Publicly, Gov. Nathan Deal embraced Monday’s U.S. Supreme Court ruling on illegal immigration, claiming that “it appears the court has upheld the major thrust of our state’s statute: That states have the right to assist in enforcing federal immigration law.”
However, there’s a noticeable undertone of caution in Deal’s statement, and in similar statements by Attorney General Sam Olens. Both men seem to realize that when read in its entirety, the court’s 5-3 opinion to overturn much of Arizona’s controversial immigration law also spells trouble for Georgia’s law.
As Deal notes, the court did recognize that “states have the right to assist” in enforcing federal immigration law. However, the key word in that phrase is “assist.” The five-justice majority was quite clear that the federal government has total authority over immigration law, and that states can assist only to the degree that the federal government allows that assistance.
The court based its ruling in part on the federal government’s clear, longstanding authority on matters of foreign policy.
“It is fundamental that foreign countries concerned about the status, safety, and security of their nationals in the United States must be able to confer and communicate on this subject with one national sovereign, not the 50 separate states,” Justice Anthony Kennedy wrote for the majority.
The court also ruled that federal officials have the exclusive discretion to decide how and even whether to deport those who are here illegally. Contrary to the philosophy behind the Arizona law and Georgia’s HB 87, a policy of “toss-em-all-out” is not required by federal law and cannot be dictated by state legislatures.
“Unauthorized workers trying to support their families, for example, likely pose less danger than alien smugglers or aliens who commit a serious crime,” Kennedy wrote. “The equities of an individual case may turn on many factors, including whether the alien has children born in the United States, long ties to the community or a record of distinguished military service.”
(Among other things, that language suggests that President Obama acted within his constitutional authority when he announced that his administration would not deport illegal immigrants who had been brought here as children and raised and educated as American.)
The court did uphold, at least temporarily, one provision of the Arizona law that is also echoed in Georgia law. In both states, local and state law enforcement are empowered to run immigration checks on anybody whom they arrest or detain, even for minor traffic offenses.
In theory, the justices noted, that authority can be constitutional. But if people end up being detained for long periods of time for no reason other than to let state authorities conduct an immigration check, the law will be reviewed and thrown out.
Perhaps the most surprising aspect of the case was the broad, even radical dissent filed by Justice Antonin Scalia. He began by arguing that states are sovereign entities, then complained that the majority opinion “deprives states of what most would consider the defining characteristic of sovereignty: the power to exclude from the sovereign’s territory people who have no right to be there.” In effect, Scalia was advancing the novel notion that states have an inherent right to control who crosses their borders.
“Even in its international relations, the federal government must live with the inconvenient fact that it is a union of independent states, who have their own sovereign powers,” Scalia wrote.
Just as remarkably, Scalia used his dissent to launch a political attack on Obama’s recent decision not to deport an estimated 1.4 million illegal immigrants who were brought here as children. Referring slyly to “the executive’s unwise targeting” of resources to combat illegal immigration, Scalia wrote:
“The husbanding of scarce enforcement resources can hardly be the justification for this, since the considerable administrative cost of conducting as many as 1.4 million background checks, and ruling on the biennial requests for dispensation that the non-enforcement program envisions, will necessarily be deducted from immigration enforcement.”
At a time when the court is already under suspicion of indulging in partisan politics. Scalia plays a dangerous and irresponsible game with judicial credibility.

I’m not sure I’d go quite as far as “I don’t have a problem,” but effectively, that part of the law, that Gov. Brewer and Sheriff Ara##hole claim has been vindicated, is effectively on probation now, anyway.

What should be more alarming to you is how the Obama administration is behaving like a bunch of thugs or a vindictive woman. Their actions to pull Arizona police authority to assist ICE and setting up a hot line to Justice for reporting suspected illegal retention in enforcing the part of the law SCOTUS let stand is one of the most obvious retributions I can remember in politics.

The problem with what Scalia wrote is 1) while states do have individual rights, they are part of the union, & it is the union which has international sovereign – not states 2) He is supposed to write an opinion on the Constitutionality of a law. If he disagrees, fine. But, the opinion is not supposed to be politically motiviated & not supposed to be nothing to do with the case before them.

We wouldn’t be in this mess if our elected leaders had enforced the law when this first began in earnest. Reagan started this whole cluster**** by admitting about 3M illegals and it has gone from bad to worse ever since. No one has had the balls to step up to the plate and uphold our standing laws regarding immigration. The laws are good laws and have worked for quite a long time to ensure that those who entered our country were free of an untainted past, had something to offer and would support themselves. It wasn’t perfect but so much better than what is going on now. Pandering to a special interest group for votes is the ultimate put down for our country. Every president since Reagan has done this and it makes you sick to see it….. as if votes are more important than our laws and protecting our citizens. We have our elected officials of both parties to thank for this. I just hope we survive it.

but – was on the Dallas ring road, I635, just merged from the left off the HOV lane onto the four lanes eastbound. Heavy traffic, all three lanes to my left crowded and moving together at about 65 as Dallas traffic does. Up ahead cop put his lights on, went way to the right and got behind this old sedan. My wife looked and said ‘what’s that cop doing? Everyone’s moving together, no room to pass or change lanes, even.” As we passed the driver had pulled over to the right and brought his arms up in that “oh cr@p, not again” gesture. Young guy.

And in anticipation of the rebuttals: cop wasn’t in a position to run his plate before the stop, all traffic was moving together, this guy was way over to the right side. Daytime, so no burned out lights. But I’m sure the cop had a reason. Just like the situation in which one of our border cities’ mayor, Italian decent but as he put it “I look like my Hispanic constituents” got pulled over in his pickup truck. Cop asked for his license and insurance. Mayor said ‘why’d you pull me over?” Cop said “your right tire skimmed the white line.”

Interesting how many on here are stuck on stupid about the Supreme Courts ruling. What happens if Obama loses and Romney orders Homeland Security and the DoJ to enforce existing immigration laws. The Supremes only ruled that the Federal government trumps the states on immigration law. It didn’t strike down existing immigration law, so a new administration could choose to enforce those laws as Obama has chosen not to. As usual Jay slants everything to support his own political party. Jay leaves out the part where the main theme of the Arizona law was upheld by the supreme court 8 to 0. That is eight to nothing the supreme court upheld the right of Arizona to “ask for proof of citizenship” during a routine stop for violating other laws. The Obama administration again has come down on the side of illegal foreign invaders against the citizens of the United States. Obama has made it very very clear he favors open borders and will not enforce any law that will restrict the invasion of our country by foreigners. We have elected an administration that represents foreign interests against our own citizens. He defends imagined rights of foreigners over the rights of our own citizens.

If we would pass very tough legislation and start enforcing it, there wouldn’t be many problems rouding them up. You can surrender for voluntary deportation within the next 90 days. After that anyone found in the country illegally will get 12 months in prison followed by deportation. We wouldn’t get all of them but 90%+ would just turn themselves in.

They may get gobs of money, they may have hundreds of thousands of employees, but when you count the number who are directly engaged in what the public perceives to be ‘the real mission’ it’s only a small fraction of the total.

Why is everybody saying SCOTUS upheld the biggest part of the law? SCOTUS said we are giving you a pass until the law has been implemented but will rule on it if/when (and there will be a when) we see there is racial profiling. With the sheriff from he!! in Arizona, you KNOW there will be racial profiling. The sad thing is most of the policeman do NOT want to be part of this. This was not being UPHELD, it seems there was so much arguing between the justices, they could not rule – so they gave it a pass, temporarily.

I think we need to increase the amount of justices on the Supreme Court to 11. This situation with 9 justices shows that with only 9, the court can easily become politicized. If Obama and the Dems win big this next election, they should pack the court so that undemocratic, plutocratic rulings like Citizens United can be overturned.

How many millions of alleged illegals are currently residing in this country? I ask this because of one of the conspiracies I recently heard was that the “illegal alien influx” was a plot by Mexico to regain territory lost by the war in 1836…(I know, I know, but it makes more sense than Obama going nothing on gun control so as to revoke Second Amendment rights).
The theory is that if we close the borders, these millions of “Illegals” will rise up and overthrow us. Sounds ignorant to me, spoken by people who have no concept of national security or any idea of what such an act would end as…probably Mexico as a territory.
But, like with the gun control thing, the main factor here is fear. Make us afraid of our Brown Neighbors. Why not, it will improve gun sales so the NRA would be all over it. Just listen to LaPeirre’s speeches.
But, bottom line, the only way I see to deal with the “Illegal Alien Problem” is to offer a path to citizenship with no penalty so that all will sign up and then close the borders if you can’t find any other way…but always remember that our neighbors from south of the border aren’t the only illegal aliens here. There is no easy solution and “Throw them all out” mentality is just moronic.

The police and state patrol already do that. They decide at what point over the speed limit they will stop people. So that are giving blanket waivers to break the speed limit up to a certain point. In a 55 mer per hour limit, most don’t stop cars doing less than seventy. On 400 south on Sunday afternoon, it’s more like 95. Average speed is about 85 or more.

There are two types of immigration and always have been.
One is immigration of people coming broadly for increased freedom, economic opportunity, etc. I agree we should limit that immigration to people with the education and skills we require. Those skills may change over time. To augment that immigration I would support a guest worker program that brings in people with specific targeted skills we may require only on a seasonal or temporary basis. We may need to consider a way for these guest workers to work toward citizenship. This is the “selfish” side of immigration – immigration that serves our needs.
But we have also always provided shelter to individuals that would otherwise be persecuted, tortured and/or killed in their home countries, irrespective of their education or skills. That is the “compassionate” side of immigration – immigration that serves the needs of individuals that are in difficult circumstances.
Both forms of immigration will continue.

I know Arizona wasnt asking to invade Mexico. But the border is a FEDERAL border , not a state border. It is up to the FEDERAL government to enforce the laws, not the state government.
I mean, does Minnesota have a paper’s please law in regard to Canadians? Im pretty sure there are some Candians who take jobs , who have criminal records , cross the border every day. I havent heard Minnesota passing their own immigration laws. Because the border with Canada is a FEDERAL border.

Progressive philosophy is to ignore the law if you don’t agree with the law – Obama style. We aren’t opposed to immigrants – just would appreciate them respecting our laws and entering the U.S. legally. I don’t blame people coming here for a better life. It is up to the President to enforce the law as he swore under oath to do. I pray for the President to get a clue and create an atmosphere that will allow the economy to turn around. Raising the debt ceiling and increasing Fed programs isn’t the answer.

Somehow liberals feel that we have some kind of obligation to accept immigrants into our country and do it on the fast track just so they won’t have to be upset about waiting so long. We do not now, and have never had, that kind of obligation to anyone from a foreign country. Immigration to the US and citizenship in this country is not a right….. it is privilege.

Agree that the border can’t be sealed completly. But crossings have been greatly reduced.
That Great Wall of Bush intended only to cover about 1/3 of the border. They exempted Texas, except for a small section down near Brownsville. Even there, their hearts weren’t in it. Huge gaps in the wall at the Hunt (Oil Billionaire) plantation and at the River Bend Resort and golf course, and probably more.

Let’s get back tot he decisionw ithout any spin. Bottom line, AZ cops can inquire into the status of anyone they arrest. Makes sense as part of a regular background check doesn’t it. Fact that it involves mostly people of hispanic ethnicity, well, as most of the illegal immigrants in AZ are hispanic, oh well. Too bad, too sad. As for the parts which were struck down, requiring anyone to carry “papers” is a bit too reminiscent of tatooing those place i nconcentration camps. I disagree about striking down the no right to work for illegals. By illogical extension (that good old “slippery slope” from law school), if illegals, who ar3e breakig the law, can’t be denied employment ont hat basis, how can a child molester or rapist be denied employment in a day care or school? Both are denied emplyment on the basis of a criminal act, so if that can be a basis for denying emplyment, how can not being here illegally?

Canadian’s have alot of problems with illegal aliens bleeding their country dry. Their problem is with Americans. I’m sure we get some Canadian crossing the border, but they don’t seem to be intent on commiting violent crimes like those to the south. Nope. That’s not their job. Congress is responsible for legislating the laws in relation to immigration. If you want it to be a criminal offense for people to be here illegally, then Congress has to legislate it as that is not how the law is written at this time. Also, if you want more enforcement along the southern border, then it is the responsibility of Congress to budget and allocate the necessary funding to implement the increased enforcement.
As long as Congress is turning a deaf ear to those two primary immigration functions they control, then nothing else can be done above and beyond what is already being done now. I’ll agree with you that the average congressman couldn’t tell you what they’re supposed to do, and that’s because we’ve let them off the hook for doing what they are supposed to do when they go to DC.

You’re misunderstanding what I said. The job of Congress is to legislate not enforce. If they are protecting American citizens by legislating, then they are doing their job. It is not their job, however, to physically protect American citizens unless they are also members of the reserves or National Guard.

I disagree.
Firstly, you’d have to *activate* many units of the Guard for an extended period of time. That’s very costly.
Secondly, most Guard units (hell, most units of the Army and Marine Corps) aren’t trained in law enforcement.
Thirdly, it still won’t work. Sealing the border is NOT the way. Securing the job market, the right to vote and the right to public assistance is they way to go.

Regardless of the politics of the issue…the real, practical effect is to impose another unfunded mandate on those states which have illegal immigrants within their borders.
States are REQUIRED to provide certain services for ALL who are within their borders, such as life-sustaining health care (you can’t let someone die because they can’t pay for the treatment); children must be educated; fire, police and judicial services are required for the additional residents; there is additional demand on water, sewer and electrical services; etc.
So if this is the ruling of the USSC, then the Congress needs to get off its keister and provide all states with the resources to fund these services, based on the population of illegal immigrants within each state. The last estimate of that population in Georgia(from Pew) was 425,000 people. Assuming that it takes about $1,000 per year to provide those services (that’s just a guess), then the State of Georgia should be awarded $425 million to pay for them.

Irrelevant. Arizona, per the Constitution, is explicitly *denied* the authority to do what it did. There are no exceptions for exigent circumstances such as you posit in your question.

If you meet certain financial criteria, you have the right to apply for public assistance. If approved, you have to verify your eligibility to RECEIVE it. That includes establishing one’s legal status in the US, and that’s normally demonstrated by means of a social security card. If you can’t produce one, then you can’t receive the assistance, even if you meet the other criteria.
What I was speaking of is the right to receive public assistance by means of proving one’s circumstances (how poor you are) and that you’re legally eligible to receive it (because you’re a citizen). If you read my link from a little while ago, you will see that I propose a national ID card that would be forgery-proof, and could be used as both a voter ID AND as proof of citizenship. Result: no illegals voting in our elections, no illegals getting public assistance that they’re not entitled to. Win-win, right?
Oblama doesn’t know me very well and leaps to a lot of conclusions. If he’d just stop listening to the voices in his head, he and I would get along a lot better.

That part of the Arizona law was there as soon as George bush took office in 2001 because a lot illegals been deported already under that law where the person been stopped on a traffic routine they think they will have a ticket and then thats it next thing they know they been on removal they didnt even know that but what people need to know about the law is just because the person is illegal dont mean he or she is deportable it just like i call the police and tell them someone is selling drug in that house they cant just showup right away burst the door and arrest somebody these illegals they use to have a valid driver licence with that they tough everything is ok and thats how they get a get a one way ticket back home

CNN Television and the rest of the Liberal channels always show the huge reinforced fences that run along the most populated areas of the Southern border. In truth the rest of hundreds of miles of the border region is nothing but a few strands of rusty barbed wire, which an elephant could slide through.

This Court is not “under suspicion” of partisanship. It is a clearly political and partisan court, put into place for that purpose. I prefer Scalia’s honesty to Roberts’ pretense of judicial impartiality – I like my snake-oil salesmen to show me their greasy palms when they go to shake my hand. But I’ll say this for Roberts – his worrying about appearing too obviously bought and paid for probably saved the health care law.
