RNC threatens Roy Barnes over use of elephant logo, and the letters ‘G,’ ‘O,’ and ‘P’

The Republican National Committee has threatened to take Democratic nominee Roy Barnes to court over the use of its elephant logo on his “Republicans for Roy” web site, as well as the letters G-O-P.

Who knew GOP was a registered trademark? Sounds like the legalese you hear before baseball games: “No accounts” of the game allowed without permission. Which, if strictly enforced, would really hamper water-cooler talk.

Read the Sept. 30 letter here. In part:

Mr. Barnes clearly lacks a belief in private property rights, as his unauthorized use of the RNC’s intellectual property demonstrates. The Barnes campaign’s use of the RNC’s Official Elephant Logo and “GOP” trademark thus appear to be clearly designed to mislead the public into thinking that Mr. Barnes is someone he is not and that he has the support of the Republican Party, which he assuredly does not have…

The RNC hereby demands that the Roy Barnes campaign immediately cease and desist from utilizing “GOP” and the Official Elephant Logo or we will be forced to pursue the matter in a court of law….

The letter is signed John R. Phillippe Jr., chief counsel for the RNC.

But no doubt the RNC will need local counsel as well. We have in mind a certain Marietta law firm with a GOP-documented reputation for suing the heck out of rich businesses — and winning.

Update at 3:15 p.m.: Both sides are looking to stoke this issue. Said Rachel Bauer Taylor, spokeswoman for the RNC:

“Roy Barnes is no Republican. In fact, he’s running as a Democrat against the bona fide Republican, Nathan Deal. During his former reign as a liberal Governor of Georgia, he left Georgia with a $640 Million shortfall at the time he was fired and also the largest overall job loss in the state for that period since the Bureau of Labor and Statistics first started tracking back in 1939. Roy Barnes was wrong for Georgia back then and he’s certainly wrong for Georgia now – no matter how hard he tries to cloak himself in our logo.”

And the retort from Emil Runge of the Barnes campaign:

“Congressman Deal asked his Washington friends to protect him after he saw how many Republicans were flocking to Roy Barnes. Georgia’s Republicans know that unlike Congressman Deal – who voted for the largest tax increase in state history – Roy is the true fiscal conservative in the race for governor.”

I am a lifelong Republican, and yes, Roy Barnes is the best choice for governor in this particular election. I can affirm that I and many, perhaps most, of my Republican friends are also supporting Roy Barnes. As such, Mr. Barnes portrayal of Republican support for his candidacy for governor is fair and accurate, and as Republicans we approve the use of our elephant logo and the phrase, “Republicans For Roy.” The RNC does not speak for us, and frankly, on this issue, the RNC doesn’t represent the majority of Republicans I know who support Roy Barnes.

Sounds to me like the GOP is starting to wish Karen Handel had won the primary. Maybe they ae realizing the Deal ain’t such a deal anymore. Lynn summed it up for me. The silent majority in the middle who would like common sense in politics instead of one extreme or the other. So where are the candidates? What if a qualified write-in candidate would present themselves? Can you imagine if we voted an independent, highly qualified candidate into office over the lesser of evils we have now?

Barnes’ campaign has made so many missteps last time and now in this one, it’s become comical. Instead of using the “official” logo which they should have known better (again comical), they should use a big elephant with it’s foot on Deal, holding him down.

It is extremely sad that the race for governor has come down to a choice of the lesser of two evils. I would say it’s going from bad to worse but, in this case the bad is horrible. Another problem with bad to worse is that it’s hard to decide which is which. This lawsuit is simply an attempt to produce as much negative publicity as possible for Mr. Barnes – the same thing his campaign is doing to Deal. It’s awful when mudslinging causes you to vote for the candidate you hate the least. The candidate that gets my vote is the one that doesn’t stoop to mudslinging. Oh wait, there isn’t one.

You see, if he has an (R) by his name, then he’s “good and honest and upstanding and has our kind of values.” But more imporantly, he’s not one of “those people.” The benefit of the letter-by-the-name system is that folks don’t have to turn off “Dancing with the Stars” or other important pursuits to inform themselves on the candidates or the issues. Just pick a letter and stick with it. No objective analysis or critical thinking required.

The author clearly has no grasp of trademark law. Of course GOP and the elephant are registered trademarks. Democrats have their own as well. Trademark law and the law of unfair competition protect the PUBLIC (not the Republican National Committee) from being confused- in this case- as to whether or not the GOP endorses or sponsors Roy Barnes. In this case it does not, but the use of the GOP’s trademarks makes it appear as though he has such an endorsement or sponsorship. This case is a slam dunk- and a flagrant misuse of trademarks. If the GOP DIDN’T send such a letter, they could also later be accused of failure to police their marks, and their rights could diminish.

The Barnes camp should know better. Nothing stops them from saying that “members of the GOP” endorse him, etc. This is a fair use. They also appear to be guilty (as does the author of this article) of preying on the general public’s ignorance of the law governing this subject- and ignorance of the law’s purpose- in order to make members of the GOP look bad. Shame on you.

not sure what the legal standing on this is – but the Republican Party didn’t actually “create” the elephant as a representation of them. The creator of this was, if I’m not mistaken Thomas Nast. If not him, then another of the late 19th Century Political Cartoonists did it. In either case, the usage is pretty old and its copyright may have expired. I suppose that depends on whether or not they’re suing about the use of an elephant or a specific design of one.

Of course – I don’t think that this lawsuit has much merit anyway. If just one “member” (not sure how to define this in an open state like GA) of the Republican Party openly supports Barnes then technically they bring the usage of the terms Republican and its logo with them. It’s like if Chipper Jones goes out on an autograph signing tour he still retains the ability to identify himself as a member of the Atlanta Braves and can be introduced and promoted as “Braves Superstar Chipper Jones.” So if there are actually Republicans supporting Barnes then technically speaking the terms/logos could be used. If GA were a closed state with strictly defined membership you might could make an argument otherwise.

I think there are some Republicans supporting Barnes and have mentioned so on this board, just as there are some Democrats supporting Deal, I’m sure. Overall this whole thing seems kind of silly. If this case proceeds and the courts find in favor of the RNC then hypothetically it could criminalize the use of the opposition party’s name. So the RNC could get sued for saying “Obama and the Democrats want to raise your taxes” simply because they didn’t have permission to use the term.

Excuse me, but have you ever bothered to pick up a newspaper? In case you’ve missed it, Georgia’s unemployment rate is higher than the national average. There are virtually no jobs in this state. Recent college graduates who have worked for years in order to have a bright future are being forced to accept minimum wage jobs simply to pay the rent. No one’s job is safe — whether you’re a teacher or a CEO, there is no real security in this country any longer. And as for health insurance — those of us who work for companies that do not offer any sort of health benefits do the best we can to get by. Put yourself in someone else’s shoes before you deem anyone without a job and/or health insurance as some lazy parasite. Act like a human being, for God’s sake.

Idiots who know absolutely nothing about Roy’s actual fiscal record will not be able to compute this but the truth about Roy’s fiscal record is he has always been fiscally responsible. He was favorably rated by the conservative Cato Insitute. In his last year in office (2002), the Cato Institute rated Roy as 3 out of the 50 governors for being fiscally responsible. It doesn’t matter how “fiscally responsible” Barnes is nor what the Cato Institue says about him. The hard, cold fact of the matter is that Barnes was ‘voted out’ of office. Nothing has changed the fact that the majority of voters don’t want to travel that road again. Roy will lose, Deal will be elected and the sun shall rise the day after the election – just as it has throughout our lives.

Since Barnes is such a good fiscal conservative of the states money, and you know so much about money can you answer me this question.

Barnes has promised teachers 6% raises every year, no more furloughs and give back their national certification supplement. According to the AJC the Federal stimulus money that will expire this year is about $1 Billion and this paper has also said that for these three promises to be kept will cost about $1.5 billion. The state revenues are not increasing so how is Barnes going to pay for this additional $2.5 billion? The entire states budget for this year was $18.5 billion so this would mean he has to come up with an additional 15% increase in the budget since Georgia has to balance its budget every year. Is he going to raise taxes on the rich to raise this money?

BTW: This does not cover his promises for high speed rail and now today tax cuts.

Regardless of what you say, Barnes has never been as fiscally irresponsible, personally, with the public money as Deal has been with his own money (which will become your money once he files, and he will have to file).
Face it, Roy lost because “Sonny Lied” about the stupid flag issue.

I wish the AJC would take a good look at Carol Porter. From all appearances she is a forthright, honest and refreshing new face in GA politics.

The focus of this issue is of promises made and promises broken by the same man who would be governor again. I learned early in life that liars rarely (if ever) become non-liars. This negs the question, “If he lied about the vote on the flag, what else has he lied to us about and what other lies will he tell in the future.” It goes to the very heart of Barnes’ credability.

Are you saying you voted for Perdue to run the state for the last 8 years. If you are a citizen of Georgia, how has that worked for your family? I do not remember Barnes coming out and saying that he would let people vote on the confederate flag. I am just tired of our great state being on the bottom of the list all the time… And this should go without saying, but I don’t want someone that can’t manage their own money in charge of the state budget and how that money is spent. Would you want them managing your back accounts?
