the state legislature — actually quite a ‘progressive’ concept. This is why the motion to dismiss was denied. The judge is not an idiot, toothless, or backwoods, he simply must hear the case, by law; the complaint was referred to his court.

The president’s college transcripts, social security number, etc, are immaterial to the question before the court, and will likely not be admitted into evidence. Judges do not take kindly to their courts being turned into circuses for political grandstanding.

Even if his grandmother ‘pulled a fast one’ fifty years ago, the fact is that an official Hawaiian state record exists that indicates a 1961 birth in Honolulu, Hawaii. The Georgia court is bound to give that record full faith and credit per Art. IV Sec. 1. This legally establishes two of the three criteria necessary for qualification to office: 1) he is a natural born citizen, and 2) he is at least 35 years old. The last criteria is that he must have resided in the United States for 14 of his 50 years.

The plaintiffs must prove otherwise, and nothing in any of the filings comes close to doing that.

As I said in my earlier post, summary judgement for the defendant. Case closed. I’m thinking 30 minutes tops.

The fact that Obama is a citizen has never been in question. Is he a “natural born citizen” is the question at hand. There are only two jobs in this country that Constitutionally require you to be a “natural born” citizen and they are to become President or Vice-President. What “natural born” citizen means is up in the air and there are several different interpretations and the SCOTUS has not ruled on the matter.

Maybe you should stop and pay attention to the birther message and consider the vocal few just may be aware of something you choose to ignore. Just maybe birthers are seeing a critical situation that you need to accept and support, or you will find yourself in a very expensive fight to correct a problem and recover the Constitutional Republic.

Why are all of these people saying Obama has a duty to appear in court like anyone else, either personally or through a lawyer? Does he? If an Article III federal court subpoena says so, maybe, but I doubt even that. It’s the federal supremacy clause. It’s separation of powers. Do you people really want your president to have to respond to every nut-case lawyer who issues a subpoena, or every nut-case administrative law judge who will not strike one down?

It is plain that this network of nuts is really intent on subpoenaing Obama all over the country.

Can we set up a place in Africa, or South America, and call it “Birthania,” and just send all of these nuts there to colonize? We can make sure it is all white, so they will be comfortable.

The SCOTUS case of Minor v. Happersett (1874) reinforced and set the precedent for the definition of natural born Citizen:

“The Constitution does not, in words, say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common-law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives, or natural-born citizens, as distinguished from aliens or foreigners.”

Obama, a Constitutional scholar, obviously knows he is ineligible, and that’s what makes him even more reprehensible.

Nonsense, the Jay Treaty, and British Treaty 1951 provide the basis for the acceptance of British Citizenship for the children of British subject present on US soil. In fact it says there well may be others but the court at that time specifically stated it was NOT deciding that question. Birthers’ own cite proves them wrong! You mean this one:
“Some authorities go further and include as citizens children born within the jurisdiction without reference to the citizenship of their [88 U.S. 162, 168] parents. As to this class there have been doubts, but never as to the first. For the purposes of this case it is not necessary to solve these doubts”

That says that the US citizenship of those born to alien parents is in doubt, not whether they were natural born Citizens. They are the ones in between the 2 extremes, natural born, and aliens or foreigners. “Citizen” is held to mean “membership in the nation” in the same case. Try reading it. The doubts as to whether children of aliens are US Citizens still persists today. They are only presumed to be US Citizens, but certainly not natural born Citizens, eligible for President.

WKA was declared to be a US Citizen, since he was born to resident alien parents, who subjected themselves to the jurisdiction of the US by the Burlingame Treaty, but were not allowed to naturalize. NO WHERE does the case say that WKA is a natural born Citizen.

That’s why they grandfathered themselves in by A2S1C5—… “or a citizen, at the time of the ratification…” There were 11 of them grandfathered in that were present in the colonies at ratification

One big mistake-1960’s birth certificates were written by hand and not dot matrix printers. The certificate he produced can be done by anyone. You go in, give your info and they print one for you. I’d like to see the hospital and the raised seal which they have in the lower right hand corner of birth certificates. Obama’s is a fake. His parents were not citizens- the father was a kenyan and the mother was a us Traitor-plus- miscegnation was not approved at that time so barack’s parents were not legally married, which makes him- you guessed it! And he continues to be one. This experiment by the Dems is another one of their failures- next to Jimmy.

if america is a nation of laws, then this fiasco is more than justified…this case has not been litigated in any courtroom in this country…it has continuously been dismissed for technical reasons and has yet to see its day in court….so many of you discount the judicial systems ability to follow the law…

if obama is truely qualified…let him stand up in court and make it known…but for the last 3 years…he has done nothing but inflame the issue by not culling the elephant in the middle of the room…

The President has already presented copies of his short and long form birth certificate and the State of Hawaii has verified their authenticity. And as if the aforementioned documents are not enough, the plaintiff has the gall to request copies of the President’s late mother’s health records from 1961. How absurd! Reading a lot of these posts indicate the race card is being used. It isn’t working!!
The really sad parts of this whole scenario is that the first black person elected to POTUS has fradulently gained entry to this position. So many black Americans looked up to him along with many other people of color. The other sad part of this is his children. They will go through life knowing that their parents were found to be frauds, liars and crooks. What a wonderful legacy to leave your children with. The Obama’s have no conscience for anything but their own gain and no respect for even their children. Sad, just sad.

Further the issue has been presented to the USSupreme Ct more than once and they declined to hear it. When SCOTUS declines to hear a case it means there is not an issue that would need to be decided. That means the CRS meaning of NBC is correct – not yours.
“The weight of legal and historical authority indicates that the term natural born citizen would mean a person who is entitled to U.S. citizenship by birth or at birth, either by being born in the United States and under its jurisdiction, even those born to alien parents; by being born abroad to U.S. citizen-parents; or by being born in other situations meeting legal requirements for U.S. citizenship at birth.”

Were both of Barak Obama’s parentS citizenS?

According to Barack Obama, in 1961 when Barack was born, his his father was a Kenyan CItizen.
At that time Kenya was British Protectorate.
Thus Barak Obama’s fatehr was British subject or citizen and not an AMERICAN Citizen.
Since both of Barack Obama’s parentS were not citizenS, Barack Obama is NOT a NATURAL Born Citizen and according to the US Constitution, he is ineligible to be President of the United States of America.
Because he is inelgible to be President, his name should not appear on the ballot.

Based on what I have read and heard about this matter…

The Supreme Court produced a clear definition of a ‘natural born’ citizen some time ago to answer to requirements of a suit that required the definition.

According to this definition, having nothing to do with Hawaii but I think with Obama’s father’s nationality, I think reasonable, level-headed people, are finding that Obama does not meet this definition. This is a newly presented issue; not the old ‘birther’ certificate issue.

Several of the previous comments seem to have been posted by people screaming ‘racist’, ‘birther’, etc. Please consider that, if Obama is truly not qualified for the office on the basis of a definition set forth by the Supreme Court, anything he signs into law could be challenged for the foreseeable future.

This is a significant issue; not to be dismissed by those who have not delved into the premise for this challenge. [sorry if I have offended any of the products of our public school system - American and Imbecile are becoming synonomous]

I do understand the argument. To be clear: Taitz and Donofrio argue that being born in the United States and subject to its jurisdiction is not sufficient to qualify for the office of president or vice president of the United States. They argue that both parents must also be citizens in order to meet the “natural born” criteria mentioned in Article II.

In other words, they would say that the subject of the landmark Supreme Court case, Wong Kim Ark, was not qualified to be president. I say that Wong Kim Ark was qualified — and so do the courts, which is why, despite their strongly held beliefs Taitz and Donofrio lose every time. They argue as if the the fourteenth amendment does not exist.

I understand that you disagree with this, and you are certainly free to advocate changing the Constitution, but until then I don’t foresee the courts agreeing with your position.

WKA was NEVER deemed to be natural born, only “citizen”, due to parents legal residence in the US and the terms of the Burlingame Treaty, which allowed them to be subject to the jurisdiction of the US, but not to naturalize. The 14th Amendment does not define “natural born”. Minor v. Happersett stated that the definition is not in the 14A. NO SCOTUS has ever held that those born of non US Citizens in America ARE natural born— EVER. Ankeney was dismissed for standing, so any “opinion” is dicta, and certainly doesn’t overrule the SCOTUS.

Birthers need to understand that Minor did not define who is a natural born citizen. It merely noted that one type of person undoubtedly is, the child of citizen parents, but that others might also be, and it specifically said it is NOT deciding that question.

The court of course later did decide the matter in the Wong case.

Nonsense. The end if story is that since the requirement to be natural born Citizen was a security requirement, to prevent foreign influence, it is IMPOSSIBLE to think that one born British is natural born, eligible to be POTUS. Then you have the holding of Minor v. Happersett that confirms. Look at Federalist #68. A “creature of their own” was the preventative step for prevention of “an improper asendant”, i.e an “improper ancestor”.. “Creature of their own” cannot possibly mean birth to a foreign Citizen father. It all lines up.

To those of you who consider this boycott to be an attempt to circumvent the law, realize that this issue has already been addressed. It’s racism. If Obama was white, this would never have come up. Too bad this isn’t a criminal case, or Obama may have gotten out under the double-jeopardy clause. Still, if he shows up, what does that do. At this point, they are making a statement: Obama’s proved he is a natural born citizen countless times, so why is this still an issue?
