House GOP lawmakers file bill of impeachment against Thurbert Baker

A House Republican on Tuesday filed a resolution to bring articles of impeachment against Attorney General Thurbert Baker, for his refusal to file a legal challenge to the new federal health care law – as directed by Gov. Sonny Perdue.

State Rep. Mark Hatfield, sponsor of HR 1886, says Baker is bound by the state constitution to file legal at the request of the governor. Says the measure:

“By failing and refusing to perform his constitutional and statuatry duties, Attorney General Baker has abdicated his authority and has committed an act against the state of Georgia….

Attorney General Baker’s shameful abdication of his lawful duties shows him unfit to serve the state of Georgia in the position of attorney general.”

Hatfield said 30 other House members have also signed onto the bill of impeachment, all Republican. Baker is a Democratic candidate for governor.

With only nine days left in the legislative session, and a tremendous budget gap yet to be resolved, the Waycross lawmaker said whether the bill would move would depend on the wishes of the Republican leaders of the House and Senate.

Baker, in a telephone interview, said: “It’s very disappointing to see some members of the Legislature respond in a way that’s not beneficial to the state. This is not productive – it’s not going to solve any of the crushing problems we face – water, transportation and education.”

The 13-year attorney general said he was confident of his legal footing and said past court decisions have declared that the attorney general, who is elected statewide independently of the governor, has the authority to make legal decisions for the state.

“I’m willing to debate this impeachment matter should the situation require,” Baker said.

A spokesman in the attorney general’s office couldn’t say when the last statewide-elected official was impeached — if ever.

A majority of the 180 members of the House would have to approve what basically is an indictment – which, in political terms, is possible. A trial would be conducted in the Senate. Conviction would require a two-thirds vote in that chamber – unlikely, given that Democratic cooperation would be required.

But there’s another good reason Republicans might hesitate. The state Constitution declares that “in cases of impeachment, judgments shall not extend further than removal from office and disqualification to hold and enjoy any office of honor, trust, or profit within this state or to receive a pension therefrom.”

So conviction could remove Baker, the only viable African-American in the race for governor, from that contest. And an attempt to impeach him could be portrayed as such.

Hatfield said he’s not concerned with the politics of the situation.

“It’s our position that the constitution is very clear, in [the] obligations that it places upon the attorney general to file suit on the request of the governor. He’s basically abrogated his constitutional responsibilities,” Hatfield said. “We feel very strongly that the attorney general has dropped the ball and failed to follow through on the mandates that are placed upon his office.”

The governor said today, as he has said earlier, that a decision to impeach should be left solely to the Legislature – he would not comment on it. Perdue said last week he would file – on his own authority – a lawsuit challenging the health care law passed earlier this month by Congress.

House Speaker David Ralston, significantly, is the second signer of HR 1824, a resolution that would direct the attorney general to file the lawsuit – but the resolution would lack the force of law. State Rep. Austin Scott of Tifton, the lead sponsor, is a Republican candidate for governor.

On the other hand, he’s a hot-headed, rigid, absolutist, idealogical A##h@le. This jerk couldn’t sell a life preserver to a drowing man. He can only intimidate, threaten, and browbeat. He’s even been reprimanded by the Speaker several times for disrespectful attacks on members of his own party when they failed to agree with his position.

The Speaker cut him off at the knees on Friday night when he started calling out members by name (a serious breach of protocol and tradition), when he was railing against a bill he saw as a tax increase.

Sure he’s an attorney and I guess that gives him the background to render a legal opinion on the merits of his action to impeach Baker, but that in no way means his opinion is a correct one.

Just another jerk whose only talent I can discern is fooling his constituents into voting for him. Voters of the 177th—you can do MUCH better!

A majority of Americans didn’t want civil rights either, but they were wrong. Just because a majority of Americans are misinformed does not mean something is unconstitutional and should be repealed.

As for this business about impeaching the State Attorney General, it’s purely political theater. The lawsuits will fail and the GA GOP are going to lose in elections if they don’t get about the business of the people and get out of national political paybacks. Baker is doing what a duely elected official should do, which is not waste tax payer money on frivilous lawsuits that the Governor wants to initiate for his own political affiliations.

Mark my words, Republicans will regret opposing healthcare reform and all the lawsuits and repeal/replace rhetoric when the American people finally start reading what was in the reform instead of letting paranoid GOP fanatics tell them what was in it.

I agree with all you smart posters: Georgia citizens should go quietly into the night and embrace everything about the health care bill. A 40% tax on a health care policy provided by employers is a small price to pay to ensure this president succeeds. I’m not concerned that the bill doesn’t index health policies–so that a $12,000 (value) policy will cost an additional $4,800 in taxes annually.

Look, it’s only $4,800 a year–stop complaining and stop being so selfish. In addition, $4,800 is a lot less than cap and trade’s tax of $3,000 on average, so quit complaining.

3 million retirees losing private Rx drug coverage is a small price to pay for showing our Democrat officials that we love them and support them. As VP Biden said, you gotta take one for the team….be patriotic.

The billions in charges to earnings that companies announced during the last week is a small price to pay for the U.S. to “get into step with the rest of the industrialized world” by having a government-provided health care system. Sure, investors in these companies will get a lower return–and the companies will have to cut back on hiring–but a country has to have its priorities.

See, if you oppose these things, you are racist. Racist. Racist. You don’t want to be a racist, do you? If you oppose the health care policy, you oppose Barack Obama and Thurbert Baker. By definition, you are a racist if you oppose these fine gentlemen.

I, for one, gladly support these measures and want to thank our fine public officials for helping us understand what is best for us. Without your help, I would not know what is best for me and my family.

There are 159 counties in the state of Georgia and it appears you don’t have a clue what is outside of Metro Atlanta or off of I-75 going to Florida. Get your facts straight and realize all of the people of Georgia besides just the metro Atlanta area have a right, opinion and vote on how things go in the state.

Maybe in anticipation of filing an appeal to the federal health care bill? Shouldn’t the governing legislators in Georgia should have done something to provide access to health care for those “deemed” uninsurable, to make sure no one died needlessly? You have to be proactive to be truly pro-life.

Regardless of the issue, the Attorney General is expected to render his legal opinion regarding litigation issues that concern the state. Just because you don’t like the opinion he provided is not a reason to impeach him. Regarding the issue of suing the federal government over state responsibilities associated with the health care bill, the AG believes that its an un-winnable case. He provided his guidance and that should be that. There are other avenues that Gov Perdue has at his disposal, and if he chooses to ignore the AG’s advice, he should pursue them. But at the end of the day, AG Baker did his job.

§ House Bill 1268 was passed out of the House on cross-over day and was referred by the Senate. This is the ARRA “fix” bill for continuation for terminated employees that are not eligible for COBRA.

§ Senate Bill 310 did not cross over.

§ House Bill 1184 was passed out of the House on cross-over day after much debate by the proponents of mandates, 108-55. Many heartfelt stories were told in the well about people who suffered and died because they were unable to access mandated benefits. The proponents of this bill successfully argued that this bill would bring competition to the state that would allow people access to affordable health insurance. This is the cross-state lines selling bill. Extra wording was added that would provide that domiciled carriers may offer policies similar to the policies offered by out-of-state carriers – and that Georgia residents arbitrate in Georgia. Senator Judson Hill’s cross state lines bill, Senate Bill 407 also passed the Senate, 29-16, and will now be in the hands of the House. It will be interesting to see which bill is finally the law.

§ House Bill 1291 did not make it through the House on cross-over day. This bill provides for claims to be filed with private insurance companies for any inmate in state prison that has private insurance.

§ Senate Bill 50 also made it on cross-over day. This bill is about registering rental networks, providing they disclose payers in the network. This bill is very complicated and has caused quite a stir in the committee meeting.

I’ve been a Republican since Richard Nixon, and I’ve voted in every election since then. I remember when Georgia was a Democratic State, then a steady stream of Republicans moved into this once great state. Now I’m sometimes ashamed to be a Republican when I read articles about Republican legislators stalling legislation, or promoting bills that waste taxpayers money and legislators time. I’ll vote for Baker for Governor in the next election, because it seems like he’s the only level-headed politician in the State of Georgia.

First, this bill of impeachment is silly. Our reps should have better things to worry about.

However, the AG should have read the bill and boned up on his U.S. Constitution before deciding not to join in on the lawsuits filed by the other states. While it is certainly an uphill battle given the makeup of the court and the swing vote of Justice Kennedy, it is a fight worth fighting given the magnitude of having Congress force people to purchase something just for being American. That has nothing to do with REGULATING commerce, which is their right under the Constitution, but engaging in commerce – which is not.

There was a time you didn’t have to buy auto insurance, but all the state governments except for one I believe requires just that. We were forced to do so. We’re forced to buy home insurance. We sat back and let the government do it. So now that the feds are requiring health insurance why are we crying foul. We should have stood up for our rights 30 years ago when the little stuff was happening. It’s too late now. We have to live with it just like we do with the auto insurance and such things. Or would you want to fight to eliminate that to? Like I said, it too and other things have been forced upon us…

Kia just built a large auto plant here in georgia(which means jobs to our state), and if they get wind of this, believe me, they will move elsewhere and take thousands of jobs with them. According to state Sen. Jack Murphy, there are 13 languages in which someone can sit and test for their Georgia driver’s license.

For him, that is about a dozen too many. So on Tuesday, the Cumming republican revised and got approved a bill that would make English the official and only language someone can use to get their license.

Murphy, who chairs the public safety committee, said it was naturally a safety issue. Drivers who can’t read road signs pose a danger to everyone, he said.

But critics of the bill, point to the fact that illiterate Georgians are still allowed to drive and are helped with the test. But their overriding concern is that the bill is anti-immigration and stunts economic development in the state.

They even have a name for it.

The “Kia Go Home” bill, named after the South Korean automaker which builds cars here in Georgia with a sizable Korean workforce.

“This bill would tell Kia that it is okay to invest a billion dollars here in Georgia, but your employees cannot drive here,” said Jerry Gonzalez, executive director for the Georgia Association of Latino Elected Officials. “This is sending the wrong message and would make Georgia the only state in the country with a law like this. It is anti-immigration, anti-Latino and anti-economy development.”

SB 67 was actually a bill from the last legislative session that many thought was long dead. It passed the Senate and the House last year but lawmakers failed to agree on language before the session ended.

Tuesday’s re-appearance of the bill was a surprise since it was not listed on the Senate Rules Calendar for Day 31. Murphy said he stripped the bill of a confusing amendment the House added. It now goes back to the House, where he predicts it will pass out of.

“Look, I can’t go to France or Germany or Mexico and get a driver’s license. Yet, we give them in 13 languages here,” Murphy said. “It is amazing how many people cannot read English who are driving. You should have to have a basic understanding of English to be able to drive. And it gives them a great incentive to learn English.”

The bill impacts those who are permanent residents only. Temporary license seekers are exempt. But while Murphy said his bill targets non-English speaking people who can’t read traffic signs and emergency messages, he said the bill doesn’t account for illiterate Georgians.

“We have to make an exception and we are not going to take them off the road,” Murphy said.

So, a 70-year-old Georgia man with a 2nd grade education, who can’t read, would still be allowed to get a license because he speaks English.

“In Georgia, an illiterate person can go and have an exam administrated to him orally,” said Democrat Nan Orrock of Atlanta. “That just shows you the hostility toward people who speak another language. Immigrants learn English. We have 250 years of history that proves that. So that is a non-issue.”

Orrock debated Murphy furiously against the bill, which ultimately passed 39-11. She said the bill diminishes Georgia’s global competitiveness.

“This sends a hostile message under the banner of anti-immigration,” Orrock said. “Our governor travels at taxpayer expense to other nations seeking businesses to come here. We are speaking with a forked tongue here in Georgia, when we say we want your investment, but create a barrier to a basic tool – which is a driver’s license.”

Murphy said the bill is not designed to be against immigration and said he doubts that the state’s economy would be impacted by it.

“It is not going to hurt economic development,” Murphy said. “Nobody has approached us about it hurting economic development.”

To all of you that oppose what Perdue is doing, you should go, sit down, calm down and read the bill. You also need to go down to the state capitol and listen to what is actually happening. This just goes to show how corrupt some of these politicians are. Some of them looked the other way when the “ability to accept gifts” from lobbyists and corporation and the obvious conflicts of interest were brought to light. Now they want to go after a good man for having the courage to do what he felt is right. We need more people like Baker who will stand up for something and have the courage to make a tough but correct decision.

I applaud AG Baker’s stance on this issue. I think it is absolutely senseless to file a suit in an effort to prevent the under-served and uninsured from getting adequate health care. Lest we forget, some legislators often act in opposition to the common good in exercising their authority. I consider the request to file the referenced law suit to be another case in point.

Obama has found his universal enemy in the insurance companies. He first tried the doctors which got nowhere as everyone loves their doctor so he picked on the insurance companies. He made them his villian. Health insurance companies are the financial conduit to pay for medical costs. If medical costs go up so do premiums. Medical premiums cannot be reduced unless medical costs are reduced. For example, requiring Rac Trac to lower prices without lowering the cost of a barrel of oil doesn’t work and requiring Rac Trac to tune up your car for the price of gas and still stay in business will result in higher prices.
In the near term you are going to be shocked at the increases. The vast majority of employer and state health plans renewal 1/1, after the fall election (timing is everything), and increases for the new mandates are going to go through the roof.

The point is, you’ve got to get involved or you end up with the current state of affairs. It is not enough to just vote. The legislative offices are swarming with lobbyists. You can’t swing a dead cat on the 3rd floor of the Capitol when the Legislature is in session without smacking a lobbyist in the face.

But they don’t outnumber constituents. They can’t drown out your voice if enough people are pounding their individual representatives in an unrelenting fashion. So get motivated and come with some ideas. It’s not enough to just bitch. And you can’t wait until the General Assembly convenes it’s annual social club. Start being an informed pain in the ass well before.

If I remember Constitutional Law class correctly, this lawsuit would go absolutely nowhere because you cannot sue the federal government. You can sue an individual in the federal government, but not the government itself.

Plus, if you change only a few buzzwords, this sounds exactly like Herman Talmadge’s attempt to block Brown vs. Board of Education in Georgia (seconded by Governor Marvin Griffin).

This is only slightly more entertaining than Jack Kingston complaining about the tax on people getting more than $200,000/$250,000 per year in unearned income under the healthcare plan when his district is the poorest in the state. All but four counties in it (of 25) being below the U.S. poverty line in per capita income.

The best cost savings for the State would be to get rid of the Attorney Generals office of misfit so called attorneys and start over. Baker has instilled in this group that it s much better and more cost effective if you ask he defense attorney what it willtake to settle a case before it goes to court or grand jury, regardless of the crime. The entire group of attorneys in the AG’s office are just waiting for retirement without doing anything.

Well, it sounds like my state representatives are doing their job! Perhaps they are attempting to toss him out of office because their constituents are blowing up their phones and filling their inbox demanding that they do everything in their power to stop Obamacare from becoming part of life in Georgia. This includes attacking from several angles to fulfill constituents’ requests – this is just one of them.
Trust me, I think that healthcare reform is needed…but a government takeover is the wrong direction….not to mention illegal. For starters, the notion of providing something like this is something a State would be responsible for handling. If the people of Georgia want government run healthcare, then they should ask for it for Georgia citizens. Secondly….WE ARE BROKE – Washington just can’t get it through their thick heads that this country is COMPLETELY BROKE and they have got to stop spending money. Thirdly, it is completely illegal to REQUIRE that someone purchase a product or service for any reason whatsoever.

This federal government is completely out of control…and I wish the whole lot of them would be replaced. I’m pleased that Georgia is looking out for the rights of its citizens, and taking action based on the wishes of its constituents to protect our freedom.

The Honorable AG Baker made his decision based upon his knowledge of the law and, his professional opinion, to pursue this lawsuit was folly and a waste of resources. He knows that this Federal law will be ruled constitutional, if nothing else but under the rubric of interstate commerce when health insurers cover hospital care of a non-resident patient (Hospital in NC and the patient is from GA for example). Money changes hands across state lines and that is interstate commerce.

This effort to impeach the Honorable AG Baker is not only silly but erodes the credibility of any representative that supports such a move.

I also implore all of the people that live in the 13 counties of the Atlanta Metro area to unite and support the good of all of Georgia but not to the exclusion of Atlanta as it is being done today. It is about time that the rest of Georgia realize that improving the Atlanta area means improving the whole of Georgia. As Atlanta’s fortunes go so do the rest of Georgia’s fortunes. I know that if my employer did not locate to the Atlanta area, they would not be in Georgia at all. My choices to live is not between the Atlanta area and another Georgia city, it is between Atlanta, Charlotte, Nashville or Washington DC. For me is it the Atlanta area or nothing in Georgia.

Hey Dave R. I admit I am not from Georgia, but you need to read the bill. In no part of the bill does the government engage in actual commerce. In no part of the bill does the US Government engage in “taking over” health care, they are acting well within their power to regulate. That is the problem with most republicans they do not fully consider the consequences of their actions. Before the 80s and Reagan beginning the process of removing banking regulations, there were no bank failures between the 30s and the 80s, since the 80s there have been a multitude of bank failures. Here we are in the first decade of the new century and our economy almost collapses because the banking industry will not play fair when left to its own devices. You sir need to bone up on your history as well as constitutional law, of which Obama was a professor, You really should consider that.

Many of these legislators represent people ( WHITES) that healthcare reform will help, ( i.e. pre-exisiting conditions, medicare recipients ( which is GOVERNMENT RUN HEALTHCARE), dropping you off of insurance if you get sick, losing insurance if you are laid off, are against healthcare. After reading some of this blog and taking notice of the mud slinging: left against right and right against left; I am not encouraged that we as a society can expect anything good to come from this.

I personally want to be part of the solution and not part of the problem, but I am angry and tired of those who believe that some one else owes them something. The Government of this great nation historically has been a government of the people, for the people and by the people. A democracy where the majority rule, but the American population needs to open their eyes and look around and see that those in power are ignoring the will of the majority (see current polls which they love when they favor them but now despise because they are contrary to them). Those in power should be representing that which is in the best interest for American and the American people. If the American people will just step back and take a look at what is going on; there are those in power who are dividing this country, polarizing its population and creating rifs that will not be easy to heal. If they continue these kinds of politics we will be driven to test the metal of our convictions and we will find out who has the will and the might to stand. When that time comes where will we be.

When we refuse to learn from history then we are bound to repeat the lessons we failed to learn from that history. I am not going to whine and cry over those who refuse to be responsible for themselves, but I intend to do everything with in my power to take care of my family and that which God has granted me power to possess and have influence over. My best advice for all of you who expect to survive this madness is to do the same.

If we had a US treasury with billions of funds stashed away then it would be foolish not to spend it for the health and welfare of our citizens, but it is totally irresponsible for our elected officials to spend funds that we do not have and especially during a time when multitudes are without jobs and many are losing and in doubt of whether their jobs will last.

I am shocked at the masses of American citizens that see nothing wrong this! If it is wrong for the average citizen to open a bank account and only deposit enough capital to get the account open and then to start writing checks like the only limit is the sky; then it is wrong for the Federal Government to do this and the Federal government is not only mis-representing the living constituents but they are mis-representing those yet to be born who would like to have a voice in their own future and not have the current Federal Government mortgage their future to bankroll the foolishness of those who refuse to take responsible care of themselves and who are inclined to ask what the government can do for them, rather than asking what they can do for their government and still believe that they are in anyways a part of the solution.

We are in deep trouble when the multitudes have been persuaded to think that those who tell them just what they want to hear and promising them every thing they want are people worthy of their allegiance.

People that really love and have our best interest at heart will love us enough to tell us the hard truth and show us how to deal with reality rather than leading us astray with their lies and deception which has been spun and woven into such a surreal fantasy that it is near impossible not to believe it.

Please wake up America before it is too late and deal with the responsible truth that will deliver us from this evil and set us free from the deception of political lies power hungry politicians who do not care for the American people and our liberties and freedoms.

So glad that I do not live in Metro Atlanta – I’m a real Georgian. Why are you people talking pot holes in Atlanta? That’s got NOTHING to do with the state (unless it’s on a state road), that’s your CITY and COUNTY – call your mayor.
This issue is about the HCR, how many of you actually read it or any part of it? Even if you haven’t read it surely you understand that people should not be forced to buy any product or service just because they are alive. Yes, I think people should be more responsble for themselves, but you don’t do that by creating more entitlement programs for the users and abuses to take advantage of.
I think Mr. Baker’s decison was bases on his political aspirations. He should have remembered he works for the people of Georgia (not the DNC) and you people need to remember that Atlanta government and Georgia government is seperate. Atlanta has it’s own attorney. Mr. Baker works for the people of the state of Georgia. If we can by pass him that’s great – as far as the cost you people are complaining about – there are already firms willing to work pro-bono, so that’s really a non-issue.
Mr. Baker should be impeached because he is not doing the job he was elected to do – represent Georgia.
If he isn’t impeached that’s fine with me too. I’m not worried about him winning the governors’ race. He’s shown the people of Georgia that he cares more about his political career than the state.
All the issues ya’ll keep talking about – roads, schools, transportaion, etc. well in case you’ve missed it we are in the midst of an economic crises, cuts have to be made.
