John Edwards, not guilty and also not innocent

John Edwards is guilty of many things — stupidity, venality, arrogance and a callous cruelty among others — but a jury of his peers has found him not guilty of Count Three in the six-count federal indictment against him.

The jury deadlocked on the remaining five charges, and the judge in the case has declared a mistrial on those counts.

For the time being, at least, the verdict means that Edwards has won his gamble not to admit guilt and to fight the charges against him, which focus on alleged abuse of campaign finance laws. I can’t claim to have followed the case closely enough to have an opinion on the legal outcome, in part because as indicated above, I had already reached a conclusion about the man himself, and it wasn’t good. It was enough to know that the country had dodged a bullet in not elevating him to the vice presidency or higher, and that his reputation was forever ruined.

As Roy Barnes, a former Edwards supporter, put it recently, “There are some people who ought to be taken out from a courthouse, tied to an oak tree and just whipped. I think he fits into that category.”

I’m sure Barnes was speaking figuratively when he said that. At least I think he was.

Maybe.

“A SCOTUS ruling establishing that gay marriage is constitutional establishes a precedent for ruling polygamy to be so as well”

Certainly that is possible. So is the opposite. The thing you have failed to prove is that there is a direct “slippery slope” between the two. You can’t, bacause there is not.

“So gay marriage will lead to polygamy”

I didn’t say that…..

No, but TC has.

And the article that he himself linked further refutes his Illogical opinion:

Such arguments, often referred to as the “parade of horribles,” are logically flawed, said Jennifer C. Pizer, a professor at the law school at the University of California, Los Angeles, and legal director for the school’s Williams Institute, which focuses on sexual orientation law.

The questions surrounding whether same-sex couples should be allowed to marry are significantly different from those involved in criminal prosecution of multiple marriages, Ms. Pizer noted. Same-sex couples are seeking merely to participate in the existing system of family law for married couples, she said, while “you’d have to restructure the family law system in a pretty fundamental way” to recognize polygamy.

Professor Turley called the one-thing-leads-to-another arguments “a bit of a constitutional canard,” and argued that removing criminal penalties for polygamy “will take society nowhere in particular.”

But this librul Edwards had You Know What with a woman that wasn’t even his wife. And she had a baby to boot. This is what you get when you have a Activist Court that won’t throw him in the slammer for about 30 years.

How so? By citing the opinion of a single law professor? Here (from a FOX article):

“The Utah Supreme Court upheld the law in 2006 as part of an appeal of a polygamist police officer’s 2003 conviction on bigamy and child sex charges. The case began as an investigation into the child sex allegations.
In a dissenting opinion, the chief justice agreed that Utah unfairly applied its bigamy law to polygamists and that it “oversteps the lines protecting the free exercise of religion and the privacy of intimate, personal relationships between consenting adults.”
Some scholars say polygamy should be decriminalized not just on First Amendment or privacy grounds, but because it would help society better regulate families.
Victims of abuse, which some believe is inherent in plural communities, might feel more comfortable seeking assistance if they don’t also fear prosecution, Lyndon State College anthropology professor Janet Bennion said.
“Laws that criminalize polygamy isolate and alienate … it’s not polygamy per se that leads to abuse, that can be present in monogamy,” Bennion said. “We really should allow more freedoms for any kind of alternative marriage.
“If we threaten polygamy, other forms will be threatened, such as gay and lesbian marriage,” she said.”

So when I meet a gay person I can only conclude that they did not “choose” to be that way since I didn’t choose to be the way I am. Jay never trusted Edwards; he seems to have had him sussed as a phony from the word go (i believe he’d interviewed the guy back in 2004 and wasn’t impressed).

During the primary battles of 2008, Edwards was the only populist running, and I actually early-voted for him in the primary. Not because I thought he had much of a shot, but I thought it would send a message to the corporatists (Hillary and Barack) who were leading in the polls at the time. Of course Edwards dropped out before Super Tuesday, somewhat shockingly at the time, of course now we know why.

I guess I wouldn’t go as far as Roy Barnes in my assessment of this very flawed individual, but obviously I’m pretty pissed off that Edwards put himself in a position where, had he managed to win the nomination, he would’ve been destroyed by what McCain’s team surely would’ve found out.

He’s still fairly young, plenty of time to redeem himself as a human being. Hope he stays hell and gone from politics, and sticks to advocating for the people he claimed to care about, four years ago.

“If all states acknowledged civil unions as legal for man\woman, man\man, woman\woman – could we then leave the definition of marriage as it’s always been – between one man and one woman?”

No. Because that would mean rewriting the entirety of all laws pertaining to marriage that are currently on the books. It’s easier, quicker, and cheaper to just define marriage as a legal contract between two consenting adults. Then all of those laws would apply to all legal marriages.
