Watchdog says Black Panther case handled correctly

From The Washington Post:

The Justice Department’s Office of Professional Responsibility (OPR) has concluded an investigation finding that politics played no role in the handling of the New Black Panther Party case, which sparked a racially charged political fight.

After reviewing thousands of pages of internal e-mails and notes and conducting 44 interviews with department staff members, the OPR reported that “department attorneys did not commit professional misconduct or exercise poor judgment” and that the voter-intimidation case against the Panthers was dismissed on “a good faith assessment of the law” and “not influenced by the race of the defendants.”

The OPR investigation was launched at the request of U.S. Rep. Lamar Smith, Republican of Texas and chairman of the House Judiciary Committee. Here’s the guts of its findings, as related in a letter to Smith from OPR Counsel Robin Ashton:

blackpanthers

In a sane world, that would be that. Unfortunately, we do not live in a sane world. We live in a world in which too many people have too much invested in feeling themselves the downtrodden victim of the black man to let this foolishness die.

Forde, a notorious nativist who moved to Arizona to start her own Minutemen militia, was accompanied by Jason Bush, a white supremacist who authorities suspect is a serial killer, and Albert Gaxiola, a local resident who served time in prison for drug dealing. The murder occured in May of 2009 and Forde, Bush and Gaxiola were arrested 12 days later and charged with first-degree murder, burglary and aggravated assault.

It is obvious that one of them is not……to add in another variable, I have read several articles that state intimidation is not a short term issue…….especially for those that live in the area………

And then this little trinket:

“In their sworn depositions, Mr. and Mrs. Counts stated that they had
not seen members of the New Black Panther Party at the polling site. In addition, both denied
speaking with anyone from the Republican Party about the Panthers. Further, Mr. Counts even
contended that he had never been interviewed by the Justice Department. His testimony on this
latter point was contradicted by his wife, however, who indicated that they each had been
interviewed by a team from the Federal Bureau of Investigation (FBI) and the Department of
Justice several months after the election”

The projected rise of debt to 87 percent of GDP under the President’s budget is worrisome. Economists Kenneth Rogoff and Carmen Reinhardt conducted research on the experience of several countries that carried high levels of debt. They found that countries with debts above 90 percent of GDP tended to grow more slowly than countries with lower levels of debt.

The Administration estimates that federal debt under the President’s policies would stabilize at 77 percent of GDP over the next 10 years. By contrast, the CBO does not expect debt to stabilize under the President’s policies. Although a full accounting of the differences will not be available until the CBO publishes its final analysis of the President’s budget next month, the differences likely stem from the fact that the CBO does not assume that the economy recovers as quickly as the Administration does. The CBO also makes different technical assumptions that can influence projections of the budgetary costs of President’s various initiatives.

In assessing the relative riskiness of debt, credit analysts tend to look at interest costs as a share of revenues. The CBO estimates that interest costs under the President’s budget will be 10 percent of federal revenues this year, which is well above the levels seen in several other AAA-rated countries. More worrisome, the CBO projects that interest costs will grow to more than 18 percent of revenues in 2018―just seven years from now. Some credit analysts believe that if interest costs were to reach that level, the United States could risk losing its AAA status. A ratings downgrade would make Treasury bonds and notes less attractive to investors and likely result in higher interest rates.

SELECTED REVENUE POLICIES IN THE PRESIDENT’S BUDGET

The most significant revenue policies in the President’s budget are:
• Permanent extension of tax cuts for families earning less than $250,000 and individuals earning less than $200,000; child credits; marriage-penalty relief; and lower rates on dividends and capital gains.

* Permanent indexing of the Alternative Minimum Tax (AMT) for inflation.
* An increase in the estate tax exemption to $3.5 million and a lowering of the top rate to 45 percent.
* A limit on the deductions that high-income filers can claim.

The permanent extension of the tax cuts (and the other provisions in the first bullet) represents the largest contributor to future deficits in the President’s budget. By the CBO’s estimates, it accounts for more than 75 percent of the total change in projected revenues over the next 10 years.

SELECTED SPENDING POLICIES IN THE PRESIDENT’S BUDGET

The President’s budget reduces programmatic spending by a modest amount over the next 10 years, but also reallocates funding among various programs. Some programs receive more funding compared to current law; other programs receive less. Over the next 10 years, the most significant changes are a:

* Freeze in Medicare’s payment rates for physicians .
* Extension/expansion of certain refundable tax credits .
* Increase in transportation funding.
* Reduction in funding for activities related to the wars in Afghanistan and Iraq .
* A five-year freeze in non-security discretionary spending.

Although annual funding for non-defense spending (known as non-defense discretionary spending) would fall by a cumulative total of about $600 billion over 10 years, most of the decline ($504 billion) would stem from a reclassification of some transportation spending from discretionary spending to mandatory spending.

understatement-

The CBO report confirms that we need to go beyond the policies outlined in the President’s budget in order to address our longer- term debt and deficits. The CBO projects that under the President’s policies, by 2021federal debt will climb to almost 90 percent of GDP. Without a change to current policies, debt is expected to grow even further.

The leading edge of the baby-boom generation turns 65 this year. Over the next decade and beyond, spending pressures on Social Security, Medicare and Medicaid will begin to mount, yet revenues will not keep pace. Failing to address the gap between spending and revenues could do great harm to our families, our businesses, and our economy in the years ahead.

Although any action on the budget must recognize the fragility of the current state of the economy, policymakers could significantly improve the outlook for the budget and economy by creating a credible plan to reduce the deficit gradually over time as the economy recovers.

The GAO’s simulations can also be used to gauge the magnitude of changes necessary to stabilize the debt. Under the more optimistic projections of the Extended Baseline scenario, in order to hold the public debt at its current level of 62 percent of total economic output through the end of the GAO’s projection period, taxes would immediately and permanently have to increase by almost 15 percent, spending would have to be slashed
permanently by 13 percent, or some combination of the two. Under the Alternative scenario, to stabilize the debt, taxes would need to increase by almost 54 percent, all non-interest spending would have to be decreased by 35 percent, or some combination of the two.

So I guess at the polling place where you vote there a guys hanging outside with black panther patches on their clothes and carrying batons? And you wouldn’t notice them? Needless to say you’ll never be called on the witness stand as an eye witness for anything.

SoCo 1:18 – it’s illegal to publicly advocate for a candidate or position within a certain distance of every polling place. they were clearly in violation of this.

I have not seen any information that stated the NBPP guys were explicitly campaigning for a particular candidate. I don’t see the clear violation if there is no proof.

The question is whether only minorities should have their rights protected, or everyone. Holder and his Justice Department seem to feel only minorities’ rights get protected, the rest of us just have to deal.

Jimmy

It was Bush’s Justice Dept that made the decision to drop the charges. I don’t see how or why Holder should take the rap for that. All persons should have their rights protected, but it’s obvious that minorities need additional help as they don’t have majority control to legislate their own protection.

if they had been “white panthers” instead, the ruling would have totally different, due to pressure from the media, sharpton/jackson and the “panthers” would be in prison.

“We live in a world in which too many people have too much invested in feeling themselves the downtrodden victim of the black man to let this foolishness die.”

So Pennsylvania voters scared away by shouting, club-wielding men who happen to be black, and who happen to be shouting “cracker” and “you are going to be ‘ruled’ by a black man!” ought not invest in those on-the-spot feelings of being downtrodden.

What if I stand with a club in front of you, Jay Bookman and effectively threaten you from the moment you leave your car, until the moment you enter your office? Would calling the cops be foolishness? Would their prosecution of me be justified?

Would it be acceptable for a white governor to pardon me because I am one of “his” people?

You’ll pardon the expression, but I hope Eric Holder “hangs” in disgrace before or after the next election when it becomes more widely known what he has done and what he is continuing to do. With him, it is a Martin Luther King Jr. feared, that justice DOES depend upon the color of ones skin.

And I’ll hope that you’ll keep the unjustifiable nonsense out of your columns in the future.
