The law says it’s not always wrong to kill.

In Texas, a grand jury concludes it’s not a crime to beat a man to death if he’s molesting your daughter.

The 23-year-old father, who has not been named to protect his 5-year-old’s identity, said he heard his daughter screaming behind a barn. When he raced to the rescue, he found Jesus Mora Flores, 47, a ranch hand hired to help with the horses, attempting to rape his child.

Using nothing but his fists, the angry father unleashed a furious beatdown. Then the father called 911 and begged for an ambulance to find his rural ranch near the small town of Shiner.

“Come on! This guy is going to die on me!” the man is heard screaming on 911 audio played for the media Tuesday in a press conference called by the Lavaca County district attorney and sheriff.

By the time emergency crews responded, Flores, who was in the U.S. legally, was dead. His pants and underwear were down around his ankles.

Medical tests indicate the girl was molested.

The father was never arrested and will not face charges. A grand jury heard the frantic 911 call and concluded the killer was authorized to use deadly force to protect his daughter.

The father is just “a regular kid, went to dances, drank beer like the rest of the kids around here,” said neighbor Michael James Veit, 48. ”They won’t find a jury pool here that will convict him.”

The neighbor’s probably right about the jury, but the father and child victim will never be “regular kids” again.

Interesting. You always hear about how many times somebody was stabbed when protecting a kid. It seems that after 8 or so times, the law starts to think that you are no longer in danger after immobilizing the attacker.

I am a FIRM believer in civil justice in all cases. This man did exactly what he was supposed to do. I would have killed him just the same and not thought twice about it. If we were able to do this to offenders right on the spot, it would be better then a lengthy trial that tax payers have to pay, and there is no possibility they couldn’t be found guilty and let go. Plus, if they are convicted, then its the tax payers that have to flip that bill as well, and then the worry about what happens when the creep gets out. I firmly believe that whatever crime you commit should be done upon you. For instance, if you kidnap, torture and rape, then you should be kidnapped, and raped. If you murder someone, then the way you did it should be done upon you. Forget the court process. If this was to happen, I dang sure guarantee that it would stop these criminals dead in the tracks and we would have less people getting hurt in this world. The same goes for animals. If you electrocute and kill an animal, then in turn you should be electrocuted and killed all the same.

I’m glad, no I’m estatic, the father protected his daughter. Too many children are molested and parents may know something is wrong but don’t dig enough to really find out…maybe because they really don’t want to know. In the end, the child always carries the pain, even if they don’t say it verbally or show it emotionally, it manifests in some shape, form or fashion. Parents love and protect your children. I have several friends who were molested as young girls and their moms didn’t believe them and I personally witnessed the torment it caused (abandonment, lack of safety and protection, etc) and affected potentially positive relationships. They eventually worked through it with counseling, prayer, and God, but not without battle wounds.

I will place this family in my prayers. Both the child and the father have been traumatized by this disgusting person who is now gone. But I sincerely hope that the child did not witness her father beating this man to death. A punch or two would be bad enough to witness for a child and justifiable for her to see as retribution; but to see her father kill a man. I have to disagree with killing always being wrong, I believe our president disagrees with that as well. Guy was caught litterally with his pants down attacking a 5 year old girl, sick or not he deserved to be put down. As a Christian I am surprised by some of these comments…as a victim of sexual abuse that lasted over 14 years I am appalled at some of the idiotic statements from others! Does the AJC need a new editor or something? How do the following quotes by George Mathis end up in a news story about a man who murdered a rapist?

Mathis writes that “the angry father unleashed a furious beatdown” on the rapist. In other words, the rapist was beaten to death by the father, and Mathis is very exited about it judging from his language. A “furious beatdown” does not sound professional and the word “beatdown” is not even passing the spell check feature in this comment box.

Mathis feels the need to point out that the rapist “was in the U.S. legally” while working on the ranch. Were we to assume he was illegal since he was Latino and working on a farm? Would it change the outcome of the case if he was illegal? Unfortunately, we are left wondering about the citizenship status of the father and his daughter.

Finally, Mathis ends by saying: “The neighbor’s [sic] probably right about the jury, but the father and child victim will never be “regular kids” again.” Thank you Mathis for your awful contraction and for pointing out the fact that this event will leave an emotional scar on the father and daughter that will last a lifetime. George Mathis, you sound like an idiot.

After reading this article I feel like it would belong in a high school newspaper. It is sad to read all the comments that applaud a man for committing murder as an act of revenge. The father obviously caught the rapist in the act and defended his daughter, but once he disabled the rapist he certainly kept beating him beyond belief in order for him to die from the trauma. Therefore, the father acted in defense of his family and then committed third degree murder as a passionate act of revenge against the man who raped his daughter.

We are a nation of laws. We must speak up for those who cannot speak for themselves. Mr. Flores was brutally attacked and killed, and we need answers.

This man should a trial of his peers.

@DawgNole no we all absolutely need answers, the law is the law and to make exceptions is to throw it all out the window. there needs to be an investigation and there needs to be a trial, sure he’ll be acquitted and its all just really going through the motions, but those motions are very, very important.

@Brandon well he wont get third degree because of the very easily argued temporary insanity. the very fact that he called 911 immediately after and was concerned he had killed the man meant that he wasnt a person capable of taking a human life without remorse. so basically we have accidental homicide.

This father is my hero!!!! I think all of these sex offenders deserve street death penalty. Why do people waste time fighting about politics and race when we should be fighting to protect our children! I applaud this father.

The article does not say whether or not the assailant was armed and dangerous or if the deadly force was needed or just the father’s passion. Rape is a serious crime. I’ve been raped, but the penalty for rape alone is usually not death. I hope the child gets the necessary treatment. Although I must admit, she should feel safer knowing the assailant is dead.

I completely agree with the father’s actions. I disagree with Mateo. It was not revenge the man was looking for, but justice. There is no justice in the murder of people who have nothing to do with the crime.

Wow… I am shocked and proud. When I first started reading this story, I was afraid to read the comments. I am in NYC where you shouldn’t call a spade a spade lest it feels inferior to the diamond, and really did not want to see that in this case. Thank you all for giving me a little more hope for the human race.
And to those of you who are of the opinion that one should not kill another human, you may be politically correct, but one should not rape children either – sadly, its not like he was ever going to be ‘cured’ now was he? I just hope that all the other little children he forced himself on (’cause at 47 you know this wasn’t the first time) could know that he is gone so they could feel a little bit of relief in their souls as well.
And to you, Dad of this story, may you and your daughter find peace.

My prayers are with the victims family, that being the little girl, I hope she will be alright, and God bless the father, I would do the same thing but feel no remorse and you can quote me. I have 3 kids with a girl the same age so I understand and commend the father for justice done in an unjust world.

I was molested by several relatives as a child… Justice was done… I dont understand how You can stick up for someone like the molester… Maybe You dont have any children or Young relatives? You’re as sick a person as the molester was if what You said was what You believe…
