False. Contrary to President Clinton’s claims, there is no “gun show loophole.” All commercial arms dealers at gun shows must run background checks, and the only people exempt from them are the small number of non-commercial sellers. According to the U.S. Department of Justice, at most 2 percent of guns used by criminals are purchased at gun shows, and most of those were purchased legally by people who passed background checks.

Who are we cons to argue with the U.S. dept of Justice?

U.S. federal law requires persons engaged in interstate firearm commerce, or those who are “engaged in the business” of dealing firearms, to hold a Federal Firearms License and perform background checks through the National Instant Criminal Background Check System maintained by the FBI prior to transferring a firearm. Under the terms of the Firearm Owners Protection Act of 1986, however, individuals “not engaged in the business” of dealing firearms, or who only make “occasional” sales within their state of residence, are under no requirement to conduct background checks on purchasers or maintain records of sale (although even private sellers are forbidden under federal law from selling firearms to persons they have reason to believe are felons or otherwise prohibited from purchasing firearms).

Those seeking to close the “Gun Show Loophole” argue that it provides convicted felons and other prohibited purchasers (i.e., domestic abusers, substance abusers, those who have been adjudicated as “mental defectives,” etc.) with opportunities to evade background checks, as they can easily buy firearms from private sellers with no accountability or oversight.

Use of the “Gun Show Loophole” has been advocated by terrorists. In the summer of 2011, Adam Gadahn declared that “America is absolutely awash with easily obtainable firearms.” He also incorrectly claimed that, “You can go down to a gun show at the local convention center and come away with a fully automatic assault rifle, without a background check, and most likely without having to show an identification card,” Gadahn urged Western extremists to follow this path. Subsequent news analysis indicated that individuals could not actually buy a fully automatic assault rifle at gun shows, although purchases of semi-automatic handguns and extended magazines remain legal without a criminal background check.[10][11]

The term “Gun Show Loophole” has been contentious with gun rights advocates, however. They claim there is no “loophole,” only a long-standing tradition of free commerce between private parties that heretofore has not been restricted in the context of secondary, intrastate firearm sales.[12][13] Furthermore, they argue that the term “Gun Show Loophole” is misleading, as private firearm sellers are not required to perform background checks regardless of location—whether they are at a gun show, a flea market, their home, or anywhere else. They also challenge federal jurisdiction in intrastate transactions between private parties, which they argue exceeds the federal power created by the Commerce Clause.[14]

But hey, with Scummy supporting your posts, you had to know it was not factual and bordered on stupidity.

USA Patriot

January 24th, 2013
10:54 pm

Thulsa Doom – I agree, 99% of guns sold at a “gun show” are by federally registered dealers, thus a background check. To date, there has not been one verifiable “random act of violence” from a gun purchased legally at a gun show.

Aquagirl – yep, if there is no background check, document of a transaction, how does the transaction get reported & to whom? It’s called a private sale, not documented, traced, reported.

Background is that a few years ago there was a “rumor” that teflon or moly coated bullets could penetrate body armor. The media and the gun grabbers siezed on this “fact” and termed such bullets “cop killer bullets” and sought to ban the manufacture and sale of them. The fact is that coating bullets has nothing to do with penetrating body armor. The NRA fought hard against the idiots and as a result shooters can still buy teflon and moly coated bullets, that extend the life of gun barrels.

“I agree, 99% of guns sold at a “gun show” are by federally registered dealers, thus a background check.”

Where does angry little elf get his 40% figure?- liberal fantasyland?

One thing that’s kind of interesting that the kooks tend to offer up is the idea that at these gun shows that some of the people selling the guns are private people that are there to sell 1 or 2 guns and hence don’t need to register as licensed firearms dealers- hence the loopholes.

But here is why and how they are so woefully ignorant. To have a booth at one of these shows or at any type of convention costs money- usually something like $100 to set up their booth there.

Whatever the registration and booth fee why in the hell would any sane person want to pay an expensive booth fee to sell one or just a couple of guns? The cost of the booth itself eats away at your profit- much cheaper ways to sell a gun I’m sure. Like liberal thinking it makes no sense.

Thulsa Doom

January 24th, 2013

“All four firearms used in that shooting — which left 13 dead and 21 wounded — passed through an area gun show”

The NRA has deliberately and methodically opposed background checks, and pursues this tactic both before and after mass shootings. In April, the NRA endorsed a Colorado bill that repealed state-run background checks on firearms. When the group opposed a bill in Delaware that would require checks on sales at gun shows, it conspiratorially floated the “true intent of this legislation is to move towards an ultimate ban on all private sales.” Far from being open to background checks at gun shows, as Keene suggested, the NRA would raise alarm whenever states sought to end this loophole.

Still, the gun show loophole is not the whole story. Thanks to the NRA, at least 11 states automatically restore ex-felons’ access to guns once they served their term, and many states allow violent felons to petition for firearms.

Of course, if as the clownish cons suggest, there are no “gun show loopholes” they should not mind if a law closes a “non-existent” loophole that 90+% of Americans want closed.

What is a “gun show loophole”? Do you mean the fact that an individual can sale a gun to another individual in the parking lot at a gun show?

You have the facts wrong 90% of Americans think background checks should be made. There is no polling data to the question as to should individuals have to run background checks on other individuals if they sell them a gun. Wonder why these polling agencies will not ask the question phased correctly?

godless, you are the one claiming it does not exist. Most Americans understand it does. But since you claim it does not, why do you care if a loophole you claim does not exist is closed.

90% of Americans believe in a sky fairy. 50% believe UFOs are aliens. 65% believe in ghosts. 51% of voters voted for Barack Obama. My duty is to try and educate and keep people from passing stupid laws that restrict freedom for no good reason.

well godless, as Clinton said, It is our job to figure out what happened and do everything we can to prevent it from ever happening again

Figuring out how to stop guns from getting into the hands of criminals and the mentality ill is part of that prevention. It will never be 100% but it can be reduced.

This is not factual information. I did some research and the question was polled.
