Two bills to ban Sharia law in Georgia courts

Because we can’t let Oklahoma get ahead of us, state lawmakers could soon debate the “American Laws for Georgia Courts Act.” From the Fulton County Daily Report and Law.com:

House Bill 45, introduced by Rep. Mike Jacobs, R-Atlanta, states “it shall be the public policy of this state to protect its citizens from the application of foreign laws when the application … will result in the violation of a right guaranteed by the Constitution of this state or of the United States.” The bill also would prevent arbitrators or tribunals from enforcing a foreign law that didn’t meet constitutional standards.

Jacobs, a lawyer and vice chairman of the House Judiciary Committee, told the Fulton County Daily Report the bill would “ban the use of Sharia law in state courts.” He acknowledged that he was not aware of any instances in Georgia where a plaintiff or defendant asked the court to apply Sharia law but believes it has happened elsewhere.

“We’re seeing more of a feeling that Sharia law should be applied in domestic cases,” he said, such as divorces.

The chairman of the House Judiciary panel, Rep. Wendell Willard, R-Sandy Springs, has signed on as a sponsor but hedged when asked whether he supports the bill.
“I want to see what comes up in hearings,” Willard said, to answer this question: “Does it serve a real purpose or is that standard [that federal and state laws trump foreign laws] already recognized by courts in the state?”

M. Khurram Baig, a litigator with Kumar, Prabhu, Patel & Banerjee in Atlanta and a member of the Georgia Association of Muslim Lawyers, said the answer is no: “I don’t know of any instance where foreign law has prevailed in a Georgia court ever. So why is this necessary?”

But Jacob’s isn’t the only bill on the topic. State Sen. Judson Hill, R-Marietta, has a similar measure — SB 51.

Since one US Supreme Court Justice has announced that America “must” consider foreign law instead of the Constitution in deciding the validity of laws, this measure is appropriate and timely. There are many in this land who would like to adopt European-type laws forbidding free speech, press, association and of course gun ownership.

There is nothing in the historical record to indicate that Islam is “the religion of peace.”

I agree with Rep. Willard. Let the hearing process explore this issue to see if it actually is a problem.

As far as Rep. Jacobs, I feel that this issue is probably ninety percent “showboating” and surely there are more germaine and important issues that our state faces right now.

The outrageous new court filing fees and copy fees passed in previous sessions need urgent reform. They seem almost punitive in nature. The courts in our state need to be open for all segments of our population and not just the wealthy.

This move to stop Sharia law is a good idea. All you need to do is pay attention to some of the rulings in the courts in Europe. Essentially what has happened over there is that there have become a seperate set of laws for different citizens. For instance, in Germany a couple of years ago, a judge ruled that a divorce case should be settled by sharia law since she was a muslim. The judge then denied the woman the divorce even though there was evidence that the woman had suffered domestic abuse. In England there have been pushes to allow the muslim community to have it’s own court system to handle domestic cases. So in other words, the laws of England no longer applied to its muslim citizens.

This is exactly one of the things that Thomas Jefferson wanted to prevent when he formed this country. I just visited his memorial in Washington DC two weeks ago. I encourage you all to visit that memorial and read his quotes concerning the importance of keeping all citizens equal under the law regardless of their religion. Ultimately what happens if you don’t keep the law equal for all citizens is that you create a special class of citizens who are above the law. This is exactly what has happened in Europe. Many European non-muslim citizens are beginning to feel as though they are second class citizens in their own country.

Even our own President will sue any State for trying to make a law to protect the lawful citizens of that State and when there is that level of disregard for the rule of law, we don’t need any degree of conflict with the “law of the land”. In a recently overturned case, a “trial judge found as a fact that defendant committed conduct that constituted a sexual assault” but did not hold the defendant liable because the defendant believed he was exercising his rights over the victim….The trial judge found that most of the criminal acts were indeed proved, but nonetheless denied the permanent retraining order. This judge held that the defendant could not be held responsible for the violent sexual assaults of his wife because he did not have the specific intent to sexually assault his wife, and because his actions were “consistent with his [religious] practices.” In other words, the judge refused to issue the permanent restraining order because under Sharia law, this Muslim husband had a “right” to rape his wife.”

It already is policy to prohibit the application of ANY law– domestic or foreign– that violates a constitutional right. Thats why when a law is “unconstitutional” it cant be enforced. Whether it originated here or in Zimbabwe. It doesnt matter.

I posted a concrete example of how a judge allowed sharia law to supersede our laws. Luckily a higher court reversed the decision BUT it is an example of what CAN happen. Those of you who keep whining about jobs, how about going out and looking or starting a business…oh wait, you don’t want to be part of those evil corporations! Like a previous poster said, government CANNOT create jobs, they can only create an atmosphere that entices those “evil” corporations to open a facility in GA. Reduce taxes, reduce spending…it works! I would think the Supremacy Clause from the US Constitution would cover any problem, real or perceived.

Some people still don’t understand that it is not the federal or state governments job to create jobs. When the government creates jobs they have to take more money from the tax payer to pay the salaries of the jobs they create. The government doesn’t have any money other then what they take from us to give to others. As for Sharia law, there are several states that have been trying to use in during court cases when muslims are invovlved. Sharia law has no business in our courts in any way. Wow, to see all the small goverment conservatives who get up in arms about the government passing stupid pointless laws cheering this on is hilarious. The 14th Ammendment to the United States Constituion reads:

Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Applying Sharia law to Muslims invalidates the Equal protection clause of the 14th Ammendment because it creates unequal protection ruling it immediately unconstitutional.

Whoever said the Founding Fathers didn’t have Radical Muslims in mind when the Constitution was being written don’t know history very well. Read up on the Barbary Pirates. They are where the line ‘The Shores of Tripoli’ in the Marine Corps Hymn comes from. They were Radical Muslims who lived all along the coast of North Africa. They were most famous for taking Europeans as slaves. They captured hundreds of thousands of people over about 300 years and most of the nations of Europe (including the US till about 1800) actually paid tribute to them to leave their ships alone. The US spent 20% of it’s GDP in 1800 to payoff the Barbary Pirates, and lead to the formation of the US Navy. So I think the founding fathers knew what Radical Muslims were. Tactics have changed over the past 200 years but the Barbary Pirates were not too different in their views of Islam than Al Queda or other Radical Muslim groups today. But the US survived the Barbary Pirates and we will survive Al Queda as long as we don’t destroy ourselves in the process by letting terror replace freedom with security.

While all of you are busy trying to paint the legislators of this bill with tinfoil hats, know that Sharia Law just killed a Pakistani child because she was RAPED by a 40 yr old cousin so she was considered an adulterer because he was married. His family was allowed to beat her and then she was sentenced to 100 lashes in the streets but only made it to 70 before she died. This is Sharia Law.

If you are gay you are hanged. If you are a woman you are allowed to be beat and raped daily by your husband. You are sold like a slave to the highest bidder for marriage and are not allowed to have a voice nor show your face.

If this was so unnecessary, you would not have occurances like the NJ court a judge refused to give a wife a protective order after her husband repeatedly beat and raped her, because the judge said he must defer to Islamic law. @Warrior Woman: Read more on the NJ case. It was overturned by an appeals court judge. That means, that our system of law worked exactly as it should. Judge A makes a bad decision, Judge B throws it out. Also, US Courts accept the outcomes of arbitrators anytime both parties agree to it. If two Muslims want an Imam to arbitrate a disagreement, the courts will agree to it. If you have a civil issue with a neighbor and you both go to the local Catholic church to have a priest arbitrate it, then it is upheld by the ‘civil’ court. The key is both sides have to agree in writing to arbitration. This is basic contract law all across the United States. Rape, Murder, Honor Killings etc, are all in direct violation of criminal codes and therefore are only tried in criminal courts. If Joe the Muslim kills his daughter because she looked fondly at the Christian boy down the street, he is tried for Murder. I don’t know of any murderers or rapist in the US who have gotten off with a Sharia based defense. Until that happens this law is a waste of time and adds a stupid pointless law to the books.

Laws, including what is proposed here, do not dictate what rulings a judge can make.

Sometimes judges make bad rulings, which is why there is an appeals process.

The bill presented in this case won’t prevent judges from making bad calls.

The big thing about this bill, is that it basically says:

“Any law that’s unconstitutional is unconstitutional”

To which I say: “DUH”

The bill being presented says:

“it shall be the…policy of this state to protect its citizens from the application of foreign laws when the application … will result in the violation of a right guaranteed by the Constitution”

Georgia and the USA need Shariah Law. It is the most American Law there could be – as opposed to Christian (which IS foreign) or Jewish (again a FOREIGN law). Shariah Law is the law of God, The Law of Truth, The Law of Conscience – unlike Judaic Christian Laws which are Roman (FOREIGN) Pagan in origin and highly primitive and contradictory by comparison.
