Your morning jolt: The complications of impeaching Thurbert Baker

Crucial details – a name would be handy, for instance – are missing, but rumors are swirling that Friday could see an attempt by House members to impeach Attorney General Thurbert Baker for his refusal to join a legal challenge to the new federal health care law.

PeachPundit says a piece of paper is floating around with 30 names on it.

We’ll add some background to the mix: On Wednesday, a spokesman insisted that Gov. Sonny Perdue harbored no ill will toward Baker, a Democratic candidate for governor. Said Bert Brantley:

“We asked him to participate and go with us, and he has not chosen to do that. And that’s fine. That’s his — he’s been the attorney general for a long time. He certainly knows his stuff. He’s also a candidate for governor. And so we know there are multiple things that he’s thinking about, looking at. And that’s fine.”

Perdue and former U.S. House speaker Newt Gingrich have a joint press conference this morning. The governor is likely to announce that he’ll pursue a legal challenge on his own.

Secondly, any attempt to impeach Baker would eat up much of the crucial 30th day of business in the House. And that could affect another lengthy, previously scheduled debate on the creation of Milton County.

Impeachment also requires a simple majority vote in the House, and a two-thirds vote by the Senate. The numbers argue futility.

In Washington, House Majority Leader Steny Hoyer voiced concern Thursday over warnings of violent reprisals against members of Congress who voted for landmark health care legislation, saying the threats are being taken “very seriously.”

Ten House members are reportedly receiving beefed-up protection. We’re assured that U.S. Rep. John Lewis of Atlanta, who had a nasty encounter with a tea party crowd on Saturday, was not among them.

Wednesday was not a good day for Gov. Sonny Perdue. As my AJC colleague Nancy Badertscher notes:

The Georgia House handed Gov. Sonny Perdue a major defeat Wednesday, rejecting his proposal to merge the Georgia Department of Corrections and the Board of Pardons and Paroles.

The 108-59 vote against his plan followed more than an hour of heated debate on the floor.

Advocates for the change argued that it would eliminate unnecessary duplication of bureaucracy and help streamline operations. Critics said it would create a giant agency and might not save money.

Tom Baxter of InsiderAdvantage adds these tidbits:

This bill had not attracted much attention before last week, when WSB-TV reported that the governor’s office put pressure on the state Pardons and Paroles Foundation – which is not a part of state government – to fire lobbyist Wendy Clifton, who had been hired to work against the measure.

Legislators were also informed through e-mails of a transition team which had been working on the proposed consolidation even before the bill was introduced, and opponents complained of other strong-arm tactics. Opponents in the hall even passed around a photograph of a car already marked with the emblem of the newly combined department.

That wasn’t the worst for the governor. Travis Fain of the Macon Telegraph picked up signals that Perdue’s transportation initiative may be falling apart:

[T]he House and Senate both re-appointed conference committees for a couple of pieces of transportation legislation: House Resolution 206 and House Bill 277. Those were the vehicles for last year’s version of a transportation funding plan, which then Speaker of the House Glenn Richardson seemed to put on hold at the end of the session.

If the House and Senate are getting ready to fire that conference committee back up, that means they don’t think the governor’s transportation bill is going anywhere.

The Georgia Hospital Association’s acquiescence to the bed tax? It came with some serious strings, according to my colleague Aaron Sheinin:

As part of an agreement struck between lawmakers and the state’s hospitals for the medical centers to accept a new tax on patient revenue for the next three years, lawmakers have agreed to protect hospitals from “bills harmful to hospitals” for three years, according to a copy of a memo obtained by The Atlanta Journal-Constitution.

Late Wednesday, Gov. Sonny Perdue issued a writ setting May 11 as the date for a special election to fill the state Senate seat of David Adelman of Decatur. Adelman was confirmed last week by the U.S. Senate to become the U.S. ambassador to Singapore.

Jason Carter, grandson of the former president, and attorney Thomas Stubbs have already spent months campaigning for the seat.

Another possible reason for Ralph Reed’s decision to opt out of the 7th District congressional race? It may have interfered with his book tour — for a sequel to last year’s “Dark Horse.” Here’s the promo that Reed sent out last night:

And finally, former Hawks star Dominique Wilkins has a photo op at the state Capitol this afternoon with Lt. Gov. Casey Cagle and other state legislators. Wilkins will be named Georgia’s diabetes ambassador.

Lawmakers are currently debating bills – one pitched by the governor – to permit Georgians to buy health insurance policies from insurance companies in other states. Critics say the measures would allow insurance companies circumvent coverage now mandated by the state – for such diseases as, say, diabetes.

Here’s a challenge for all you people calling for Thurbert Baker’s head:

Mark your calendars for March 24, 2011. That’s a year from now. On that day, if no court in the land has accepted any part of the constitutional challenges now being made to the healthcare bill, then every one of you will owe Baker an apology for accusing him of politics when he was just doing his job. If the courts have struck it down, then Baker will owe you an apology.

Fair?

Thank God Baker has the guts to stand up to the ignorant rednecks running this state. He is the only one in Atlanta who is exhibiting any leadership. Why waste taxpayer money on a lawsuit that has little or no chance of going anywhere. Let’s use that money to keep from furloughing teachers.

From Jay Bookmans column: (The amendment was sponsored by state Sen. Judson Hill, who three years earlier had introduced legislation that would have — wait for it — forced Georgians to buy health insurance, even giving state officials the power to garnish wages of those who refused. At the time, Hill attributed the legislation to House Speaker Newt Gingrich, who is now one of the sternest critics of “Obamacare”. In other words, mandated health insurance was a good idea until it became part of the Democratic health-reform bill, at which point it became unconstitutional and the most dire threat to American liberty since General Cornwallis surrendered at Yorktown.)
These Republican legislators have lost their mind. Pure politics without regard for the welfare of the citizens of Georia.

Impeachment is not something that should be done over a political disagreement. Baker did not commit malfeasance. Anyone who wastes time, money or energy on impeachment for this should themselves be thrown from office. Those people obviously do not understand politics, governing or wasting taxpayer money.

Thank God for Attorney General Baker. Most of us do not want the state to sue to take away our health care rights. Why do Republicans want to side with big insurance companies and not with the people? Why Republicans want to restore the big insurance companies right to deny me because of a pre-existing condition? Why do Republicans want insurance companies to be able to cancel my coverage if I get sick?

Jim, are you going to ask Perdue why he doesn’t just prove the Republicans can write a better health care plan instead of spending all that money on a law suit? The law that passed has an opt out written and inserted by Ron Wyden from Oregon that any state that thinks they can do as well as Obamacare can opt out and do their own plan. Maybe Newt can take it national.

You can’t impeach an Attorney General just because he made a decision you don’t agree with. Politicians have made a lot of decisions that many people don’t agree with. Should we impeach all of them for that?

AG Baker was elected to his office by Georgia voters the same way Gov. Perdue was.

Impeachment talk is a waste. That said, Baker’s chances to be a force in the Governor’s race just went down the toilet. This November will be a butt-kicking of epic proportions for the Dem’s in this state.

Georgia will either join another state in a suit or else hire counsel with more qualifications than Baker ON A PRO BONO basis. Maybe their suit will demand the Fed Gov’t force everyone in all 50 states to buy peanuts and peaches even if they don’t want them.

These Republicans are really looking HORRIBLE these days. To impeach someone just because they don’t agree with you is simply CHILDISH. They keep saying “This is what Georgians want” I’d like to know what Georgians have they asked because they didn’t ask me nor anyone in my family. So who are they asking, Republicans???? Smh…these people could care LESS about this bill…could have been a bill on free parking in the country & they STILL wouldn’t have passed it because the man in office is NOT one of them…he’s not republican & he’s not white. God bless the Democrats & President Obama. You shouldn’t be faced with such disrespect for doing your job.

There is really nothing Sonny can do since the amendment to opt out of the healthcare bill failed in Georgia.

Georgia had its chance to opt out and granted the amendment didn’t pass because it was supported by mostly Democrats they still had their chance and they failed.

You can blame the Democrats all you want, but the Republicans are in control of both the Senate and the House of Representatives here in Georgia and ultimately it is their responsibility.

A little advice for Mr. Baker: If you want to get elected in this state, you might want to get on board.

Jim,
It is unfortunate that you feel the way you do. If insurance companies covered all pre-existing conditions, all of our rates would shoot through the roof!! Not to mention MY employer (a small business) would find it much easier to let me and others go because of the taxes levied upon him. Healthcare is NOT a right!! It is just selfish of anyone who would put the burden of cost for this legislation on their children. It is irresponsible. Let me put it into perspective for you. We were one of the only countries that did not have socialized medicine. We went from a NEWLY founded country to the GREATEST country in the world in 200 YEARS!!!! Not once having socialized healthcare. People came from all over the world to see our doctors. Now ask yourself, “Why are we the best country in the world?” Because of CAPITALISM and FREE MARKET ECONOMICS. And I will be da**** if I am going to let Obama, aka. Mr. Handout tell me I have to buy health insurance.
One final note: Do you happen to know who is not subject to this legislation (To put it simply, who will NOT be taxed and forced to buy insurance)? The people who wrote the bill, along with the President. So this change is good enough for us common folk, but Mr. Pres. and Nancy (the Devil) Pelosi aren’t subject to the rule of law. That should tell you a little something about this Pile of Garbage that has been shoved down our throats.

If this legislature and the governor can’t pass a reasonable transportation bill in this session they ought not to be thrown out of office. They should RESIGN for failure to enact one of the two most important bills this session: transportation funding and the water issues. And I say further that if they can’t, or won’t, pass meaningful transportation legislation they have failed GA and its citizens miserably.

I voted for Thurbert Baker twice for Attorney General. Today, I wouldn’t vote for him to be dog catcher. However, he is doing the right thing by not wasting our tax dollars suing about something that is obviously constitutional. Just because you don’t like something doesn’t make it unconstitutional. In the Civil War, the South lost over 100 years ago. Many Georgians fought for the Union, “one nation”. If the Corporate Republican wants to go at it again, this is one Georgian (born and raised) who will once again stand for the the Union. Sonny and the Flagger Republicans can sue all they want but not with tax money (but then Sonny has made enough on the side as Governor and the Georgia Bankers Association have enough to foot the bill).

(1) Used eminent domain to throw people out of their houses who were unfortunate to live in the propsed Northern Arc. How is that project doing?
(2) Siphoned off monies from the GA 400 Toll Authority for Atlantic Station. Real ethical there.

It is hard to believe how much race plays a factor in our society. We’ve seen an unfounded, unneccessary and unpopular war declared which has cost billions of dollars to fund and accomplished absolutely nothing but increased the national debt. Now this President passes some legislation that actually helps Americans and the “minority” in the US Government is out for blood. How hypocritical can a group of people be, I guess as much as those who penned a document that stated that “we are all created equal” but then in the same document state that one group is only 3/5 of a human being. Everyone is coming across as being so hypocritical. Left and Right…one side is blaming the other for something. Democrats are evil because [insert typical extreme conservative statement]… Republicans are horrible because [insert typical extreme liberal statement]…

The fact is, our nation is made up of a large spectrum of opinions, and since it has been made clear that the two sides cannot get along and make any progress, I say vote independent. Vote moderate. Don’t vote for any incumbents, and vote for the moderate leaders. Moderate Dems and moderate Repubs are more likely to make progress than those who are on extreme opposite sides. It would be a better representation of “the people” (even if your opinion is not moderate, realize you alone are not “the people,” we all are, together). Even while we are not all moderate, the fact remains that progress can only be made by COMPROMISE…compromise tends to be somewhere in the middle of two extremes, thus MODERATE.

Just a suggestion. I was raised Republican, even though college introduced me to a more liberal opinion for a few years. However, right or left wing doesn’t matter…progress (true progress) with “the people” in mind can only be made by compromise.

Whether it will actually work that way, I can only hope. Assuming the bill goes through, we are going to have to watch carefully to see how it is implemented. We all know the government can screw up just about anything. I certainly hope your coverage remains the same…or gets better. You deserve it and I think most politicians know that.

I grew up believing that America was the land of the free. I learned about our forefathers standing up against taxation without representation and government oppression. I was taught, “Don’t ask what your country can do for you, but what you can do for your country.” When 50% of all taxes are paid for by 98% of Americans, then we have a serious problem. I didn’t inherit any money, no big pay day at the horse tracks, no Powerball jackpot. I got up every morning, went to school, listened and respected my teachers, came home did my homework, stayed away from drugs and alcohol, borrowed $200,000 to go to college, studied on the weekends, missed some Monday night football games, missed some frat parties, missed some March Madness games. I have over $1 million debt currently, but I don’t give up. I still get up and go to work, and try to heal some of my patients with with health problems. But, I am finding the battle isn’t with their disease; it is them no showing for appointments, showing up 15-20 minutes late for appointments, them talking on their cellphones back in the operatories, them smelling of alcohol, tobacco, and weed. It is trying to take their blood pressure reading using a XXL cuff because they eat everything supersized at every meal and then come home, sit on the couch, watch tv and snack on junk food, and maybe even doing drugs to pass the time. Even worse, people are having 4-5 children with no plan or means of supporting them. I just love when the medicaid kids come in and none of them have the same last name, they all have a different babbies daddy. And worse yet, they all are playing with their iPhones. This isn’t Obama’s money, it hard working Americans’ money and even worse, it is money of Americans not even born yet. It isn’t a right to have healthcare, it is a privilage. Just like any service provided in America. If you want to have a tan or laser hair removal, you have to pay for it. If you want a luxury car, you have to pay for it. I probably won’t have the American dream, because I have to give it to the IRS and payoff my high interest business loans. This is a warning to America, if we keep paying for people who make bad decisions, poor choices, getting drunk and knocked up, or just lazy free loaders; then America will no longer be the envy of the world, we will be the next Roman Empire.

I mistyped, I meant when 98% of all taxes are paid by 50% of Americans. I think the top 5% earners pay, 37% of all taxes; and the top 10% earners pay over 67% of all taxes. The top 50% pay for basically the other half of Americans. When you add this tax that Obama care is going to create, it will even be worse.

Patriot…you have stated your frustration in a compelling manner. These are extremely tough problems, but there has to be a way. If people make bad decisions, we can’t just leave them to die or take it out on their children who had nothing to do with it. That is where I struggle. People are not always evil, they just do stupid things and the penalty for doing stupid things should not be death. As a civilized people, we will treat folks who show up at the emergency room, so we have to pay for their care anyway. If we can help them before their need is critical, we can do it cheaper and with less pain. Your story is compelling, but I hope you will recall that the frustration you have to face every day really does help people. And your example may help some of them to make better decisions in the future. You are doing a great service and getting damned little thanks for it. MiltonMan- Protecting your Civil Liberties is not a Democrat or Republican thing its an American thing it a Constutional thing. Determining whether or not the government should use our tax dollars to pay for healthcare for people who don’t have it is a Democrat vs. Republican thing, its a political thing. So let’s not get political issues confused with Constitutional issues and let’s not waste more taxes dollars going to court over something that is not a Constitutional issue and should be settled thru the political process. If you don’t like what’s going on, this November you have the right to change things.

When you think about it, whether it is a tax credit or a fine, the result is the same. If you are not willing to protect the rest of us from having to pay for your critical care, we are going to demand that you make a contribution of some kind. We may not want to give everyone free coverage, but if we don’t, our choices become paying for high cost care in the emergency room, or letting people get sick and, in many cases, die. It sucks, but these are the facts. I wish we had other choices, but I can’t think of any.

Its hard to single this current legislation out as unconstitutional when neither the president, the Congress, nor the Supreme Court have in any way upheld, defended, or even respected the Constitution of the United States for well over 100 years. Of course I do not include Ron Paul and a handful of others over those 100 years in that list.

Impeaching Baker would certainly be a wonderful thing, but the list of those who should be impeached is very long and reaches well across america and is heavy on Washington DC folks. The next order of business should be war crimes trials. That will address the major crimes of the current and past several administrations as well.

But a FINE by nature is a “punitive” action. So if you are FINED for not purchasing healthcare then you are being MANDATED to purchase a product by the US Government. I will grant to you that the US Gov’t has the right to regulate commerce, but nowhere do thay have the right to CREATE commerce by directing citizens and business to purchase a product or service. By the way also included in this Helahtcare Reform bill are taxes on Medical Devices, and Prescription Drugs; tell me just how increasing taxes on Drugs and Wheelchairs, etc… is going to “lower healthcare costs”?

We fear that poor people and minorities may have the same opportunity to go to the doctor like those of us with employer health care plans that we pay high premiums for limited care. For a country that was built on thievery, lies and hatred, you would think that at some point people would develop a conscience.

Cheryl

@ Retired Soldier, you asked for someone to point out the constitutional grounds for HCR and I will be happy to do so for you. It will also answer why those scamming you all into thinking they can Impeach AG Baker are doing just that, as are the “leaders” in the State Gvmt, and Federal Gvmt, who are leading protests against it. It’s all a sham, they know it well.

The first constitutional basis for health insurance, The Federal Government has the right to levy taxes on the citizens. If the government could require individuals to participate in a government health insurance program paid for by a tax on individuals, it can achieve the same result by requiring the purchase of private insurance. The fine for not purchasing the private insurance is nothing more than the equivalent of a tax to pay for the insurance. (btw, there is no pay of be prosecuted portion in the bill nor jail time) The penalty, is in fact the inability to claim tax credits which will be offered to you if you purchase an insurance plan, otherwise, not credit, and you have to pay the tax. Completely Constitutionally sound.
The second constitutional basis for upholding the new law is the Commerce Clause. Ever since the 1930s, the Supreme Court has consistently held that the act of even one individual in one state can affect the national economy and thus be subject to federal control.

The effect of health care on the economy already constitutes over 17 percent of the economy, and predictions are that it will rise to almost 25 percent within the next two decades. The federal government has the right to regulate the industry.

The third basis on which to uphold federal power over health care insurance is the extent to which the federal government pays health care costs. Between Medicare and Medicaid as well as the Department of Veterans Affairs, estimates are that the federal government already pays over 25 percent of the nation’s $2.5 trillion health care bill. It is by far the largest payer of health care costs.

So you see, all of this invasion and usurping of liberties, etc…. is a bunch of malarkey, and those who are leading the American people to do it, are just doing it for political purposes. It has nothing to do with socialism, or communism or any of the other things they led you to believe.

Lastly, please, when you can, go back and read Bob Dole/Newt Gingrich’s counter proposal to the Clinton’s Universal Health Care. Outside of a few amendments, it is almost identical to the Health Care Law we now have. It’s ironic that Newt is leading the charge against the plan HE and Bob Dole Wrote! How’s that for getting snookered!

I am having a real problem with people like TheTruthHurts, BootObummer and their cohorts who just refuse to take the time to read anything that will tell them what the Law actually is. Nowhere does it state that people get to not work and “suck off the Govt. Teet. The bill does in a few years time lift the income limit to $29,000 for a family of four to be eligible for medicaid but a family making $29,00 is a working family, but you cannot deny they are poor. That is 133% below the Poverty level, and there are many many working American families who fall into this category, lots of them right here in GA, but many in Appalachia, Pennsylvania, Alabama, Mississippi, Texas, Louisiana, Florida, South Carolina, Tennessee and Kentucky, Michigan go on and on. Other than that, all Americans will be required to purchase health care insurance. People who are currently uninsured for at least the last 6 months because a pre-existing condition kept them from being eligible to purchase it, will be able to do so, within the next 90 days, and Medicare recipients will receive a $250 rebate from that doughnut hole clause in acted by Medicare Part D (Bush & Republican Congress did this). Now why would you have a problem with this? Do you want our Seniors having to eat dog food because they can’t afford the high priced medication (Part D bans negotiation of medicine prices by Medicare for its recipients so they pay the highest prices in the world) that they have to take to live. Why would you want people who need health care but are not allowed to purchase it, to just get sick and die when they don’t have to? What kind of person would want that? Your dreams of revolting against a socialist/communist/Marxist regime are just that, Dreams, they are not rooted in reality at all. If you didn’t want to just carry on with nonsense, you would find out the real information, and not just say what somebody else who is just as ignorant told you. Some people just like to be mad about anything, but you will never be right being mad about this one. There is no right in your anger – it’s just anger.

I live in Georgia, which is a backwards state filled with hateful rednecks who are mostly secret members of the KKK. Not only are they backwards, and ignorant, they are also evil!

There is a reason why this state is red, and it has nothing to do with being a Conservative. They condoned everything the Bush Admin did with ALL his UNFUNDED mandates, like 2 wars, and cutting taxes for the rich during the 2 wars, which they had no money for. Bush and Paulson scared the public with gloom and doom asking for BILLIONS of dollars to bail out Wall Street written on a piece of paper. Yes, you all loved it, and happily swallowed.

They hate Obama for one simple reason, he is Black. Period!

I am glad the guy stood up for his right to have a THINKING BRAIN, which the ignoramus have yet to have developed. ALL people of color should get of their duffs and VOTE people into office that will look out for your best interests. The rednecks are always going to try and keep you down. The haters will always threaten you and hope you listen.

No, BootObummer, which is a slur against someone who you are not fit to lick his boots, it is people like you and your kind who have ruined this great country. No matter what you call him, he is a great man, and you can just crawl back into your double-wide and lick your wounds, because no matter what you do, friend, he will be our President for the next 7, yes I said, SEVEN years!

Maybe if you had a bit more than a 6th or 12th grade education you would know that slavery days are OVER! Too bad and too sad for the likes of you.

@The Truth Hurts – No, I am reading from the Front page of USA Toady and Page 7A where what happens next and when were clearly printed for all to read, if you are interested in knowing what the law really says. These are not State secrets, the information, the real information is there for anyone who wants to know it to read. It’s free! what I wrote about the new law is not my opinion, it is the facts. Medicare Part D also is not my opinion, it is a fact, it is how it works. There are ways things work, that are facts, and then there are opinions. I happen to be a journalist, a real one, and so it is my job to look up the facts. Not the opinions, and when I see what appears to be an opinion, I investigate it up find out the facts. There are other tools available to people who want facts, like the Library of Congress, Lexus Nexus, other data bases, etc….that have nothing to do with opinions, they are facts. What I wrote are the facts, there is NO Communist/Socialist/Marxist takeover in our country, it’s a ruse to rally the people to give back power to the group who lost it in the last two elections. The members of congress who rally against government control, no more want government abolished than they want to resign. If they didn’t believe in government, they would not run for office to be a part of the Government. That’s just common sense, but it also my opinion, I know the difference.

Here’s another fact for you: The Government runs many successful programs every day, the IRS for one is a very successful program, even though we do not like what it does, none can say it is not successful. FAA, NTSB, FCC, United States Military, and the list goes on. There are literally thousands of successful government entities which you rely upon daily for everything, and they work just fine, if they didn’t you wouldn’t be on the computer now, you would have no power to run it on. The fact that you rely on them daily for the American lifestyle you are accustomed to living, would by your definition, make you a Socialist too, if your definition were correct. Facts, are what they are, not opinions and you are full of opinions which you believe are facts. I say, you don’t know what you are talking about most of the time, based upon your writings! And that is my opinion, but it just may be a fact too!

Cheryl,

Do not listen to TheTruthHurts. You are right, and it is so wrong, while it touts Republican Talking Points. The government runs Medicaid, and they love it. The VA is government run, and they love it! HCR is NOT government-run. That is a LIE! Therefore making the Truther a LIAR!

Polls are very dynamic and ever-changing, and the last one changed to a POSITIVE on HCR, and will continue to improve when people realize the good it will do them.

I am hoping that since the Bill has to go back to the HOUSE, they will include the PUBLIC OPTION, which will be a great MITIGATOR for the mandates, even though I do understand why they would be needed.

They want to sue because they are sore losers. All they have to do is OPT OUT. That is in the Bill. Just OPT OUT!

It mentions talking points, because that is what it does. They use daily Repub talking points, which they seem to ingest intravenously. But those of us who know how to read, process, analyze and think for ourselves, and who are not blinded by our hatred of the man of color who sits in the WH, can easily see where the benefits are.

So I say, if it is a VET make sure it does not utilize any services the from the government, that is simple enough to do. YOU can just opt-out!

I read the BILL. I am pretty sure it did not. So, it should speak for itself and do whatever it pleases, but it does not speak for me, or you Cheryl, or anyone else who supports HCR.

MD, there is a snowballs chance in Hades that the Republicans will pick up 113 seats in the House of Reps in November. You have to remember, 1) most Democrats will vote this year, the races will be too hot to ignore and they are NOT voting for Republicans, 2) that it’s March now, by November, millions of people will be able to be insured, and checks will have gone out to the Majority of Seniors on Medicare which will only help the Dems and none of this will have cost taxpayers who gross under $200k, 3) Americans are fickle so if it’s not costing them and it actually helped people they know, then it won’t matter so much by then. So the chances of the Repubs retaking the House with a veto proof majority are as I said, Slim to None. You do remember the President has the power to Veto right? So as a matter of probability, I’d say, don’t bank on that. Just my opinion, but based on real facts again.

@MD, the American Consensus was to vote for Health Care Reform. It was a big part of the Debates during the election. Both candidates stated what they would do, McCain said he would allow interstate shopping and offer tax rebates. President Obama said he would mandate coverage, and create risk pools and mandate insurance companies offer coverage for pre-existing conditions and end rescending practices by insurers. The country voted, all who are legally eligible to vote were allowed to do so, and give consensus. It was done, President Obama’s plans had more votes than McCain’s plans did, More Democratic candidates were elected than were Republican candidates to Congress and thus, the voice of the people were heard. They did what they were elected to do. And that is how the will of the people is defined in American Government. To change that means to change our entire system of governance, and then what do you suppose we change to? Right now, our system of Representative Government works, even when you don’t like the outcomes. What do you suggest we change to, or do you just suggest that our entire government should only listen to what you and others like you want? What form of government is that exactly?

@ Truthhurts, I saw it, but it is silly, they already have health care coverage, the exchange pools are for those who are uninsured and or underinsured……. All employees of the Federal Government have health care coverage, with many providers they can choose to purchase from to provide the best option for their own family. The new law, will create these same types of pools in each state for citizens who need to or wish to, to choose. So, it will be the same type of system that is used currently for Federal employees, which includes the President, members of Congress and the janitors who clean after them. If you already have insurance, like I do, then you do not have to join one, if you wish to get your own insurance directly and go around the pools, you can, if you can’t then you can purchase through them. Again, these are the facts……. And I have not stated I am a Democrat, I just am an American who reads and comprehends what I read.

@ Safire, IMNO, and others, I see when you really bring facts to the conversation, the rabble rousers die down. It only works if uninformed people continue to be the only ones speaking. Continue to arm yourselves with the facts, and ask the hard questions, like I did with MD, I see he had no response to my questions regarding what type of Government does he want if not our form of Representative Government/ Democracy. He has no response because you cannot call our system or leaders Socialist and Marxist and Communist (Unless you are Rush Limbaugh) if you really are aware of how it works. Those inflammatory titles are just that, but not accurate if you put it to them and make them prove it (which nobody who listens to Rush/Hannity/Beck ever does). Our elections system works, our representatives vote based upon THEIR constituents voices and their own conscience and that is how we get our laws and how this country is supposed to work. Sometimes you win, sometimes you lose, but that is what being an American is about! Anybody who doesn’t know that doesn’t know what American Government is…….Rush knows his listeners don’t know it so he says what he says and they eat it up, and he’s all wrong, most of the time. Our constitution is not simple, our system of government is complex, the average American does not know basic American civics, but they profess to know and understand Marxism, Socialism, Maoism, Communism enough to be able to look at a person and say he is one of them. They don’t even know enough about our own Constitution or Bill of Rights to know what is and isn’t in it, or what it means. If somebody yells out unconstitutional, then they just repeat it, and have no idea why they are saying it. Keep holding their feet to the fire, and maybe just maybe, one of them will become more educated and informed instead of reactionary and angry. Then and only then, can they claim with certainty, that this is in fact, the greatest country on the earth, and know why they say that.

I’m not terribly happy about potentially paying higher insurance rates. I have insurance right now, but at the present time what recourse do I have if I were to get seriously ill and the insurance company were to find some loophole in my coverage and refuse to pay? What would I do? A few years ago I had a potentially fatal condition which, however, was easily cured, but it is one that could come back and not be so easily curable. I have since changed jobs and health insurance providers, but if the disease were to come back they could claim a pre-existing condition and refuse coverage. Leaving me with only one choice: bankruptcy.

I read recently that 62% of all bankruptcy filings are due to medical bills. And of that 62%, 78% had some form of health insurance at the time they got sick. This health bill appears to prevent that from happening, which is why I support it.

And don’t call me some kind of welfare sponge. I have been gainfully employed 100% of my adult life.

@ warbler – If the Governor is demanding that he file a law suit against the Federal Government under the 10th Ammendment, the Attorney General is most certainly NOT obligated to do so if the Governor is in error on his interpretation of States rights vs. Federal rule. The AG swears an oath to represent the State and act as an advisor to the Governor. He did that, and the Governor has not taken his legal advice paid for by the Taxpayers for strictly political reasons, not legal ones. This does not mean he has to do the Governors bidding should he not follow the AG’s legal advice. The Attorney General, elected by the people should not be used for political points by the Governor. The AG in Pennsylvania has joined the suit, against Governor Ed Rendell’s wishes. It is his right to challenge the law as he sees it, even though it’s stupid and going to cost the state a boat load of tax-payer money. (The AG in PA is also running for Governor) BTW, The Governor himself is not above the law. So as you can see, the AG is not beholden to the will of the Governor. That’s not how it works, and AG Baker is right to advise against joining if he thinks its not a defensible case, which he is correct in reasoning, America’s Affordable Health Choices Act of 2009 is constitutional. Most non-partisan constitutional scholars expect that the Supreme Court will rule as such if it ever makes it that far. It could also decide not to hear the case at all.

That’s right @ Whatever I completely forgot about that portion of the Law (bill) The Empowering States to be Innovative Amendment which is part of the new law is taken and is one of the over 200 Republican co-sponsored amendments contained in this health care reform legislation. There is NO NEED for States to sue, they have the right to opt-out and make their own Health Care Systems like the State of Mass and California have already. States that find the mandate objectionable can simply create and insert a new system in its place. All it would require is applying for a waiver from the Department of Health and Human Services, which has a 180-day window to confirm or deny such a waiver.

That language has been inserted, almost verbatim, into the bill Obama signed into law on Tuesday. So grasping what the Law actually states vs, what people are being led to believe,
if a state can demonstrate that they can meet the criteria — particularly on cost containment, improving the delivery system — they can do it without an individual mandate. This of course kills the whole taking our liberty, and Government Take Over of our Health Care Sham…..So this is why your Republican Representatives didn’t tell you about this part. There is NO Takeover of your healthcare. The State of GA can implement it’s own Health Care System……. if it has the intelligence to do so.

He hasn’t collected over $100,000 for his run like Jason Carter, he isn’t a lawyer like Tom Stubbs. He’s a Libertarian.

Who’s talking about ending the failed War on Drugs? David Montané.

Who’s talking about a Death Penalty Moratorium in Georgia? David Montané.

Who’s talking about equal rights for ALL Georgians? David Montané.

The citizens and denizens of Deklab county and Decatur have a unique opportunity on the 11th of May. Let see Perdue thinks that it is Intrusion on state rights with the Health Care. He does not think it is intrusion on state rights when it comes to the Race to the Top. He didn’t think it was Intrusion with stimulus money. The Georgia senators are against it but yet brag about NCLB act–which violates state rights regarding education. I don’t understand—I thought you either against the federal involvement in state affairs or you were for it–oh but he is Perdue. If he doesn’t get his way he punishes the entities involved such as public schools and hospitals. I just don’t know what the veterans did that he kicked them out of their home in Central Georgia.

@MiltonMan-I know you didn’t disrespect my POTUS. I’m going to sue you; the term “Obozo” has already been copyrighted, patented and he resides in the Governors Mansion NOW-Perdue. I guess when Cheney/Bush wrote the “Patriot Act” they had sense enough to put a “clause” in it..Like Obama’s did with healthcare ONLY Obama’s was a win-win instead of ball and chain. It would probably take Houdini to unravel all the illegalities in the Patriot Act. BTW, when are you going to call on our President Obama to begin investigation for War Crimes? hmmm. Governor Purdue has done ABSOLUTELY nothing for the State of Georgia. No Legacy except “holding up air rights”. What did he NOT do? MY property taxes went up last year because the Homeowner’s Tax Relief Grant was rescinded. A Tax Relief granted by Roy Barnes. So right now,Perdue owes me money; I cease and desist from him spending MY money for a frivolous lawsuit. BTW, I thought Republicans argued AGAINST “tort reforms and frivolous law suits”. Hmmm how can you be confident in winning in a house so divided????It’s against Universal law….Clean up the HOUSE PEOPLE AND THROW OUT THE TRASH. “We are moving forward not backwards”-words from President Obama as he is “selling” the Healthcare Bill to MILLIONS of us who LOVE IT! BTW, President Obama gave us 16 months. Admirable. Considering he KNEW we shouldn’t have been there in the FIRST place. If memory serves me, Your kind went in without “AN EXIT STRATEGY?”. Please stop making this easy for me.

@ He is Satan: What a name for oneself and you sound like you are crazy. Where have you been for the last 8 years. My premiums are already HIGH. If you are just thinking this HC bill is what did it or is going to do it..you late. That tells me you’ve been eating some Georgia Red Clay. You are siding with a Governor that is about to build $9M horse farm and a fishing tournament in waters NEVER paid for by his State and about to be taken eventually.”Heard that from the horse’s mouth”.

Black person speaking: No I do not agree with the welfare state. I believe that the welfare systems should be overhauled–meaning anyone who accepts a dime for the government–should and must work for it. For example, cleaning the highways in order to received their check–and if they have more than two children the cost of their welfare check cannot go up–three or more on their own.

However, I also realize no matter what I do as a person–I will always pay for someone else–whether white, black, latino, asian, or other. Thus why should I not get the proper healthcare that I deserve–oppose to those who do nothing and still will qualify for medicaid–which I will not.

Healthcare for All–and Repeal and Replace Sonny.
