Publicly, Gov. Nathan Deal embraced Monday’s U.S. Supreme Court ruling on illegal immigration, claiming that “it appears the court has upheld the major thrust of our state’s statute: That states have the right to assist in enforcing federal immigration law.”
However, there’s a noticeable undertone of caution in Deal’s statement, and in similar statements by Attorney General Sam Olens. Both men seem to realize that when read in its entirety, the court’s 5-3 opinion to overturn much of Arizona’s controversial immigration law also spells trouble for Georgia’s law.
As Deal notes, the court did recognize that “states have the right to assist” in enforcing federal immigration law. However, the key word in that phrase is “assist.” The five-justice majority was quite clear that the federal government has total authority over immigration law, and that states can assist only to the degree that the federal government allows that assistance.
The court based its ruling in part on the federal government’s clear, longstanding authority on matters of foreign policy.
“It is fundamental that foreign countries concerned about the status, safety, and security of their nationals in the United States must be able to confer and communicate on this subject with one national sovereign, not the 50 separate states,” Justice Anthony Kennedy wrote for the majority.
The court also ruled that federal officials have the exclusive discretion to decide how and even whether to deport those who are here illegally. Contrary to the philosophy behind the Arizona law and Georgia’s HB 87, a policy of “toss-em-all-out” is not required by federal law and cannot be dictated by state legislatures.
“Unauthorized workers trying to support their families, for example, likely pose less danger than alien smugglers or aliens who commit a serious crime,” Kennedy wrote. “The equities of an individual case may turn on many factors, including whether the alien has children born in the United States, long ties to the community or a record of distinguished military service.”
(Among other things, that language suggests that President Obama acted within his constitutional authority when he announced that his administration would not deport illegal immigrants who had been brought here as children and raised and educated as American.)
The court did uphold, at least temporarily, one provision of the Arizona law that is also echoed in Georgia law. In both states, local and state law enforcement are empowered to run immigration checks on anybody whom they arrest or detain, even for minor traffic offenses.
In theory, the justices noted, that authority can be constitutional. But if people end up being detained for long periods of time for no reason other than to let state authorities conduct an immigration check, the law will be reviewed and thrown out.
Perhaps the most surprising aspect of the case was the broad, even radical dissent filed by Justice Antonin Scalia. He began by arguing that states are sovereign entities, then complained that the majority opinion “deprives states of what most would consider the defining characteristic of sovereignty: the power to exclude from the sovereign’s territory people who have no right to be there.” In effect, Scalia was advancing the novel notion that states have an inherent right to control who crosses their borders.
“Even in its international relations, the federal government must live with the inconvenient fact that it is a union of independent states, who have their own sovereign powers,” Scalia wrote.
Just as remarkably, Scalia used his dissent to launch a political attack on Obama’s recent decision not to deport an estimated 1.4 million illegal immigrants who were brought here as children. Referring slyly to “the executive’s unwise targeting” of resources to combat illegal immigration, Scalia wrote:
“The husbanding of scarce enforcement resources can hardly be the justification for this, since the considerable administrative cost of conducting as many as 1.4 million background checks, and ruling on the biennial requests for dispensation that the non-enforcement program envisions, will necessarily be deducted from immigration enforcement.”
At a time when the court is already under suspicion of indulging in partisan politics. Scalia plays a dangerous and irresponsible game with judicial credibility.

Agree that the border can’t be sealed completly. But crossings have been greatly reduced.
That Great Wall of Bush intended only to cover about 1/3 of the border. They exempted Texas, except for a small section down near Brownsville. Even there, their hearts weren’t in it. Huge gaps in the wall at the Hunt (Oil Billionaire) plantation and at the River Bend Resort and golf course, and probably more.

Let’s get back tot he decisionw ithout any spin. Bottom line, AZ cops can inquire into the status of anyone they arrest. Makes sense as part of a regular background check doesn’t it. Fact that it involves mostly people of hispanic ethnicity, well, as most of the illegal immigrants in AZ are hispanic, oh well. Too bad, too sad. As for the parts which were struck down, requiring anyone to carry “papers” is a bit too reminiscent of tatooing those place i nconcentration camps. I disagree about striking down the no right to work for illegals. By illogical extension (that good old “slippery slope” from law school), if illegals, who ar3e breakig the law, can’t be denied employment ont hat basis, how can a child molester or rapist be denied employment in a day care or school? Both are denied emplyment on the basis of a criminal act, so if that can be a basis for denying emplyment, how can not being here illegally?

I’m sure we get some Canadian crossing the border, but they don’t seem to be intent on commiting violent crimes like those to the south. Once that starts to happen, I’m sure we’ll address the problem.

Nope. That’s not their job. Congress is responsible for legislating the laws in relation to immigration. If you want it to be a criminal offense for people to be here illegally, then Congress has to legislate it as that is not how the law is written at this time. Also, if you want more enforcement along the southern border, then it is the responsibility of Congress to budget and allocate the necessary funding to implement the increased enforcement.
As long as Congress is turning a deaf ear to those two primary immigration functions they control, then nothing else can be done above and beyond what is already being done now. I’ll agree with you that the average congressman couldn’t tell you what they’re supposed to do, and that’s because we’ve let them off the hook for doing what they are supposed to do when they go to DC.

You’re misunderstanding what I said. The job of Congress is to legislate not enforce. If they are protecting American citizens by legislating, then they are doing their job. It is not their job, however, to physically protect American citizens unless they are also members of the reserves or National Guard.

I disagree.
Firstly, you’d have to *activate* many units of the Guard for an extended period of time. That’s very costly.
Secondly, most Guard units (hell, most units of the Army and Marine Corps) aren’t trained in law enforcement.
Thirdly, it still won’t work. Sealing the border is NOT the way. Securing the job market, the right to vote and the right to public assistance is they way to go.

Regardless of the politics of the issue…the real, practical effect is to impose another unfunded mandate on those states which have illegal immigrants within their borders.
States are REQUIRED to provide certain services for ALL who are within their borders, such as life-sustaining health care (you can’t let someone die because they can’t pay for the treatment); children must be educated; fire, police and judicial services are required for the additional residents; there is additional demand on water, sewer and electrical services; etc.
So if this is the ruling of the USSC, then the Congress needs to get off its keister and provide all states with the resources to fund these services, based on the population of illegal immigrants within each state. The last estimate of that population in Georgia(from Pew) was 425,000 people. Assuming that it takes about $1,000 per year to provide those services (that’s just a guess), then the State of Georgia should be awarded $425 million to pay for them.

If you meet certain financial criteria, you have the right to apply for public assistance. If approved, you have to verify your eligibility to RECEIVE it. That includes establishing one’s legal status in the US, and that’s normally demonstrated by means of a social security card. If you can’t produce one, then you can’t receive the assistance, even if you meet the other criteria.
What I was speaking of is the right to receive public assistance by means of proving one’s circumstances (how poor you are) and that you’re legally eligible to receive it (because you’re a citizen). If you read my link from a little while ago, you will see that I propose a national ID card that would be forgery-proof, and could be used as both a voter ID AND as proof of citizenship. Result: no illegals voting in our elections, no illegals getting public assistance that they’re not entitled to. Win-win, right?
Oblama doesn’t know me very well and leaps to a lot of conclusions. If he’d just stop listening to the voices in his head, he and I would get along a lot better.

That part of the Arizona law was there as soon as George bush took office in 2001 because a lot illegals been deported already under that law where the person been stopped on a traffic routine they think they will have a ticket and then thats it next thing they know they been on removal they didnt even know that but what people need to know about the law is just because the person is illegal dont mean he or she is deportable it just like i call the police and tell them someone is selling drug in that house they cant just showup right away burst the door and arrest somebody these illegals they use to have a valid driver licence with that they tough everything is ok and thats how they get a get a one way ticket back home

WASHINGTON — The Supreme Court released their opinion Yesterday that the federal government has the sole power to enforce the laws against illegal immigration, striking down three key provisions of Arizona’s first-in-the nation crackdown on illegal aliens squatting there and stealing our children’s education, American family health care and a cornucopia of welfare payments and programs. ONLY THE TEA PARTY CAN SAVE US NOW. THE TEA PARTY IS EVERY WALK OF LIFE, EVERY RACE, & EVERY RELIGION THAT HAVE HAD IT WITH THE TWO POLITICAL PARTIES. ID YOU DON’T WANT A SOCIALIST FUTURE, EVERY AMERICAN WHO HAS NEVER VOTED—SHOULD VOTE. NON-CITIZENS WILL VOTE TO SAVE OBAMA.

CNN Television and the rest of the Liberal channels always show the huge reinforced fences that run along the most populated areas of the Southern border. In truth the rest of hundreds of miles of the border region is nothing but a few strands of rusty barbed wire, which an elephant could slide through.
OUR COUNTRY IS BEING OVERPOPULATED IN THE NAME OF VOTES AND GREED.

This Court is not “under suspicion” of partisanship. It is a clearly political and partisan court, put into place for that purpose. I prefer Scalia’s honesty to Roberts’ pretense of judicial impartiality – I like my snake-oil salesmen to show me their greasy palms when they go to shake my hand. But I’ll say this for Roberts – his worrying about appearing too obviously bought and paid for probably saved the health care law.
