Supreme Court strips Romney of favorite argument

So how does Mitt Romney, the architect of RomneyCare, attack ObamaCare from this point forward?

Until now, Romney has claimed that the individual mandate is fine as policy when implemented at the state level. In fact, he has said repeatedly that he believes he did the right thing as governor of Massachusetts.

In a GOP debate in January, for example, Romney defended his plan on its merits, arguing that “everyone has a requirement to either buy it or pay the state for the cost of providing them free care. Because the idea of people getting something for free when they could afford to care for themselves is something that we decided in our state was not a good idea.”

However, while Romney argued that such an approach was right for Massachusetts, he also argued that it would be unconstitutional to implement it at the federal level. That was his get-out-of-jail card; that was the core of the distinction that he attempted to draw between RomneyCare and ObamaCare:

What was good policy at the state level was unconstitutional at the federal level.

Except that as we now know, it’s not. Romney’s argument has been rendered null and void by today’s Supreme Court decision upholding the mandate and the tax penalty used to enforce it.

Romney could, I suppose, try to seize upon the court’s description of the penalty as a tax to try to explain how his plan was different. U.S. Sen. Lindsay Thomas, in an appearance on Fox News this afternoon, was already pitching that line, claiming that “the issue is no longer about health care; it’s about taxes.”

Unfortunately for that line of argument, the tax penalty levied under RomneyCare on those who refuse to buy health insurance differs from that under ObamaCare only by degree, and not in a way friendly to Romney. You see, the maximum tax penalty in RomneyCare, at $1,212, is considerably higher than the maximum of $695 under ObamaCare.

Of course, none of this means that Romney won’t keep attacking the federal plan so clearly modeled after his own strategy. It just means that he won’t be able to do so credibly or logically.

“bman: What will happen if a person doesn’t pay? If there’s a “fine”, someone has to collect that fine, right?”

Deducted from anything you get when filing at the end of the year (if you are lucky enough to have anything coming back at the end of the year). If not they will probably tack on a nice late fee which keeps on growing until it’s paid in full. That’s usually the way IRS works.

Some things are known.

The rate at which the feds will support the states for Medicaid spending.

How much it won’t cost families if they get a catastrophic illness with a game-playing insurance company under the old system – the cost of lifetime savings, home equity, draining retirement savings.

That one can count on some money being spent – for a child or grandchild who, because of preexisting conditions, was not before insurable.

For a lot of people, that’s what they can count on.

I don’t know how old any of you are nor would I have any way of knowing how old you are.

But, I will tell you this, once you reach 50, be prepared for your insurance premiums to skyrocket.

“Oh, I not worried, I’m covered at work.” Guess what? Higher insurance costs are the reason many employers let workers go in their 50s.

It’s especially bad if you’re self-employed. When my insurance reached $500 a month, I simply had to let it go. I don’t have $500 a month.

As I mentioned earlier, I estimate (based on past increases) that my insurance now would be approximately $750 a month. That’s bumping up against what my mortgage costs.

You young folks, enjoy it while you’re young. You face a harsh reality when you get older.

From Five Thirty Eight:

With due respect, I think this counterintuitive conclusion is too cute by half. It may involve the same sort of wishful thinking that liberals were guilty of when some began to argue that the court striking the health care bill would actually help Mr. Obama politically.

….

…continued dissatisfaction over the health care bill was presumably already priced into the polls. A decision that upholds the status quo is not likely to change that much.

To the extent there are marginal effects of the court’s decision, they would seem to be positive for Mr. Obama. The framework of the bill has now been endorsed by the court, including by John G. Roberts Jr., the relatively conservative and relatively well-respected Chief Justice who wrote the majority opinion.

I’m headin’ for a land not so far away just across the Grande Fountains.
So come with me, we’ll go and see Barack’s Candy Mountains

In Barack’s Candy Mountains there’s a land that’s fair and bright,
Where the food stamps grow on bushes and you step out every night,
Where the TEA Parties are all empty and the sun shines every day
On the birds and the bees and the marijuana trees,
Where the lemonade springs where Common sings
In Barack’s Candy Mountains.

In Barack’s Candy Mountains all the cops have sold their guns,
And the president claims privilege while Holder is all but done.
The tax coffers are full of loot and ACORN is flush with dough.
Oh, I’m bound to go where there ain’t no snow,
’Cause Al Gore says that Global Warming is so
In Barack’s Candy Mountains.

In Barack’s Candy Mountains you never sell your stocks,
And the little babies in the womb never get to wear their socks.
The conservatives have to tip their hats and the talk show hosts are mute.
There’s a lake of stew and of Honest Tea too,
You can find them all at the gay wedding ball
In Barack’s Candy Mountains.

In Barack’s Candy Mountains the doctors all are free,
And you can walk right in their office any time you please.

There ain’t no nuclear power plants, no oil or gas or coal.
I’m a goin’ to stay where you sleep all day,
Where they hung the jerk that invented work
In Barack’s Candy Mountains.

For, getalife, Kam, JamVet, and others.

Is it more important that the “right” loses or that Americans win?

Would all of America’s problems go away if all “cons”/repub were teleported to planet kablob or where ever?

Comic Book or Fantasy Game nerds can type real good.

Carpenters with two crushed fingers however have a hard time of it.

Thank you for your concern, BTW.

That you see that as an either/or speaks volumes.

Would all of America’s problems go away if all “cons”/repub were teleported to planet kablob or where ever?

Your moniker could use some more creative flair…..

Surely you have something better…..

Like: jay is dumber than a tax on people too poor to buy health insurance

They BOTH suck

You saved a few dollars in FL but the wife wants to come home (your words, not mine) but your pride can’t do it.

It is ok

Since the Supreme Court deprived the Obama sheep this November with their talking points, where else will the current Communist occupation find their aimless emotional, misguided anger to rally their government dependent minions? LOL!!!
