With enforcement tightened, time for immigration reform

You’ve heard and read the response so many times by now that you can probably recite it yourself. It goes something like this:

“Republicans will consider basic immigration reform only after this administration commits to an ‘enforcement-first’ approach to close the border and enforce our laws.”

But what would this “enforcement-first” approach look like? How would we know that it was being implemented?

Would it look something like this, as described by Roll Call?

“The United States spent nearly $18 billion on immigration enforcement in fiscal 2012, about 24 percent more than it spent collectively on the FBI, the Drug Enforcement Administration, the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Secret Service and all other criminal law enforcement agencies, according to the 182-page report by the Migration Policy Institute, a nonpartisan think tank.

“From the standpoint of resource allocations, case volumes and enforcement actions … immigration enforcement can be seen to rank as the federal government’s highest criminal law enforcement priority,” the study says.

In 1986, by contrast, when Congress passed the last sweeping overhaul of immigration laws, immigration enforcement amounted to less than 20 percent of the budget for criminal law enforcement agencies, said Doris Meissner, a co-author of the report and a former immigration commissioner under President Bill Clinton.

Again, we spend considerably more on enforcement of immigration laws than we spend on the FBI, ATF, Secret Service and DEA combined.

Other numbers in the report (available here) and elsewhere confirm what the raw spending data suggest:

– Five years ago, 291,000 illegal immigrants were deported, and 35 percent of them had criminal records. In 2012, the number of deportations rose to a record 410,000, more than half of whom had criminal records. In other words, enforcement dollars are being used more aggressively and with a tighter focus on those actually causing problems.

– According to the report, “Border Patrol staffing, technology, and infrastructure have reached historic highs, while levels of apprehensions have fallen to historic lows.” The low level of apprehensions is a sign of progress, indicating that fewer and fewer people are even trying to immigrate illegally. In fact, today “there is no net new illegal immigration from Mexico for the first time in 40 years.”

– The rapid decline in illegal border crossings means that “an increasing share of the unauthorized population is likely to be comprised of those who have been admitted properly through ports of entry and overstay their visas. As a result, the relative share of the unauthorized population from countries other than Mexico and Central America will likely increase.”

According to the report, the additional resources, commitment and focus have produced “an historic transformation of immigration enforcement and the emergence of a complex, modernized, cross-governmental immigration enforcement system that projects beyond the nation’s borders and and at the same time reaches into local jails and courtrooms across the United States to generate an unparalleled degree of enforcement activity. The stem’s six pillars have been resourced at unprecedented levels and a panoply of enforcement mandates and programs have been implemented that demonstrate the federal government’s ability and will to enforce the nation’s immigration laws.”

Personally, I think a successful “enforcement-first” policy would look very much like the program outlined above. With that condition having been met — although more progress can and should continue to be made — it’s now time to move forward on other elements of basic immigration reform.

In contrast, since January 2009, ICE has audited more than 8,079 employers and debarred 726 companies and individuals. ICE has announced sanctions against several high-profile targets, including a $1 million settlement with Abercrombie & Fitch and the termination of hundreds of workers from Chipotle restaurants….

According to (Congressional Research Service), the number of final orders assessing civil monetary penalties through worksite enforcement operations increased significantly from 18 in FY 2008 to 237 in FY 2010, as did the total amounts of administrative fines collected and criminal fines imposed. Thus, the policy shift has shown concrete results in targeting employers rather than unauthorized workers, for their hiring practices, which was the goal of the sanctions provisions of IRCA.”

This.

Any sort of stiffer enforcement mechanism has to include heavy penalties for those knowingly — or who should have known that they were — hiring/employing illegals.

Jail time and financial penalties that are a percentage of the previous year’s gross — not flat monetary fines. The only way companies will care about financial penalties is if they’re large enough to make a dent in the bottom line and thereby draw the interest and ire of investors.

e.g. if Hormel gets caught using illegals to can and package Spam, then slam Hormel for 5% of their previous year’s gross and put a director or two in jail. Investors will notice the hell out of THAT.

Well, I sure hope this immigration reform don’t cause more Mexicans to move here to take the job of God-fearing rednecks. More of us would be employed if all those cheap laborers wasn’t around for employers to scarf up. Anyhow, a good redneck can doing anything a Mexican can do, so there’s no reason not to hire us.

I would write more but it’s time for my 5th break of the morning and I don’t want to miss out. Also, I got to get enough beer stocked so I can call in sick tomorrow and take little Nathan Zell George up to the mountains.

From what I understand, that’s pretty much how Canada handles immigration. If you’re educated, healthy, skilled and don’t have a criminal history, it’s not hard to get in and get residency and/or citizenship.

Yes, it’s time to move on with basic elements of immigration reform. But I am afraid Republicans will follow the same model they did with debt reduction:

1. Complain about the debt.
2. Accuse the other side of ignoring it.
3. Say only Republicans can fix it.
4. When pressed on details, say “the ball’s in the White House’s court. It’s up to them to say what they’d do.”

We have the H-Class visas for everything from agriculture workers to healthcare workers. There’s E-Class visas for business starters/investors. You have L-Class visas for people who transfer from overseas offices to US offices within the same country. There are visa classes for victims of traffficking. Iraqi and Afghani translators who helped during those two conflicts have a special visa class. If the proper paperwork is done, a person can enter the US as a tourist and become a resident. What you’re suggesting is already available. People simply don’t read or research to see for themselves.

There’s two other visa classes that goes towards what weetamoe suggested. P-Class visas are for people in all types of sports, performing arts, and other endeavors. When you’re in the top 10% of your field, then you can qualify for an O-Class visa. At one time, Disney workers had their own visa class because of the people working at Epcot.

None of this “reform” addresses the question as to how did all the horses get out of the barn in the first place.

If our Government was seriously commited to the people and not to their Parties and corporate sponsors, we’ed have a blue ribbom committee determine how we got so many millions of illegals here in the first place.

Then, this committee would see what US laws were violated, name the guilty and appoint special prosecutors to bring them to trial.

In the meanwhile, all possible efforts would be made to seal our borders, including bringing our troops home from Afghanistan, at once, and deploying the necessary number of them at the borders to stop any further illegals from entering.

Naturally, the chances of any of this actually happening are about the same as winning the powerball lottery.

I guess it might go beyond your scope a bit here, but why no mention here of the very problematic blurring post-9/11 categorizations such as asylum seekers, illegal aliens, criminal aliens, etc.? And how about the shifting rationales related to immigration enforcement as part of a larger strategy of counterterrorism?

You seem to view the immigration issue as an entirely discrete problem, entirely detached from any wider context of security and law enforcement and other governmental efforts like the so-called “war on terror”.

We all Obama is doing in his “enforcement” efforts is the same thing Castro did in Cuba with his boat lifts. He is getting rid of the hard core criminals to save money for jailing them and because he knows they will never become democratic voters.

Our borders will never be “sealed”. With our skimpy manufacturing base and the “just-in-time” shipping mode replacing warehousing goods, an open border is essential to the survival of our businesses and commerce altogether. Americans get offended having to show a passport now at the border, and their inspections generally take about 2 minutes. Can you imagine us making a citizen prove themselves each and every time they cross the border? Some people cross the border daily to go to work.

You should also research the “illegals” to see exactly how they enter the US. If you think 11 million people walked across the border from Mexico, you’re extremely way of the mark.

I realize that there is an alphabet list of visas. My point is that the US should prioritize and fast-track visas for those whose intellect and expertise will benefit us. I also think we need a solid, humane, guest-worker program for farming needs, but I know less about the bureaucracy and politics in that area.

I’m finding that Clinton did virtually nothing in order to keep voting base, Bush deported 2 million in 8 years and BO is at 1.4 million at 4 years…all things being equal…the trend is favorable since Clinton…BO will become the champion of deportation in short order…

Lets take money and resources from defense budget and step up our program at the border. Seems to me we have much more risk from border crossings than we do from…say Afghanistan, Iraq, Iran, etcetera..

Guest workers come in under H2A visas for agriculture and such. That particular visa has a cap, but if they’ve been here once under that visa, then they qualify for an H2R visa which does not have a cap. The students, who choose to work here, usually get employment-based visas and stay without much of a hassle.

The process works, and it’s fairly efficient. As soon as somebody files that petition, they begin the process to change status. While they’re going through the process, they have temp status that has no effect on their legal standing.

As for fast tracking visas, I’ve seen someone get turned at the border and return 2 days later with a new visa. Depending on the situation, we fast track everything, deportations included.

There ain’t much going on anywhere along the Southern Border that we don’t know about or respond to. You do realize that we have approximately 8000 miles of land border between Mexico and Canada, right?

BP Agents patrol those areas away from the official ports of entry, and they do a damned good job of it. There are about 20,000 BP Agents in total. So, there are approximately 2.5 Border Agents per mile of US land border. If you ran them in 12 hour shifts, that would give you one agent per mile coverage, not giving them a single day off. If you want the border locked down, then pay the necessary taxes to hire more agents. Even then, there is no way to “lock down” open space. That idea is pure fiction.

The right are big shots with our money. The other big dollar item in the Justice Department is drug enforcement. And even then it doesn’t cover the cost of building prisons and housing a small nation of over sentenced felons which the majority of this country is moving against doing in the first place. Well over 50% of the federal prison population is drug related. The violence in Mexico which cost this country billions each year is directly related to the war on drugs. We love playing Rambo, something to do with the right’s gun fetish.

What happens in these hard winded programs is reality catches up with the snake oil; the medicine gets too expensive and doesn’t cure the problem. When it comes to immigration, there is no difference. That officer checking that cargo container in Savannah is a Customs and Border Protection Officer. That same officer can and does process stowaways on those ships to be removed from the country. That same officer has to be able to process people entering the country on cruise ships, private vessels, and private aircraft. The days of the customs agent are long gone, and it’s been that way since 2003.

The only people who’s primary focus is on immigration is Border Patrol Agents, and they are still part of CBP. CBP Officers on the border have to be able to do cargo and people just as the person in Savannah or the officer in Atlanta.

While the Dems are now in control of federal efforts, Republicans are in control of state policies designed to stop illegal immigration. One of the things they’ve tried to do is make it harder for illegal immigrants to get business licenses. In Georgia and Alabama, you now have to sign a statement that you’re a legal citizen when you apply for a business license, and in Georgia you have to send a copy of your driver’s license. It’s my job to keep my employer in valid business licenses. As a low-ranking employee, I’m not allowed to sign official documents, so I have to get my manager to sign the statements and produce his driver’s license. On the one hand, I’m astonished at what an ineffective requirement this is: it simply means that one worker of the 20K employed by our organization is a legal citizen. On the other hand, I’m irritated by the hassle of it. I have to provide hundreds of these forms per year, and as I have told a number of city employees, I work for a corporation that sells stock on the NYSE and therefore can legally be owned by aliens, legal and otherwise.

My opinion on this is that e-verify needs to be enhanced to:
1. all business’s need to comply
2. e-verify needs to be a quick phone call or online app to insure that they ID matchs SS ID (along with this verification is that the SS# is not in use elsewhere).
3. ANY employer who doesn’t comply is SHUT DOWN.
4. Lower the number of provable dependants for taxable income to 2.
5. do away with 1099’s.
6. do away with ALL H visas until the employing company and target employer can PROVE that they have complied with the existing US laws they state the rates offered are competitive and no US citizen can be found to take the job.

If the US is serious about immigration reform these are the first steps needed.

E-verify needs to check current SS roles (for the age of the cardholder).

If the person presenting the card is remotely the age on the verification (or the number is being shown as used elsewhere) the police can become involved as the user could be commiting fraud.

That is the first step.

A budget would have to be approved to enhance and update the system if people are serious about immigration.

In the construction industry (hiring undocumented aliens) you can issue a 1099 with an incorrect SS# and say you had no clue as to the identity or address of the worker.

His SS# checked out, he had matching ID etc.

The business is off the hook according to existing rules.

And no they did work for FORMERLY good companies that decided they wanted to cash in on the building boom.

Saying we shouldn’t use the military for border control is completely separate from other issues. I don’t think the military is incompetent, I served in the military myself. (Although there were individuals who couldn’t find their butts with both hand and a flashlight.)

Military training does not equate to border patrol training, just because both groups usually carry weapons does not mean you can exchange the two. And while your confidence in the Armed Forces is flattering, it’s still a misuse of those people who sign up. If they wanted to be guarding the border they would get a job with the appropriate agency.

They don’t enlist so they can be separated from their family and shipped to the Mexican or Canadian border because we don’t feel like hiring border patrol agents.

Our military isn’t trained for this job any more than the Border Patrol is trained to go fight in Afghanistan. I notice no one suggests that scenario, why they think a 19 year old tank crewmember should be checking passports is not clear. Being a veteran myself, I don’t think most servicemen/servicewomen *want* to go to war at all.

F*Y*I, U2s, spysats and “spookies” are overkill for a surveillance job that could easily be handled with aerostats and loitering drones/light aircraft. And with military-grade ground-surveillance radar, which I’m sure is already used on the border.

Canadians are tricky to deal with and catch. They’re mostly exempt from the US-VISIT program, so they avoid the primary “overstay” indicator when they come to the country. They’re treated almost like US citizens, so they can sometimes fall through the cracks that others get caught in. I’ve caught a few, but it took a great deal of research to get the information necessary to catch them in their deceit.

I know. I was just exaggerating (in a satirical way) in the way she often does. I don’t know how many people enlist with the thought of being “lifers”, but I would guess it is not the majority. In that respect, I don’t have a problem with, say, the National Guard, being trained to watch the border – as it sure beats digging holes and then filling them in.

If they’re trained to watch the border, why not call them “Border Patrol?” Are they going to do this one weekend a month? What about the other 28 days of the month? Or do you think we should call them up indefinitely away from their families, jobs, and businesses?

As a bonus we could avoid using the military to enforce civilian law. As someone else pointed out, that’s not a good thing. It’s also illegal, and WHUT PART OF EYE-LEGAL DON’T U UNNERSTAND?

There is a real danger if you don’t train to do your actual military job. That takes time and money, and we need to decide if they will be trained for military jobs or border patrol jobs. Again, despite all the admiration for the military, they aren’t like swiss army knives that can pull out the border patrol attachment on demand.

Let’s leave such demands to the ignorant who don’t understand the military. They’re just silly noisemakers.

I’m rather troubled that he didn’t even retain copies of his supporting evidence (I’ve got copies of papers and notes from the time I earned my first degree back in the early 80s), especially for something as contentious a topic as this. That’d be my guess, too. Out of all the people I served with, I’d be surprised if more than ten percent *intended* to do 20+ years, and that includes officers and enlisted. Among junior enlisted, I’d be surprised if more than two percent signed up with that intention.

I used my military service as a springboard to further higher education; I saved quite a bit of money while in uniform and combined that with jobs and GI Bill benefits for grad school. The GI Bill bennies lasted for another two degrees before petering out.

Guardsmen and Reservists have the same sorts of MOSs as active-duty servicemembers, though they get called on a lot for disaster relief-type missions. When I left active duty, I transferred to a Reserve unit in Georgia, and they actually called me up at home before my reporting date, trying to talk me into volunteering to go to Miami to assist with Hurrican Andrew relief efforts. I got the distinct impression that they were trying to fob off a really undesirable duty assignment on the new guy, so since it was a volunteer thing, I declined. I ended up spending only a year in that unit; they turned out to be pretty worthless, so I transferred to the Inactive Reserve for the remainder of my service obligation.

Still, there’s not a lot of border specialization or the like in any of the military components. If you have a disaster recovery situation, you send the people/units that can directly relieve the problems. If communications are an issue, send signal units. If clean water is a problem, there are specialized quartermaster detachments that can produce clean water. If food is scarce, transport and supply units can cover that, There are engineer units that can provide power and power distribution, MPs that can augment local law enforcement, medics who can provide basic first aid and emergency care, and plenty of other military occupations as well.

That said, I’m not sure who you’d put on the Mexican border, if it came to that. I’m guessing a combination of infantry, military intel and aviation assets.

I once had a very bright young Vietnamese student who said *for some of us, the US is not the promised land,* which I understood completely. He did go home, eventually. My daughter-in-law spent part of her sabbatical in Southeast Asia. My son joined her for a few months. They were the guests for a week in the large Hanoi home of a well-to-do physician and family. My son remarked that in some ways capitalism is thriving there. One of my daughters works in a bio-lab in Houston with a number of Indian and Chinese who have HB-1 visas. My point again being that Immigration is not Mexico.

For example, Customs budget includes not only checking entries and exits at our ports, but also inspecting and testing goods coming into this country, figures that are NOT backed out from that $18 billion.

By the way, if supposedly spending $18 Billion on enforcement is a large figure, then ask yourself why, if we have so few illegal aliens in this country, we paid out $4.2 BILLION in just one year TO ILLEGAL ALIENS who filed for the additional child tax credit using ITINs.

THE AMERICAN PUBLIC DON’T SPEAK UP NOW, THE MAJORITY OF US TAXPAYERS WILL BE FOREVER SORRY?

It don’t matter which group of politicians you vote for, as the cost for another Path to Citizenship is prohibitive for all Americans. Speaking for myself, as an Independent and probably a good half of America just surfing the web and not hand tied by the Liberal press and their leftists editorial staff, I believe that in heavily Liberal strongholds that unknown numbers of non-citizens voted in the presidential election. With Obama pushing even more taxes, he wants another Amnesty and hundreds of billions of people throughout the world is avidly listening? The encouraging word is going out and all these uncountable numbers of foreign nationals are going to sweep down on the poorly guarded borders of Mexico and Canada. Then with this well publicized scenario that entries as a tourist is not tracked, a good course of action will bring unfettered numbers of visitors to our door, that are of no mind to return home.

All we going to gain from Obama’s immigration venture is more poverty, more illiterate and uneducated who we the taxpayer will eventually have to cover their bills. Another multi-trillion dollar amnesty is a catastrophe waiting to happen, so says the Heritage Foundation. Have you noticed that you already paying for every smuggled child of illegal aliens, who have reached sovereign America? The “Anchor Baby” is the real thing, as once settled here under a fabricated misuse law, they get automatic citizenship and YOU PAY, and YOU KEEP PAYING from delivery to grave. UNLESS WE ADD AN AMENDMENT TO THE 14th AMENDMENT, CHANGE WILL NEVER COME AND FOREVER WE WILL BE PAYING FOR ILLEGAL ALIENS CHILDREN WHO CLAIM CITIZENSHIP, WHICH WAS STRINGENTLY APPLIED TO ONLY SLAVES? Their parents have that foothold and are able to collect every citizen benefit, without even spending one penny. No wonder Medicade is out the window in entitlements that should be going to citizens, real citizens.

Obama is showing his true Socialist true self, especially when he declares we must pay our bills? Can anybody tell me that his spending isn’t extravagant, when every prior and post administration we are paying for every foreign child; overloading our schools with non English speaking illegal children and the consequences to Americans who taxes are riding sky high. The newspapers and Lib-Democrats always broadcast about entitlements for low income families, when millions of these families are here illegally? One member slips across the borders, fly here and the rest relatives follow, and collect ample amounts of cash payments and citizen benefits for every infant.

Two laws could send illegal aliens packing and you can read about the Legal Workforce Bill, which detects illegal aliens stealing jobs from Americans Mandatory E-Verify is the way to go and it enforces strict regulations on unconcerned business owners. Amnesty is a senseless, diabolical plan for illegal aliens, when an estimated 24 million Americans are jobless? The Birthright Citizenship Bill will stop children of millions of illegal aliens from legal theft of citizenship, thus discouraging the never ending stream of illegal aliens arriving here. These people disrespect our laws and come here to pilfer citizen’s rights. It can be guaranteed that if you read about passing these two laws, our government could save hundreds of billions of dollars each year, which would certainly help to relieve the pressure on the amount of money being spent on entitlements on foreign nationals. Don’t listen to the ravings of the open border zealots, who have infiltrated the Obama Administration. In addition ignore what you read in the national press, as they are tainted with the Liberal Progressives, who think America should have an open door policy with no borders. Investigate your States costs and the federal government and then contact your Congressman and those in Congress and stop this invasion for good?

I really could care less who comes here legally, as they have not broken the law and waited patiently for a visa. I just don’t want to financially support them with my taxes, specifically illegal aliens and their extended families. Foreign nationals are so pampered by Congress, not judging illegal entry as bad behavior and even disrespect for our policies once here, deserve punishment for this lawless Turpitude as a class 1 felony. We have our own mess of “freeloaders” who prefer to leech of the rest of us taxpayers, but the U.S government seems to think we should offer even more taxes to support the corrupt United Nations and all the parasites that arrive here with their smuggled children.
