Judge soundly rejects Ga. birther claims

Deputy Chief Judge Michael Malihi has rendered his judgment, breaking birther hearts all over the country: Barack Obama will remain on the 2012 primary and general election ballot in Georgia.

The judge’s written opinion
all but drips with scorn for the absurd case presented to him by Orly Taitz and her colleagues:

“The Court finds the testimony of the witnesses, as well as the exhibits tendered, to be of little, if any, probative value, and thus wholly insufficient to support plaintiffs’ allegations…. None of the testifying witnesses offered persuasive testimony. Moreover, the Court finds that none of the written submissions tendered by plaintiffs have probative value. Given the unsatisfactory evidence presented by the plaintiffs, the court concludes the plaintiffs’ claims are not persuasive.”

In other words, the birthers finally got a judge to listen to their “evidence,” and even with no opposing counsel in the courtroom, the judge concluded that their case was total and complete bunk.

Cue the caterwauling ….

That’s a mealy-mouthed whine. No matter what he would have done “ordinarily,” this was no ordinary case. He was forced to make clear in his decision that not only the testimony but also the submissions of the plaintiffs were wholly without merit. He knew what was in this case. No way would he have given a pass to these worthless claims.

Arthur, I think the ALJ was giving them that language. Even if Obama did not show they still had to make some presentation of proof…. and they failed that. If they had claimed Obama is from Mars and Obama does not defend, that does not mean they are entitled to a verdict that Obama is from Mars. They would still have to show some evidence to support their claim….. and in this case they could not even meet that low threshold on the birth certificate.

Oh, I agree. The birthers have been saying all along that what Malihi offered them was a kind of automatic win, and I’ve been seeing that as a misinterpretation of the Georgia Administrative Code.

Nevertheless, I see Malihi’s reference to it here as a wink in that direction, implying that he was pissed enough at Jablonski to punish him with a loss, but I think he’s bluffing.

These “lawyers” may be the biggest incompetents on the face of the planet. Imagine a football team that had a default because the other side failed to show, insisted on playing anyway, then managed to score an own goal. That’s these idiots.

This is the best opportunity birthers ever had to put on all their “evidence,” without anyone on the other side, and even then they bungle it. What a bunch of fools.

Speaking of the Komen fiasco, it occurred to me that given the close relationship that organization appeared to enjoy with the NFL, that the upcoming Super Bowl might have been one of the actors playing into their reversal of their earlier decision.

Given that the NFL will already be facing protests over the weekend over union-busting Indiana governor Mitch Daniels’ recent despicable actions, maybe it was felt that yet another questionable political firestorm hanging over the festivities was bad for image. Might be a stretch, but I wonder if there wasn’t a connection there.

While it took us 123 years to actually find out that Chester Aurthur wasn’t a natural born Citizen, it will probably take us another 123 years to get our birthright back from this decision. But for now, I will have to concede, candidate Barack Obama is qualified to take the oath of office of President.of the United States under the present ruling.

And, as a result of this ruling, Mitt Romney is also qualified, as is Sen. Marco Rubio and the others, and the political parties will continue to vet their own presidential candidates and not the states for the foreseeable future.

I am sure with Sen. Rubio on the ticket as vice-president, the right side will win this upcoming election and we can take up the issue of Wong Kim Ark at another time.

Legal Liberty Foundation (some of the attorneys in this case) has posted this: Georgia ruled and it’s not good. Judge Malihi found Wong Kim Ark to be the deciding standard. That means anyone can fly over to the U.S. have a baby and fly back to another country, raise their kid there and when that kid moves back to the U.S. he or she can run for President. We’ll post more and send out a message tomorrow.

“Many of us who are biblical scholars have watched Mr. Obama’s use, or should I say abuse, of the Bible with dismay.

Who can forget when he gave a speech mocking the ceremonial law of the Old Testament then saying something to the effect of, “How can you govern by the Sermon on the Mount?”

Well, he did it again at the National Prayer Breakfast. I never understood that name since very little prayer, if any, takes place. Instead, perhaps it should be called the National Breakfast Gathering.

The president quoted the Bible to justify punishing those who have worked hard, and most of whom are very generous givers, in order to take their money and give it to many of his constituencies who are always standing outside the doors of the White House with out-stretched hands.

Mr. Obama, in justifying his misguided policy, quoted Jesus in Luke 12:48: 
“From everyone who has been given much, much will be demanded; and from the one who has been entrusted with much, much more will be asked.”

No, you do not have to have a seminary degree to know that Jesus is talking about individual stewardship in an individual’s relationship with God.

For it is God who gives each person different portions of gifts, talents, and treasure to manage according to His sovereign will. It is God who entrusts people with what they have, not the government.

God is the One who will judge the faithfulness of each individual’s stewardship and blessing, or lack thereof. In Luke 12:48, Jesus, God the Son, is exhorting individuals to be faithful and give generously without regret.

Understanding this, one has to wonder if Mr. Obama has replaced God with his administration. He must believe that when he says “much is given,” he refers to what is given by the government, and “much is demanded,” as that which is demanded by the government. This is 180° opposite to the truth.

This is a very dangerous precedent. We have had egotistical presidents before, from both political spectrums, but never to my knowledge have we had one who saw himself as replacing God, or one who views his administration as acting on God’s behalf or instead of God.

Misquoting the Scripture is a common practice by some politicians to advance their cause, but this abuse of the Scripture and viewing one’s administration as the judge and executioner, not for crimes, but for personal stewardship, has reached a new low in egotism.

Mr. Obama needs to issue an immediate and urgent apology for his misuse and mangling of the Scripture.”

We’ve had this exchange several times. I had my doubts in the beginning because they were so secretive about releasing documents. They could have saved themselves a lot of trouble early on.

As a matter of fact, Romney did just that by releasing his tax returns. To have kept them secret for months would have been bad for his campaign.

After Chster Arthur was nominated for Vice President in 1880, his political opponents suggested that he might be constitutionally ineligible to hold that office.

A New York attorney, Arthur P. Hinman, apparently hired by his opponents, explored rumors of Arthur’s foreign birth. Hinman initially alleged that Arthur was born in Ireland and did not come to the United States until he was fourteen years old, which would make him ineligible for the Vice Presidency under the United States Constitution’s natural-born citizen clause.

When that story DID NOT TAKE ROOT, Hinman spread a new rumor that Arthur was born in Canada, BUT THIS CLAIM ALSO FAILED TO GAIN CREDENCE.

Scout, deny your birther roots all you want but remember that despite your repeated false accusations that the President released the lawful document before he was elected. Then after you lost that one and until recently you argued the “natural born” clause required 2 US citizen parents…… Each time you failed to mount a credible argument, each time you suffered defeat and then you blame the other side.

As for Mittens, we have only seen the cleaned up years….. where are the prior years? what is he hiding Scout? Unlawful activity overseas? Better look at Form 23 and 26 when they come out. :D
