It’s tough to be an illegal immigrant in the United States these days.

But it’s even tougher to be an illegal immigrant caught up in the meat grinder of a Republican primary.

Jessica Colotl, the 21-year-old Kennesaw State University student from Mexico whose secret was uncovered during a traffic stop, must think she’s hauling the entire GOP race for governor on her back.

Three candidates — former state Sen. Eric Johnson, state Insurance Commissioner John Oxendine and former Secretary of State Karen Handel — say they’d like to see people like Colotl expelled from all state universities.

A spokesman for Nathan Deal says that, for years, the former congressman has written university officials in North Georgia, warning that they break federal law when they permit undocumented students to pay in-state tuition rates. As Colotl did.

But the young lady can take some comfort, however small, in the fact that she has merely become the face of a debate that has been bubbling within the state Capitol for years — out of sight, just like Colotl and her parents.

Policy has been the driving force. On one hand, an estimated 60,000 to 70,000 undocumented students graduate from high school each year in the U.S., according to David Hawkins, director of public policy for the National Association of College Admissions Counselors.

Denying them access to college, advocates for the undocumented say, is a sure-fire way to create a permanent, uneducated — and thus dangerous — underclass.

But in Georgia, the prevailing argument has been that undocumented students eat up the resources — and limited university slots — that should belong to legal residents of the state. The result, it appears, has been a rear-guard action to dilute and delay.

In 2005, five Republican state senators — including Chip Rogers, now Senate majority leader, and Casey Cagle, now lieutenant governor — introduced SB 171, a bill to bar undocumented students from all state universities under any circumstances.

It was withdrawn. The next year, the Republican-controlled Legislature passed SB 529, which — until Arizona passed its measure this year — was called the nation’s toughest state-sponsored attempt to curb illegal immigration.

The legislation shut off state-paid benefits to illegal immigrants in a number of areas. But the bill permitted the Board of Regents, which oversees the University System of Georgia, to develop its own policy toward undocumented students, as long as it complied “with all federal law” governing restrictions on “public benefits.”
That last phrase is important.

“State and federal law are very clear — those in this country illegally are not eligible for any public benefit, including postsecondary education,” said Ben Fry, campaign manager for Johnson — who was the ranking Republican in the Senate when SB 529 passed and voted for it.

But others say that by permitting the regents to adhere to federal guidelines, the Republican-controlled Legislature authorized a loophole.

Deal’s office pointed to an official 2007 congressional interpretation of federal law: “Unauthorized aliens are neither entitled to nor prohibited from admission to postsecondary educational institutions in the United States.”

Pell Grants, the HOPE scholarship, even in-state tuition are considered a “public benefit,” and illegal immigrants are barred from receiving them. But admission to a university is not. This is the regents’ formal policy.

“There is no legal prohibition to admitting a student to a college. That’s not considered a public benefit, even at a public university. I don’t think you could talk to any lawyer who says that admission is a public benefit,” said Hawkins of the NACAC.

There is more. SB 529 demanded that businesses and other entities receiving public contracts verify that employees and other recipients of public funds are indeed citizens. But the Board of Regents was exempted from the requirement.

Since 2007, state universities have required students to provide a Social Security number, or, if they aren’t citizens, proof of legal residency.

But the University System isn’t required to make sure that the information submitted is correct. “I think the intent was that there’d be significant resources involved in trying to do that for 302,000 students every semester,” Board of Regents spokesman John Millsaps said.

D.A. King, who lobbies for tougher immigration laws at the state Capitol, pointed to HB 1164, a bill introduced by state Rep. Rick Austin (R-Demorest) this year that would have required the University System to guarantee that every student was a citizen. It failed.

“Simply asking a student to check a ‘yes or no’ box is not good enough. [The regents] have a chance to fix this, but if they don’t, Eric will as governor,” said Fry, spokesman for Johnson.

Both Handel and Oxendine said they would favor outright prohibitions of undocumented students at state universities. Said a spokesman for Deal: “We simply need to enforce the law that’s in place.”

Colotl, the young woman who started this hoopla, can rest assured that, in a meat grinder of a primary, an undocumented college student satisfies very few appetites. Larger game is required and will be sought.

It’s a point the two candidates would dispute. But let the grinding begin.

That is why we need to pass Arizona-like legislation to return illegal immigrants to their countries of origin.

“Unfortunately, we are in this position because Washington politicians like Nathan Deal have failed to protect our borders and state politicians like Eric Johnson exempted the Board of Regents from laws requiring proof of legal status to receive state services. Because of this lack of leadership, this issue became a problem and the problem became a crisis. Now we have to take extraordinary actions to fix the mistakes of the career politicians.”

State and federal law are very clear- those in this country illegally are not eligible for any public benefit, including post secondary education. The regents were given the latitude to implement a policy, but simply asking a student to check a yes or no box is not good enough. They have a chance to fix this, but if they don’t, Eric will as governor.

“Federal law prohibits states from giving illegal immigrants in-state tuition. As a congressman, Nathan voted for that legislation in 1996. Since then, Nathan has written letters to college presidents in Georgia’s 9th Congressional District to inform them that they’re violating federal law by giving in-state tuition. We simply need to enforce the law that’s in place.”

“It has always been an issue for me that Georgians are losing jobs and taxpayer benefits due to illegal immigration. Respectfully, your question involves an incorrect premise. SB 529, although it does not state that the Board of Regents is required to verify citizenship, it does make it a federal and state offense for illegal aliens to receive taxpayer funded post secondary education.

“It is unconscionable to allow Georgia citizens and legal immigrants to lose jobs and be denied spots in our public university system because the law goes unenforced. If any government body is not enforcing the rule of law, we must take immediate steps to hold them accountable and mandate that they do.”

And in return, I get open borders that let liars, cheaters, and thieves like this girl and her parents get a free ride on our backs. Why? I know there will not be a straight answer to that from our declining state and country. Is it too much to ask from my own elected officials and bureaucrats for a fair deal for our own citizens and to get what you pay for? Yes, apparently. Not all of Georgia colleges have a finite number of slots for students. Some colleges are “open access” institutions that will admit students without SAT scores or minimum high school gpa as long as the student has a high school diploma or GED. If an undocumented student was brought to the U.S. as a child, and if they are paying out-of-state fees (4X in-state fees), and if they are attending an open access college, how does that take anything away from any citizen? We all stand to gain when more people obtain a higher education–whether they live in Georgia or Mexico.
Yes, we need immigration reform. Certainly, our elected representatives often do not represent the interests of the people. However, these issues must not be the catalyst for hatred of an ethnic group or of an individual college student.

The level of heat in this debate should be taken down a few levels. First illegal immigrants were blindly used to replace American workers at a cheaper rate by employers. Second as a result of a race of jobs being outsourced to places like China and new working class jobs going to illegal immigrants less than 50% of Americans pay income taxes now. And we all know this is not sustainable. Third we cannot afford to subsidize an illegal workforce via schools…..when are own middle class is spiraling down.

It makes no sense nor would any another country subsidizes illegal workers and their families with schools…… And I feel terrible for the situation this young woman finds herself in. With that said we cannot afford to keep paying for illegal workers and their family.

We do need an immigration system based on filling the needs of our country with best and brightest from other countries, not a race to the bottom for wages. Cesar Chavez testified before congress that immigration cannot be a tool to drive down wages.

The irony Mexico has some of the toughest immigration laws in the world.

Regardless of this loony newspaper’s slanting of this story, we are still a nation of laws. Why is that so hard to understand? It is not up to us, as American citizens, to give every Mexican who wants to slip across the border free healthcare and free education. Let them get in line, like everyone else, and come in legally. If the Feds had been doing their job, this situation would have never gotten to this point. Somebody posted that Colotl should be able to finish her degree. I don’t agree, if she wants to finish her degree, she can do it at National Autonomous University of Mexico (NAUM) http://en.wikipedia.org/wiki/National_Autonomous_University_of_Mexico. Perhaps NAUM will consider her stolen education as credit toward a degree at their university.

There, now all the people who are so full of compassion can feel all warm and fuzzy because they helped Colotl obtain her “Law Degree” and the rest of us don’t have to pay for an “illegal immigrant’s” education.

BTW, I’m not the least bit interested in hearing the “she won’t be near her family”. College students leave family and friends all the time to go off to college. Oh my goodness, some even go to Mexico. Go figure.

I do not see how she was going to get into law school or the state bar afterwards without proof of legal residency. I think she needs to go back to Mexico and pursue her education there. She is not an American. She does not have US citizenship or legal residency. If she does not want to return to Mexico, she should seek out a 3rd country that would accept her as a legal immigrant and perhaps she may be able to get her education there.

What a bizarre story/law. Most of our graduate schools are filled with students from all over the world who are not “citizens”, they are here on student visas. Our own students are too stupid and/or lazy, by and large, to do graduate work in technical fields. So we need foreigners to do research in this fields instead.

It’s funny everyone screams “Send them back to Mexico..each and every one of them…” What about the ones that are paying taxes each month and not receiving any public benefits? They are practically paying their own way here. If you pay your taxes I don’t care if you are here legally or not. I am sure though every single person that wants to send everyone back will be happy to take money that is not theirs when it is their time to apply for social security, food stamps, etc. So isn’t that stealing also? If we sent everyone back, where would the excess money come from to fill our greedy needs? Our economy would be in worse shape than it is now if there was a mass deportation. And the jobs that are being stolen? In my opinion as an American the majority of people think they are too good to cut the grass, work in fields or wash dishes for a living. Why weren’t we filling the jobs in the past that everyone is claiming to be ’stolen’ from people now? Because nobody wanted them. Everyone thought they were better than that. Well grow up. I bear this lady no ill will. However, letting her stay here and be educated in our public system sets the precedent that if you lie well enough and for long enough, then the United States and the state of Georgia will reward you for being a good liar.

I cringe for the many honest people from all over the world who want live in America, but whose immigration requests have been denied for any number of reasons. If the immigration laws are unacceptable as written then they should be modified. In the mean time, the laws should be enforced.

People that scream to have this young lady deported need to rethink the logic of their demand!

This country is built on immigrants. We should allow people from Mexico to immigrate to this country legally. The currently laws do not allow for this. Someone that wants to immigrate legally, has to go threw some trade-agreement BS or be rich enough to hire a legal team. We essentially have a prohibition on legal immigration, which as history shows prohibition creates crime.

This girl has been in this country since she was 8 years old. She went to grade school here and of course the natural progression was college. Do you expect to send this girl to a country that she has not lived in since she was 8 years old? Also, she is a senior in college…why would we deport someone that we have already made a capital investment in? This doesn’t benefit anyone!

We need to allow anyone who is currently in this country illegally, the chance to apply for a visa and to get in line for citizenship. No, we don’t need to just give them all citizenship, but put them at the back of the line and give them a chance to become legal. The immigrants that are here with good intentions (a better life, the American dream, provide for family, etc.) will be allowed to come out of the underground world we have pushed them into.

To deport someone like this girl, would be like putting you in jail, because you have a certain religious view.

In-state tuition is a granted to Georgia residents because those students or their parents pay taxes to the state of Georgia. State taxes FUND Georgia Universities. Illegal immigrants do not contribute to that funding and hence do not deserve in-state tuition. If they get accepted to the University, let them go, and make them pay out of state tuition. Why do we keep allowing people to profit from scamming teh system?

LOU AND POL. Yall are a breath of fresh air. I feel like nothing will change the minds of these people. I agree illegal immigration is a problem but what AZ is doing is not a solution. It will not work. It will only create more race tensions in the country.

Poeple should stop acting like this problem just started under Obama. These has been a problem during Bush Sr, Clinton and Shrub’s term that has not been solved.

How did she obtain a Mexican drivers’ license? Mail order? She has admitted to working;how was this done without a SS#? Her mother is also in the country illegally-will she be deported also? A full 12-hour load at KSU is $2200 per semester,plus textbooks,plus sorority dues,add rent,food,gasoline,tires,various supplies for class-how did she afford this? ‘Cleaning offices’? (which apparently is a Job Americans Won’t Do)

Pick a country, any country Jim, and try to set up shop there. Tell them you’d like to work, go to school, and maybe buy a house or property in a country where you are not registered or invited. See how long you last.

Tell me again that these people will do the jobs that Americans won’t do, and I’ll show you the same argument made by slave masters who claimed you could not get cotton picked without slaves.

Keep trying to obscure the difference between legal, paid their fees, filled in the forms, waited and waited and were granted a visa, and the people who jumped the line. Keep trying.
