The Obama administration has announced it will no longer try to defend Section 3 of the federal Defense of Marriage Act from lawsuits alleging the law is unconstitutional. (The law forbids the federal government from recognizing any marriage other than that between a man and a woman.)
The decision is big news, but probably not as big as some have suggested. In real terms, it probably doesn’t change much at all. As Attorney General Eric Holder noted in the announcement:
“Section 3 of DOMA will continue to remain in effect unless Congress repeals it or there is a final judicial finding that strikes it down, and the President has informed me that the Executive Branch will continue to enforce the law. But while both the wisdom and the legality of Section 3 of DOMA will continue to be the subject of both extensive litigation and public debate, this Administration will no longer assert its constitutionality in court.”
In other words, it’s still law, and despite concerns about constitutionality, the Obama administration will still honor it. Other parties, including members of Congress, are also still free to defend the law from constitutional challenges already underway in several federal court jurisdictions.
One of the constitutional issues at stake involves states rights. Marriage has always been regulated and defined by the states; the federal government, for example, does not issue marriage licenses, and nothing in the Constitution gives it the power to do so. The entire area of family law — marriage, divorce, child custody, etc., — has been a state responsibility.
Last year, a federal judge in Massachusetts — a Nixon appointee — ruled the law unconstitutional on just those grounds, citing the Tenth Amendment:
It is a fundamental principle underlying our federalist system of government that “[e]very law enacted by Congress must be based on one or more of its powers enumerated in the Constitution.” And, correspondingly, the Tenth Amendment provides that “[t]he powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” The division between state and federal powers delineated by the Constitution is not merely “formalistic.” Rather, the Tenth Amendment “leaves to the several States a residuary and inviolable sovereignty.” This reflects a founding principle of governance in this country, that “[s]tates are not mere political subdivision of the United States,” but rather sovereigns unto themselves.”

WELL IT’S ABOUT TIME! The Obama Administration obviously dropped its defense of DOMA, because from a Constitutional standpoint there is no defense! DOMA sets up differing legal standards for Gay and Straight couples. Because of DOMA, even Gay couples who are legally married in Iowa or Massachusetts are unrecognized by the federal government for the purposes of tax law and Social Security; obviously this violates the 14th Amendment. Also, such couples become “UN-married” if they move across state lines, so DOMA violates the “Full Faith & Credit” clause. Thank goodness DOMA’s days are finally numbered!

We’ve been through this before. There’s a whole lotta state/local code out there referring to marriage, spouses, etc., that’d have to be fixed.
While a part of me figures, why not just make all legal marriages “civil unions,” I think it’d be a lot simpler to just acknowledge that same-sexers make lifelong commitments that should be recognized as such.

The ACA will not be repealed.
The ACA’s Constitutional challenges will go to the Supreme Court, where it will be found to be Constitutional.
The WI protests will continue until the governor and Senate members agree to allow collective bargaining rights to remain. This will happen even if you fire them all (remember, if they’re fired, they have no reason NOT to set up camp and stay there).
Any outcomes that are the direct opposite of what I have laid out above are nothing more than far right wing wishful thinking.

Jay 3:26 correct, and indeed it has an obligation to defend the laws of this country,… unlike what he’s doing. I don’t care about this particular law. But I do care about the complete BS this President engages in. I’m sure its nothing new with this country.

Jay 3:27 – actually, I think there are agreements recognizing such things. A license is not a “contract” per se. A marriage is a contract that has to be recognized. A permit, as such, I don’t think has to be recognized, and as I said Drivers Licenses are recognized, if I remember correctly, via “pacts.”

No offense to your 3:54, but tax cuts were supposed to do that too. The tax rates have been lowered for over 10 years, yet the net +/- for jobs over that same time period is – to date. Spending cuts only takes money that would spent by the government for business with private and/or public run entities and cut the income for that business entity. When you cut a businesses income back, that does not create jobs.
Before you go all bat shiite crazy, I understand the reasons and logic for cutting government spending. I’m only talking about the reprecussions of those cutbacks. That money does not just disintegrate when it leaves possession of the government.

But this instance, I think it is only serving to piss off the masses who are not “public workers” and “union members”. Something is shifting in this country and it isn’t going to be pleasant for any of us. When taxpayer money has been provided to people in such quantities for such an extended period of time, they, like heroin addicts, have to go through withdrawal when their supply is cut off. Interesting case but the kicker is in the pipeline headed for the Supreme Court. This is the California Prop 8 case being marshalled by Ted Olson and David Boies.
Said Olson: “Our Constitution guarantees every American the right to be treated equally under the law. There is no right more fundamental than the right to marry the person that you love and to raise a family.”
I am sure the Court would like to avoid this case, but it is on the way.

On the subject of gay marriage, I’m one of those who think congress and state legislatures need to focus on other crap. Two men getting married or civil unionized will not affect what my wife and I do at home. I think that allowing gays to marry would actually improve marriage statistics and lower divorce rates. If you can live with the same person for 10+ years and you haven’t choked the sh*t out of each other, you can stay married forever.

If the states do not validate teh original contract of marriage there is no questionto be answered. They cannot get a divorce if the state never acknowledged their marriage. I would imagine teh court caase would be thrown out after the court was uable to show an actual marriage having taken place. And right or wrong if the state does not recognize the marriage what exactly would one be getting a divorce from?
Or are you speaking more to the splitting of shared property, and or alimony?
if so an arbitrator should be able to handle he procedure and thus it would not be a divorce.

Did anyone see the thing about Israel being attacked by rockets today? “Democracy” in the Middle East is how the mainstream media in the US initially heralded the happenings over there (including Jay). Now, they are mostly silent because they know they just may have “screwed the pooch” on that one. The Middle East is about to swing to Sharia law and we, as Americans, are not going to like that at all. Because of it, oil is about to skyrocket and gasoline is naturally going to follow. That is not the only result we won’t like but it is very important. That compiled with the inflationary “monetary easing” actions of Obama’s Fed are going to work out real well, don’t you think? How does $4.00 for a loaf of bread sound to you? And what is so laughable (if it wasn’t so pitiful), Obama and his EPA have placed such a regulatory burden on the US drilling for our own resources that even our children will be way worse off than ourselves because it would take about 10 years to get to 100% production and to make an impact even if he lifted them today.
$5.00/gal gasoline and bread at $3.50/loaf = Obama gone in 2012 and good riddance to bad rubbish. And even if he somehow won, which I doubt, he loses. Congress will be in the hands of the republicans after next November which means he would have to whip out his veto pen on every law which would result in nothing getting done. In Obama’s case, nothing getting done is far better than him having his way. Soros, Immelt and Stearn are his loyal advisors (and his masters) and no president could have a more unsavory bunch advising him. He is totally open to their advice which means he must believe that he, like them, believes that it is all about himself. Not what is best for the country. And that is all he has ever cared about.

2) In this case the judge and the 10th Amendment are right …….. leave it to the states.

4) In my opinion, the Supreme Court (after the appellate decision) will have to re-establish federal jurisdiction on this or their past (and future) abuse and ignoring of the 10th Amendment will be in doubt.
5) As a case in point, a knucklehead federal judge just ruled that “mental activity” (aka “thought”) is covered by the “Commerce Clause”.

Regarding our continuing debate on the meaning of the 10th Amendment, a Clinton appointee federal district court judge in Washington (a slave owner by the way) D.C. has ruled that Congress Can Regulate “MENTAL ACTIVITY (emphasis added)” Under Commerce Clause.

1) She should never have been appointed.
2) That reasoning under a plain reading of the 10th Amendment is idiotic.
3) That reasoning if upheld would make the 10th Amendment null and void.
4) Making an Amendment null and void without further amending it or abolishing it is Constitutional treason.

Basically it was to ensure we had legal rights in each others lives. We owned a house together, we had life insurance policies for each other…we were married in every aspect except under the law.
When mr. nonjewcowboy passed away, these documents allowed my to get his body back from Dubai…even to just to bury him. Without these documents, his next of kin would have automatically been his parents…who are great people…but when you devote your life to someone, you devote it through death as well.

Cons are in perpetual denial. They claim that the stimulus package hasn’t worked. Despite the fact that in less than two years’ time the prospects for U.S. growth look *much* improved, and are improving every day.
Would we all like to see more rapid reductions in unemployment and greater improvements in labor market conditions?
Of course.
But, under Obama the economy has gone from a nearly 7% rate of contraction to six straight quarters of growth, with a 3.2% rate of annualized GDP growth in the 4th Quarter of 2010.
There are record corporate profits. And job growth led entirely by the PRIVATE sector (not, as Republicans repeatedly assert, growth in the government sector). Banks have gone from bankruptcy to multi-billion dollar profits.
The Dow Jones has passed the 12,000 point threshold for the first time in 2 ½ years.
The International Monetary Fund released a report last week which upgraded its forecasts of growth for the American economy, and attributed the more optimistic assessment to the prudent fiscal policies of the Obama Administration.

Indiana Attorney General Greg Zoeller has dismissed a deputy, Jeff Cox, for posting inappropriate comments online critical of the labor union protesters in Wisconsin.
Cox sent out a message on his Twitter account saying that police should “use live ammunition” against the protesters.

Regarding our continuing debate on the meaning of the 10th Amendment, a Clinton appointee federal district court judge in Washington (a slave owner by the way) D.C. has ruled that Congress Can Regulate “MENTAL ACTIVITY (emphasis added)” Under Commerce Clause.
Now I submit to you the following:
1) She should never have been appointed.
2) That reasoning under a plain reading of the 10th Amendment is idiotic.
3) That reasoning if upheld would make the 10th Amendment null and void.

Del / Scout – the biggest problem opponents have for overturning the law is that…. it doesn’t say you have to buy insurance, only that you have to pay a fine / penalty / tax / fee if you don’t. That said, on its face, its still silly.

SoCo 7:59 that education stat was interesting. The only complicated one, with that, as with health care, is it needs to be normalized for demographics. But all things considered, pretty crummy.
For context though, since no one has kids in Europe, you don’t need to spend as much as a % of GDP on ed. Same with 1 child China. And the whole M.E., in contrast, should be spending 30% of GDP.

Revelations contains the only description of God. That description describes him of having hair like lamb’s wool and skin of bronze. Why is it that every picture of Jesus has long straight hair? That one’s always puzzled me. If Jesus was King of the Jews, the hair like lamb’s wool would be possible as I’ve met more than a few Jews coming from Israel that would fit that description.

Not only is it insulting, but as a single person, I end up paying much more in income tax than “married” couples. In reference to your post, I try to stay well informed, too, and like you, I don’t see how some folks have the time to research all the stuff they comment on. A lot of my beliefs, on a particular subject, are based on a working knowledge of the topic, but not in depth, expert knowledge, and just pure gut instinct. Like any human, I’m not infallible but I’ve found that my gut instinct usually gets me to the right decisions, in life.

The group appears to have a broad reach in Florida schools.
According to an interview the group’s founder and president gave to the American Family Association in 2003, her program was projected to reach “50,000 kids.” A post on Project SOS’ own website claims the group has reached nearly 300,000 Florida students since its founding.
Also troubling are Mullarkey’s ties to Ugandan pastor Martin Ssempa, a vocal advocate for that country’s 2009 “Anti Homosexuality Bill”, nicknamed the “Kill the Gays” law.

Compliment is greatly appreciated. I’m perfectly aware of my personal biases, and I try to tamp them down as much as possible if I’m trying to participate in a reasoned debate.
As far as the graphs and stuff, I was and still consider myself to be a nerd of sorts. I was the one in high school who knew all kinds of inane trivia. I’m always looking into different things for two reasons.
First one is sheer curiosity. I like to know how things work, how people think, and why people or things behave in the manners they do. My eventual goal is to retire on about 50 acres in the middle of nowhere and be completely off the map. I don’t want to have to depend on anyone for anything if possible. It’s not completely viable this date, but I still have a few decades before I retire.
Second, researching different things helps me at work. When someone tells me what kind of work they do, I can quiz them about their work and give them the impression that I know a great deal about what they do. In turn, it tends to cut down on the attempts to try to pass bs as legit info. I’ve been able to make a few cases by doing that. Hell, today alone, I gave a female lessons in how to make cucumber rolls when she owns a catering company and told me her best dish that she prepares is sushi. Yet, she had no clue as to how to make them.

1) Calling oneself a “Christian” does not make you one.
2) Being born a Muslim means you ARE a Muslim.
3) The difference in volume between the puny few you came up with (which I submit are probably false Christians anyway by their deeds) and the hundreds of thousands of atrocious crimes and degradation of women, and lashing girls to death, and cutting off of hands and feet and …………………………… well, you get the picture.
It’s sort of like comparing a couple of FBI agents who go astray vs. the Mafia.

40 acres is a quarter mile by a quarter mile, and that’s not nearly as big as it used to seem. So dream large; shoot for a full section (one mile square, 640 acres). You can always scale back, if need be.

Just a few: Dave R regularly does not actually have a real discussion with anyone, attacks whoever he can, and often tries to say he uses facts and no one else does. He also is on record as saying he knows everything. In reality he knows very little, and often uses data that doesn’t actually support his position (baseless conclusions). That’s, of course, assuming he even talks about the subject at hand at all.
Just a few thoughts, don’t know where you’ve come from, but you obviously like to throw out random bits of unrelated thoughts and make judgment calls about people you don’t have the foggiest idea about.
Talk about projection! Right here he described himself almost to a tee.

Very true. Except that I don’t have the fault of buying into the idea that I must never ever be wrong about anything, and even if I am, never admit it. That’s a ridiculous idea that actually many politicians seem to think, and it’s sad that one of the sheep here has bought into it.

It’s the strangest thing to me how the “Christian Nation” will glom onto a book like the Bible and most especially Revelations, and never try to educate ones self of other possibilities. Life is good for Normal. Went to the doctors yesterday and they took the braces off my knees. Pending insurance acceptance, in around ten days, they will shoot my knees full of new padding and after around five shots per knee, I will once again be able to chase Grand Babies around!
