Your morning jolt: The complications of impeaching Thurbert Baker

Crucial details – a name would be handy, for instance – are missing, but rumors are swirling that Friday could see an attempt by House members to impeach Attorney General Thurbert Baker for his refusal to join a legal challenge to the new federal health care law.

PeachPundit says a piece of paper is floating around with 30 names on it.

We’ll add some background to the mix: On Wednesday, a spokesman insisted that Gov. Sonny Perdue harbored no ill will toward Baker, a Democratic candidate for governor. Said Bert Brantley:

“We asked him to participate and go with us, and he has not chosen to do that. And that’s fine. That’s his — he’s been the attorney general for a long time. He certainly knows his stuff. He’s also a candidate for governor. And so we know there are multiple things that he’s thinking about, looking at. And that’s fine.”

Perdue and former U.S. House speaker Newt Gingrich have a joint press conference this morning. The governor is likely to announce that he’ll pursue a legal challenge on his own.

Secondly, any attempt to impeach Baker would eat up much of the crucial 30th day of business in the House. And that could affect another lengthy, previously scheduled debate on the creation of Milton County.

Impeachment also requires a simple majority vote in the House, and a two-thirds vote by the Senate. The numbers argue futility.

In Washington, House Majority Leader Steny Hoyer voiced concern Thursday over warnings of violent reprisals against members of Congress who voted for landmark health care legislation, saying the threats are being taken “very seriously.”

Ten House members are reportedly receiving beefed-up protection. We’re assured that U.S. Rep. John Lewis of Atlanta, who had a nasty encounter with a tea party crowd on Saturday, was not among them.

Wednesday was not a good day for Gov. Sonny Perdue. As my AJC colleague Nancy Badertscher notes:

The Georgia House handed Gov. Sonny Perdue a major defeat Wednesday, rejecting his proposal to merge the Georgia Department of Corrections and the Board of Pardons and Paroles.

The 108-59 vote against his plan followed more than an hour of heated debate on the floor.

Advocates for the change argued that it would eliminate unnecessary duplication of bureaucracy and help streamline operations. Critics said it would create a giant agency and might not save money.

Tom Baxter of InsiderAdvantage adds these tidbits:

This bill had not attracted much attention before last week, when WSB-TV reported that the governor’s office put pressure on the state Pardons and Paroles Foundation – which is not a part of state government – to fire lobbyist Wendy Clifton, who had been hired to work against the measure.

Legislators were also informed through e-mails of a transition team which had been working on the proposed consolidation even before the bill was introduced, and opponents complained of other strong-arm tactics. Opponents in the hall even passed around a photograph of a car already marked with the emblem of the newly combined department.

That wasn’t the worst for the governor. Travis Fain of the Macon Telegraph picked up signals that Perdue’s transportation initiative may be falling apart:

[T]he House and Senate both re-appointed conference committees for a couple of pieces of transportation legislation: House Resolution 206 and House Bill 277. Those were the vehicles for last year’s version of a transportation funding plan, which then Speaker of the House Glenn Richardson seemed to put on hold at the end of the session.

If the House and Senate are getting ready to fire that conference committee back up, that means they don’t think the governor’s transportation bill is going anywhere.

The Georgia Hospital Association’s acquiescence to the bed tax? It came with some serious strings, according to my colleague Aaron Sheinin:

As part of an agreement struck between lawmakers and the state’s hospitals for the medical centers to accept a new tax on patient revenue for the next three years, lawmakers have agreed to protect hospitals from “bills harmful to hospitals” for three years, according to a copy of a memo obtained by The Atlanta Journal-Constitution.

Late Wednesday, Gov. Sonny Perdue issued a writ setting May 11 as the date for a special election to fill the state Senate seat of David Adelman of Decatur. Adelman was confirmed last week by the U.S. Senate to become the U.S. ambassador to Singapore.

Jason Carter, grandson of the former president, and attorney Thomas Stubbs have already spent months campaigning for the seat.

Another possible reason for Ralph Reed’s decision to opt out of the 7th District congressional race? It may have interfered with his book tour — for a sequel to last year’s “Dark Horse.” Here’s the promo that Reed sent out last night:

And finally, former Hawks star Dominique Wilkins has a photo op at the state Capitol this afternoon with Lt. Gov. Casey Cagle and other state legislators. Wilkins will be named Georgia’s diabetes ambassador.

Lawmakers are currently debating bills – one pitched by the governor – to permit Georgians to buy health insurance policies from insurance companies in other states. Critics say the measures would allow insurance companies circumvent coverage now mandated by the state – for such diseases as, say, diabetes.

Will anyone of you ever even attempt to explain to me why Medicare Part D which cost $750B and is not even funded did not provoke this same outrage?

I mean, this new bill is at the least attempted to be paid for in tax increases. Medicare Part D was simple spending with no funding.

@The Truth Hurts – No, I am reading from the Front page of USA Toady and Page 7A where what happens next and when were clearly printed for all to read, if you are interested in knowing what the law really says. These are not State secrets, the information, the real information is there for anyone who wants to know it to read. It’s free! what I wrote about the new law is not my opinion, it is the facts. Medicare Part D also is not my opinion, it is a fact, it is how it works. There are ways things work, that are facts, and then there are opinions. I happen to be a journalist, a real one, and so it is my job to look up the facts. Not the opinions, and when I see what appears to be an opinion, I investigate it up find out the facts. There are other tools available to people who want facts, like the Library of Congress, Lexus Nexus, other data bases, etc….that have nothing to do with opinions, they are facts. What I wrote are the facts, there is NO Communist/Socialist/Marxist takeover in our country, it’s a ruse to rally the people to give back power to the group who lost it in the last two elections. The members of congress who rally against government control, no more want government abolished than they want to resign. If they didn’t believe in government, they would not run for office to be a part of the Government. That’s just common sense, but it also my opinion, I know the difference.

Here’s another fact for you: The Government runs many successful programs every day, the IRS for one is a very successful program, even though we do not like what it does, none can say it is not successful. FAA, NTSB, FCC, United States Military, and the list goes on. There are literally thousands of successful government entities which you rely upon daily for everything, and they work just fine, if they didn’t you wouldn’t be on the computer now, you would have no power to run it on. The fact that you rely on them daily for the American lifestyle you are accustomed to living, would by your definition, make you a Socialist too, if your definition were correct. Facts, are what they are, not opinions and you are full of opinions which you believe are facts. I say, you don’t know what you are talking about most of the time, based upon your writings! And that is my opinion, but it just may be a fact too!

Do not listen to TheTruthHurts. You are right, and it is so wrong, while it touts Republican Talking Points. The government runs Medicaid, and they love it. The VA is government run, and they love it! HCR is NOT government-run. That is a LIE! Therefore making the Truther a LIAR!

Polls are very dynamic and ever-changing, and the last one changed to a POSITIVE on HCR, and will continue to improve when people realize the good it will do them.

I am hoping that since the Bill has to go back to the HOUSE, they will include the PUBLIC OPTION, which will be a great MITIGATOR for the mandates, even though I do understand why they would be needed.

They want to sue because they are sore losers. All they have to do is OPT OUT. That is in the Bill. Just OPT OUT!

It mentions talking points, because that is what it does. They use daily Repub talking points, which they seem to ingest intravenously. But those of us who know how to read, process, analyze and think for ourselves, and who are not blinded by our hatred of the man of color who sits in the WH, can easily see where the benefits are.

So I say, if it is a VET make sure it does not utilize any services the from the government, that is simple enough to do. YOU can just opt-out!

I read the BILL. I am pretty sure it did not. So, it should speak for itself and do whatever it pleases, but it does not speak for me, or you Cheryl, or anyone else who supports HCR.

MD, there is a snowballs chance in Hades that the Republicans will pick up 113 seats in the House of Reps in November. You have to remember, 1) most Democrats will vote this year, the races will be too hot to ignore and they are NOT voting for Republicans, 2) that it’s March now, by November, millions of people will be able to be insured, and checks will have gone out to the Majority of Seniors on Medicare which will only help the Dems and none of this will have cost taxpayers who gross under $200k, 3) Americans are fickle so if it’s not costing them and it actually helped people they know, then it won’t matter so much by then. So the chances of the Repubs retaking the House with a veto proof majority are as I said, Slim to None. You do remember the President has the power to Veto right? So as a matter of probability, I’d say, don’t bank on that. Just my opinion, but based on real facts again.

@MD, the American Consensus was to vote for Health Care Reform. It was a big part of the Debates during the election. Both candidates stated what they would do, McCain said he would allow interstate shopping and offer tax rebates. President Obama said he would mandate coverage, and create risk pools and mandate insurance companies offer coverage for pre-existing conditions and end rescending practices by insurers. The country voted, all who are legally eligible to vote were allowed to do so, and give consensus. It was done, President Obama’s plans had more votes than McCain’s plans did, More Democratic candidates were elected than were Republican candidates to Congress and thus, the voice of the people were heard. They did what they were elected to do. And that is how the will of the people is defined in American Government. To change that means to change our entire system of governance, and then what do you suppose we change to? Right now, our system of Representative Government works, even when you don’t like the outcomes. What do you suggest we change to, or do you just suggest that our entire government should only listen to what you and others like you want? What form of government is that exactly?

@ Truthhurts, I saw it, but it is silly, they already have health care coverage, the exchange pools are for those who are uninsured and or underinsured……. All employees of the Federal Government have health care coverage, with many providers they can choose to purchase from to provide the best option for their own family. The new law, will create these same types of pools in each state for citizens who need to or wish to, to choose. So, it will be the same type of system that is used currently for Federal employees, which includes the President, members of Congress and the janitors who clean after them. If you already have insurance, like I do, then you do not have to join one, if you wish to get your own insurance directly and go around the pools, you can, if you can’t then you can purchase through them. Again, these are the facts……. And I have not stated I am a Democrat, I just am an American who reads and comprehends what I read.

@ Safire, IMNO, and others, I see when you really bring facts to the conversation, the rabble rousers die down. It only works if uninformed people continue to be the only ones speaking. Continue to arm yourselves with the facts, and ask the hard questions, like I did with MD, I see he had no response to my questions regarding what type of Government does he want if not our form of Representative Government/ Democracy. He has no response because you cannot call our system or leaders Socialist and Marxist and Communist (Unless you are Rush Limbaugh) if you really are aware of how it works. Those inflammatory titles are just that, but not accurate if you put it to them and make them prove it (which nobody who listens to Rush/Hannity/Beck ever does). Our elections system works, our representatives vote based upon THEIR constituents voices and their own conscience and that is how we get our laws and how this country is supposed to work. And finally, back on the subject, the Attorney General’s job is to enforce the laws of the State of GA and of the United States. If no law has been broken, which he as the Attorney is to determine, then there is no case for him to file……. He can file it, but we won’t win it is what he is telling us and says he won’t waste the money. Since we are closing schools, cutting off transportation, our counties are facing huge deficits, etc….shouldn’t we be thanking AG Baker for being frugal with our short money, than for grandstanding and blowing it to make his name bigger and to pander for votes.

I’m not terribly happy about potentially paying higher insurance rates. I have insurance right now, but at the present time what recourse do I have if I were to get seriously ill and the insurance company were to find some loophole in my coverage and refuse to pay? What would I do? A few years ago I had a potentially fatal condition which, however, was easily cured, but it is one that could come back and not be so easily curable. I have since changed jobs and health insurance providers, but if the disease were to come back they could claim a pre-existing condition and refuse coverage. Leaving me with only one choice: bankruptcy.

I read recently that 62% of all bankruptcy filings are due to medical bills. And of that 62%, 78% had some form of health insurance at the time they got sick. This health bill appears to prevent that from happening, which is why I support it.

And don’t call me some kind of welfare sponge. I have been gainfully employed 100% of my adult life.

@ warbler – If the Governor is demanding that he file a law suit against the Federal Government under the 10th Ammendment, the Attorney General is most certainly NOT obligated to do so if the Governor is in error on his interpretation of States rights vs. Federal rule. The AG swears an oath to represent the State and act as an advisor to the Governor. He did that, and the Governor has not taken his legal advice paid for by the Taxpayers for strictly political reasons, not legal ones. This does not mean he has to do the Governors bidding should he not follow the AG’s legal advice. The Attorney General, elected by the people should not be used for political points by the Governor. The AG in Pennsylvania has joined the suit, against Governor Ed Rendell’s wishes. It is his right to challenge the law as he sees it, even though it’s stupid and going to cost the state a boat load of tax-payer money. (The AG in PA is also running for Governor) BTW, The Governor himself is not above the law. So as you can see, the AG is not beholden to the will of the Governor. That’s not how it works, and AG Baker is right to advise against joining if he thinks its not a defensible case, which he is correct in reasoning, America’s Affordable Health Choices Act of 2009 is constitutional. Most non-partisan constitutional scholars expect that the Supreme Court will rule as such if it ever makes it that far. It could also decide not to hear the case at all.

It’s called the “Empowering States to be Innovative” amendment. And it would, quite literally, give states the right to set up their own health care system — with or without an individual mandate or, for that matter, with or without a public option.

Baker has won 3 statewide elections as Georgia State Attorney General (having been appointed by then-Gov. Miller in 1997) in 1998, 2002 and 2006, but he won’t be in the Executive Mansion anyway because former Governor Roy Barnes (D) has a good chance of taking back the governorship for the Democrats and FINALLY putting the GA GOP in their place for their arrogance of ignoring folks who really need health insurance.

That’s right @ Whatever I completely forgot about that portion of the Law (bill) The Empowering States to be Innovative Amendment which is part of the new law is taken and is one of the over 200 Republican co-sponsored amendments contained in this health care reform legislation. There is NO NEED for States to sue, they have the right to opt-out and make their own Health Care Systems like the State of Mass and California have already. States that find the mandate objectionable can simply create and insert a new system in its place. All it would require is applying for a waiver from the Department of Health and Human Services, which has a 180-day window to confirm or deny such a waiver.

That language has been inserted, almost verbatim, into the bill Obama signed into law on Tuesday. So grasping what the Law actually states vs, what people are being led to believe,
if a state can demonstrate that they can meet the criteria — particularly on cost containment, improving the delivery system — they can do it without an individual mandate. This of course kills the whole taking our liberty, and Government Take Over of our Health Care Sham…..So this is why your Republican Representatives didn’t tell you about this part. There is NO Takeover of your healthcare. The State of GA can implement it’s own Health Care System……. if it has the intelligence to do so.

Louisiana Governor Bobby Jindal (R) is trying to eliminate the Lieutenant Governor’s office in the aftermath of Democratic LG Mitch Landrieu (D)’s victory as New Orleans Mayor last month, but we haven’t heard any more details on Jindal’s controversial plan.

Greetings All,

At the risk of being repetitive, there are currently three candidates competing for Bundlin’ Dave Adelman’s old seat in Georgia’s 42nd District State Senate special election. Libertarian David Montané is campaigning for that seat and is a distinctly different kind of candidate. He hasn’t collected over $100,000 for his run like Jason Carter, he isn’t a lawyer like Tom Stubbs. He’s a Libertarian.

Who’s talking about ending the failed War on Drugs? David Montané.

I watched the Democratic gubernatorial candidates debate and I came away convinced that there are no liberals in this race. You’d have to be a totally racist Freeper like Truthbe here to think otherwise.

Dear Sonny, the state mandates that I have workers comp insurance for my employees, the divorce courts in Ga can make me buy health insurance for my ex-wife and children and I am required to buy insurance for my automobiles Maybe we can ask Baker to sue you. We can use your fish pond money to offset the cost

The health care bill was written by a committee whose chairman said he didn’t understand the bill, passed by a Congress who exempted itself from it, signed by a president who smokes, underwritten by the treasury department whose head didn’t file his taxes, supported by a surgeon general who is obese and financed by a c…ountry that is broke. What could possibly go wrong?

Heard if from the Horses mouths.. the ones of YOU that voted this joke of a reform in… you have no idea what you have wished for…. Rates will go up for the healthy.. Rates for the poor are going to be off the charts.. You think its unaffordable now… You will be choosing between food rent meds or the right to carrry a worthless card!!

Let see Perdue thinks that it is Intrusion on state rights with the Health Care. He does not think it is intrusion on state rights when it comes to the Race to the Top. He didn’t think it was Intrusion with stimulus money. The Georgia senators are against it but yet brag about NCLB act–which violates state rights regarding education. I don’t understand—I thought you either against the federal involvement in state affairs or you were for it–oh but he is Perdue. If he doesn’t get his way he punishes the entities involved such as public schools and hospitals. I just don’t know what the veterans did that he kicked them out of their home in Central Georgia.

@MiltonMan-I know you didn’t disrespect my POTUS. I’m going to sue you; the term “Obozo” has already been copyrighted, patented and he resides in the Governors Mansion NOW-Perdue. I guess when Cheney/Bush wrote the “Patriot Act” they had sense enough to put a “clause” in it..Like Obama’s did with healthcare ONLY Obama’s was a win-win instead of ball and chain. It would probably take Houdini to unravel all the illegalities in the Patriot Act. BTW, when are you going to call on our President Obama to begin investigation for War Crimes? hmmm. Governor Purdue has done ABSOLUTELY nothing for the State of Georgia. No Legacy except “holding up air rights”. What did he NOT do? MY property taxes went up last year because the Homeowner’s Tax Relief Grant was rescinded. A Tax Relief granted by Roy Barnes. So right now,Perdue owes me money; I cease and desist from him spending MY money for a frivolous lawsuit. BTW, I thought Republicans argued AGAINST “tort reforms and frivolous law suits”. Hmmm how can you be confident in winning in a house so divided????It’s against Universal law….Clean up the HOUSE PEOPLE AND THROW OUT THE TRASH. “We are moving forward not backwards”-words from President Obama as he is “selling” the Healthcare Bill to MILLIONS of us who LOVE IT! Black person speaking: No I do not agree with the welfare state. I believe that the welfare systems should be overhauled–meaning anyone who accepts a dime for the government–should and must work for it. For example, cleaning the highways in order to received their check–and if they have more than two children the cost of their welfare check cannot go up–three or more on their own.

However, I also realize no matter what I do as a person–I will always pay for someone else–whether white, black, latino, asian, or other. Thus why should I not get the proper healthcare that I deserve–oppose to those who do nothing and still will qualify for medicaid–which I will not.
