Democrats, including the attorney representing President Barack Obama, have made a last-minute decision to boycott the Thursday hearing to consider a “birther” effort to remove Obama from the March 6 presidential primary ballot.
“They can tilt at windmills on their own,” said state Democratic spokesman Eric Gray on Wednesday night.
Last week, in a surprise ruling, a Georgia state administrative judge declined to quash a subpoena directing Obama to attend a hearing Thursday at the Fulton County courthouse on a challenge to strike him from the Georgia ballot this fall on claims he is not a natural born U.S. citizen. Among tomorrow’s no-shows will be Michael Jablonski, the Atlanta attorney serving as counsel to Obama. He’s written a letter to Secretary of State Brian Kemp, a Republican, asking him to intervene and bring the circus to a halt.
Among those pressing the action is state Rep. Mark Hatfield, R-Waycross. But many ranking Republicans are doing their best to keep their distance.
Here’s the statement just released by Mike Berlon, chairman of the state Democratic party:
“Several lawsuits were recently filed against President Obama questioning whether he is an American citizen in an attempt to remove him from the Georgia primary ballot. Despite the fact that these issues have been thoroughly litigated, a hearing has been scheduled in these cases for Thursday, January 26, 2012. The Democratic Party of Georgia is not a party to any of these lawsuits.
“This afternoon we received a letter from counsel for the President directed to the Georgia Secretary of State asking him to intervene in these lawsuits and bring them to a halt, because it is well established that there is no issue here – a fact validated time and again by courts in this country.
“In the letter, counsel also indicated that they had no interest in continuing to appear or participate further in the litigation and have suspended their involvement.
“We respect the President’s position and urge the Secretary of State to bring this matter to a conclusion. We also believe that each political party has the absolute legal right to determine who should appear on their primary and general election ballots according to their own rules without interference from outside parties.
“In light of these developments the Democratic Party of Georgia has no plans to continue to be involved in these baseless cases. Furthermore the Democratic Party of Georgia will cooperate with the President and his campaign in any way requested to make sure that his name appears on the primary and general election ballots for 2012.”

Why are all of these people saying Obama has a duty to appear in court like anyone else, either personally or through a lawyer? Does he? If an Article III federal court subpoena says so, maybe, but I doubt even that. It’s the federal supremacy clause. It’s separation of powers. Do you people really want your president to have to respond to every nut-case lawyer who issues a subpoena, or every nut-case administrative law judge who will not strike one down?
And if you say birthism, at this point in time, is no longer racism, well, it is a rare racist who openly admits to being a racist. It’s like OJ saying he didn’t do it. Birthism today is racism, through and through, to the core.

“Natural-born” undoubtedly precludes anyone born by C-section. Let’s sic the birther dogs on all those who are not “natural-born.” This is so absurd as to be humorous, except that it is tying up courts that have more important issues to decide. It is a free country and everyone has a right to humiliate themselves. I just hope the judges who didn’t quash this are elected and the voters in their districts wake up and smell the coffee. During the 2008 campaign, candidate Obama’s own website attempted to refute the Clinton campaign’s charge of his ineligibilty with the admission that at birth Barack Obama inherited his father’s status as a CUKC, ie, Citizen of the UK & Colonies, ie, a British subject. I’ve done some surfing this morning.
It is plain that this network of nuts is really intent on subpoenaing Obama all over the country.
Can we set up a place in Africa, or South America, and call it “Birthania,” and just send all of these nuts there to colonize? We can make sure it is all white, so they will be comfortable.
There is no way Kemp or Deal are dumb enough to sustain anything this judge does. If they take Obama off the ballot, and a federal judge steps in and says he is back on the ballot, that would be interesting. I’m trying to remember–which side wins those federal-state confrontations?
Dems can only hope that Kemp and Deal ARE that stupid. This would completely galvanize support for Obama.

The SCOTUS case of Minor v. Happersett (1874) reinforced and set the precedent for the definition of natural born Citizen:
“The Constitution does not, in words, say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common-law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives, or natural-born citizens, as distinguished from aliens or foreigners.”
Obama, a Constitutional scholar, obviously knows he is ineligible, and that’s what makes him even more reprehensible.

Scenario 1: Kemp takes Obama off the ballot, a federal judge says to put him back on, and Kemp refuses.
Scenario 2: Arrest warrant is issued for Obama for failure to respond to subpoena. Obama then flies to Georgia in Air Force One for a political appearance. (If I was Obama, that is exactly what I would do, the day after the warrant was issued.) So, what is the State of Georgia going to do–arrest Obama when he gets off Air Force One? (”Excuse me Mr. Secret Service Man, I need to put these handcuffs on the President.”)

Obama has NEVER claimed to be a natural born Citizen, at his campaign websites, paid for by Obama for America, he claimed to be a “native citizen” and an ” American- born citizen”— all lawyerly wordsmithing. . As a Constitutional scholar, Obama surely knows the correct Constitutional term. He has hidden behind the Birth Certicate controversy for three years, and now the true constitutional question is coming to light. Since the purpose of the natural born Citizen requiremnet was the prevention of foreign influence, how can a natural born Citizen of the US be born a British subject, of a British subject father?
