Supremes’ ruling on gay marriage important, not critical

The U.S. Supreme Court announced Friday that it hear arguments in two important but very different cases involving gay marriage, raising the odds that it will soon establish the basic legal architecture for how that issue is handled in the future.

One case, out of New York, addresses how the federal government must handle gay marriages that are conducted in states where such marriages are legal. The second, out of California, raises the more fundamental question of whether gay marriage is a right protected under the Constitution’s promise of equal protection.

Given the range of legal questions at stake in those two cases, the court’s final ruling next June could take any number of turns. And you just know that Justice Antonin Scalia is itching to get his hands on this issue.

However, it is also important to point out that however the nine justices decide, all final decisions on the matter will be made by the American people. And they have already made it clear that we will not be going backward on this issue, and that whatever the Supreme Court’s ruling this year, in time the right to marry will be extended to all Americans, gay or straight.

Young people support that right overwhelming. Despite the stern opposition of their church, almost 60 percent of Catholics support it. According to a Pew poll in July, political independents support it by an 11-point margin. Black Americans, long dubious of the notion, also support it in increasing numbers.

As recently as 1996, 65 percent of Americans rejected the notion of gay marriage; only 27 percent supported it. Yet in the July Pew poll, 48 percent of Americans supported it and just 44 percent opposed it. That is an extraordinary shift in public opinion in just 16 years, on an issue that that you might think people might be stubborn about.

So do your worst, Justice Scalia. At worst, you and others can temporarily affect the pace of the change that is taking place across this country. But you cannot affect the final outcome.

It’s not so much that young people “support gay rights” as much as they are just don’t see how other people live or who they marry as any of their business. If the Supreme Court rules there is a Constitutional right to gay marriage then there is no legal basis for not extending that same right to those who which to have multiple marriage partners.

We won’t know until the Supreme Court rules one day but in my opinion if they rule that gays have the right to legally marry under the Constitution then there is no legal basis for saying polygamists can’t have multiple partners (gay or straight polygamists included) wth all of the legal, tax and health benefits involved.

I was in DC this past week and walked by a bookstore that had at featured book on sale..SATAN YOU CAN’T HAVE MY CHILDREN…now, I’m not spun from any religious clothe so you can imagine how amusing this was to me. I flipped thru the chapters and it did address SATAN as somewhat of a steering committee to homosexuality and the like..

Met a woman last month who is the daughter of a Greek Orthodox priest. I thought that was a scandal, but she said it is accepted in the Greek Orthodox church. Since the new testament was written in Greek, I suppose we have to defer to them over the Romans. Or, the various protestant offshoots of the Romans.
I suppose the supremes could decide that if the government is not enforcing DOMA, and the states are not enforcing the prohibition against gay marriage, there is no conflict that has to be decided. Usually, someone has to prove that they have been damaged to get some kind of action by a court. In this case I don’t know what the damage is.

I just have one comment before I have to go run errands, and it’s a long one so I apologize in advance. Gay marriage is as conservative of a value you can get.

I support gay marriage because I’m a Conservative.”

Yes, the legalization of gay marriage is inevitable in this country, in large part due to straight advocates. But for those straight people who do not see this fight for civil rights as pertinent to their lives, ask yourself what you would tell your child who grew up to be gay and was denied the right to marry the person they loved due to your apathy.

This is best encapsulated in a quote by Dr. Martin Luther King Jr., whose wife Coretta Scott King was an advocate for gay marriage, who was addressing the business community on January 27, 1965, at the Dinkler Plaza Hotel in downtown Atlanta. The business community had originally plan to snub Dr. King’s speech until Robert W. Woodruff allowed his name to be used on the invitation as a sponsor. Suddenly the event was standing room only. During the speech Dr. King said, “History will have to record that the greatest tragedy of this period of social transition was not the vitriolic words and the violent actions of the bad people, but the appalling silence and indifference of the good people. Our generation will have to repent not only for the words and acts of the children of darkness, but also for the fears and apathy of the children of light.”

So it remains true today for another group of American citizens and their struggle for civil rights.

Indigo, How about this view? Think of America as a large house being held in place by a strong foundation. Then imagine, years ago that engineers discovered that the foundation, which had been done well but was lacking by current engineering standards. The foundation needed to be re-worked. Then let’s imagine that as other materials wore out and that technology brought roofing products that were sturdier and less toxic to the inhabitants. Then windows were invented that were not only safer but provided weather protection that kept the inhabitants more comfortable year around.

opposite sex who is a husband or a wife.” Ibid. The question presented is:
Whether Section 3 of DOMA violates the Fifth Amendment’s guarantee of

Moralilty?

I am a Christian but don’t believe in the literal Adam and Eve story. The Biblical story of creation mimics and is younger than similar creation stories that were among other nomadic tribes at the time. It is a nice, simple story that places God’s relationship with mankind in a way people of the day could comprehend.

We now know that the universe, at least as we can perceive it today, originated with the Big Bang. I have no problem reconciling the big bang, the earth’s geologic development and evolution with my belief in God. God set all of this in motion. So he didn’t create Adam and Eve and set them in the garden.

Further there is NOTHING in the Bible that speaks of persons of same-gegnder attraction. Man-on-man sex was a method of humiliation and domination among many peoples at the time. It was, as with rape, a matter of power and control, but not sexual attraction. The concept of same-gender attraction is relatively new and only now being understood.

And if you are so convinced the Bible proscribes same-gender sexual activity, I guess lesbians get a pass because there is no mention of woman-on-woman sex in the Bible.

The fundamentalists will frame their arguments in such a way that they will always find biblical support for their belief that not *every* citizen deserves equal rights under the law but there are two separate issues here. First, marriage is a religious sacrament. If your church doesn’t want to sanctify marriage between people of the same sex, no one is going to force them to do so. Second, certain legal rights are conferred on those who are married.

Those legal benefits conferred on heterosexual marrieds can’t reasonably be denied to others based on religious beliefs, at least not in the US which was created on the stated premise that all are created equal by God.

The scripture fundamentalists need to revisit is the one about beams and motes I think.
