Did you know that the NFL is a tax-exempt nonprofit?

Once in a while, I run across something that I did not know and it leaves me flabbergasted.

For example, I did not know that the National Football League, the colossus of professional sports, is classified as a non-profit — a tax-free non-profit, to be more specific. That’s right: The NFL has its own exemption, written into federal law, that makes it exempt from federal corporate taxes.

IT'S GOOD! ... to be a tax-exempt nonprofit

IT'S GOOD! ... to be a tax-exempt nonprofit

The Professional Golf Association and the National Hockey League, among others, enjoy a similar exemption although in their cases, it is not an exemption specifically written into the law.

As described in Waste Book 2012 — compiled by the staff of U.S. Sen. Tom Coburn, a conservative Republican from Oklahoma:

In 2010, the registered NFL nonprofit alone received $184 million from its 32 member teams. It holds over $1 billion in assets. Together with its subsidiaries and teams – many of which are for-profit, taxed entities – the NFL generates an estimated $9 billion annually. Each of its teams are among the top 50 most expensive sports teams in the world, ranking alongside the world’s famous soccer teams. Almost half of professional football teams are valued at over $1 billion….

League commissioners and officials benefit from the nonprofit status of their organizations. Roger Goodell, commissioner of the NFL, reported $11.6 million in salary and perks in 2010 alone. Goodell’s salary will reportedly reach $20 million in 2019. Steve Bornstein, the executive vice president of media, made $12.2 million in 2010. Former NFL commissioner Paul Tagliabue earned $8.5 million from the league in 2010. The league paid five other officials a total of $19.2 million in just one year. In comparison, the next highest salary of a traditional nonprofit CEO is $3.4 million.

The NFL’s exemption stems from a 1966 law, passed at the time of the merger with the old American Football League, specifically allowing “professional football leagues” to enjoy 501(c)(6) status as tax-exempt trade organizations. Other leagues have piggy-backed on that legislation to claim that status themselves.

Major League Baseball also used to enjoy the same tax-exempt protection, but in 2007 it chose to surrender that status in part because as the salary information above illustrates, tax-exempt, non-profit status requires you to report the salaries of your top executives. MLB decided that protecting that information from the public was more important than escaping taxes.

As the Coburn report points out, “state and local governments usually exempt these organizations from state income and sales tax as well….” As the Indiana Business Journal reported, that proved to be a nice little perk when the Super Bowl was held in Indianapolis this year, because “hotels and restaurants … won’t be taxing National Football League employees. They’re exempt from paying, according to an Indiana Department of Revenue directive. The NFL is using its tax-exempt status as a 501(c)(6) to avoid paying the taxes, in addition to fuel, auto rental and admissions taxes.”

In Atlanta’s case, a hotel-motel tax was used to build the Georgia Dome and would also be used to help finance the proposed new open-air stadium demanded by the Falcons. If Georgia tax law is like that of many states, the NFL and its employees would be exempted from paying the tax that everyone else must pay to subsidize stadiums built for a highly profitable industry.

Can you say “Scchhhwwweeeeet”?

” The NFL has its own exemption, written into federal law, that makes it exempt from federal corporate taxes.”

Money doesn’t buy votes. Money’s just like someone talking and expressing an opinion, don’tcha’ know?

Okay, Republicans who want to cut waste and balance the budget. You all are going to get on board and write your Congressman and Senators and demand this classification be dropped, right?

Or are you going to argue that by dropping the classification, the NFL will have to pay taxes and you’re against any tax increases?

Which is it?

Its clear that the “job creators” should never be taxed….. only the laborers.

So when we hear about how these stadiums are “paid for” through hotel taxes….its taxes not paid by the sport itself. But hey, they built that….right?

Any idea if the teams deducted their shares of the $184 million from their taxable income? If not, they’ve already paid whatever tax would be owed on that income. I can see either a team or the league owing the tax, but not both.

On the other hand, if the teams did deduct the payments and the league was exempted from tax…well, I can’t improve on “Scchhhwwweeeeet”.

If a new Georgia Dome is built, it will not guarantee that the Falcons will win a Super bowl. Down in New Orleans they went through Katrina where there was a lot of damage to their dome; it was repaired and they continue to play there today. They were still able to capture a Super bowl Championship. I think that Arthur Blank can afford to build the Dome with some of those tax free dollars and the people of Atlanta can use their money to help the struggling schools!! This demonstrates how out-of-touch this state and the Republican Administration are with reality.

I reviewed audited financial statements of NFL…Fun facts…annual revenue is app $150M with 2010 net loss of ($37M)…The auditors advise that no uncertainty exists for non-profit status to be eliminated…Most significant item is G-3 loan program to help teams build new venues..They are currently tapped out with outstanding loans over $800M…

Typical stuff fof 501(c)3’s…however the organization, like many, many for-profits is set up to lose money…

Of course, the unions contribute the lions share of pressure to always increase ticket prices but you should assume that if 501(C)3 was lifted and taxes were incurred, they would simply pass the cost to teams who will pass the cost to fans….

Republican here…. The NFL should not be tax exempt, nor should taxpayers be paying a dime for stadiums. They used to make the argument that it brings more money in, but studies have shown that not to be the case. When taxpayers build stadiums for NFL teams, taxpayers lose money and NFL owners gain money.

And if Arthur Blank threatens to move the team, call his bluff. As big a football fan as I am, I’d rather have no team here than have a team that picks my pocket and then expects me to thank them for it.

AN OLDIE BUT GOODIE!

An economics professor at a local college made a statement that he had never failed a single student before, but had recently failed an entire class. That class had insisted that Obama’s socialism worked and that no one would be poor and no one would be rich, a great equalizer.

The professor then said, “OK, we will have an experiment in this class on Obama’s plan.” All grades will be averaged and everyone will receive the same grade so no one will fail and no one will receive an A…. (substituting grades for dollars – something closer to home and more readily understood by all).

After the first test, the grades were averaged and everyone got a B. The students who studied hard were upset and the students who studied little were happy. As the second test rolled around, the students who studied little had studied even less and the ones who studied hard decided they wanted a free ride too so they studied little..

The second test average was a D! No one was happy. When the 3rd test rolled around, the average was an F. As the tests proceeded, the scores never increased as bickering, blame and name-calling all resulted in hard feelings and no one would study for the benefit of anyone else. To their great surprise, ALL FAILED and the professor told them that socialism would also ultimately fail because when the reward is great, the effort to succeed is great, but when government takes all the reward away, no one will try or want to succeed. It could not be any simpler than that.

Remember, there IS a test coming up. The 2012 elections.

TAXPAYER et al,

No way this single report captures a fraction of the leakage that really occurs in various programs..consider that in 2009 Obama indicated that he identified waste in spending at .004 of 1% or $140 million…Shortly thereafter, he found 622 Billion of waste in Medicare/Medicaid alone and used this as an offset for PelosiCare…ie any waste they identify is justification for new spending…of course the GOP isn’t any better.

Point here is that there are many reports on waste but nothing is ever done about it that results in less spending…

Jay listed several professional sports organizations “among others”, which leads me to wonder if trade unions also qualify for this exemption status. I am still not clear but will continue to look. None of them should be exempt, although I do know that the NFL, as one example does have a vibrant charity aspect.

What is a 501(c)(6) organization?
According to the Internal Revenue Service, a 501(c)(6) organization is a business league devoted to the improvement of business conditions of one or more lines of business. It is not engaged in any regular business typically carried on by for-profits.
Trade associations and professional associations are considered to be business leagues. The mission of a 501(c)(6) organization must focus on the advancement of the conditions of a particular trade or the interests of the community.

A 501(c)(6) business league may further its exempt purposes through lobbying as its primary activity without jeopardizing its exempt status. However, a 501(c)(6) organization that engages in lobbying may be required to either provide notice to its members regarding the percentage of dues paid that are applicable to lobbying activities, or pay a proxy tax.

Examples of 501(c)(6) organizations include the National Association of Truck Stop Operators, Home Builders Associations, and local chambers of commerce.

Learn more about 501(c)(6) organizations at the IRS Web site.

Paul — “Victoria’s Secret to sell items at Cowboys Stadium”

Fellas, listen to me closely. THIS IS A VERY DANGEROUS THING.

Guys, if you go to Cowboys Stadium and decide that, for some inexplicable reason, you need to buy your lady some lacy underthings while you are there, buy them while you’re sober. If you wait until you’ve had a few beers, you’re going to screw up, get something in the wrong size and THIS will happen:

Lingerie is too big:

wife/gf/POSSLQ: OH MY GAWD, YOU ACTUALLY THOUGHT I WAS A SIZE 16? (throws breakable objects)

Lingerie is too small:

wife/gf/POSSLQ: (murmuring softly and tearfully) you think I’m fat . . . snif (breaks into tears and sobbing)

Guys, YOU CANNOT WIN IN THIS SCENARIO. If you want to get your lady some frilly girl undies, take her to VS YOURSELF. The advantages of this are clear:

1) She’s going to pick out something she likes
2) You’re probably going to like it, too
3) She’s going to get the right size
4) You look generous
5) You’re spending time on something she wants to do (clothes shopping)
6) Are you gonna get any afterwards? Confidence is HIGH

Save yourself some hassle and sweeping up broken plates and curios after her tantrum. Use the JHM method instead and WIN!

In addition to the tax exempt status, the NFL likes to argue (depending on how it suits them) that they are: a) a single entity with 32 subsidiary units or b) 32 independent businesses.

Whenever they are facing scrutiny over issues such as ticket price fixing, franchise valuations, or in labor negotiations they try to argue they are 32 separate small businesses. Detroit Lions owner Bill Ford said “The NFL has 32 owners, as opposed to a single corporation,” Ford said in an interview in his office at Ford Motor’s world headquarters in Dearborn, Michigan. “The whole thing is so different. And the issues are so different.” (http://www.reuters.com/article/2011/01/07/us-nfl-ford-idUSTRE70645920110107)

In American Needle V. NFL, they claimed to be a single business entity for the purpose of being immune to the antitrust cases that have allowed player unions to establish and to protect free agency and other benefits. The NFL initially won the case, but American Needle got the verdict reversed on appeal. The NFL won an appeal to a higher court to let the original verdict stand. Then in an highly unusual move, the NFL appealed the higher courts decision (which they had just won) to the SCOTUS. They got greedy. They wanted to expand the ruling to broaden their monopoly. The Supreme Court ruled the NFL is 32 separate small businesses and the case was won for American Needle. (http://sports.espn.go.com/nfl/news/story?id=5214509)

“We’ve steadily been hiring for the last couple of years, but it’s always a lot of work,” Murphy said in a recent interview. “You end up having to develop ways to try and and find these folks, whether it’s using recruiters, strengthening your own recruiting focus internally, even just old-school things, like bigger internal employee referral bonuses.”

For-profit schools often seek to provide vocational skills rather than traditional academic training and could, in theory, move more quickly to respond to changes in what employers are demanding. The industry argues that it gives working parents, returning service members, and other nontraditional students more freedom to earn degrees.

Yet across the sector, there aren’t enough safeguards to protect instructional quality. Recently, Tom Harkin, chairman of the Senate Committee on Health, Education, Labor and Pensions, issued a scathing report; the product of two years of investigation, it found that for-profit universities spend more on marketing, advertising, recruiting, and admissions staffing than on actual instruction. The average salary of a for-profit college CEO was $7.3 million in 2009 — eight times the average presidential pay for the nation’s 50 wealthiest universities, as calculated by the Chronicle of Higher Education.

Other data back up Harkin’s concerns. Statistics from 2011 show the percentage of students who get a diploma within six years of entering a for-profit school is 28 percent — half the 56 percent graduation rate at public institutions. Meanwhile, a 2010 Education Trust report found that the graduation rate at the University of Phoenix, by far the nation’s largest college system of any kind, was only 9 percent; the 12 percent at its Boston campus was barely better. (The University of Phoenix told the Arizona Republic that its internal records show a 36 percent graduation rate.) In 2010 and 2011, the Government Accountability Office found irregularities at a number of for-profit institutions — recruitment tactics in which enrollees were told not to worry about student debt, unrealistic projections of how much students would earn with their degrees, and inconsistent adherence to academic standards, including inaction against plagiarism.

For example, I did not know that the National Football League, the colossus of professional sports, is classified as a non-profit — a tax-free non-profit, to be more specific

Which of course helps explain why the league absolutely positively could NOT under ANY circumstances even THINK about budging one inch in yielding to the pensions demands of the refs during the recent lockout.

It was obviously hurting for cash.

Almost half of professional football teams are valued at over $1 billion.
+++++
I believe you are confusing the league with the team. I do not think the teams themselves are non-profits. A non-profit means there is no profit. It does not mean it doesn’t have any assest or revenue. All non-profits have assets. There are several non-profits which have revenues of over $1 billion. The Mayo Foundation has 5.8 billion in revenue plus with assets over 3 Bilion.

I really don’t know why men like the NFL. The NFL is a big part of gay recruitment. The gays are trying to get you.

From what I understand the gays designed the NFL uniforms. The pants they wear are disgusting, you can see a players backside. I do research on this so I have to watch all of the games. Last week I was focusing on Tom Brady. I have his backside seared into my memory, disgusting. The close ups, the slow motion, the hi-def tv, all made it impossible to take my eyes off his backside, it was like he was naked. Other players had their hands all over him, disgusting.

The NFL should require their players to wear little flaps over their backsides. At least the tv networks should be required to blur out the image. The players are showing more than Janet Jackson showed during the Super Bowl half time disaster. Disgusting.

Boycott the NFL until they cover up. Don’t let the gay recruiters win! Do it for the children.

As an entity the NFL or other associations operate under 501(c)3 or 5 status and are tax exempt. Basically good non-profits are restricted in distribution of proceeds to directors. They can and do pay salaries for staff positions and other reasonable expenses. They players, coaches and all other personnel pay all kinds of taxes so don’t get your panties in such a wad.

Elect Romney and he’ll (according to some of the things he says that may have already been contradicted by other things he says) roll back welcome changes to health care market, increase the deficit, start a war with Iran, kill off nursing home care for seniors, destroy the promise of SS and Medicare, and make abortion something the government gets to arbitrate.

We need to eliminate all corporate taxes. It’s an unfair system with tons of loopholes to begin with. Let them reinvest all their earnings or pay them out to the owners as divinends. However, those cuts should be offset by taxing dividends and capital gains at regular income rates. Why should Romney, or Anne Chambers Cox, pay a lower rate on their passsive income than I pay on what I actually have to work for?

Even as the federal deficit has ballooned, U.S. corporations are paying lower tax bills than ever before, according to one measure.

That’s the takeaway from a new report by the Center on Budget and Policy Priorities dissecting the tax structures of corporations, which CBPP Director Chuck Marr says are now paying taxes at “historical lows as a share of the [total] economy.”

Corporate Tax Revenues Nearing Historic Lows As A Percentage Of GDP, Report Says
Marr points to a basic discrepancy: While the U.S.’s top corporate tax rate of 35 percent is one of the highest in the world, the amount corporations actually end up forking over to the government is much lower, sometime as low as 4 percent. This is due to a dizzying number of deductions, write-offs, and other accounting tricks that allow corporations to legally reduce their tax burden.

Ok so I went to Obama site and Romney site (glad I didn’t eat breakfast)..I’m still not coming up with any more specifics…just goals and alledged accomplishments..

Both: Champion Small Business/Promise to Build a Stronger Middle Class/Getting Deficit and Debt Under Control/Reform Tax Code (I must be missing the specifics here…other than raising 80 billion a year from top 3% or whatever..when you divided 80 billion by 1.2 tillion deficit, you still have 93% left to cover)/Creating jobs for tomorrow per education (we seem to keep spending more on education with no results)…

I really don’t see any more specifics from either although I also think its Congress’ job to cover that…how is Romney going to create 12 million jobs? I dunno..How is BO going to address the deficit when his focus will only address 7-8% of problem…which won’t alleviate the demonization of the rich..

ADAM,

I can’t disagree with your rebuttal…I could have provided a better debate point to be sure.

I’m trying to point out that the odds of either plan being pulled off and accomplishing any meaningful improvements for us are slim to none.

So my point here is that BO’s primary objective of raising an additional 80 billion a year to reduce deficit by less than 10% is real? For that to even be possible he would need economic growth that is unrealistic and he would have to actually produce the spending cuts that were already on the table before he hit the scene..if he actually gets growth and cuts he puts out (not remotely likely) there, our interest spending alone will increase by 147% between now and 2017…

Romney’s claim of 12 million jobs is equally absurd as many of those jobs are already projected but again, the odds of them happening or the WH having any real impact are slim to none as well…

Was listening to Boortz just a few minutes ago, (Boortz was his usual insulting self – calling her flat chested, pulling some of her past tweets and trying to make her out to be a slut — however his old azz didn’t understand what half the stuff she was tweeting meant, and I bet he’s hoping his audience doesn’t know it either.
You may have the radio tuned to Boortz, but either you aren’t really listening OR you are a liar. I am listening to Boortz and heard exactly what he said about Ms. Fenton.

He said she was flat bellied, offered as a compliment, and read actual tweets from her now scrubbed Twitter account. The tweets I heard Neal read were pretty straightforward and made it very clear that this young lady (woman if you prefer) drinks heavily and acts a little trampish, not that that bothers me personally. He said she was attractive, but not too bright, based upon her writings.

That is correct. Why is it that cons never complain about the socialism of governments building stadiums for private business (professional sports teams) to use. Sounds like a double standard to me.

Romney says Obama also has investments in Chinese companies and through a Cayman Islands trust

Romney told Obama: “You also have investments in Chinese companies. You also have investments outside the United States. You also have investments through a Caymans trust.”

It’s an accurate set of statements when you consider investments made by managers of the Illinois pension fund in which Obama has an account.

As we noted in reviewing previous claims about Romney’s investments in China, the investments involved are indirect and — as far as anybody has said — made without the knowledge of the account holder.

With that clarification, we rate Romney’s statement Mostly True.

Fact checks in advance would be hard. They have rules now in advance that the candidates ignore once the debate starts. They would never stay with the facts presented in advance. Too much temptation to add facts as they go. Some kind of instant fact check provided to the moderator might be an idea. With a buzzer system.

Also, the moderator should be able to turn off the microphones of the candidates which he wants, if they go over time or need to be corrected on their facts.

Pension Envy: Who Has More—Obama or Romney?

In one of the debate’s lighter moments, Obama countered, “I don’t look at my pension. It’s not as big as yours so it doesn’t take as long. I don’t check it that often.”

But what about Romney?

It’s extensively documented that Romney is, well, a rich guy. He earned untold millions —though famously circumspect about releasing tax returns — while leading private equity giant Bain Capital and has a substantial retirement plan.

His Individual Retirement Account could be worth in the neighborhood of $87 million, as documented in an extensive report from the Washington Post .

But as for a strictly public pension? Zip, zero.

Romney only served one term as governor of the Bay State and did not take a salary, so he is eligible for nothing.

So while Romney appears headed for a happier retirement financially, he’ll be footing his own bill — unless, of course, he wins next month. In that case, his nest egg will be even that much bigger than Obama’s.

I’d wait for rebuttal before peddling that particular number hard…per WH data kindly supplied by my close personal friend Taxpayer…past four years:

Medicare/SS spending up 27% each
Education/Social Services up 51%
Total income security (including housing assistance and food stamps) up 58%

To be fair all of these were on an unsustainable trajectory the prior 10 years and when you factor in recession, some of the increases can be justified….the demographics play a big role..

The big problem is we can’t afford these trends to continue…no candidate has or likely can stem the flow of deficit ceiling increases…of which drive our interest expense up an estimated 147% by 2017

Hollywood too !!!!!!!!!!!!

Hollywood tax breaks extended under bill headed to Gov. Brown

A $100 million annual tax break for California motion picture companies would be extended under legislation headed to Gov. Jerry Brown.

Sylmar Democratic Assemblyman Felipe Fuentes proposed the two-year extension, Assembly Bill 2026, which cleared its final legislative hurdle late Friday night in the Assembly by a vote of 60-4.

The program of tax credits initially was signed into law by then-Gov. Arnold Schwarzenegger, in 2009. Fuentes’ measure would extend the program from July 2015 to July 2017.

The tax concession targets major motion picture projects in which 75 percent of the shooting days take place in California or 75 percent of its production budget pays for services, purchases or property rental in the state.

AB 2026 is meant to encourage California’s motion picture industry, which has made Hollywood famous, not to relocate.

Forty states offer financial incentives to the industry, as do Canada, Australia and much of Europe, according to a legislative analysis of AB 2026.

Now that is good news.

So let’s fast forward to a possible Romney inauguration.

There’s a parallel with Pres Obama and the Bush administration. Obama took over right at the time we experienced the culmination of years of Republican policies that led to an economic collapse. Democrats pointed that out and all we heard was ‘you’re just blaming Bush!”

So we then would have a Pres Romney taking over shortly after four years of Pres Obama’s efforts came to fruition. Which means the trends were well underway. In very positive ways, as the article showed.

Question is, will we hear Republicans say ‘well, it really did begin under Obama…”?

Ahem — “Romney told Obama: “You also have investments in Chinese companies. You also have investments outside the United States. You also have investments through a Caymans trust.”

Leave it to a con to miss the point.

Romney’s outsourcing activities (conducted via Bain and its properties) meant that Romney *directly and personally profited* from choosing to screw Americans out of their jobs and send them to China. That’s what he — and you — are missing.

JAY,

All good stuff but what concerns me is the use of a poll to ascertain unemployment..seems to me we should be comparing apples to apples (BLS)…my other concern and as evidenced by the graphs is that most of those categories are uber-sensitive…..it wouldn’t take much for the banks to stop whatever lending (a minscule amount compared to what capacity they are sitting on) they are providing…

Increase in domestic car sales is awesome…I don’t see that changing anytime soon.
Consumer confidence and stock gains are also great trends but again, any slight reverse economic news could change these in a heartbeat..

At least we can enjoy these for today…I’m more convinced the economy will dip into recession again in the next couple years..of course I’m paid to be cynical..

The crowd at the airport included two toddlers holding American flags who were greeted by the president, but apparently “looked a bit disinterested.”

“I do great with the 2-3 year old crowd,” President Obama joked.

Democrats enacted $1.803 billion for embassy security, construction and maintenance for fiscal 2010, when they still controlled the Senate and House. After Republicans took control of the House and picked up six Senate seats, Congress reduced the enacted budget to $1.616 billion in fiscal 2011, and to $1.537 billion for 2012.

The administration requested $1.801 billion for security, construction and maintenance for fiscal 2012; House Republicans countered with a proposal to cut spending to $1.425 billion. The House agreed to increase it to $1.537 billion after negotiations with the Senate.

The administration requested $1.654 billion for the State Department’s Worldwide Security Protection program for fiscal 2012. House Republicans proposed funding the program at $1.557 billion. Congress eventually enacted $1.591 billion after the Senate weighed in.

For fiscal 2013, the administration requested $2.15 billion in funding for the worldwide security protection program, a larger increase from the previous year. The House countered with a proposal to increase the program to $1.934 billion.

Are people ever going to get around to discussing the difference between an act of terror, a terrorist attack, an attack by terrorists, a military attack by terrorists, a terror attack by military?

Seems to me they base their… analysis… solely on ‘the groups a group we have labeled a terrorist group; therefore, anything they do is a terrorist attack.

So if Hezbollah joins forces with the Iranian Revolutionary Guards in conducting classical military operations against Israel, we’re going to hear how Israel is responding to military and terror attacks. In the same battle.

Ah yes, simplicity does have a certain attractiveness for some -

It’s not even that. When you’re part of a state pension, you have no say in even who the trustee is going to be. With blind trusts, you pick the trustee. Mitt’s wasn’t a blind trust when he hid his money overseas, was it? And if that’s the case, did he break blind trust rules by having that money moved back so he could run for President for pete’s sake? :)

A good book to read is “Soccernomics”. As a general rule sports are unprofitable. The value of them has nothing to do with their profitablity. It is more or less a luxury good for the owner. If you really want a good understanding of sports business this book is great even though it primarily focuses on England’s Premier League.

I believe the main issue with sports teams in the US is the leagues are granted monoplies and they use the monopoly to levarage local governments to build stadiums. In Europe a soccer team can’t just up an dmove to another town because every town already has a soccer team. The leagues have teams moving in and out of the leagues based on performance. In the United States the number of teams is fairly static which means citys have to compete with each other to get a team.

Let’s not get sidetracked by the issues and the debates. Forget the party affiliation. If a candidate wants to win in a landslide then that candidate needs to adopt this simple platform:

1. Any law passed by congress will apply to the members of congress as it does to United States citizens.

2. There will be no pension or retirement pay for elected members of the federal government or their appointments.

3. No tax rate for an individual citizen or corporation can be higher than the lowest tax rate of any member of congress.

If you want to discuss the NFL and transition to cover ups, you should review the Pat Tillman story. He was killed in April of 2004, and the actual cause of death – friendly fire was not disclosed until 2007. This was despite the fact that investigators knew within days that there was no evidence of hostile fire, and Tillman had been killed by rounds likely from US forces. There are some reports that soldiers were ordered to lie to Tillman’s family at the funeral. The Actual CID investigation was opened in March 2006 and the report was issued in March 2007.
This sequence of events is consistent with the history of coverups. Watergate occurred in 1972, and the investigations and hearings took two years to reveal the extent of wrong doing. Reagan’s sale of weapons to Iran was being investigated, when Oliver North was shredding documents in the basement of the White House.
That is how cover ups works USMC. If you are angry about cover ups, talk to the Tillman family about the Bush administration and cover ups. You are spending a lot of energy on faux outrage on an incident that was clarified within two weeks.

“It will show if the Right is, as they say, only about defending marriage, or if their real agenda is to deny protections to same-sex couples.”

Any two people of any persuasion can have wills, powers of attorney (medical/legal/financial), etc. that will allow them those protections. The sanctity of one man/one woman should be protected. If the marriage of two people of the same sex is eventually upheld by the Surpeme Court then there is no “legal basis” to deny anything else including three people.

Just FYI, I was looking over some recent polls last evening, and I stumbled across one that . . . GASP . . . OVERSAMPLES REPUBLICANS. And as we all know (because the cons told us so) that never happens and oversampling automatically leads to invalid survey results, right?

FWIW, I wasn’t *looking* for such a poll; I just happened to notice that cons were oversampled in the poll. And I bet if someone did some research, I bet they’d find out that cons get oversampled quite a bit more than cons are actually willing to admit.

Here’s the poll in question:

http://www.publicpolicypolling.com/pdf/2011/PPP_Release_CO_1016.pdf

You will, of course, notice that the MOE is +/-4.7% in that poll. IMO, that’s a horrible MOE and not in any way reliable.

As I’ve said many times, I have no problem with requiring ID to vote. The problem with the GOP approaches is that they’re half-azzed, insecure, rushed to completion and always happen right before an election (so they wind up suppressing the vote whether they mean to or not).

If y’all were serious, you’d come up with a serious proposal for a voter ID program that addresses all those problems. But I’m not going to hold my breath waiting for one.

Here’s some reporting(from CNN of all places) that pretty much cancels out the elation you lib-tards had over the fake U3 job numbers.

“Along with the official unemployment rate, the Department of Labor also calculates something called the employment-population ratio, which measures the percent of the U.S. adult population that has a job.
The rate currently stands at 58.7%. While it jumps around slightly from month to month, it has essentially been stuck there for three years — close to the lowest level since the 1980s.
That paints a much bleaker picture of the job market than the unemployment rate, which has fallen considerably in the last year. “

I have a different take on it. I do not think religious aurthorities should be deputized to perform a legal function. I think everyone should be married by a legal authority. She and her team had to select and sequence questions in a matter of hours, and then she had to deal with the tricky format, the nervous questioners, the aggressive debaters, all while shutting out the pre-debate attempts to spin and intimidate her. She pulled it off masterfully.
The reviews on Candy’s performance have been overwhelmingly positive but Romney supporters are going after her on two points, no doubt because their man did not have as good a night as he had in Denver.
On the legitimacy of Candy fact-checking Romney on Obama’s Rose Garden statement, it should be stressed that she was just stating a point of fact: Obama did talk about an act (or acts) of terror, no matter what you think he meant by that at the time.
On why Obama got more time to speak, it should be noted that Candy and her commission producers tried to keep it even but that Obama went on longer largely because he speaks more slowly. We’re going to do a word count to see whether, as in Denver, Romney actually got more words in even if he talked for a shorter period of time.”

People arguing over who won and didnt win the debate are rearranging deck chairs on the Titanic. The only debate that mattered was the first, and Romney showed himself to be a viable candidate. With the economic malaise brought on by Obama, that is all that is needed. The race was over from that point forward. The only question remaining is how large of a mandate the Republicans will get. I am sure they will get not only the presidency, but the senate as well. Unlike Obama, who got a mandate and thank God squandered it for 2 years, you will see Romney move quickly to reverse the ACA, and end the recession that the Democrats have maintained with stupid policies.

There is still hope for America, and its time for the change.

“POLLS: “Romney takes first lead in electoral college…”

I saw that, Scout. JHM, here’s an interesting article by Silverman that mentions some of the problems with polling I have talked about:

http://fivethirtyeight.blogs.nytimes.com/2012/10/17/oct-16-can-polls-exaggerate-bounces/

In particular, I found these statements to be illuminating (emphasis added):

This recontacting procedure is uncommon in survey research, but not unprecedented (The New York Times and CBS News have used the technique occasionally in their polls). It has advantages and disadvantages.

Let’s start with the potential downsides. First, to the extent that the original sample was off the mark because of random variance, the new one will be also. If the 800 voters you reached in Ohio or Virginia originally happened to be more Republican- or Democratic-leaning than the broader group of voters in those states, you’ll reproduce the flaw when you survey them again.

Next, the technique potentially reduces what is known as nonresponse bias. Even the best surveys these days only manage to get about 10 percent of people on the phone, while the shoddy ones might struggle to get 3 or 5 percent of voters to return their calls. These percentages have fallen precipitously over the past two decades.

Polling firms are hoping that the 10 percent of people that they do reach are representative of the 90 percent that they don’t, but who will nevertheless vote. But there are no guarantees of this, and it is really something of a leap of faith. The willingness to respond to surveys may depend in part on the enthusiasm that voters have about the election on any given day.

LeRoi2 — “Real Clear Politics Website now shows Romney in the lead for Electoral College votes.”

I don’t think it’s going to happen the way you seem to. I’ve been fiddling with the map forr weeks now, and unless the tossup states break for Romney in a BIG way, Romney’s still in trouble. The key issue for Romney is that the tossup states are *still* leaning to Obama, so he’s got an uphill climb with states he HAS to take in order to win.

So of the tossup states RCP shows, give Romney NV, IA, CO, VA., NH and go ahead and give him FL as well. Give the others to Obama, including OH. In that case, Romney JUST squeaks out a win, but he’s GOT to take ALL those states or Obama wins. If Romney somehow takes OH *instead* of FL, however (and takes the other tossup states I listed), he loses. He’d have to break off one more state with at least nine EVs or Obama would win.

If Obama takes BOTH OH and FL, Romney’s hosed. He’d have to take all the tossup states PLUS break off WI, MI and PA (which are well in Obama’s column) in order to pull off a win.

But again, Romney’s key problem is that of those tossup states, only Colorado is leaning to him. All the others are still showing Obama ahead. So Romney’s got to make up a LOT of ground in the last debate. I personally look for sparks to fly that night.

“Is this not how it’s done in many European countries? Civil ceremony first, then a church wedding if the couple wants it?”

I wouldn’t know. My opinion on the whole issue is that marriage is a legal contract and any calls for same-sex couples to have any other sort of legal contract is just another attempt at “separate but equal” – which doesn’t work. The vast majority of laws are already written to regulate the legal state of marriage, and to inject any other sort of contract would mean a whole new set of laws. It’s just easier and cheaper to completely separate legal marriage from a church blessing on that marriage and let marriage remain a legal contract between consenting parties.

Towncrier, I think you missed two key points in the matter you quoted.

This recontacting procedure is uncommon in survey research, but not unprecedented (The New York Times and CBS News have used the technique occasionally in their polls). It has advantages and disadvantages.

Let’s start with the potential downsides. First, to the extent that the original sample was off the mark because of random variance,

Firstly, recontacting is uncommon. So it’s not going to be a widespread phenomenon.

Secondly, the reproducible error he speaks of only creeps in *when* you use the recontacting procedure BUT he’s also clearly saying “random variance,” which directly refutes the notion that oversampling is somehow *planned.* The simplest way to eliminate the error is to draw a new sample population each time you conduct the survey.

And FWIW, I gave you an incorrect link this morning on our previous discussion thread. This is the link to the survey I mentioned that oversamples Republicans.

No president has been reelected with the kind of economic failure Obama has created, and he is not going to be either.

“Even twenty years ago people said the same thing you just did about same sex marriage. Give it another twenty and polygamy will be in the game. If you can’t draw a line somewhere you can’t draw it anywhere.”

Well, line drawing is really what is at the heart of any of the social “issues” being hotly debated. For instance, it would be logically ideal to either allow no abortions or any and all abortions. But since almost no one is willing to take that position, it gets down to where one wants to draw the line and for what reason(s). Similarly, once marriage is defined as something other than a heterosexual union of two people, then lines are going to be drawn according to one’s values. My objection to same sex marriage is simple: homosexuality is proscribed in the Bible (quite aside from the fact that there appears to be no evidence of life-long homosexual relations in the animal kingdom at large and that we have no comprehensive long term studies to determine whether of not child rearing by a homosexual couple is not harmful to children) and so institutionalizing it in this way is wrong in my view. If I were an atheist or agnostic, I really wouldn’t care. Once you get outside of Biblical morality, then ethics are clearly situational and not absolute – so it gets down to philosophical arguments. Polygamy has a long history and it is interesting to see gay rights advocates arguing against it on philosophical grounds when there is a much greater historical precedent for it than for gay marriage.

Romney spokeswoman Andrea Saul writes in an email to The Weekly Standard. “Decisions about what services to cover were ultimately determined by the independent Health Care Connector Authority pursuant to the law.”

It’s true that the Massachusetts supreme court ruled in 1981 that the state must fund abortions for people on government health plans such as Medicaid. Twelve other states—including conservative or battleground states such as Arizona, West Virginia, Minnesota, and Alaska—pay for abortions for Medicaid recipients because of state supreme court rulings. Only four states have enacted laws through the legislative process to allow taxpayer funding of abortion.

What I consider appalling about the debate is the fact that the Prez utterly avoided questions about Benghazi, the economy, the poor college student concerned about getting a job and our dead ambassador.

Fortunately, there is yet another debate, in which the Obama machine can come into its weekly tangential meeting with reality, which because of the helpful media, can only be achieved with a real opponent standing opposite him, asking him tough questions.

Whether Romney wins or loses, probably the only things Obama voters will remember about Obama’s pathetic campaign is “47%” and “binders of women”—those trite examples rather than $16 trillion deficits, Iran going nuclear, dead ambassadors, a failing foreign policy, high unemployment and nascent inflation.

Pretty pathetic that the modern liberal media behaves this way, but they do.

You seem to be confusing people’s *personal* take on the matter. Yes, many consider themselves “pro-life,” it sounds nicer, I guess.

And you can say “I don’t want my wife/girlfriend to have an abortion even if the pregnancy is unintentional and I’ll do my best to talk her out of it” if you’re a man; you can say you’d never terminate any pregnancy, yourself, if you’re a woman–and *still* support the sound public policy of making that option available, as it is now, limited to unrestricted access during the first trimester.

This isn’t a real head-scratcher for most, and it’s a loser issue for Republicans, if the Democrats only have the balls to push this out there.

Fortunately, we don’t put people’s rights up for a vote in this country. Oh, sure, some states and localities might do it, and might even pass a law or two that stands — for a while. But in the end, laws that enjoin individual rights in the country get legal review, and unless there’s a compelling *state* interest that’s drawn as narrowly as possible in the law, such laws get overturned.

I’ve adopted–two children actually. One special needs.

Good for you. I do mean that genuinely.

But your insinuation is dangerous, that knowing whether one of your kids has special needs, you might condone killing it.

Well, your insinuation that a weeks-old embryo is a “kid” is, IMHO, dangerous too.

But I wasn’t insinuating anything. Having gone through the adoption process myself, I know that prospective parents are placed in a position where they’re asked just what type of child they want to foster, or adopt. Which is why I was asking the question.

Anyway, congrats on your decision. We have adoptive parenting in common, anyway, so I guess I can’t completely hate yer guts…

Joe,

I bring reminder to the embarrassment that is Obama, but today you do so to yourself.

Fortunately, we don’t put people’s rights up for a vote in this country.

We all know that the left does not think of unborn as persons (we also know that Obama doesn’t want to consider that air-breathing babies born after an abortion has been attempted on them are persons). Thanks again for the reminder of what you believe.

If you use the words “will of the people,” it does beget the end of slavery, actually. Slaves were people too despite what the slavery curmudgeons attempted to say. Interestingly, you are the one making the slavery argument–that certain segments of the population manifestly are not persons. The recipe for the demise of your argument then is in your own words. You string up this concoction and then proceed to hang yourself from it.

How nice.

Your own words bury your own argument….. and then you proceed to high-minded nonsense:

laws that enjoin individual rights in the country get legal review, and unless there’s a compelling *state* interest that’s drawn as narrowly as possible in the law, such laws get overturned.

….sure…. like slavery was “overturned” by the Supreme Court….? ??

Or was that Abraham Lincoln?

Help me to recall what really happened Joe, could you do that, please?

Queen,

Right, so we have states doing very little else besides trampling on people’s rights, right? Then we’ve got the federal government, the quintessential hero in all things good–headed by Barack Obama–wielding his sword and shield to save us from our own state governments?

Just what ARE you saying anyway?

Speak plainer.

Towncrier — “Well, my point in even citing Silverman’s statement there was to show that he appears to imply that oversampling (of Democrats or Republicans or Independents) is a “flaw”. This is in contrast to what you were arguing yesterday – that oversampling of a party demographic does NOT necessarily mean it is suspect.”

FWIW, from Silver’s perspective, *any* kind of demographic oversampling could be termed a flaw; age, gender, education level, geographic residence, household income — but I don’t see any hand-wringing over those particular demographic categories not being accurately represented.

Look, seriously, this is what the Margin of Error addresses. Statistically speaking, it’s virtually impossible to draw a survey population of ~1000 people in the US that will *exactly and precisely* reflect the results that the poll would have if EVERYONE in the potential universe of survey subjects was asked. Survey populations are drawn from the pool/universe, and if you know the N (number of survey subjects) and the total number of *possible* respondents in the potential universe, you can mathematically derive the MOE. Bigger sample populations mean smaller MOEs, but it’s a matter of diminishing returns. You have to add an increasingly large amount of respondents once you get past about +/-3% if you want to decrease the MOE even more.

As a rough rule of thumb, a survey population of around 1,000 adult Americans will generally give you an MOE in the neighborhood of 3%. A survey population of around 2,500 would be necessary to get it down to around 2.5% or so. If you’re shooting for a certain MOE (and FWIW, I don’t rely on polls with anything worse than 3.0%), you can estimate how many respondents you want in order to approach or beat that level of acccuracy. Polls with 4% or greater MOE are, IMO, garbage. I saw a couple of recent polls with 4.8 and 5.2 MOEs; my response to those is ‘why waste your time conducting them in the first place?’

“Since you cite Silverman so often and seem to highly respect him, I just wanted to point out that he seems to think of this as problematic.”

FWIW, I think he’d tell you the same thing as I did about age, gender, etc. as being pertinent demographic data points that aren’t being tracked. And I think it’s important to note that party affiliation is probably the most *fluid* of those factors.

TBG, sorry you missed the irony. Trying “blame Bush”…. of course most of these things have been in process for years, just like the deficit. The point is that when it comes to Obama, there was “no one” before him, but when it comes to others like state republicans, there is always an excuse.

“So how do you feel about basing law on Sharia? After all, if something is proscribed in the Koran, no one should complain about using that as a basis for legislation.”

I am not a Muslim and don’t at all regard the Koran as anything more than the basis for a false religion. And the US is not a theocracy (Judaism entails that but not Christianity). Therefore, I am free to express my views and cast my single vote.

“I double-dog dare you to address that to josef.”

This is NOT the first time I have made this claim. I believe he is very familiar with my views.

“You may not want to put ignorance on full display like that. Anything other than morality referenced in the Bible is situational and not absolute?”

Ooops… looks like I hit a proverbial nerve. But my “ignorance” (such as it is) is always on display. So – by the way – is yours and everyone else’s.

Now that we have that out of the way, let me invite you to provide an objective grounds for morality outside of that ostensibly provided by God. If there is no God, what morality is absolute? Can you make a case from human history? If morality is not absolute, then it is also situational.

“So…. you are aware of what Jesus had to say about divorced people marrying, aren’t you? You going to support legislation do codify that moral absolute?”

Of course. He said the only grounds for divorce and remarrying is adultery. To remarry after a divorce for other reasons is to continually commit adultery. As for whether or not I would support legislation to enforce this, I don’t know. Should things that cause great societal harm be outlawed? Aren’t some already? I do believe that a many of our societal ills are traceable to broken or incomplete families and the disintegration of the so-called extended family. If the Bible says anything about the nature of God it is that He is committed to relationships. I am afraid many Americans today have a very nonchalant attitude about commitment in relationships. But I am not sure you are so much interested in discussing the basis or wisdom of Jesus’ teaching as to use it as a debating point.

Abortion may be ruled illegal, but it won’t go away.

the wealthy will pay enough to get it done either in this country or outside the country.

The poor will either go with the coat hanger solution or give birth to an unwanted child.

“Now that we have that out of the way, let me invite you to provide an objective grounds for morality outside of that ostensibly provided by God.”

First it was the Bible, now it’s God.

Move those goalposts…

“As for whether or not I would support legislation to enforce this, I don’t know. ”

Why not? It’s in the Bible. Jesus said it. It’s a moral absolute. It came from God.

Ever heard of cafeteria Christians?

What I read from you is a hard line on those teachings you like, and a whole lot of “well… it depends…” on teachings, like remarriage after divorce, you don’t like.

Not a debating point. It’s about seeking consistency from one who trumpets moral absolutes from the teachings of Jesus.

Upstairs – fits right in with this discussion.

Obambarrassment — “I bring reminder to the embarrassment that is Obama, but today you do so to yourself.”

No embarrassment at all. Simply clueless misunderstanding from your corner. (giggling) :D

“We all know that the left does not think of unborn as persons (we also know that Obama doesn’t want to consider that air-breathing babies born after an abortion has been attempted on them are persons). Thanks again for the reminder of what you believe.”

You want a reminder? I’ll give you a reminder. I support abortion on demand. :)

“If you use the words “will of the people,” it does beget the end of slavery, actually. Slaves were people too despite what the slavery curmudgeons attempted to say.”

And they were property, too, and laws were promulgated to enforce property rights with respect to slaves. Fortunately, the slaves’ rights were eventually recognized. And so it shall be with women, whereupon they will be able to make their own decisions about their bodies, as opposed to the government deciding for them.

“Interestingly, you are the one making the slavery argument–that certain segments of the population manifestly are not persons.”

Aaaaaand the point goes right over the clueless con’s head (laughing, pointing) :D

The “persons” I mentioned aren’t feti. They’re the pregnant women y’all want to boss around, Champ.

“The recipe for the demise of your argument then is in your own words. You string up this concoction and then proceed to hang yourself from it.”

Well, sure if I meant to say what you wrongly THOUGHT I meant to say. But I *didn’t* think or say that, so you’re wrong. (laughing, pointing) :D

“How nice.”

Maaaaaan, you’re clueless. :D

“Your own words bury your own argument…”

Nope. You simply misread me and leapt to judgment thereby. (laughing) :D

“… and then you proceed to high-minded nonsense:”

Said the master of the art. (snickering) :D

“….sure…. like slavery was “overturned” by the Supreme Court….? ??”

There are documented cases of slavery in the US as late as the 1880s. Suppose you tell me how those slaves were freed? Do you imagine that someone waved a copy of the Emancipation Proclamation at the slaveowner and the shackles magically popped off the slaves’ ankles and wrists? :D

“Or was that Abraham Lincoln?”

You really should read more. (laughing) :D

“Help me to recall what really happened Joe, could you do that, please?”

Sure! :D

Who exactly defines “fair share”? I thought is was the IRS…is it you? Is it the DEMS who are victimizing 99% at the hands of the 1%? You realize that rolling back rates for top earners as suggested by DEMS will not likely even offset new spending going forward? $80 billion per year with at growth rate less that 2%..and an annual deficit of over 1 trillion?

DEMS seem to think this is about unfairness…its’ purely political ploy by DEMS to further victimize its’ core voting block.
