Cobb grand jury indicts Jessica Colotl on felony charge

The Marietta Daily Journal reports this morning that a Cobb County grand jury has indicted Jessica Colotl on a charge of making a false statement.

Jessica Colotl during a Cobb County courtroom appearance last year. Bob Andres, bandres@ajc.com.

Colotl, brought here by her illegal immigrant parents as a child and now a student at Kennesaw State University, became a focal point of debate last year after a traffic stop revealed her own undocumented status.

Says the MDJ:

The felony charge stems from statements made to Cobb Sheriff’s deputies when she was booked in at Cobb Jail for driving without a license. During the book-in, she gave her address as an apartment in Duluth, though she did not live there, sheriff’s officials contend. They also insist the telephone number she gave the deputies was false.

District Attorney Pat Head said his office presented the charge for indictment “because we believe the evidence was sufficient to present to a grand jury.”

Head, though, did not personally present the case to the grand jury.

What a brilliant move on indicting EMC chairman. I’m sure they’ve got a judge in line to handle the charges. What a joke . . . their defense . . . my attorney made me do it. Brock is known for sorry advice to more than one, remember Cobb Board of Education.
Stay after this one and leave the kid alone. How about a list of the preferred stockholders of Cobb EMC. The list released had been clensed. That would be a real eye opener, and I bet more indictments.

Cobb EMC has no stockholders…..all EMC belong to the customers they serve.

Honor student, attending school, no previous criminal record, normally, they would just plead this thing out as the crime is not severe enough to warrant spending taxpayer money one. Looks like Head is trying to make a name for himself at this girls expense. What a cynical piece of dirt he is.

“no previous criminal record”

She is a criminal.

Maybe we should adopt this philosophy towards murderers. After all, the vast majority never kill again. Providing false information to a police officer is a crime – with a penalty. She is in this country illegally – which is also a criminal offense.

A great use of scarce law enforcement resources. Brand this poor young woman as a felon for the rest of her life. Bankers, lawyers, politicians, corporate CEO’s–all need prosecuting for making false statements on a daily basis, but let’s go after a helpless college kid–Let’s send a message to anyone even considering coming to this country to better themselves. And the kids that strive hard and go to college are particularly dangerous and threatening to our way of life.

I think this is a great idea. We indict, convict all of them for giving false information and then they can not vote when we give them amnesty.

LMS: She lied to a police officer so that she could lead a better life. You’d lie to the Gestapo, the Stasi etc to save your skin. Put it in perspective, man. The girl committed a crime, she lied to the police. She didn’t steal or murder, she’s not even a prostitute. Yes, she should pay a fine. But should it be a FELONY? This should be a misdemeanor. That’s exactly what a bunch of conservatives are arguing in the Ohio case – mom lied about where she lived so her kids could go to a different school, ended up in jail for nine days. It shouldn’t be a felony.

Hey pn – SHE’S HERE ILLEGALLY!! SHE LIED TO THE POLICE!! She should be used as an example to all who want to come here ILLIGALLY!! If she had followed the law she would have no problem. It’s her fault and no one should be shedding any tears over this issue.

Boy …Cobb County is something else,
This is nothing more than a witch hunt.
Every decade the conservatives have to select the “enemy”
Perceived or real.
Remember 2001-2010 it was the muslims and the “terrorist”.
2011-2021 It will be the Illegal Immigrants. but the most troubling thing about this immigration situation that upsets me
Is that the imigration issue appears to be regional specific (Mexico)?
What about Canadians,Europeans , and Australian?
(well…..you dont think this has anything to do with Ra _ _ ??…..oh never mind, then you accuse me of using the ra_ _ ca_ _ ….you said it I didnt .)
I use to live in Ohio and there were TONS of illegals from Canada.
Can someone verify that I am not crazy or this appears to be a witch hunt based on Ra_ _ .

What does the prosecution of an illegal immigrant have to do withe Cobb EMC? She KNEW she was in the country illegally, thus her availing herself of services specifically provided to legal residents makes her a criminal. The fact she was identified because of a traffic stop is immaterial to her criminal act. She is a thief. Her parents are thieves. Your support of her means you are specifically supporting that theft. If you don’t like this then change the law. Until you change the law, abide by the law that exists.

What is readily apparent is you are actually using this as a forum to air your opinions about your lunatic conspiracy theories.

If Cobb County was so interested in doing something real about illegal immigration, they would shut down the open jobs bazaar on S. Cobb Dr. just a couple miles from the County Courthouse where this indictment was presented. Practically hundreds of illegal immigrants gather near a gas station every day to wait for people to pick them up in unmarked vans and take them to work sites. Been like that for years, I am sure everyone in the county government knows about it.

But instead they want to pick on a college student who lied to prevent her parents from possibly being deported. Brave man that Pat Head, very brave to stand up for what is politically popular while ignoring the enablers for these illegal immigrants who get them to come to the US for cheap labor in the first place.

Wow! You’re totally right! Comparing what she did to murder really gets your point across! Murder and lying about your phone number and home address are exactly the same, and we should treat both violations with the same severity!

This makes me proud to live in Cobb County, where justice is serve. Also, last week I read an article about some punk that beat and robbed an 80 year old couple in Mableton. The Cobb County jury put that scum bag away for a long time. The criminals know this and that’s why for the most they stay away. It’s not like the City of Atlanta with their rocket docket, you see what kind of environment you create with that nonsense.

Ordinarily, I would say that felony charges for giving false statements to police should come with incidents like the one on Lake Allatoona where two people, including a former Cobb County police officer, lied to cover up a crime. Lying about your contact information is serious because you can skip your bail and disappear. You can skip your court dates, and the worst that will happen is a judge issues a bench warrant. But a felony? It depends on the case.

I think this is one of those cases. If you look at the reports of the incident, this little girl committed a traffic offense, and then when stopped by police lied the entire time. She didn’t just string one little yarn. She did essentially what the people in the Lake Allatoona incident did, that is lie to cover up a crime. This girl is here illegally, driving without a license, and probably driving without insurance. And when she lies to try and hide all of that, people come to her defense?

Forget that. Charger her with a felony then ship her back to Mexico before she gets into an accident that an American’s insurance has to pay for.

Redneck alert!!! She came to the US as a child! Hardly her fault. Oh yeah, I’ve been a Cobb County resident for 25 years, this reminds me of the Olympics and gay issue. But with a leader like Newt (liar, cheater) and a choice other few, what do you expect out of Cobbers? I once called the cops because a stray dog was in my yard (growling, aggressive) and F.I.V.E patrol cars showed up. Sheesh! Gotta love Cobb.

jm – our laws state that what she did is a felony. Pat Head didn’t just make up this law, he is just enforcing the law. If you think it should be a misdemeanor then work to have the law changed. Our country is the best in the World BECAUSE we are governed by the rule of law. Move to any other country and see how you like it. You would probably be on the next plane heading back here. This girl is not special. She is a liar and a deceiver. I went to KSU along with thousands of other immigrants who had no problem obtaining a student visa and a valid driver’s license. This girl could have done that, but she decided to lie and take advantage of the system instead. And now I am supposed to feel sorry for her? Give me a f*cking break. Send her to jail or back to Mexico and good riddance.

Yes she came here as a child but she knew she was an illegal resident…maybe she should have done something about that??? Bottom line is this, she is an illegal immigrant, she drove without a license and she lied to the police……NOBODY should get away with any of that. If you want to say she is being used as an example…then so be it…maybe other people will get the hint.

Let’s just say that we let her stay in college and give her HOPE money to fund college, where can she work since she is here illegally? Is she working now? Someone should investigate the employer.

He did not presented the charge for indictment “because we believe the evidence was sufficient to present to a grand jury.”
He presented the charges “because he believed his political career would be over if he did not.”

Last man is right: every driver pulled over and asked if they knew they were speeding replying that they were not should be charged with a felony

Then td could get his wish to cleanse our voter roles of driver who might vote for higher taxes for transportation

It is sort of like trying to put that proverbial horse back in the barn.
not saying we should make it uncomfortable for the illegals, but I love the poiliticians tripping all over themselves acting all indiginant now.

Funny how we didn’t hear from them when Zell et al were actually cutting privater deals to get them to come to help build up Georgia for the Olympics and the bubble-boom.

They’re a bunch of hypocitres, acting like coroners now – “yup that person is dead”

Word to all freedom loving Americans.

Don’t tell the police crap.
Exercise your right to remain silent.

The only reason anyone needs to know your name or address is if you should wish to be granted a bond. Let them work for their precious “first-responder money”.
And good luck keeping someone incarecerated indefinitely if they provide a real name but say address = homeless
Here- I’ll pay my fine, no bond required.

The more you say to LE, the more you are participating in their “evidence gathering”

Leave the girl alone? You can’t be serious. Everyone is always talking about why Georgia is in such economic shape, well illegal immigrants is one of those reasons. I don’t care if she’s becoming a doctor, she knows what is right and wrong, yet she continued to break the law and use tax dollars to fund her elementary, middle, high school, and probable college education. Mooching off our system has made this a weaker state. There is not one definitive reason she should be able to continue school, or even remain in this country. She has had plenty of time to right they ship, and she continued to slip through the cracks until she finally got caught, most criminals do until they are caught. I don’t want my degree from Kennesaw tarnished because it’s known for letting illegals smooches off the system and get a degree with other American citizens that are true Americans.

When a child is brought to this country illegally, what do you want them to do? The day they turn 18, return to their country? The point is that it is not that easy to become a citizen. You can’t just go to the courthouse and fill out papers.

We need to FIX THE SYSTEM. It’s so far out of control, the best thing to do at this point is give amnesty to those here illegally, and make it easier to become a citizen in the first place.

She is costing the Cobb citizens by appealing her conviction on charges of driving without a license AND lying to the police. She knows she was guilty yet decided to stick it to us yet again costing judicial time and money for an appeal.

Martha Stewart went to jail for a whole lot less, and she paid a boat load of taxes and was here legitimately. Colotl availed herself to HOPE scholarship money and in-state tuition by lying on her application. She also purchased a car illegally and drove it illegally. How was this car ever registered? Someone used a legitimate citizen to allow this or she has fake documents – yet another lie.

I am so sick of these illegal immigrants using our public benefits and then demanding special treatment for law breaking. The knife attack in Lawrenceville was horrendous, by of course an illegal immigrant. What I want to know is how the victim at age 23 with three children can possibly afford a house that I can’t when I have worked my whole life and paid taxes.

For those that feel that the DA’s decision was a waste of resources, I say not. Right back at Coloti in that she wasted our resources on a jury trial for a traffic offense. While that was, in fact, her right, it is the right of Cobb County to come back at her on such a charge. This should further educate Coloti if she intended on getting a law degree as has been previously reported.

Contractor, get a clue. Look at the great state of Texas. They had (ewww, the bad word….) MEXICANS there illegally longer than we progressive, too busy to hate, Georgians and their economy never tanked. We should adopt Alabama’s motto, “thank god we’re not Mississippi.” Move to Arizona or something.
