I’m in the courtroom of Judge Michael Malihi, awaiting arguments in a case attempting to remove Barack Obama from the 2012 Georgia presidential ballot.
Roughly 100 people are in the courtroom, most of them older white Americans. The conversations are thick with various birthed theories being bandied about.
Dressed tastefully in black and wearing a pearl choker, The redoubtable Orly Taitz swept in a few minutes ago, making a star’s entrance amid whispers of “look, there she is!”
A bailiff has summoned attorneys for the plaintiffs and defendants into chambers for a pre-hearing conference. Since the Obama camp has decided to boycott the hearing, only the four plaintiffs’ attorneys, including Taitz, are in the session.
The plaintiffs have queued up a number of exhibits, including CBS and ABC videos reporting on Obama’s time in Indonesia. No sign of whether such exhibits will be allowed.

The main issue you hear about from Democrats is the tax issue, the 1% vs the 99%.
I was out with some friends last night, a close friend of mine who is a Democrat made roughly 38K in 2011. He just did his taxes and after his deductions he paid virtually zero federal income tax, he received a refund of over $4000. He asked why there is so much talk about the rich not paying enough taxes? He asked how is the system unfair if he paid almost nothing in federal income tax?
The whole Democrat stategy of making people think the tax system is unfair to the 99% is a pathetic joke.
I do wonder what Democrats think will be different when a guy like Mitt Romney pays 5-10% higher in taxes, do they really think that’s going to change their lives?? For this issue to generate so many headlines you would think it would actually have an impact on the 99%. Why do Democrats waste their time?

The Constitution is interpreted by the entire judicial branch, however the Supreme Court is the ultimate decided. However you are aware that we have had Presidents who’s parents where not born in the US before? And Mitt’s father was born in Mexico, is Mitt natural born?

I saw the proceedings online. The testimonies were kept to a minimum. Perhaps much more evidence were submitted in writing. The Judge, in a few instances, intervened to speed along the witnesses and asked why evidence was relevant. Orly Taitz called herself as a witness at one point to tell of evidence she discovered personally.
Of course all this has political overtones and one wonders if the Judges and Politicians involved can truly separate themselves and rule according to law and nothing but the law.

You mentioned Mitt’s father being born in Mexico. But he was a U.S. Citizen – otherwise, I don’t think he’d have been Governor of Michigan. Mr. Obama Sr. was never a U.S. Citizen.
The birther point is that an NBC has to have a U.S. Citizen for both parents. I don’t know the answer to this, but I do hope the Supreme Court does rule on it someday to clear it up.
There are other nit-picky legal issues, like Mr. Obama qualifying for aid as a foreign student. Some people suspect this as a reason he won’t release his college papers. His mother renamed him Soebarkah Soetoro when he was in Indonesia — there are just weird things.
This is all semantics, but some of the things look strange.

Rather than providing us with slanted commentary, concerning Ms. Taitz’ unprofessional behavior, could you please provide some objective feedback, with regard to the content of the testimony?
I myself downloaded the birth certificate off the white house website and extracted data from the .pdf, using a simple Python script. Furthermore, I also confirm that the .pdf was generated on a Mac and contains six layers which, as far as I am aware, would be impossible unless the image had been ‘Photoshopped’. In fact, all one has to do is zoom in on the image to see the distorted pixels underneath the central portion of the image.
I’m not saying that Obama is not a citizen, I’m saying that the .pdf has been doctored with almost absolute certainty. And that, in my mind, warrants investigation. Do you not agree?

That was a good article, published in November 2011, so it’s a fairly new official source.
I don’t think that Obama has any foreign influences like the original framers were concerned about, which is why I also think it’s a fairly technical point for us today.The article states that “there is no Supreme Court case which has ruled specifically on the presidential eligibility requirements (although several cases have addressed the term natural born citizen), and this clause has been the subject of several legal and historical treatises over the years, as well as more recent litigation.”
All I am saying is that a ruling would be beneficial. I don’t know why that makes me a “fool” as per commenter mm, when smarter people than I who have written scholarly articles have said it’s not a frivolous issue.

In the United States government, executive privilege is the power claimed by the President of the United States and other members of the executive branch to resist certain subpoenas and other interventions by the legislative and judicial branches of government. The concept of executive privilege is not mentioned explicitly in the United States Constitution, but the Supreme Court of the United States ruled it to be an element of the separation of powers doctrine, and/or derived from the supremacy of executive branch in its own area of Constitutional activity.
