The U.S. Supreme Court announced Friday that it hear arguments in two important but very different cases involving gay marriage, raising the odds that it will soon establish the basic legal architecture for how that issue is handled in the future.
One case, out of New York, addresses how the federal government must handle gay marriages that are conducted in states where such marriages are legal. The second, out of California, raises the more fundamental question of whether gay marriage is a right protected under the Constitution’s promise of equal protection.
Given the range of legal questions at stake in those two cases, the court’s final ruling next June could take any number of turns. And you just know that Justice Antonin Scalia is itching to get his hands on this issue.
However, it is also important to point out that however the nine justices decide, all final decisions on the matter will be made by the American people. And they have already made it clear that we will not be going backward on this issue, and that whatever the Supreme Court’s ruling this year, in time the right to marry will be extended to all Americans, gay or straight.

Young people support that right overwhelming. Despite the stern opposition of their church, almost 60 percent of Catholics support it. According to a Pew poll in July, political independents support it by an 11-point margin. Black Americans, long dubious of the notion, also support it in increasing numbers.
As recently as 1996, 65 percent of Americans rejected the notion of gay marriage; only 27 percent supported it. Yet in the July Pew poll, 48 percent of Americans supported it and just 44 percent opposed it. That is an extraordinary shift in public opinion in just 16 years, on an issue that that you might think people might be stubborn about.
So do your worst, Justice Scalia. At worst, you and others can temporarily affect the pace of the change that is taking place across this country. But you cannot affect the final outcome.

No, it isn’t. It’s a legal contract. That the church has muscled it’s way into that and made it ALSO a religious sacrament does not change the fact that it is primarily a legal contract.
But you are correct that there is no intention to force churches to marry those outside their faith.
Personally, though, I have a different take on that aspect of the discussion. I think that “separation” of church and state should mean that religious leaders OUGHT NOT be deputized to perform a legal function. If a couple chooses to be married in their church, that is their right, but when it comes down to the legal statement pronouncing the “man and wife” THAT should be performed by a legal functionary, not the presiding religious authority.

Certainly it is. But you can go through the whole ceremony. The presiding religious authority can even pronounce you “man and wife”…but if he (or she) doesn’t sign the marriage license you are NOT legally married. Marriage is, and always has been, primarily a legal contract between consenting parties. But if they fail to fulfill the laws pertaining to that contract they are not legally married…no matter WHAT their particular church says or does.

wayne: a lot of it is about spousal rights. If you have a “partner”, yes you can leave anything you want in a will. It’s then subject to estate taxes. A same-sex partner also can’t legally qualify for survivor benefits if your pension or insurance plans offer such. There are limits to what one can leave for a partner’s care, and surely any couple who stay together as partners in life should have those rights.

Christian Conservative: OKAY, just so you know, I’m gay and raising two healthy, happy boys I took custody of from a heterosexual, drug addicted couple. They were neglected and probably abused, and you wouldn’t know it to look at them now. They’re smart, they’re successful in school, and have a much more mature and healthy outlook on life and their responsibilities as citizens and members of God’s community than a lot of kids from homes with “traditional family values.” They don’t think my lifestyle is “pervers”, nor do they hide behind some religious notion that they have the right to judge anyone who doesn’t think, live, or believe like they do. Ironically, their treatment of others is so Christ-like, you’d think surely they had to have had the finest of your examples of family raising them. BOTH: I dont’ think my sixteen year old appreciates me much here lately. He’s got a truck, so I told him he had to get out and start putting in job applications today. He’s having a lesson in being a grownup, and he’s finding out the responsibility side of it sucks!!
Conservative (I just can’t seem to call you Christian for some reason): noone’s forcing anything down your throat. You don’t have to have gay weddings in your church or condone those unions in any way. This is only about the legal recognition of that commitment. It doesn’t involve your church in any way. In fact, if you think about it, if more gays got married, then there’d be less of them prowling around spreading their hateful ideology to unsuspecting Christians, who we all know could just neeeeever decide to accept that reality about themselves on their own, right?

Please work to keep it in the context of gay marriage not the slippery slopes and deflections such as poligamy, slavery or whatever other excuses and deflections you and others have been presenting

The Episcopal church has redefined marriage. US states and other countries too. In fact the more Catholic a country is the better chance they allow gay marriage.

Why would you bring Christ into the conversation? I honestly could care less who wants to be homosexual. I have a problem with the gubmint trying to force us to accept that it is somehow normal when its certainly not. By the way Jesus said man and woman shall be joined to form one. That sums up the definition of marriage for me…

He changed the laws, not the Constitution. That did not happen until a Constitutional amendment was passed. No President (or Congress) alone can change the Consitution.
