Jury awards jailed illegal immigrant $750,000 lottery ticket

A jailed illegal immigrant in Georgia is the rightful owner of a $750,000 lottery ticket, a jury decided Thursday.

The Macon Telegraph has an excellent write-up on the tale of suddenly rich but soon-to-be-deported Jose Antonio “Tony” Cua-Toc, 27, a native of Guatemala who entered the country illegally in 2000.

Cua-Toc, a day laborer in the employ of Fort Valley business owner Erick Cervantes, bought the winning Jingle Jumbo Bucks lottery ticket in November 2010. Cua-Toc said he asked Cervantes to cash in the ticket because he was in the country illegally, but Cervantes kept the money.

Cervantes claims he gave Cua-Toc $20 to buy the ticket for him, but jurors watching store video of an exultant Cua-Toc decided that was not the behavior of a man who had just won a fortune for someone else.

The verdict in the civil suit would seem to set precedent — the jury determined the owner of a lottery ticket is not who pays for it, but who actually purchases it, which has me reconsidering the AJC office pool.

Cua-Toc’s winnings after taxes total $517,500. The Houston County jury also awarded him $207,000 in attorney’s fees and $25,000 in punitive damages. He is currently jailed on a DUI charge and will likely be deported after completing his sentence.

According to Georgia law, Cua-Toc could have claimed the prize as an illegal immigrant, which would have made this story a lot less interesting.

Now, I’m off to buy a $1 Mega Millions ticket. The drawing tonight is worth $148 million, and, if I win, I can assure you I won’t be asking my boss to cash it in for me.

Actually, many of the immigrants, legal or not, do spend a large portion of their money here. The amount they send home is comparatively small. $10 goes a lot farther in some of these other countries than it does in the US.

Unfortunately, companies hire illegals as independent contractors. After the WSB or TV46 undercover news story over the summer. As a result, deductions are not made by the employer for SS, FICA, GA taxes etc. So big deal they spend 20% of their pay in the state and send 80% to their families.

The next time you are in an emergency room, take a look at the other users of services there. Medicaid sure is great when you don’t pay taxes. Take a look at our schools and the number of students that can’t speak English. They don’t pay taxes, but sure do use the services.

I’m still trying to figure out the meaning of the word “Illegal” ! If the guy is in this country illegally then his gains are illegally gained ! I have stopped buying tickets, and plan to never buy another one. We pay illegals, we give hope scholarships to illegals and folks from out of state, and we spend millions on advertisements to be pocketed by lottery cronies even though we’re the only game in the state. Bob if you are referring to Peachcare – one of the primary qualifications is that you have to be a US Citizen or Legal Resident. Almost half of Americans do not pay federal income tax any yet they still hold their hands out each month for their government handouts. If you want to solve the Immigration Problem, we need immigration reform. Instead of spending billions of dollars sending people back home, why not offer the non-crimal immigrants a path to citizenship which requires them to pay back taxes and refuse goverment assistance for a period of ten years.

Illegals do not qualify for Medicaid but you are right that they must be treated in emergency rooms due to a law that Reagan signed called EMTALA.. The hospital then writes this off but makes up the difference with the rest of us. The uninsured is a problem and it’s not caused just by illegals.

Judging from this response, it appears as if many people don’t know that you can be perfectly legal in this country, and still not be a citizen? All of the comments here about only benefits being for American citizens are simply not even valid. Ever heard on a green card? Some of the smartest people have these – doctors, engineers, scientists, and more. They want to work here, pay taxes (more than most due to their positions), but do not acquire citizenship. I realize that this guy is illegal, but some of these comments are so dumb.

Some people marry a spouse from another country, live in that country, but retain their original citizenship. I did, and have lived in the US for over 25 years, with a Permanent Resident card. I own a business, hire US Legal Residents, and pay a boatload of taxes since I am a small shop. In the early 80s, I did live here illegally, worked at resturant jobs, and never took any handout. But guess what – no one noticed or cared, because I was white and spoke English.

There needs to be an employement center setup at the U.S. – Mexico border and when there’s a need for labor they issue the company in need however many labors they need. There is no requirement lottery winners be US citizens. In fact many US citizens play foreign lotteris and many foreigners play US lotteries.

This man was working. He had a job and if he had a job he was paying taxes. It has been my experience that millions are paid by working illegal immigrants who never get a tax refund. There has been no indication he did anything but work. Secondly and most importantly, the lesson is of the greed and exploitation of those who hire illegals. It has always been said the best way to stem the illegal problem is to give jail time to those who get caught more than 2 times hiring illegals.

If you want to stop the illegal problem jail the employers. As long as you only deport or jail the illegal, the employers will simply replace them with a fresh batch of illegals. We saw that when states passed strict immigration laws and immigrants refused to come there. Now those states, including Georgia are stating they have a shortage of certain types of workers.

The most troubling of this situation is the continuing exploitation of illegal immigrants. I think the person who attempted to take the money should also be tried criminally. It was low life for him to do that and he knows he attempted to take this man’s money. And trust me, if he had given him the money when he won it, he probably would have returned to his homeland and lived happily everafter.

I’m glad he won his case. But forget the lottery fiasco. Here’s my issue. He is an illegal immigrant who was arressted for dui. He is receiving Clothes, food, a place to live, medical care and other things i may not know about. Seems to me “They” should have made him pay monetarily and deported him already. GA is one of the states that has the harshest immigrant laws (which I do not support) But if that is the case, why are “They” giving away all our valuable resources $$$$$$$$$$$$$$$?????????

HL Bob is right look in the emergency rooms they are not on Medicaid but guess wat,I bet all their children were born here which makes the kids American born citizens which they are eligible for Medicare

I agree with all the comments here am a Hispanic living in GA for about 16 years and I get annoyed when hispanics that come here illegally or legally don’t get with the program. I paid my taxes, I have health insurance, I spend my money in the States, I learned the American culture, but am just a small percentage of hispanics that get with the program, the rest just don’t get it and that’s insane.

This should be the cue for the legislature to make it illegal for border jumpers to receive $ from the GA Lottery. The $ could be put back into the lottery pool, or donated to charity …just about anything other than allowing it to migrate to Guatemala.

Thank you to the illegal immigrants for keeping hope alive. It is a shame that they are not allowed to earn a higher education in this wonderful state of hate. Hope scholarship is funded by the purchase of lottery tickets a large percentage of the tickets are purchased by illegals yet GA wants to deport and block them from earning a higher education. Stop the hate continue to educate a mind is a horrible thing to waste remember Georgia the state to busy to hate. This kind of hate fuels bulling and we wonder why are kids behave the way they do lead by example a positive loving welcoming example.

Truly it’s a state of hatred. At least the majority of them. I thought people who cares about news are those who are at least fairly educated. So much of education that they are blind folded by jealousy, hatred, and superiority. Wake up already. Go downtown and look at those so called born and raise here drain the crap out of federal money, welfare scam. How about that female American citizen who won the lottery and still want to use her food stamp? Where is your moral? It’s not about where were you born, it’s more about moral issues and dissatisfaction of life.

sure he may have won it fair and square; but before you go deport him, make him spend it ALL here in the USA. This is part of the reason this country has gone into the gutter; us hiring legal (illegal, doesn’t matter) immigrants and allowing them to send all of their money out of the country, and not keeping it in our economy.
