As my colleague Jim Galloway first reported, U.S. Sen. Saxby Chambliss will soon announce that he will not seek re-election in 2014.
Georgia conservatives are already taking credit for the decision, arguing that they pushed “Taxby” into retirement. And they probably did. The senator has a very conservative voting record, but not conservative enough for many in his party. His admission that maybe, just maybe, the Republicans would have to accept higher taxes as a necessary evil made him unacceptable in their eyes, guaranteeing a bitter primary fight.
I doubt Chambliss will admit that internal party dissent played a role in his decision. He might say that by announcing so early, he allows himself to devote the next two years to trying to solve problems in Washington. He’ll probably also tell us that if he had wanted to run again, he’s certain that he would have won.
However, few will believe him, and his departure marks another step in his party’s inexorable march to the right.
The announcement also sets off a free-for-all among Georgia congressmen, who are all too aware that an open Senate seat doesn’t come along very often. As they give up their seats to run, that in turn will create ripples in the Georgia General Assembly, as legislators position themselves to fill those vacancies. It promises to be quite the scene, with GOP Senate hopefuls competing with each other for the title of most-diehard-conservative-ever-ever-ever.
And as an added attraction? As the AJC’s Dan Malloy tweets from Washington, a spokesman for Newt Gingrich may be cracking the door open a bit, observing that “Newt might be on Medicare, but he is not ready for the retirement home.” As you recall, Gingrich won the Georgia presidential primary by 20 percentage points. He had ruled out running in a primary against Chambliss, but this could change things.
(Personally, I think a Gingrich run is unlikely. But in a second tweet, Malloy reports that “Expecting a statement from @NewtGingrich on #GASen today after he speaks with his wife.” UPDATE 12:34: A Gingrich spokesman now says that the former speaker “will not be a candidate in the 2014 GOP Senate primary.”)
On the Democratic side, the promise of a hard-fought, expensive, blood-letting GOP primary, with the process almost certain to produce a candidate much more conservative than the conservative Chambliss, may create a small window of opportunity.
No, the timing isn’t perfect. The demographics of the state may be changing, but they haven’t quite changed enough. The political fortunes of Democrats in general are improving, but they haven’t improved quite enough in Georgia. And the party infrastructure in much of the state is abysmal. Nonetheless, the right Democratic candidate, with the right campaign and message and against the right opponent, could potentially accelerate the process by a cycle or two.
And who might fit the bill as the “right Democratic candidate”? The list is pretty short. U.S. Rep. John Barrow, the only white southern Democrat remaining in the House, has already announced he won’t run for Senate. State Sen. Jason Carter of Decatur has a bright future, but youth and relative inexperience would make victory difficult. And while Atlanta Mayor Kasim Reed is probably the party’s best hope in a statewide race, it would be a big political risk even for him.

That was vague. What I meant is maybe he’s got a good pay out, (campaign fund), to live from along with a sweet “power job” and as such he gets to be the guy who negotiates, cuts the deal that needs to be cut and then takes all the blame.
The Republicans have shown that they are easily lied too and will believe ANYTHING as long as it comes from talk radio or FOX. So once the things are done that we HAVE to have done to fix our economy, Rush and his boys along with FOX start blaming it all on Taxby to clear the other guys “name” with the tea party idiots.
Were it any other group I would say it couldn’t happen, but with this crop of FOXBOTS? It’s a cakewalk. Expect one or two other sacrificial lambs Jay. Look for other states like Georgia where there isn’t a snowballs chance in hell of a Democrat being able to take the seat. Look for another State where they would gladly elect a thief who ran from Congressional Ethics charges like here in Georgia.
Time will prove me right. They’ve backed themselves into an unwinnable corner and this is how they will attempt to get out of it.

Jay, Barrow said he would not run against Chambliss which is what Gingrich also said. I’ll bet he is at least thinking of it. Carter will be tempted because he obviously has higher aspirations than State Senate but he is young and can wait for demographics to come more into play. A lot will depend on how bloody the Republican primary is.

Agree on the last part, but that’s fixable. Not so sure about the first two; remember that an energized African American votership helped get Obama 47% in 2008. in 2014, with a less-abysmal GA democratic organization, it could be real competitive.

I’m struck by the usually non-right posters lamenting the loss of a conservative senator. Personally, I had no large axe to grind with Chambliss, except that he’s past my term limits. For that reason alone, I rejoice and look forward to the blood-letting, I mean vetting, that will occur on both sides to present a viable candidate. Isaacson’s next. Doesn’t matter to me R or D. Won’t vote for a senator past a second term, or a congressman past a fourth. Long live term limits! Fire them all. Start over!

I guess you have never heard any adages about words counting for little and actions counting for a lot. Or know about used car salesmen. I don’t believe him. At this point I think he is a liar. He has put nothing credible on paper for all of us to see (as the GOP has done in the House – whether you agree with all of the proposed cuts or not, it is at least a clear starting point) in four years time. NOTHING. I want to know what spending he would be committed to cutting. And, judging from his ACTIONS (rather than his words), I can only conclude he really doesn’t want to cut spending.

We are in a particularly vicious cycle of politics whereby many viewed bush as being installed by the supreme court and the dems begrudgingly accepting it without threats of 2nd amendment solutions or tea party type opposition. Bush panned out to be one of the worst ever, just as many feared and predicted. Obama gets elected and its payback time for repubs who want to vent and hate on the first african american president. Obama’s intellect and pragmatism is far and above that of bush’s who was basically a yes man for cheney’s hard right ideology. to bush’s credit, after about the sixth year of cheney leading, he cut it off and went his own way which was too little and too late.
After this 4 years is up, maybe, just maybe, there will be someone out there that can unite and bridge the gap. Even though I’m an optimist, I have no illusions that will be a very long shot…

Saxby will do more good for the state in the next two years with the special interest lobbies off his neck than any senator we have had since Nun. There is a movement for term limits that I think may cut in by the end of Saxby’s term anyway.
How about bringing Roy Barnes out of mothballs? Remember Johnny had less a track record of winning than Roy when he finally got in, or maybe Pierre Howard or Cathy Cox who should have been governor in the first place. I think there is a window that will be wider in two years if Saxby stands up to the wing nuts like I am thinking he will. If Saxby handles himself well he could become the next governor. We need to root out the nasty political machine that has run this state and local congressman and replace it with the character we are electing for senate now days. I maintain my original point and you have said nothing to disprove it, (actually you PROVE it for me), that you only offer excuses like “he did this” to justify poor behavior. It’s weak, ignorant, and “proves” nothing.
Why did you beat the dog? Johnny kicked a horse.
Why did you throw your milk on the table? Johnny spit on the floor.
Why did you key that car? Johnny threw a rock through Mrs. Crabapples window.
You had kids didn’t you? Did you put up with that sht when you confronted tehm about misbehavior? I somehow doubt it. Those are juvenile responses. Why do you engage in that here?

Catholic organizations have for decades fought to change federal and state laws that fail to protect “unborn persons,” and Catholic Health’s lawyers in this case had the chance to set precedent bolstering anti-abortion legal arguments. That seems to be the case, RB. I also have yet to see a column from Jay on wasteful and fraudulent government spending. You know, when something isn’t really working at some point you have to say “Maybe we should try a different approach”. All of the money the federal government has spent to help the disadvantaged in our inner cities doesn’t seem to have done much. Maybe money per se isn’t the solution. Maybe it’s something else. The DC court of appeals just laid a smack down on Obama about recess appointments.
“The dearth of intrasession appointments in the years and decades following the ratification of the Constitution speaks far more impressively than the history of recent presidential exercise of a supposed power to make such appointments,” the judges wrote.
“Recent presidents are doing no more than interpreting the Constitution. While we recognize that all branches of government must of necessity exercise their understanding of the Constitution in order to perform their duties faithfully thereto, ultimately it is our role to discern the authoritative meaning of the supreme law.”

Morality, with a name like “Morality,” you should already know the answer to your question.
Yes, something that is technically legal can be cheating. Is legality the only basis for determining right and wrong? (And again, the legality of this particular approach is itself uncertain.)
When slugger Mark McGuire was taking the steroid androstenedione back in the late ’90s, was he cheating? It wasn’t on baseball’s list of proscribed drugs at the time.

The Cato Institute estimated that, in 2002, $93 billion were devoted to corporate welfare. This is about 5 percent of the federal budget. To clarify what is and isn’t corporate welfare, a “no-bid” Iraq contract for the prestigious Halliburton, would not be considered corporate welfare because the government technically directly receives some good or service in exchange for this expenditure. Based on the Pentagon’s Defense Contract Audit Agency (DCAA) findings of $1.4 billion of overcharging and fraud, I suppose the primary service they provide could be considered to be repeatedly violating the American taxpayer. On the other hand, the $15 billion in subsidies contained in the Energy Policy Act of 2005, to the oil, gas, and coal industries, would be considered corporate welfare because no goods or services are directly returned to the government in exchange for these expenditures.

Your “question[s]” were absurd and deserved no answer from me. If you don’t that the federal government is now spending money at a percentage of the GDP that is considerably above the historic norm – a good part of which is devoted to paying an almost 17T dollar debt, then I don’t know what to tell you. The only prayer Obama has of us getting out of this huge hole we are in without substantial spending cuts is if the economy recovers to a good state. If that does not happen, and cuts are not made, our situation will not be better. It will not even be the same. It will be worse – perhaps much so.

I think maybe the court of appeals smackdown of Obama is sort of relevant adding to the slow but steady bits of evidence that he is no constitutional scholar. Let’s see, Laurence Tribe, two Chicago Law School deans….
How about Hank Johnson as a Saxby replacement? He will keep Guam stable and protect the *little people* he inadvertently offended by making any reference to midgets *hate speech.* In fact his comments explaining what moves *little people* is a classic and could be woven into his campaign speeches.
Obama could no doubt match Broun in a dinosaur wrangling contest, since in April 2008 Obama gave essentially the same opinion about creation as Broun did.

Wow. “Impeachment” has become as meaningless a phrase as “racism” and “sexual harassment.” It gets bandied back and forth so much like the little boy crying wolf that no one believes it when it’s real. Nowadays if the President jiggles and whizzes on the floor, some ass clown wants to take him to court or try to impeach him.

Is the name “Bush” is necessarily a bad one in the GOP? Isn’t Jeb Bush, at 59, still a potential national-level candidate?
As for Carter’s name, you might want to look outside your bubble–the former President is beloved by many, it’s mostly the hardcore right who still have a bone to pick with him.

If it had gone to court he would have been found innocent of cheating. Don’t confuse morality with law. Two completely and unrelated things. If the drug was not on the banned list it wasn’t cheating because they all could do it (as Cat said). It should have been on the list but wasn’t. Fred, you should conduct an Internet search on the topics Jay writes about to see how often the EXACT same story is being covered by the Huffington Post, Mother Jones and various other liberal media sites. You know – just to get some more perspective about the political “echo chamber” you seem to be condemning. It happens on both the right and the left. If it’s not finger pointing, it’s name calling. Almost all of the “talking heads” do it to some extent. The ironically funny thing is that pointing out the failings or immorality or hypocrisy of the other side seldom get those on that side to reflect and perhaps decide maybe they shouldn’t be in the business of defending politicians, but (instead) their own personal beliefs.

New issues come up and are resolved. Pres Obama’s role is now that of president – not university instructor. One of those duties is to push gray areas in favor of the Executive. The problem with your whole thesis is that the Senate agreed to and voted to withhold their own pay if they did not come up with a budget. This makes it Constitutional. As far as Obamacare, the SCOTUS said the way the bill was sold to the American people “penalty” was unconstitutional. Obama’s lawyers came up with the tax argument at the last minute to do an end run and Roberts bought the argument. The court did strike down as Unconstitutional the parts about holding the states hostage unless they increased Medicaid and set up the exchanges.

“Withholding Congress’s pay until they actually do their job would be a partial solution to reducing this Fed Debt and should be considered seriously. ”
According to many conservatives on this site, any solution, such as the one proposed above, must COMPLETELY eliminate the deficit, or it may not be considered. I offer as an example example the rejection above of cutting the 5% of the budget going to “corporate welfare” – the response to which was, “but, but, but, that won’t reduce the deficit to zero!”

Let’s see if I have this straight, JV. All military veterans who served in combat are worthy of respect, but some are more worthy than others – especially when they “spit” on their comrades (or perhaps denigrate their service to a government expecting insanely unrealistic things from them before Congress).

Jay, to jump back to your prior thread regarding the RNC proposals to the EC, one thing I was aware of:
the National Popular Vote interstate compact, an agreement among states to award all their electoral votes to whichever presidential candidate wins the popular vote nationwide. If states with more than half of all electoral votes sign up for this, it goes into effect.
So far, only nine states with a total of 132 electoral votes have signed up [but that is 49% of the 270 EV's needed. ]
The GOP may bring about the effective demise of the EC. http://www.nationalpopularvote.com

Like I said, the probability of not two but THREE of you post NOT ONLY the same off topic subject, BUT ALSO using the same non traditional term to describe it all within 90 minutes is astronomical.

I guess to play devil’s advocate, one can effectively stop SOME people from having the procedure by incrementally making it as difficult as possible, as these a-holes have done in some of the more backward states. But of course you can’t forcibly prevent pregnancy terminations from happening; and while I’ve heard some “pro-lifers” vociferously object to my term “pro-criminalization,” I don’t know what else you’d call advocating for a personhood amendment. Obviously if you’re conferring basic citizenship rights to embryonic life, you’re going to be committing some crime if you end that life. I don’t see any way around the use of the criminal code to accomplish that.

Let it go on record here that I did not call anyone a coward – that was JV. I did not call Obama a coward – just pointed out that he did not serve. I guess Bush joined the guard to avoid Viet Nam – not to further any political career. That is my guess. That happened a lot and I thought it was wrong. This was LBJ’s and Congress’s loophole to keep their children from being drafted. As you know as long as you could stay in college you could also avoid the draft. Back then gub’ment scholarships and so forth were non existent. So, you had to be fairly well off financially have political connections or actually flunk the physical to avoid Viet Nam. Ali refused to be drafted – did that make him a coward? There are different reasons why people do or don’t do things. We could go on about this all day but – let’s don’t.

I agree. It’ll come down to a race between Broun and Price to see who is the most narrow minded, radical wing-nut and most likely to take the state closer to the 19th century in education, science and social outlook.
Broun, winner of the 2012 Darwin Award, looks to be about a half step out in front of Price, but that can be made up easily by Price uttering two or three ridiculous statements that would demonstrate equal ignorance and stupidity to Broun.
It’s going to be a race back to the Republican Comfort Zone — the 19th century.

Legally speaking if the law says it is legal to murder babies then you can legally murder them and not be tried for murder as long as you follow the legal procedures. However that does not keep murdering the unborn from being immoral – which it is. Legal just means the gub’ment says go ahead and do it and we will let it go. Immoral means go ahead and do it if you wish – God will be the final judge and jury.

“Morality” — “Mama – I don’t know that much about Chambliss and his bum knee – in fact this is the first I have heard of it. If that is true how did Chambliss get past the military physical?”
Well, that’d be between him and his draft board. Maybe he did a Ted Nugent and crapped his drawers in the induction station so he wouldn’t have to go to ‘Nam.
“I guess Bush joined the guard to avoid Viet Nam – not to further any political career. That is my guess.”
I think a lot of guys did just that around that time, but some of them wound up going anyway. Going National Guard really isn’t a reliable way of avoiding service in a combat theater any more IMO. FWIW, after I left active duty, I transferred to an Army Reserve unit here in Georgia, and I was told that my first drill weekend would include a Class A uniform inspection. They told me not to worry about unit patches; that they’d square me away over the weekend, so I showed up with my “A”s on.
Imagine my surprise when I saw that everyone in my new Reserve unit had been to Desert Storm — and I hadn’t. They had combat patches and decorations for having been there, but not active-duty me, whose division just didn’t get sent.
FWIW, a young fellow who used to work for my wife was former Air Force who served a tour in Iraq. He figured he was safe until one day he and some other airmen from his section were eating in the chow tent and they heard a dull, metallic KA-CHINK about ten feet away. One of them looked, and sure enough, it was a dented and dinged-up DUD MORTAR ROUND the bad guys had obviously just fired at them, still smoking hot and fresh from the mortar tube. Right about that time, they started to hear automatic weapons fire around their base, and other *not dud* mortar rounds started coming down in the area, so lunch was definitely suspended while the attack was repelled.
This young fellow was, he told my wife, an Air Force *meteorologist.* A freakin’ *weatherman.* And he had an AQ mortar round drop ten feet from the table where he was eating chow. So clearly, there’s no such thing as a safe place any more when you’re in the theater of operations. And it doesn’t seem to matter if you’re active duty, Reserves or Guard, either.

“Unborn child” is a term for a HUMAN fetus – meaning that what is aborted is a living human being and will become a human child if left alone. If you can change words around to mean something else why not “unborn child”. For example gay always meant happy until someone stole the word and it is now a slang word for homosexual. A human fetus is a human being – has human DNA – can’t be anything but human. Stick that one in your pipe and smoke it. If you want to kill human’s for your convenience just say so. Now I am not one that would say that a woman raped should be made to have the child – I couldn’t make that decision – but killing a human out of convenience because it will cramp your life style – that’s another matter that I can’t agree with. Will become does not equal is right now.

“A human fetus is a human being – has human DNA – can’t be anything but human. Stick that one in your pipe and smoke it.”
Human cancer cells have human DNA, too. So by your logic, cancer can’t be anything but human. So stick *that* in your pipe and smoke it.

I think this kind of substantiates your point. The “legality” and “morality” of killing another human being lies in its justification (valid or not). I think he is a disingenuous far left wing nutcase. In other words, he says the words but doesn’t walk the walk. But his military service? As a war protestor he JOINED the Army so that someone else wouldn’t be sent in his place. After his father was defeated he DID get to Vietnam.
I’m short of time, but I think you should research Gore’s time in the Army. Like I said, I despise the man and his politics, but I very much admire his military service, his reasons for joining, and his conduct while in the Army. Mama – National Guard during Viet Nam was a pass to stay out of Viet Nam. Today it’s a different story. Some of these politician’s kids were to stupid to get in to college and back then social promotion didn’t work on college. So the Guard was just another loop hole to keep Congress’s kids out of Viet Nam. It was hard to get in the Guard back then because so many wanted to avoid Viet Nam so it took political pull to get you in but once in you were safe. The Guard back then was meant for defense of the USA on USA soil and they weren’t sent over seas. As for a free pass on immoral acts – I don’t think you get a free ride just because you are a no believer. God is real even if you choose not to believe so. Jawja. My, my. Just when Sen. Chambliss begins to see the incredible responsibility of a US Senator, the party to whom he has shown so much fealty allows their peanut gallery to kick him to the curb. Or is it that the senator doesn’t want history to paint him as just another teacake?
I swear if the all powerful Republican Party of Georgia allows itself to be deconstructed (much the way the national party has done) by the lunatic fringe, it will be the greatest choke since the 2011 Braves.
I am sure there are decent people who subscribe to the “government and taxes are bad” mantra of all things tea. But as a somewhat detached political observer, it seems many are in financial distress without significant job stability and their families run as can only happen under the authoritarian follower structure. They can shout out every word of the standard diatribe on government handouts and 2nd amendment rights, but are generally uninformed about the drastic assault on the 4th amendment over the last 12 years.
All that said, I’m surprised Jim Marshall’s name wasn’t part of the discussion. The most conservative democrat to have recently held office, he might pull from the legions of common sense Republicans – and they are available.

“There’s no such thing as an “unborn child.” Until the fetus is born, it’s not a “child.” And once it’s born, it’s no longer “unborn.”
False. There is no objective way of knowing that. I guess it all depends on where you are getting your “information” or “knowledge” or “understanding”. The Bible, for instance, plainly speaks of pregnant women being “with child”. The definitions follow from one’s worldview.
Isn’t funny that these same people that want to deny the unborn is alive will argue till they are blue in the face that global warming is man made. There is way more scientific evidence that the unborn is alive then man makes the temperature rise.

I understand and respect that. I appreciate you meeting me halfway here.
Towncrier’s suggestion that I take a class on semantics is, of course, about 25 years too late. Besides, he — and you — wants me to apply a specific denotation to “child” that I simply don’t agree with. I don’t reject the notion that a fetus is “alive,” but being “alive” is not, in and of itself, sufficient for the imputation of *human* rights. Ergo, pro-lifers like yourself and Towncrier are now trying to argue that a fetus is “alive” (which I grant) and that it is ‘human’ (which I don’t) and that it is a “child” (which I also don’t grant).
Towncrier’s right in that this is a matter of semantics, but he’s incorrect in his insistence that his preferred denotaion be used. He’s certainly welcome to use it himself — and I presume that you’d agree with him — but he’s in no position to require that others use it as well.
Good try though, TC.

It’s just playing with semantics to justify what is unethical behavior at the least. Even playing the legal game, how many people have been convicted of mulitple homicides for killing a pregnant woman? I’m pretty sure homicide is a synonym for murder, so yes even under the law we’re talking murder. No one was ever tried for war crimes for firebombing and nuking a few hundred thousand Japanese women and children either, but that didn’t make it a morally righteous act.

FWIW, the bugs in your digestive system are “alive” and you kill them by the millions whenever you take antibiotics for seasonal upper respiratory infection. The definition of “alive” is quite broad, but I’m sure we could agree that Streptococcus Thermophilus are in no way “human.”
Honestly, I think the definition of “child” or “human being” — when it comes to the abortion issue — is going to have to be couched in a legal definition that’s simply *bound* to upset some people. Either it’s going to be too inclusive (which would give me agita) or it wouldn’t be exclusive enough (which would likely trouble you).
Clearly, there has to be an operational definition of “child,” and since not everyone operates the same way, some people’s opinions are simply inevitably going to be trod upon. I’m afraid I don’t see any way around it.

Saxby shows a little common sense and a sincere interest in doing what is right for the country and the
wacko rights hammer him. The GOP continues to slide into irrelevance. The very wealthy and blue collar whites now the majority of their. Wealth only care about taxes and the blue collars are too dumb to know they are voting against the own interests.

“Clearly, there has to be an operational definition of “child,” and since not everyone operates the same way, some people’s opinions are simply inevitably going to be trod upon. I’m afraid I don’t see any way around it.”
Well, if an absolutist position is not taken (one is a human being at conception or only one upon being born), then all everyone is doing is engaging in line drawing. I mean, the very definition or idea of “viability” has changed since Roe v. Wade due to nothing more than medical and technological advances (since 90% or more of babies born before the 28th week now survive). That to me proves how ill-advised (if not immoral) it is to draw lines with respect to human life. My own personal opinion is that any and all abortions should be allowed OR none except in cases where the mother did not choose to engage in intercourse (because she was raped or molested) causing a pregnancy or her life is endangered by the pregnancy (on the theory that the government cannot compel her to either bear a child or risk her own life for what would likely be religious reasons).

Cons, you can spin this any way you like, but the fact is the Party throws away a near certain win, with three term seniority, for first term (Mack Mattingly, anyone?) replacement, at longer odds.
Or, the same decision making that resulted in:
-loss of the White House
-fewer seats in the Senate
-fewer seats in the House
You seem to have forgotten to also say that:
30 Governors
total control of 29 state legislatures
half control of 6 state legislatures.
233 to 200 majority in the house while in 2008 256 Dems and 178 Republicans.
See the parties that hold the power in the states control the congress.

“The political fortunes of Democrats in general are improving, but they haven’t improved quite enough in Georgia.”
Jay I’d argue their fortunes have peaked in Georgia and probably will peak relatively soon elsewhere as well.
Consider the demographics. The current Dem base is largely younger voters, African Americans and Hispanics. As the young’uns mature, and … assuming the economy grows … the minorities prosper and learn about paying income taxes they will transition over to the other side. That’s the way it usually plays out. By the time BHO’s second term has ended everyone will be so disenchanted and disappointed that their won’t be another Dem in the WH for many years.

An interesting read related to the status of the unborn:
http://hotair.com/archives/2013/01/23/salon-yeah-abortion-takes-a-life-so-what/
I had never even considered this whole question from the standpoint of individual women vacillating in completely contradictory ways on whether or not the life they are carrying is human. You have to be kidding me! That is no way to logically resolve the question. So the morality of abortion is determined by a woman’s moods (if her pregnancy was brought on by a choice she made to have sexual intercourse without ensuring she wouldn’t get pregnant if that isn’t what she wanted)? How unbelievably idiotic, contradictory and immoral!

When a lab takes a blood sample from any of us, the sample contains living human cells. Is that murder?
Of course, a fetus is different from a blood sample. But it is also different from an actual human being. A fetus is only a potential human being. Killing a fetus is not murder and should not be criminalized or otherwise forbidden.

Again, I am not an anti-abortion extremist, but why is feticide criminal if unintended, but legal if intended?
O.C.G.A. 16-5-80 (2010)
16-5-80. Feticide; voluntary manslaughter of an unborn child; penalties
(a) For the purposes of this Code section, the term “unborn child” means a member of the species homo sapiens at any stage of development who is carried in the womb.
(b) A person commits the offense of feticide if he or she willfully and without legal justification causes the death of an unborn child by any injury to the mother of such child, which would be murder if it resulted in the death of such mother, or if he or she, when in the commission of a felony, causes the death of an unborn child.
(c) A person convicted of the offense of feticide shall be punished by imprisonment for life.
(d) A person commits the offense of voluntary manslaughter of an unborn child when such person causes the death of an unborn child under circumstances which would otherwise be feticide and if such person acts solely as the result of a sudden, violent, and irresistible passion resulting from serious provocation sufficient to excite such passion in a reasonable person; provided, however, that, if there should have been an interval between the provocation and the killing sufficient for the voice of reason and humanity to be heard, of which the jury in all cases shall be the judge, the killing shall be attributed to deliberate revenge and be punished as feticide.
(e) A person convicted of the offense of voluntary manslaughter of an unborn child shall be guilty of a felony and shall be punished by imprisonment for not less than one nor more than 20 years.
(f) Nothing in this Code section shall be construed to permit the prosecution of:
(1) Any person for conduct relating to an abortion for which the consent of the pregnant woman, or person authorized by law to act on her behalf, has been obtained or for which such consent is implied by law;
(2) Any person for any medical treatment of the pregnant woman or her unborn child; or
(3) Any woman with respect to her unborn child.
