Gingrey, Broun would put rape theory into federal law

Last week, U.S. Rep. Phil Gingrey, Republican from Marietta, announced that a former colleague who suggested that “legitimate” rape victims rarely become pregnant had been “partially right”.

Here are Gingrey’s remarks to a Chamber of Commerce breakfast, as reported initially in the Marietta Daily Journal:

“Part of the reason the Dems still control the Senate is because of comments made in Missouri by Todd Akin and Indiana by (Richard) Mourdock were considered a little bit over the top. Mourdock basically said ‘Look, if there is conception in the aftermath of a rape, that’s still a child, and it’s a child of God, essentially.’ Now, in Indiana, that cost him the election.

“And in Missouri, Todd Akin, a long-term member of the House of Representatives and a very, VERY good personal friend of mine, was asked by a local news source about rape and he said, ‘Look, in a legitimate rape situation’ — and what he meant by legitimate rape was this, look, someone can say I was raped: a scared-to-death 15-year-old that becomes impregnated by her boyfriend and then has to tell her parents — that’s pretty tough — and might on some occasion say, ‘Hey, I was raped.’ That’s what he meant when he said legitimate rape versus non-legitimate rape.

“I don’t find anything so horrible about that. But then he went on and said that in a situation of rape, of a legitimate rape, a woman’s body has a way of shutting down so the pregnancy would not occur. He’s partly right on that.

“I’m an OB-GYN doctor. I’ve been an OB-GYN doctor for a long time, since 1975. And I’ve delivered lots of babies, and I know about these things. It is true. We tell infertile couples all the time that are having trouble conceiving because of the woman not ovulating, ‘Just relax. Drink a glass of wine. And don’t be so tense and uptight, because all that adrenaline can cause you not to ovulate.’ So he was partially right, wasn’t he? But the fact that a woman may have already ovulated 12 hours before she is raped, you’re not going to prevent a pregnancy there by a woman’s body shutting anything down, because the horse has already left the barn, so to speak. And yet the media took that and tore it apart.”

Not surprisingly, those remarks re-ignited a national controversy. The American College of Obstetricians and Gynecologists released a statement exposing the bad science behind Gingrey’s claim, noting that “while chronic stress, for example from extreme exposure to famine or war, may decrease a woman’s ability to conceive, there is no scientific evidence that adrenaline, experienced in an acute stress situation, has an impact on ovulation.”

The science — not to mention eons of tragic human history — make it clear that pregnancy through rape is all too common. For example, in a study of 68 victims assaulted as part of mass rape during the Bosnian war, 29 women became pregnant as a result of the attacks and 17 chose abortion to end those pregnancies. As the researchers found, “The decision to have an abortion was strongly predicted by suicidal thoughts and impulses” on the part of the victim. Other studies have documented a pregnancy rate of 5 percent in rapes, producing an estimated 32,000 rape-created pregnancies a year in this country.

(In the horrors of the Bosnian war, women were raped repeatedly and for an extended period of time, sometimes with the avowed goal of impregnation as a means of ethnic humiliation, which may account for the higher pregnancy rate in that instance.)

The next day, Gingrey attempted, implausibly, to back off his clear statement of support, saying that “I do not defend, nor do I stand by, the remarks made by Rep. Akin and Mr. Mourdock. In my attempt to provide context as to what I presumed they meant, my position was misconstrued.” (

You can re-read Gingrey’s initial statement above and judge for yourself whether it was misconstrued. (In his initial comments, he did go on to say that “I’m not standing up here defending people saying stupid things.”) But more importantly, you can and should judge Gingrey and his colleagues by their actions.

Earlier this month, U.S. Rep. Paul Broun of Georgia introduced “The Sanctity of Human Life Act,” co-sponsored by Gingrey, U.S. Rep. Lynn Westmoreland of Georgia and recent GOP vice presidential nominee Paul Ryan, among others. The bill (text available here) declares that “the life of each human being begins with fertilization, cloning, or its functional equivalent, irrespective of sex, health, function or disability, defect, stage of biological development, or condition of dependency, at which time every human being shall have all the legal and constitutional attributes and privileges of personhood.”

Should such absolutist legislation become law, an embryo conceived in rape would “have all the legal and constitutional attributes and privileges of personhood,” and a rape victim who sought an abortion would become guilty of attempted murder. There is no rape exception in the legislation, because there is no exception in the mindset that created it. A rape victim should just “man up” and deal with it.

That’s the bottom line of this discussion; that’s what makes this whole affair much more important than just another congressman saying something offensive.

I agree that as a matter of logic and principle, it is plausible to argue that even an embryo conceived in rape has the right to life. “Even when life begins in that horrible situation of rape, that it is something that God intended to happen,” as Mourdock put it in a debate last fall. Yet for many Americans, the real-life implications of that theoretically tidy position are absolutely unacceptable. It would mean that rape victims would be required by law and government edict to carry the product of rape for nine months and then to endure the pain of birth.

Many women — let me correct that, many people of both genders — see that as almost a second rape, a second instance in which control of a woman’s life and body is stripped from her involuntarily and she is reduced to an unwilling breeding machine. And we are not going back to those days.

For a party against government mandates (an unfortunate word for these circumstances), you would think they would be howling about the loss of “freedom”. Under the GOP mandated birth provisions, would a raped woman be required to support that child? Would there be government assistance to cover the costs of pregnancy and birth? While there may be adoption options for some, what if the child is premature or has medical issues?

And I don’t agree. As long as the foetus is developmentally at a stage where it is completely and totally dependent on the woman’s body for survival, and it WOULD NOT survive outside the womb…it does NOT have a “right to life” Nature has provided that it is the woman’s decision to continue the pregnancy, not that of the foetus.

This touches on something I insist upon in these discussions: This is a POLITICAL blog. This is not about arguing personal ethics. It’s not about whether you, personally, would carry any/all pregnancies to term.

It’s about how laws are made and applied.

If you are of the opinion that a rape victim must carry a pregnancy to term, you have something like 14% support among Americans.

Which is why, understandably, those of us who oppose the likes of Broun, Gingrey, Westmoreland, & co., do seize upon idiocy like “The Sanctity of Human Life Act.” The kind of warm-fuzzy rhetoric they use to defend this horror–catch phrases like “unborn babies” and “right to life”–cannot be allowed to stand.

It’s built on a pile of absolute excrement, and needs to be understood as such.

This is such a touchy subject. WAY too many “personal” beliefs on both sides to make this “debate” have any objectivity. I would like to believe that if something such as rape happened in my family, that it would be a personal issue…and a decision based on personal beliefs, expectations and a moral compass.
However, it is always easy to espouse your own belief when you are NOT affected. I had a sibling who left her husband because of “sexual improprieties” with her kids…he wasn’t “caught in the act” but it was there…now that piece of trash luckily checked out of their lives..however, he “is” their father…and by that, he can come back anytime to argue for equal visitation with his kids..

I believe these people are doing in a round about way is showing the exception is more complex than just saying I against abortion except in case of rape and incest. This forces people to either be for abortion or against in all cases.

Not to attempt to hi-jack the thread, but, I posted on Friday that I planned to attend the gun show at the local Hassan temple this weekend. Some of you expressed interest in hearing of the experience…

So, my 17 yo and I went on Saturday and paid our $8 a head to get in the door. Regarding the “gun show loophole.” After seeing some of the posts on this issue last week, it sounded like to me that anyone could go to a gun show and purchase firearms from anyone without a background check. I talked to 3 different vendors there and asked specific questions about the loophole. Here’s the deal. No gun dealer with a federal firearms license will sell you a firearm of any make or model without a background check. If they did, they would put their license at risk and therefore, their livelihood. Yes, private individuals can sell firearms at these shows, hence, the “loophole” I suppose. But, then again, citizens can sell firearms at yard sales or flea markets too.

Although I completely disagree with it, Gingrey’s position, along with that of the Ryan, Broun, Akins, Mourdock et alia, is the only moral position that a pro-life person can legitimately take.

As far as they are concerned, a zygote is a reflection of God’s Will, and is equal to a “person” at any other stage of life. I completely disagree with this, but it is a defensible position to take.

What is not defensible is the rape and incest exception. Positing that a zygote is not a zygote when the female might be able to prove that she was an unwilling participant in the sex act itself reveals that it is the woman’s (or little girl’s) action that is being judged, not the value of the zygote.Allowing abortion in the case of rape or incest is an outright admission that access to abortion is simply a way to control women and punish those who transgress the patriarchial traditions of chastity. The fact that the lead sponsors on the ‘personhood’ bill are male only reinforces the lynchpin of those traditions, which is that men own female sexuality.

If the pro-lifers were forced to choose between the two logical positions – either never any safe, legal abortions (because regardless of the law, there will continue to be abortions – the law will just push poor women into unsafe means) or leaving the decision in the hands of the woman and her doctor – the movement would be as fractured as the GOP in general. Most Americans, including pro-lifers, reject protection of pregnancies that endanger the woman just as most reject forcing women to carry fetuses against their will.

The country is not going back to that, and the sooner extremist language like Gingrey’s/Akins’/Mourdock’s and extremist legislation like Broun’s/Ryan’s/Gingrey’s is pushed onto the rest of us, the sooner the will of the people can be unequivocally expressed.

I am ashamed to say I went to Gingrey’s office when I was pregnant with twins. Had to see all the doctors in the group so I saw him a couple of times. I’m glad however, to say he was not in the room during the birth of my twins. For that, I am eternally grateful. It is scary these people keep getting elected. And now I see the state senate has passed a $100.00 cap on gifts, with the mandate that no citizen can complain about ethics. I have to feel that is compeltely against the constitutional rights of our citizens. So the tyrannical government they are so afraid of is their own party? Such irony!

I have never seen a functioning firearm at a flea market. That’s not to say they have never been available, but that I have never seen one. Most items at flea markets and yard sales are junk that no one wants.

If a criminal wants a functioning firearm with no background checks, a gun show is the way to go. Plenty of inventory to choose from.

I am ashamed to say I went to Gingrey’s office when I was pregnant with twins. Had to see all the doctors in the group so I saw him a couple of times. I’m glad however, to say he was not in the room during the birth of my twins. For that, I am eternally grateful.

If a criminal wants a functioning firearm with no background checks, a gun show is the way to go. Plenty of inventory to choose from.

Kammy, I’ve found the opinions of most regulars on here can’t be moved with a hand grenade. Are there corrupt federally licensed gun dealers? My guess would be YES! Are there corrupt ____ ? (fill in the blank) The answer is still, yes. “Close the gun show loop hole…it will keep guns out of the hands of criminals and the insane!!” It’s an ill-advised lib talking point. It makes you feel good because you are doing something, anything to address the issue. How, exactly, do you propose that we control person-to-person, private sales of firearms? That is what it will take to close the loophole. Telling citizens that they cannot sell something that belongs to them.

Or as VP Biden would say, “there is no silver bullet to solve gun violence….” (Did he really just say that?) No, I’m not in favor of doing nothing. Yes, gun violence needs to be addressed.

I’m out in the country. My neighbor used to have a jackass named jack. I renamed him of course after one of the bloggers here. When I revealed the handle that I named the jackass after Jay gave me a brief vacation. The 2 goats were named after my 2 other fan club members. But they weren’t fainting goats. They were just plain ole stupid goats. So being stubborn and stupid they were still befitting the bloggers they were named after.

Or they can go to the local gun store or Walmart and do the same. In fact, those businesses are open 7 days a week. The gun show comes to town twice a year and you have to pay to get in!

It is unlawful for a convicted felon to have a gun just like it is unlawful for a convicted felon to vote (they have given up their Constitutionally protected rights when they were convicted, although they can be restored). If you want to make it a law (which may already be one) that makes it illegal to sell a gin to a convicted felon then I could go along with it.

Owning a car is not a Constitutionally protected right while owning a gun is (comparing apples to oranges). On top of that fact, I would be willing to bet you that there are more laws on the books about gun ownership then there are about car ownership.

Hmmm a man marries in good faith and is divorced by his unfaithful wife against his will – raped of his children, home and financial resources – and to add insult to injury he is required to pay child support for his children even though his ex wife won’t allow him visitation and seeks to turn them against their father. Man is told to shut up, man up and pay up or go to jail.

Turn about is fair play and as far as I’m concerned until our society decides to have compassion for men in the above situation women can shut up, man up and carry the child to term.
