Tom Goldstein, a veteran litigator before the U.S. Supreme Court and publisher of ScotusBlog, listened to the morning’s argument over the ObamaCare mandate and posted the following assessment:
“Towards the end of the argument the most important question was Justice Kennedy’s. After pressing the government with great questions Kennedy raised the possibility that the plaintiffs were right that the mandate was a unique effort to force people into commerce to subsidize health insurance but the insurance market may be unique enough to justify that unusual treatment. But he didn’t overtly embrace that. It will be close. Very close.”
I know firsthand that trying to discern a judge’s mindset based on the questions that he or she asks is tricky business at best. The judge may be asking tough questions of one side merely to hone his or her own later arguments in support of that side.
For example, consider the divergence between two witnesses to the discussion, first from Lyle Denniston, also of ScotusBlog:
If Justice Anthony M. Kennedy can locate a limiting principle in the federal government’s defense of the new individual health insurance mandate, or can think of one on his own, the mandate may well survive. If he does, he may take Chief Justice John G. Roberts, Jr., along with him. But if he does not, the mandate is gone. That is where Tuesday’s argument wound up — with Kennedy, after first displaying a very deep skepticism, leaving the impression that he might yet be the mandate’s savior.
Meanwhile, Jeffrey Toobin of CNN concludes from the questioning that Kennedy is “a lost cause” for the Obama administration:
“This was a train wreck for the Obama administration. This law looks like it’s going to be struck down. I’m telling you, all of the predictions including mine that the justices would not have a problem with this law were wrong… if I had to bet today I would bet that this court is going to strike down the individual mandate.”

I’m sure that’s been the first reaction. How about factoring in your buddy’s business competition? do those competitors not also have employees to cover?
I’m not saying legislation like this is without disruptions; nor am I a fan of having businesses subsidize health insurance (I’d much rather we had a single payer that had reasonable monthly premiums for all of us) But without knowing the details, it’s kind of hard to put much credence in such objections as your friend’s.

If the mandates are upheld, it will be a big victory for the insurance industry, and those in favor of health care continued to be controlled by them. The mandates were an idea from the conservatives, Newt, Mitt and the Heritage Foundation as an alternative to government managed health care.

Why Clarence thomas doesn’t ask questions? When your mind is made up you may become confused by facts.
In practice, as has been posted, probably both sides are pretty well decided, and that’s why Kennedy is always the swing vote ( Sandra O’Connor’s former role). They could always limit it to this particular situation. See Bush V. Gore, “This decision is not to be construed as applying to any other case.”
I know that the Republican “plan” is Paul Ryan’s $6000 voucher. What I don’t ever hear is if that plan includes provisions that 1) all insurance companies must accept your voucher, and 2) that that voucher will cover medical expenses exactly the way Medicare does now. Otherwise, it’s written on toilet paper.

No, not really. He is a “small business” with about 250 employees. Some he offers healthcare to, some he doesn’t. He competes against much larger companies. These much larger companies were able to make the payoffs to get the “exemptions” from the law that he wasn’t able to get. bottom line, his competition doesn’t have to pay the extra $500,000 per year but he does. That not only has him working for free, but actually has him PAYING a couple 100 grand a year for the right to work and own a company.

Sad part of the entire process is the back office deals and the opaqueness surrounding the passage. We favor all or nothing deals as well as immediacy. In 2008 Pelosi was holding up a 50 page loan document saying no one could understand it. In 2010 Pelosi was holding up a 2,500 page Obamacare document saying pass it so that we could read it.
The whole thing is a cluster f. Pick the top 3-5 items that need changing and start changing the items. Bend the cost curve 2-3% a year for 5 years.

Interestingly I saw an interview last night with one of Zimmerman’s best friends a black man who looked to be in his 40s. The man said not only did Zimm have no history of racism being a Hispanic man but that Zimm and his wife both had done volunteer tutuoring on Saturdays and Sundays to guess who?- mostly minority, mostly black students. Didn’t stop the liberals on here from screaming racism though before getting a fuller picture of the man.

I’m only aware of exemptions being made to employers who were already offering insurance to their employees; that the exemption was from some of the filing / paperwork requirements.

One reason I’m for the indivdual mandate. As long as ER’s are forced to treat folks everyone needs insurance. Otherwise those costs are passed onto those who already have insurance. I’ve heard various reports that it costs about $1,000.00 to a family – that is what you pay because others will not purchase insurance.

I have no idea who most Roman Catholics vote for clown. I didn’t know there was such an office as clown. Just like I didn’t know that Rick Santorum was a Democrat.

Taking out the individual mandate shouldn’t be a problem for liberals. Obama promised that if anyone likes their present insurance they can keep it. Unless of course he didn’t really mean it.
