Feds consider challenge to Georgia’s illegal immigration law

Just up at the Washington Post website:

The Obama administration is escalating its crackdown on tough immigration laws, with lawyers reviewing four new state statutes to determine whether the federal government will take the extraordinary step of challenging the measures in court.

Justice Department attorneys have sued Arizona and Alabama, where a federal judge on Wednesday allowed key parts of that state’s immigration law to take effect but blocked other provisions.

Federal lawyers are talking to Utah officials about a third possible lawsuit and are considering legal challenges in Georgia, Indiana and South Carolina, according to court documents and government officials.

Maybe the Obama administration should consider a suit to force itself to follow the laws passed by Congress instead of picking and choosing how to obey the law themselves. Maybe if Obama and the feds would follow the law, there would not be a need for state level immigration laws. It’s deeply dishonest for Obama to argue on on hand that this is a federal matter and on the other hand openly admit that his administration won’t enforce the laws on the books.

Right on spot Jackie. The Obamaites need to understand why the states are passing these laws. The data is there but they are not understanding it. Don’t care to understand I suspect. Examples:

According to a 2010 cost study by the Federation for American Immigration Reform (FAIR), the estimated annual total of the costs related to illegal immigration that taxpayers must bear on the federal, state and local levels in $113 BILLION. Of that, $84 BILLION at state and local levels. This breaks down to approximately $1,000 per tax-paying American household. An average 27 percent of this dollar figure has to do with the administration of justice, while 16 percent are public assistance expenditures. Twenty-one percent go to medical care and an estimated seven percent support education.

Undocumented workers received refundable tax credits totaling $4.2 billion in 2010, a dramatic rise from less than $1 billion in 2005, according to a September 1, 2011 report by the Treasury Inspector General for Tax Administration. At issue is use of a tax break based on earned income called the additional child tax credit, which taxpayers can claim to reduce their taxes owed, sometimes gaining them a check from Uncle Sam if their tax obligation goes below zero. The report states that the payment of federal funds through this tax benefit appears to provide an additional incentive for aliens to enter, reside and work in the United States without authorization, which contradicts federal law and policy.

JV you are totally clueless just as FAIR is. FAIR is nothing more than a propaganda machine just like Fox. Numbers that are relevant are “real” numbers and not those made up by Republicans and their consituents because most of the things they say are totally false. Just ask Michelle Bachman and Sarah Palin. Homeland security’s border patrol already put out numbers that showed that illegal border crossing has significantly dropped over the past 5 years and it being its lowest it has ever been past 2 years. You should be mad at these countless corporations that send OUR jobs overseas and not these jobs that illegals “supposedly” take from citizens (I don’t pick strawberries or work on poultry farms). I have education and qualify for much more than that. But yet those jobs go to India, Philippines, etc. You should be mad at all the manufacturers that take their business to China, Korea, Taiwan. You should be mad that the education system sucks and we can’t get enough people qualified to work in certain jobs that are major for our country.

Did you know that we can’t even manufacture Kindles or iPads in the U.S. because we are simply not qualified to produce this stuff here simply because we have been outsourcing it for so long that they got so much better at it and we don’t even know where to begin.

It has become way too expensive to buy undocumented Democrat votes. In addition to the welfare, SSI, WIC, housing, taxpayer supported free hospital care, schooling with free breakfast and lunch, and crime – according to the U.S. Treasury Department, illegal aliens are bilking the federal government for billions because they are filing fraudulent returns.

The Treasury reported in July that the Internal Revenue Service coughed up $4.2 billion in child tax credits for illegal aliens in 2010 rocketed from $924 million in 2005. ILLEGALS are fraudulently using the Additional Child Tax Credit (ACTC), which was created to give more money to taxpayers who cannot claim a full tax credit for children.

Because all wages, even those earned illegally, are taxed, but since illegals cannot get valid Social Security numbers, the government needs a way to track their income and collect what is due. It does so using individual taxpayer identification numbers (ITINs), which, again, are for those taxpayers who cannot obtain a Social Security card. The refund credit can be claimed even even if no income tax was withheld or paid, up to $1,000 per child. An estimated additional $1.8 billion was going to illegals via the Earned Income Tax Credit, for which they are also ineligible because it can be claimed only by taxpayers with Social Security numbers.

The report concluded that “[t]he payment of Federal funds through this tax benefit appears to provide an additional incentive for aliens to enter, reside, and work in the United States without authorization, which contradicts Federal law and policy to remove such incentives.”

From what I can gather, the feds are saying that states can’t enforce these laws because the federal government is responsible for enforcing immigration laws…but they aren’t enforcing federal laws consistently. I fully support Georgia, Alabama, Utah, etc for trying to get a handle on the economic drain this causes. I still support Obama (mainly due to the alternative) but I think this is a bad move on his part that sure looks like pandering to the Hispanic vote.

If all levels of Georgia Law Enforcement would just arrest the major and minor EMPLOYERS and make sure the TV cameras are handy for the perp-walk, then follow through with rigorous prosecutions this problem would solve itself.
I can’t blame anyone for attempting to improve their life and while the illegals are definitely breaking the law. That said, the EMPLOYERS have known the rules for many years and should be following the LAW! By providing the demand and the funding, they are creating the problem.
I’m sure after they are in prison, their factories, farms and personal assets can be auctioned off to responsible Citizens who will follow the law!

It’s the high wage non-Americans that are here with our consent that is our biggest threat. Educated in our schools and business only to go home and develop businesses that compete with US companies. They ultimately win because they have cheaper labor back home. In the meantime, our cheap labor (our only hope) is being run back to Mexico.

Everyone who complains about illegals, spends their next breath complaining about losing jobs overseas. Our labor market has priced itself out of business. We’re dealing with a global economy. We need to be out looking for cheaper labor, not running it off.

Your right “ordinary American”, illegals are illegal. But I do think the path to citizenship is very cumbersome and expensive (like most government processes) and therefor only the ones who can afford it need to apply. That’s the catch.

I don’t think all who make the argument against iilegals are motivated by racial bias. But, unfortunately, many are. Can’t help but think that if it were Canadians streaming over the borders that anyone would be very upset about it.

These folks are working and filling positions that the average low income American is just not going to perform. It’s a very serious issue.

Within the last hour I applied for part-time work, the application process was very, very, thorough. For instance backgound check about high-school and college, felony conviction, am I legal and can I prove it. Felt like I was applying for a job with the FBI or CIA (it was neither) just a part-time job in retail. My question how do illegals get around this ? Social Security card and proper I.D. seem to elude them but yet are required for employment. Of course fraud plays into this, but I just wonder if these background check are really on the up and up. I think my chance of getting a job was probably better had I been illegal or lied through my teeth. Better yet do most of these retail stores have the resources to check on every potential employees background or work history and how do they route out fraud?

Clear – The illegals seem to be not very incumbered by filing tax refunds or applying for welfare programs or forging fake documents starting businesses, etc.. I think they could handle applying legally. Maybe a few non-essential government workers could be shifted to this area to speed up the process.

I think if you have the same numbers from the southern border coming from the north, yes people would be just as upset.

You are right on the willingness of our own to take low income jobs, but we know what the conditions are our southern neighbors are living. But once they are here legally, assimilation must be expected.

Clear – on the costs I have an idea. Issue the “green card” and do a payroll deduction to reimburse for fees. Employers in some cases I understand may pick up part or all of this expense for these folks. Government likes to give tax deductions as incentives, so make paying these fees tax deductible. Just a thought, not sure how “clear” though.

I wonder how many US born citizens have actually taken the time to see what the process and qualifictions are for becoming legal and how the vast majority of those that want to be here legally will never qualify. I know a handful of people who have been through th process, legally, and they were only able to do so because one came from Columbia and needed asylum, two married US citizens (for the traditional reasons, not citizenship), and one was lucky enough to have a family member sponsor him. I have had many illegals tell me that they want to do it the right way, but many times they might even be forced to leave the country, on their dime, while their preliminary applications are filed. For up to two years. Who can afford that?

I’m with John D on most of what he stated. if in all honesty we want to bring our economy back up to new peaks, we are going to have to begin all working for that cause, but on the same roadmap. let’s make sure we give business to all of those shops, stores, retailers, companies, industries, etc. that have their business here. those that manufacture, produce, and return capitol back to the u.s. i know that when most think of the title “illegal immigrants” we think of horrible human beings that come to steal our jobs, our tax returns, welfare, and etc. but guess what else they’re doing? they’re trying to use that money to invest it back to the u.s. i’m 99 percent certain, if we would give residency to the good natured people whose only crime is illegaly crossing over a border, these people would buy homes, buy land, buy cars, create businesses. i understand that there are a lot of people out there struggling without jobs, but can someone one tell me why everytime my father hires a u.s. citizen (doing the legal thing) to work hard manual labor, only one out of twenty will last over a month, only to later quit as well, while being paid an above minimum wage salary? i guess its easier to collect a $200.00 unemployment check for your alcohol and drugs.

•Illegal aliens are involved in criminal activities at a rate that is 2-5 times their representative proportion of the population.
•In 1980, our Federal and state facilities held fewer than 9,000 criminal aliens but at the end of 2003, approximately 267,000 illegal aliens were incarcerated in U.S. correctional facilities at a cost of about $6.8 billion per year.
•At least 4.5 million pounds of cocaine with a street value of at least $72 billion is smuggled across the southern border every year. ..
•56% of illegal aliens charged with a reentry offense had previously been convicted on at least 5 prior occasions.
•Illegal aliens charged with unlawful reentry had the most extensive criminal histories. 90% had been previously arrested. Of those with a prior arrest, 50% had been arrested for violent or drug-related felonies.
•Illegal aliens commit between 700,000 to 1,289,000 or more crimes per year.
•Illegal aliens commit at least 2,158 murders each year — a number that represents three times greater participation than their proportion of the population.
•Illegal alien sexual predators commit an estimated 130,909 sexual crimes each year.
•There may be as many as 240,000 illegal alien sex offenders circulating throughout America. Based on studies, they will commit an average of 8 sex crimes per perpetrator before being caught.
•Nearly 63% of illegal alien sex offenders had been deported on another offense prior to committing the sex crime.
•Only 2% of the illegal alien sex offenders in one study had no history of criminal behavior, beyond crossing the border illegally.
•In Operation Predator, ICE arrested and deported 6,085 illegal alien pedophiles. Some studies suggest each pedophile molests average of 148 children. If so, that could be as many as 900,580 victims.
•Nobody knows how big the Sex Slave problem is but it is enormous.
•The very brutal MS-13 gang has over 15,000 members and associates in at least 115 different cliques in 33 states.
•The overall financial impact of illegal alien crimes is estimated at between $14.4 and $81 billion or more per year. Factor in the crime as a result of the cocaine and other drugs being smuggled in and the number may reach $150 billion per year.
Still think illegal immigration is a “victimless crime” and we don’t need to control our borders? Remember, about 60% of the crimes being committed are by illegal aliens who were previously deported.

Mr. Obama did promise “high priority to immigration reform his first year of government” got the Latin votes and after two years and having a Democratic Congress doing nothing in this issue his promise was broken….
So all those Latin legal votes are not happy and probably are not going republican either, so this will be less people voting and going to a “do not care” democratic system and thats not good.

States try to do something without real studies risking more and ore racial problems.

Dalton Public Schools are 70% Hispanic. 85% of the outstanding warrants on the Dalton Police Department blog are Hispanic – look for yourself – I’m sure a smart guy like you can google the info. The Health Dept. is broke, the hospital is wrecked, half of the drivers on the road have no license. Everyone in town either has been involved in an accident with an illegal alien, or knows someone who has. Drive up to Dalton and take a look. It is a third world slum, in every respect, because of fools like yourself. You don’t have a clue.

If you rob, cheat or coerce away the goods or services of other citizens, don’t be surprised if the rest of us get together and lock you away in a place where you still won’t have the right to a big-screen color TV or a life of leisure.

ARTICLE VIII: You don’t have the right to demand that our children risk their lives in foreign wars to soothe your aching conscience. We hate oppressive governments and won’t lift a finger to stop you from going to fight if you’d like. However, we do not enjoy parenting the entire world and do not want to spend so much of our time battling each and every little tyrant with a military uniform and a funny hat.

ARTICLE IX: You don’t have the right to a job. All of us sure want all of you to have one, and will gladly help you along in hard times, but we expect you to take advantage of the opportunities of education and vocational training laid before you to make yourself useful.

Folks, lets remember that while many of us may like this law, any GOP candidate that supports this bill can essentially kiss the hispanic vote goodbye! Don’t think this matters? Well, to beat Obama, votes in heavly hispanic states will be needed. Any GOP official that says votes from California, Oregon, Washington State, Nevada, Colorado, New Mexico, New York or even Florida are not important they are lying. Also, its probably no secret to the Obama election team that most people in Georgia, Alabama and perhaps Arizona had not intention of voting for him in 2012. Thus, there is no political risk associated with challenging the immigration laws in court. For the Georgia GOP to pass this bill now is more of a headache than a benefit.

I absolutely LOVE the comments about how the rate of illegal entry into the US have dropped over last few years … Could it be that there has been a lower level of economic activity – commonly called a MAJOR recession? Could it be the separate state efforts to reduce their individual attractiveness so the illegal population have fewer places to go? This is the BEST time to prepare for the FUTURE recovery that the government claims is just around the corner by eliminating the draws that bring the undocumented to us and PUNISHING the businesses that push their expenses off on the rest of us indirectly. And PLEASE NO more harping on the farming situation – they can bring in as many legal workers as they need – they just have to plan to use the tools supplied them for this activity like other businesses. The farms that didn’t this last crop season will in 2012. Time to move on to a real issue.

How you stop illegals from coming??? They need to go back home and say the employers will not give me a job. The employers are to blame not illegals, no job they will leave.
The employer hire the illegals and push down wages for Americans. There is no excuse, there are plenty of Americans trying to get work.

The employer should have to pay $20,000 for each illegal found on his job site whether his employee or subcontractor’s because he is one responsible. He and subontractor should pay, and spend some time in jail.
What about confiscating his business like you take car/boat/house/money when someone is caught with drugs or breaking another law,

You have to blame your neighbor, businessman, contractor, restaurant if you see his work-site does not have a mixed group or too many workers not speaking English. See if your local police will check it out, but with businessman’s pull I do not know if you will get far.

It is time to take the battle against the third word invasion of the West to the next level with NEW laws targeting illegals…how about a challenge to the Supreme Court’s flawed 5-4 ruling in Plyler v. Doe requiring taxpayers to babysit illegal alien children in public schools or the insane ruling giving American citizenship to children of illegal aliens.

Southern states’ laws against illegal aliens are causing them to leave and either self-deport or go to the “sanctuary” areas like California or New York. I am sure that the exodus of productive people from “blue” illegal alien-friendly states will escalate…that’s great! This is another reason that the Establishment wants to stop these laws…they escalate “The Big Sort” of America into communities of like-minded folk.

We do not need a bottomless pool of cheap labor for big business or an instant proletarian mob for deployment by marxist revolutionaries in this country. Post-1965 immigration has been a disaster for America and may cause its death.

Some bloggers here believe that anyone who wants to enter the US should be granted permission…essentially and open borders immigration policy.

US immigration policy should benefit the US and it’s citizens, not the other way around! I don’t care how “hard” it might be to enter the US legally, we are a sovereign nation and like most sovereign nations, the government should make decisions that aid their citizens.

We certainly do not need any more low-skilled workers in the US, we are graduating or failing to graduate from HS, plenty of US citizens that will HAVE to do these low skilled jobs or they shouldn’t be getting any unemployment checks.

Our population is swelling and second generation migrants will not work any harder than current US citizens. Our welfare system as it is currently executed, will only “develop” more slackers here in the US.
