Americans had the option of ignoring court subpoenas?

It is not a COURT subpoena. It is a hearing agency subpoena and different rules apply. These are often the nuances that are not understood by the general public reading from newspaper accounts without the complete details and training. But if you want to be fully informed….OSAH is your friend. It even has videos for the reading disinclined.

Why did you not report on the cases of the first two plaintiffs? They are not arguing BHO’s citizenship status, they are arguing that he was not eligible to be POTUS due to not being a natural born citizen, as both of his parents were not citizens.

That said. the documentation questions that Orly Taitz’s witnesses are bringing up certainly are interesting. Why haven’t we heard about these documentation problems much from the AJC?

The court is subpoenaing *candidate* Obama.

No, they are subpoenaing President Obama. He is the President, the head of the Executive branch, the branch that would be responsible for enforcing the subpoena, which means it can’t be enforced without his consent.

And if you go with the tortured “logic” that it’s only about his 2012 ballot qualifications, then you are ignoring that if the ballot qualifications are found wanting that would invalidate his position as President, so it’s really all about the latter.

I have a question for you, though. Don’t the parties have to certify that the candidate is eligible? (I think I saw forms signed by the Democrat party to that effect. Nancy Pelosi changed the form — it’s different in HI from the lower 48, so that the DNC didn’t have to state that Obama was eligible according to election laws but according to party laws.)

If, for example, the Georgia Republican Party put up, for the sake of argument, a native Cuban, wouldn’t there be some legal ability to stop it?

The main issue you hear about from Democrats is the tax issue, the 1% vs the 99%.

I was out with some friends last night, a close friend of mine who is a Democrat made roughly 38K in 2011. He just did his taxes and after his deductions he paid virtually zero federal income tax, he received a refund of over $4000. He asked why there is so much talk about the rich not paying enough taxes? He asked how is the system unfair if he paid almost nothing in federal income tax?

The whole Democrat stategy of making people think the tax system is unfair to the 99% is a pathetic joke.

I do wonder what Democrats think will be different when a guy like Mitt Romney pays 5-10% higher in taxes, do they really think that’s going to change their lives?? For this issue to generate so many headlines you would think it would actually have an impact on the 99%. Why do Democrats waste their time?

You mentioned Mitt’s father being born in Mexico. But he was a U.S. Citizen – otherwise, I don’t think he’d have been Governor of Michigan. Mr. Obama Sr. was never a U.S. Citizen.

The birther point is that an NBC has to have a U.S. Citizen for both parents. I don’t know the answer to this, but I do hope the Supreme Court does rule on it someday to clear it up.

There are other nit-picky legal issues, like Mr. Obama qualifying for aid as a foreign student. Some people suspect this as a reason he won’t release his college papers. His mother renamed him Soebarkah Soetoro when he was in Indonesia — there are just weird things.

This is all semantics, but some of the things look strange.

That was a good article, published in November 2011, so it’s a fairly new official source.

I don’t think that Obama has any foreign influences like the original framers were concerned about, which is why I also think it’s a fairly technical point for us today.The article states that “there is no Supreme Court case which has ruled specifically on the presidential eligibility requirements (although several cases have addressed the term natural born citizen), and this clause has been the subject of several legal and historical treatises over the years, as well as more recent litigation.”

All I am saying is that a ruling would be beneficial. I don’t know why that makes me a “fool” as per commenter mm, when smarter people than I who have written scholarly articles have said it’s not a frivolous issue.

Your point is a good one, but it is my understanding that once individuals are elected to the Senate, they are granted secret clearance and a background check would not be performed. So, unless I am mistaken, any background check would have taken place prior to his having taken office as Senator.

The requirements for the Senate differ from those for the Presidency.

For expediency’ sake, I’ll quote Google:

“Article I, Section 3 of the Constitution sets three qualifications for senators: 1) each senator must be at least 30 years old, 2) must have been a citizen of the United States for at least the past nine years, and 3) must be (at the time of the election) an inhabitant of the state he or she seeks to represent.”

Murdoch: Romney’s Tax Returns May ‘Kill’ Him

Rupert Murdoch, the conservative media mogul who owns Fox News, tweeted Wednesday that the release of Mitt Romney’s tax returns could “kill” his candidacy.

“Romney’s tax returns might kill his chances. See Republican establishment panic now!” Murdoch tweeted.

The former Massachusetts governor remains in a thorny political situation. He made more than $20 million income last year and paid only about 14 percent in income taxes.

But Romney’s own tax plan has called for all Americans to pay a minimum 25 percent tax.

Newt Gingrich’s plan, however, calls for a flat 15 percent income tax for all Americans. Gingrich has mocked Romney’s plan, saying that Romney wants Americans to pay more in tax than he himself does.

Romney’s campaign is reeling.

Murdoch’s Wall Street Journal reported this week that Romney’s posture suggests that his wealth embarrasses him.

The Journal reported that Romney is thinking of scrapping the so-called “carried interest” provision that has allowed Romney and other venture capitalists to invest and reap profits at the low capital gains tax rate of 15 percent.

If “carried interest” were scrapped, rates on venture investments could be taxed at normal income rates.

Gingrich, for his part, says Romney’s plan is folly. Gingrich has argued he would cut capital gains taxes across the board to zero to stimulate investment and create new jobs.

Romney appears in a box. Shamed by his low tax rates, he is calling for higher taxes for everyone else. As Politico put it, “Mr. Romney remains in a defensive crouch, as if he’s embarrassed by his wealth.”

The Supreme Court already has ruled on this. A little case known as US v Wong Kim Ark. An American born in San Francisco to two Chinese Nationals parents. At the time, Chinese could not become naturalized citizens (due the Chinese Exclusion Act). He was prevented from returning the US (from China) because the US claimed he was not a citizen. The Supreme Court went on to define what Natural Born Citizen was, and also ruled that Wong Kim Ark was a citizen because of his birth. that his parents citizenship was not a factor in his citizenship status.

This case has been cited more than a 1000 times in other cases on citizenship.

I have to produce tons of documents for everything under the sun. Now they are talking in NY about having kids give a DNA sample before taking the SATs. There are serious questions about the legitimacy of the president’s qualifications for the office of president and nothing he has produced so far has aleviated those questions/concerns. His contempt and disdain for the constitution are evident from his behavior in office over the past 3 years. It is imperative that this question be answered once and for all and I applaud this judge for having the balls (even if a woman) to actually stick to principles and demand answers. Most of america doesn’t give a damn about the constitution, liberty, freedom, or the rule of law if the ends can justify the means. That is why the judicial branch was supposed to hold the politicians to the law. It is about time that is happening.

And by the way, I think that Bush was an unconstitutional war criminal too, so this is not about left/right, republican/democrat. I actually respect the constitution and want to see every past president tried and convicted for their crimes against it and all of the international laws they have violated (yes, virtually every one of them).

I make no claims, with regard to Hawaii’s records. I merely stated that the copy of the birth certificate on the White House website is far from a photocopy and has been photoshopped on a Mac.

Why? I have absolutely no idea.

Is Obama a ‘Natural Born’ citizen? That is for the courts to decide.

Was Obama born in the United States? The burden of proof resides with the plaintiffs.

Is the document on the White House website heavily doctored up? Absolutely. And, concerning my original point, I can’t imagine for the life of me why anyone would doctor up a file of such huge importance.

I’m no ‘birther’, just an inherently curious person. So I checked out the birth certificate and wound up with more questions than answers.

Unless you’d like to present your hard-and-fast EVIDENCE that they are not, then your concerns and suspicions are irrelevant.

Ingredients
16 pieces of crow breast meat (no bones) (8 crows)
16 pieces of green pepper
16 cherry tomatoes
8 button mushrooms
8 ears of sweet corn
1 1/2 cups of Teriyaki sauce
1/2 cup melted butter
8 kabob skewers
Preparation
Cut each piece of crow in half and place in a covered bowl with the Teriyaki sauce over night. Clean and cut each ear of corn into 3 pieces. Cook in boiling salt water for 10 minutes. Alternately put corn (3 pieces), green peppers (3 pieces) and cherry tomatoes (3) along with 4 pieces of crow meat on each skewer. Use 1 mushroom to top each skewer. Brush with melted butter and place on preheated grill for about 4 minutes. Flip, butter again and place back on grill for another 4 minutes. Repeat one last time for a total of 12 minutes or until they appear done. Serves four adults.

No. First, there has been plenty of discussion about why a scanned document may have layers. But please listen carefully: The scanned PDF was provided for the public. Any “analysis” of the PDF is completely irrelevant, because the paper document was provided for the campaign, before the 2008 election. The state of Hawaii, through various officials, has stated numerous times that he was born in Hawaii, and the original document exists. They even allowed President Obama to receive a copy of that “long-form” certificate onto security paper, at his request.

Tell me, since the state of Hawaii has certified that he was born there and provided two certified birth certificates, what would be the reason to forge the irrelevant online version? There is none.

@Scott, because there is and never has been any proof Obama’s used anything but his own SSN. The Search that Oily continues to bring up was done with no controls, no testing and no verification. Any computer person can tell you general searches like that will bring you a whole bunch of garbage. That’s why it’s not front page news, but a running joke.

Now you understand why I had more questions than answers. Since, until today, I had seen no discussion whatsoever on the document’s multiple layers, having only downloaded the birth certificate two days ago. I haven’t followed this issue. So, if the argument is that I have been ignorant, then I’m guilty as charged.

Now that’s just the kind of feedback I was looking for! Perfect. While you might all think I”m a birther, I really just stated an observation. What’s more, you’ve won me over on this. I care little about the other issues in the case, just what I found on my own laptop, with a Python script.
I had some grave concerns, when I first ran the script, but I think I can safely say, case closed.

Certaintly that is some standards there. So in your inexpert opinion you raise “questions” that need to be addressed despite state certification and a number of actual court cases but a link to another webpage that apparently has information from someone with more information about a computer program suffices to resolve all your serious questions and it gets an Emily Latella “nevermind”. Geniuses I tell ya!

1) So what if he was born to a Kenyan Father? Chester A Arthur was born to an Irish father.

2) nothing in the Constitution says what you can’t be to be the President. Only what you have to be. Dual citizens are not excluded from qualifying to be President. No law supports this claim. US v Wong Kim Ark already dealt with this.

4) Wrong. many dual citizens don’t even realize they are dual citizens. And many nations require that you submit an application to be RECOGNIZED as a citizen of that country (not apply for it). If you have an Irish born Grandfather, or a Italian born father, yet they are both citizens of the US, you are an Irish citizen or an Italian citizen.

5) No, its not pretty obvious, because 200 years of legal history has shown us that by being born on US soil makes you a natural born citizen (otherwise we woldn’t have the nutcases who hate illegal immigrants cry about anchor babies)

6) Hawaii disagrees since they provided Obama with a paper official document of his COLB. That would be used as evidence. Not an image on the net, studied by fake experts.

That often seems to be the reason island folks come to the mainland; better pay and lower cost of living. Just bear in mind that you’re probably not going to find any place that knows how to prepare island specialties like saimin, spam musubi and manapua. No okazuyas around here. However, if you can find a good BBQ place with decent macaroni or potato salad, you can come up with a reasonable facsimile of a plate lunch.

I missed sweet tea the whole time I was living out there, but now I miss Hawaiian-grown pineapple. No other pineapple is as sweet, IMO.

I don’t recall the specifics, but I seem to recall that she followed some non-traditional means of being admitted to the bar; something that didn’t require a formal law school education, but which is very restricted in the US. Do we have any attorneys in here today who can speak knowledgeably on that topic?
