The Obama administration has announced it will no longer try to defend Section 3 of the federal Defense of Marriage Act from lawsuits alleging the law is unconstitutional. (The law forbids the federal government from recognizing any marriage other than that between a man and a woman.)
The decision is big news, but probably not as big as some have suggested. In real terms, it probably doesn’t change much at all. As Attorney General Eric Holder noted in the announcement:
“Section 3 of DOMA will continue to remain in effect unless Congress repeals it or there is a final judicial finding that strikes it down, and the President has informed me that the Executive Branch will continue to enforce the law. But while both the wisdom and the legality of Section 3 of DOMA will continue to be the subject of both extensive litigation and public debate, this Administration will no longer assert its constitutionality in court.”
In other words, it’s still law, and despite concerns about constitutionality, the Obama administration will still honor it. Other parties, including members of Congress, are also still free to defend the law from constitutional challenges already underway in several federal court jurisdictions.
One of the constitutional issues at stake involves states rights. Marriage has always been regulated and defined by the states; the federal government, for example, does not issue marriage licenses, and nothing in the Constitution gives it the power to do so. The entire area of family law — marriage, divorce, child custody, etc., — has been a state responsibility.
Last year, a federal judge in Massachusetts — a Nixon appointee — ruled the law unconstitutional on just those grounds, citing the Tenth Amendment:
It is a fundamental principle underlying our federalist system of government that “[e]very law enacted by Congress must be based on one or more of its powers enumerated in the Constitution.” And, correspondingly, the Tenth Amendment provides that “[t]he powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” The division between state and federal powers delineated by the Constitution is not merely “formalistic.” Rather, the Tenth Amendment “leaves to the several States a residuary and inviolable sovereignty.” This reflects a founding principle of governance in this country, that “[s]tates are not mere political subdivision of the United States,” but rather sovereigns unto themselves.”
Despite their professed reverence for the Tenth Amendment — U.S. Rep. Phil Gingrey, you might recall, said “the very future of freedom and limited government depends (on it)” — I doubt many conservatives will find the judge’s logic convincing.

Seems to me people have just made up their minds on this issue and most of usunderstand nothing we say or do is going to influence or change the opinion of the “other” group.

Did anyone see the thing about Israel being attacked by rockets today? “Democracy” in the Middle East is how the mainstream media in the US initially heralded the happenings over there (including Jay). Now, they are mostly silent because they know they just may have “screwed the pooch” on that one. The Middle East is about to swing to Sharia law and we, as Americans, are not going to like that at all. Because of it, oil is about to skyrocket and gasoline is naturally going to follow. That is not the only result we won’t like but it is very important. That compiled with the inflationary “monetary easing” actions of Obama’s Fed are going to work out real well, don’t you think? How does $4.00 for a loaf of bread sound to you? And what is so laughable (if it wasn’t so pitiful), Obama and his EPA have placed such a regulatory burden on the US drilling for our own resources that even our children will be way worse off than ourselves because it would take about 10 years to get to 100% production and to make an impact even if he lifted them today.
$5.00/gal gasoline and bread at $3.50/loaf = Obama gone in 2012 and good riddance to bad rubbish. And even if he somehow won, which I doubt, he loses. Congress will be in the hands of the republicans after next November which means he would have to whip out his veto pen on every law which would result in nothing getting done. In Obama’s case, nothing getting done is far better than him having his way. Soros, Immelt and Stearn are his loyal advisors (and his masters) and no president could have a more unsavory bunch advising him. He is totally open to their advice which means he must believe that he, like them, believes that it is all about himself. Not what is best for the country. And that is all he has ever cared about.

1) This issue is so important I have always supported a Constitutional Amendment route.
2) In this case the judge and the 10th Amendment are right …….. leave it to the states.
3) However, one federal judge does not a Constitutional issue make or Obamacare is also out the window.
4) In my opinion, the Supreme Court (after the appellate decision) will have to re-establish federal jurisdiction on this or their past (and future) abuse and ignoring of the 10th Amendment will be in doubt.
5) As a case in point, a knucklehead federal judge just ruled that “mental activity” (aka “thought”) is covered by the “Commerce Clause”.

Regarding our continuing debate on the meaning of the 10th Amendment, a Clinton appointee federal district court judge in Washington (a slave owner by the way) D.C. has ruled that Congress Can Regulate “MENTAL ACTIVITY (emphasis added)” Under Commerce Clause.
Now I submit to you the following:
1) She should never have been appointed.
2) That reasoning under a plain reading of the 10th Amendment is idiotic.
3) That reasoning if upheld would make the 10th Amendment null and void.

Basically it was to ensure we had legal rights in each others lives. We owned a house together, we had life insurance policies for each other…we were married in every aspect except under the law.
When mr. nonjewcowboy passed away, these documents allowed my to get his body back from Dubai…even to just to bury him. Without these documents, his next of kin would have automatically been his parents…who are great people…but when you devote your life to someone, you devote it through death as well.

Today comes word that Georgia state Representative Bobby Franklin is shopping a bill that wouldn’t just make abortion illegal in Georgia, it would criminalize miscarriages to boot.
Georgia Republicans just refuse to be outdone. They are determined to hold their title of “Mostest Stupidest in the GOP.”

Cons are in perpetual denial. They claim that the stimulus package hasn’t worked. Despite the fact that in less than two years’ time the prospects for U.S. growth look *much* improved, and are improving every day.
Would we all like to see more rapid reductions in unemployment and greater improvements in labor market conditions?
Of course.
But, under Obama the economy has gone from a nearly 7% rate of contraction to six straight quarters of growth, with a 3.2% rate of annualized GDP growth in the 4th Quarter of 2010.
There are record corporate profits. And job growth led entirely by the PRIVATE sector (not, as Republicans repeatedly assert, growth in the government sector). Banks have gone from bankruptcy to multi-billion dollar profits.
The Dow Jones has passed the 12,000 point threshold for the first time in 2 ½ years.
The International Monetary Fund released a report last week which upgraded its forecasts of growth for the American economy, and attributed the more optimistic assessment to the prudent fiscal policies of the Obama Administration.

All sides admit that jobs are the No. 1 issue in 2010, but only three weeks before the crucial make-or-break congressional election on Nov. 2, Obama casually admitted that his claim last year that his stimulus spending bill would create 3.5 million “shovel-ready jobs” was not true.
Fox News played six video clips from different Obama speeches bragging that his $787 billion stimulus bill would create millions of “shovel-ready jobs.” Now, Obama admits that those things he talked about never existed.

Don’t know what to tell you…”shovel-ready projects” are real…they are a real term…and there is a concrete example of stimulus money being spent on one on Peachtree Road from Shadowlawn Road to Wieuca.
