Judge’s ruling on stem-cell research may politicize issue

According to a ruling Monday by U.S. District Court Judge Royce Lamberth, U.S. law forbids federal funding of any scientific research using human embryonic stem cells. The decision invalidates an executive order issued by President Obama shortly after taking office in 2009 that expanded federal support for such research, and for that reason was quickly applauded by the Family Research Council and other right-to-life groups.

In issuing a preliminary injunction against such funding, Lamberth cited a law dating back to 1996 that forbids federal funding of “research in which a human embryo or embryos are destroyed, discarded, or knowingly subjected to risk of injury or death.” Until now, that law had been read to prohibit federal funding for the actual creation of embryonic stem cell lines — which requires the destruction of an embryo — but not subsequent research into the use of those stem cells.

Had it been in effect at the time, Lamberth’s ruling would also have invalidated the stem-cell policy of President Bush, who limited federally funded stem-cell research to 21 already-existing embryonic cell lines. However, those lines also were created through the destruction of embryos, and by Lamberth’s logic were thus ineligible for federal funding.

Under Obama’s policy, stem cell lines could be derived only from embryos that had been created for use in fertility treatments and were no longer needed for that purpose. That safeguard was intended to prevent the creation of embryos for the sole purpose of destroying them. Those embryos also had to be “donated by the individuals who sought reproductive treatment . . . and who gave voluntary written consent for the human embryos to be used for research purposes.” It also barred any financial compensation or inducement for donating embryos for research.

Lamberth’s ruling dismisses those safeguards as meaningless.

According to The Washington Post, the decision has stunned much of the scientific community.

“This is devastating, absolutely devastating,” said Amy Comstock Rick, immediate past president of the Coalition for the Advancement of Medical Research, a group of patient organizations that has been lobbying for more federal funding.

“We were really looking forward to research finally moving forward with the full backing of the NIH. We were really looking forward to the next chapter when human embryonic stem cells could really be explored for their full potential. This really sets us back,” Rick said. “Every day we lose is another day lost for patients waiting for cures.”

“I have had to tell everyone in my lab that when they feed their cells tomorrow morning, they better use media that has not been funded by the federal government,” Dr. George Q. Daley, director of the stem cell transplantation program at Children’s Hospital Boston, told The New York Times. (”Media” refers to food given to cells). “This ruling means an immediate disruption of dozens of labs doing this work since the Obama administration made its order.”

It’s not clear whether Lamberth’s ruling will hold. Courts have the power to intervene in such matters only if the executive branch is clearly and unambiguously breaking the law. Three consecutive administrations have concluded otherwise, believing that research using stem cell lines can and should be distinguished from research using embryos.

And as a practical matter, it’s hard to see what right-to-life groups have gained in the ruling. A significant number of human embryos created in vitro for fertility treatments are destroyed or abandoned every day in this country. It’s an inevitable by-product of the process. The odds against any single embryo implanting in the womb are so high that large numbers of embryos have to be created in hopes that one or two will be successful. Once pregnancy is achieved, any leftover embryos are literally put into cold storage for possible future use, and many are left there until discarded.

The Obama administration will almost certainly appeal the ruling and seek to block the preliminary injunction, although no announcement to that effect has been made. It may also try to correct the problem through Congress, which would put the volatile issue in the political arena. If it takes that tack, the administration would seem to have public opinion on its side.

As the WSJ notes:

“A 2009 poll by Pew Forum on Religion and Public Life found 54% of adults think it’s more important to conduct the research that might result in medical cures vs. 32% who said it was more important not to destroy the potential life of a human embryo.”

Once again, Jay, stem cells come from three main sources, “unused” embryos being only one of the three. Umbilical cord blood and adult bone marrow are the other two. By not clarifying that, you are feeding into the false hysteria perpetuated during the Bush years that ALL stem cell research is being “blocked” in some way.

Thus far, the fetal stem cell research has yielded the fewest results, and raises what I consider to be valid objections to disrespecting the sanctity of life.

AmeVet, I get the gist of your post, but let’s not go deifying the medical research enterprise (big Pharm) anymore than the neo-cons like to deify fetuses. I honestly don’t know where I stand on this (family member with Parkinson’s), but as I said, cancer, spinal injuries, cancer, Parkinson’s and Alzheimer’s are part of life. do we want to place a “price” in life (you’re sick; how much you got?). the cynic in me dismisses the “pro-life” and the “let’s cure cancer” positions as more self-serving than altruistic. that said; the libertarian in me says; do all the research you want, just to ask me to pay (taxes). this whole obsession with “life” originates from the same place as Islamofacism (fear of the unknown, trying to insert gods and monsters into life).

I do not discount legitimate moral concerns, as is the case with abortion, death penalty, etc. But being a pragmatist, I see this issue as pretty much contrived.

As I freely acknowledge my lack of expertise in this matter, I am not concerned about looking foolish (Like I EVER am? LOL!)

The number one advantage of embryonic stem cell research is that they can be manipulated and grown into any type of cell in the human body. Unlike adult stem cells, embryonic cells contain the genetic information for every cell type. This means that scientists can use any cell to grow nerve, blood, tissue or other cells. The advantage to this is that scientists can see how and why a certain cell develops. This will aid them in understanding the differences between different cells and their full function within development and growth. According to the American Medical Association, there are approximately 215 clinics around the country that house an estimated 2.2 million human embryos. The majority of these embryos have no use and will be discarded unless research is conducted.

I cannot and will not argue the merits of one type of research over the other. My contention is simple, if ANY worthwhile and valuable research is available, there had better be a damn good reason to disallow it.

I simply don’t see that as being the case here…

Here’s another – the amount of money allocated for this research is chump change. $39Million.

Compare that with the corporate subsides and giveaways tor BIG Pharma and it is a joke.

MUCH of the research is done at publicly funded institutions of higher learning and then basically given away to these corporations.

Then Uncle Sam, after doing so, doesn’t even demand that BIG Pharma allow him decent pricing on the bounty they make.

Now that is where the consumers and taxpayers should be directing their wrath…

USinUK–I understand your feelings about “globs of cells”, and share them to some extent. I also sympathize with you regarding your sister’s condition. My objections to using “globs of cells” which are also developing humans for any other purpose other than to develop a human are more philosophical than practical. I believe that there are certain lines which shouldn’t be crossed however useful the results may be. The Nazis did a lot of medical experimentation on live humans which yielded a lot of good information. I still don’t think it was right.

I have a good friend who is an embryologist in NYC… what Jay said above is true… many (if not a MAJORITY) of fertilized eggs (embryos according to the “sanctity of life” crowd that supports the death penalty and munched popcorn while watching “shock and awe”) are discarded each and every single day.

If the “sanctity of life” cheerleaders cared about LIFE for the “already living”… they’d support embryonic stem cell research. Most of all…it’s pathetic how the Talbangelical crowd gets so up in arms about every baby being born from a fertilized egg…yet they are silent on the eggs fertilized and discarded via IVF)…it makes ZERO sense.

If a fertilized egg is a “human”…why is IVF okay? More fertilized eggs are “discarded” every year compared to the number of abortions performed…

Can’t have a baby? ADOPT one. Against abortion? ADOPT a child that needs a home instead of having the mother give birth and provide a crappy life for their child… Sad that those against abortion adopt so few… Palin’s little failed “project” Handel…spoke about all the money she spent..and years she spent trying to conceive (and some Evilgelicals called her “infertile”…NICE touch!)….yet I never heard her ONCE say that she wanted to ADOPT a child. Give a child who NEEDS a home one…

Prolife? Start working HARD and getting every single kid that NEEDS a home a GOOD home… get back to us when you’ve finished the job. Sanctity of “life” means giving a crap about the ALREADY born… not just embryos…

I’d like to see a lot more stem-cell research, myself…and I think that President Obama’s policy was a reasonable one. However:
1, The law is the law, and should be followed. If it’s a BAD law, as I believe this one is, it should be revised. (And revised by congress, not just by a federal judge wink-winking it away.) But until then, it is the law of the land and should be followed.
2. You’re right that this will politicize the issue, Jay…but it’s ALWAYS been politicized.

It may be splitting hairs somewhat, Am, but nothing is being “disallowed” in this case. Private research isn’t being limited in any way, the ruling only affects federal funding. In light of both the moral objections AND the lack of any productive results from fetal stem cell research, I’m ok with dropping federal funding. If there is any good to come from the research, then private companies can blaze the trail.

That’s a matter of opinion. I took a full course in embryology in college, and it’s amazing how quickly the organ systems develop. I don’t think we can make definitive judgments yet about whether the developing human is “sentient” or not. I personally believe that all living beings are sentient and worthy of respect, along the lines on Jainist philosophy.

For the record, I also oppose IVF. There are plenty enough children to adopt in the world that we don’t need to take such unnecessary, drastic measures.

That’s one issue we’ll agree upon Bruno…I too oppose IVF…but ONLY because of the failure of those who spend their money on it…who have the MEANS to spend the money on adoption..fail to do so. Let me ask of those who oppose abortion…WHY do you not picket and stand outside of IVF clinics in the same way you do abortion clinics? The “logic” of anti abortionists always come down to this: a “fertilized egg” is a “human”… yet millions of “fertilized eggs” are discarded via IVF. If anything…it makes the “argument” of the anti-abortionists quite weak… actually very weak.

Not to be snarky here, but wow, really? My incredibly limited understanding of Jainism is that they’re not just vegetarian, they take special steps to avoid killing insects while harvesting the veggies they do eat.

I’m not vegan, or vegetarian (or even all that picky about what kind of meat I do eat) but I do have kind of an awe for those who manage to tread that righteous path as part of an overall commitment to lessen suffering.

Given the government’s lack of oversight on so many issues, there’s no reason to believe they’d be any better at monitoring fertility clinics.

Don’t worry folks. China will probably do the stem cell research and discover the cures to mankind’s ailment’s and reap all the Nobel prizes. Meanwhile, while this country likes to rant about Islam’s proclivity for hanging on to Dark Ages notions, we have our own atavistic plunge into the Dark Ages going on right here in River City. Ah, who needs science anyway. And the way our kids are “educated” these days, they won’t be able to do any science, so it’s a moot point. It’s enough for us to have our kids study from those Texas “science” books and send them on field trips to the Creation Museum in Kentucky. They’ll be able to see the exhibits of caveman and dinosaurs together and the Tree of Knowledge there. That is a lot better than any stem cell research. And while we are at it, let’s stop all this NASA stuff. We”ll just hitch a ride with the Russians in their trusty Soyuz capsule if we want to do any space science. . We could also just wait for the Chinese to build their space station and exchange Us Treasury bonds for a ride up. I wonder if stem cell research is legal in outer space. And also, let’s stop the evolution versus creationist debate all together, and just go back to the three R’s – Reading (we rank number 23 in the world today by the way), Riting and Religion. With that curriculum, none of our kids will ever grow up wanting to be scientists and do stem cell research.

I have to say…I was “amazed” while there…the families… the kids…knowing those kids belonged to those families…and just WHAT they were being taught… AMAZING to see how it’s so easy to manipulate the mind of a child.

All that was missing was the Santa and Easter Bunny exhibit… where Santa, his elves, and the Easter bunny were playing cards together… sheeeesh!

AmVet–I know you’re not here to follow up, but I find this practice, along with all medical experimentation on live beings to be morally reprehensible. Particularly disturbing to me are the medical experiments done on primates. Emory University makes a pretty penny torturing primates, yet pats themselves on the back for supporting a host of liberal causes. Cosmetic companies along with others have caged and tortured rabbits. Pretty sick stuff, IMO.

The bottom line is that God has already shown us the way to a healthy life. Trying to patch things up with drugs after living a horrendous lifestyle comes across as stupid to me.

This is TOO funny… how this how NOW become a thread of what different gnanimals taste like!

Anyway..to each their own…if you asked ANYONE I grew up with (most of all my parents)…if i’d have been a veggie…and then a vegan…they would have pee’d themselves…that includes myself! Trust me…I was the “grill king”… how it happened…I’m not sure…but my heart simply went in that direction after seeing some things about just HOW we treat animals as “commodities” instead of seeing them as living beings.

That’s just me. Enjoy. Not here to “convince” anyone who is right or wrong on this issue. I KNOW I’m FAR down the totem pole when it comes to my own choice and lifestyle. But I will never ask ANY of you to “convert” and become a veggie and/or vegan. I made my bed and I sleep comfortably in it.

I loved the recent HBO movie about Temple Grandin, the autistic woman who, because of her unique perspective, invented a more “humane” way to slaughter cows. As appalling as it is to slaughter them, before she championed on their behalf, it was much more brutal. “Nature is cruel, but we don’t have to be.” Her methods were adopted for their cost value, but they are undeniably better than what the cattle experienced before.

I’m curious as to where you got that Clayton County information from – if anything it proves my earlier point that they lost accreditation because they failed to meet SACS standards — that information you posted says nothing about the groups mentioned and the information is suspect because it says that there was a conflict of interest in a board member was a member of a teacher union – so to me that says, that whoever supplied that information you posted doesn’t know what they are talking about.

It mentions administration incompetence, that has nothing to do with the professional organizations you mentioned earlier — and unless it specifically mentions them in the actual report, your speculations mean nothing.

(CNN) — Zemco Industries in Buffalo, New York, has recalled approximately 380,000 pounds of deli meat that may be contaminated with bacteria that can cause a potentially fatal disease, the U.S. Department of Agriculture announced Monday.

The products were distributed to Wal-Marts nationwide, according to the USDA’s website.

The meats may be contaminated with Listeria monocytogenes, which was discovered in a retail sample collected by inspectors in Georgia. The USDA has received no reports of illnesses associated with the meats.

IH–Great point, but I should have mentioned that I’m not investing right now for any long haul, I’m just trying to make a few quick bucks. In looking at the one year graph and factoring in the great earnings report from last quarter, I was convinced that CSCO would at least return to the $24 average that it has held, despite the CEO’s warnings that the next quarterly results would likely be flat due to the declining economy. SHoulda/coulda/woulda sold when it hit 22.50. too much greed on my part, should have been happy with the $1 per share increase.

If “I stay at Holiday Inn” is still on board, you may consider selling your stocks and locking up your profit for a while. I don’t see any good economic news on the horizon, indicating that the market will stay flat at best through the rest of this year.

The Federal Housing Administration (FHA) will offer financial institutions holding mortgages worth more than the value of the houses, so-called “underwater” mortgages, a guarantee on 90 percent of the mortgage value if the institution will write-off 10 percent of the mortgage. These risky mortgages have been bought up by Wall Street investment banks at may be 30, 40 or 50 cents on the dollar. The government now says that if the holder takes 10 percent off the mortgage, the government will guarantee 90 percent of the mortgage. So they may have bought a $400,000 mortgage for $200,000. If the mortgage holder agrees to write-off $40,000, the government will guarantee the mortgage for $360,000

My investing luck fell apart last summer Matti when I sold my Citi stock prematurely in August, missing out on a huge gain. Since then, I keep looking for a big score which just isn’t there. The best anyone can do right now is make short-term trades, trying to catch a stock after a substantial decline, then sell it again after a modest gain. If I had been following that strategy, I could have almost doubled up again since last year. I’m still way ahead since last March, however.

My belief is that you are more of a long-term investor, looking ahead to retirement in 17 or so years. In your case, you may consider some of the bank stocks, which are likely undervalued right now. Bank of America is really in the tank, and may represent a good opportunity. As much as you hate the Republicans, I think a lot of companies are waiting on the sidelines until the current “Let’s Screw the Big Guys” Congress gets voted out in November.*

I’m a part-time vegetarian… like Jules in Pulp Fiction; “…my girlfriend is a vegetarian, so that kinda makes me a vegetarian…” to be honest, I don’t eat much meat, and some of the fake meat you can buy at the store isn’t bad, but it isn’t pork ribs or an 8 oz. fillet. my biggest “beef” with beef (and pork, and poultry) is the disregard for the ecosystem shown by huge corporate farms, and the Kamchack post about the actual process of “processing” meat from slaughterhouse to package, makes a vegan or vegetarian diet healthier. Ted Turner has some interesting thoughts on the matter (raising bison instead of cattle). any wild game (venison, elk, rabbit) is certainly a better alternative, but in a pinch, the Kroger or Publix meat counter is fine. but, at the end of the day homo sapiens are omnivores. our digestive tract, from incisors to intestines is set up to digest meat. damn, all this talk has taken the sustenance out of the black bean burger I had for lunch.

Herschel got his Bachelor of Science , Criminal Justice degree in 1983.

The information came from the SACS report/findings, which clearly pointed to a dysfunctional board as the root of Clayton County’s loss of accreditation. They were more concerned with pushing their respective “unions” than they were with Clayton’s student body. Even some high school kids showed up at meetings, asking the board members to get their act together.

MACE members (on the board) refused to agree with the state’s curriculum.

Thanks for the financial tips, but I don’t like the stock market. It’s like poker: You have to really know what you’re doing in order not to totally suck, and even then it’s easy to totally suck. I have no faith in banks (having worked for them) and get hives just looking at my 401K envelopes. Don’t ask what happens when I open one!

In 1990? Maybe. Not in 2010. Most households are wired for cable or satellite, most have access to Fox “News.” Switching to a “broadcast” network show rather than a “Cable” show doesn’t require any special jumping through hoops.

Of course given that TeeVee news programming as a dominant form of dissemination is in its death heaves anyway, this is roughly akin to having an argument over who sells the most buggy whips.

I wouldn’t expect a paraprofessional to understand the workings of a professional organization considering you have never been a member, but it might do you some good to learn the difference between them before basing an argument upon it said knowledge.

As for the issue itself, I, too, have my qualms about embryonic stem cell research. Those qualms are, I admit, based as much in ignorance and emotional response as anything else. I am not a scientist. However, if we learned nothing else from the 1933-45 descent into barbarism by the most sophisticated, cultured, and highly educated society of the times, it is what men and women of science can and will do when let off the chain.

As for the arguments making the rounds, the memo riddled are merely using this as yet another nyanh-nyanh to bash religion or lack thereof and, in so doing, are not really doing anything constructive in addressing the matter at hand.

The emmphasis on math and science to the exclusion of the humanities is, in my opinion, an outgrowth of the McCarthy era and the attendant space race. In that generation the humanities factulties were hounded unremittingly and any academic with a sense of self perservation knew better than to go there. Science, math and technology were more or less safe havens. In the thaw that came in the 1960s we swung to the opposite extreme of party line and the humanities were again sacrificed, the “safe havens” this time around again being science and technology. We have now produced three generations, while perhaps not “scared” to think, no longer know how, that is in the classical philosophical sense. We produce scientists with no moral compass nor real knowledge of the socio-cultural factors which determine so much of our fate. We produce hordes of PhD/s (Doctors of PHILOSOPHY) who have never cracked a book on, say Maimonides, and who have never taken a course in any of the great languages of Philosophy (Greek, Latin, Hebrew or Arabic)…it has become with each passing day more and more a paper chase from Mail In U, the piece of paper bought to increase the pay scale and little more….

josef, though I didn’t make a career out of the “hard” sciences, I was at the top of my class while at HMC, and still read advanced math and science books for fun. The bottom line is that science is a tool, and nothing more. And like any tool, it can easily be misused as a weapon. Your “gut feeling” is right on the mark, and ultimately is more important than possessing great proficiency in tensor calculus or quantum physics.

I’ll pull some quotes from Richard Feynman, the greatest physicist of the second half of the 20th century, for you in just a moment regarding the relationship of science and values.

Thanks for the input. I hesitate to comment much on education issues but I do have my own ideas. As I’ve made no secret, I didn’t go to college and have always survived just fine. The “piece of paper bought to increase the pay scale” describes things very well from my experience. I do know some people who actually went to college to learn a profession (engineering, medicine, etc) or to study something that they really wanted to learn, archeology in one case, but most I knew who went to college, never have worked in a field related to their degree. Some went for the piece of paper, some because it was “the thing to do”, some to put off growing up (knew one who was still going at 30, without taking any major time off), and a good many who went to party on Mama and Daddy’s dime.

And people also forget that colleges and universities are a business, even the public ones. The more students they can get, the more grant money they can get, the more money administrators make, etc.

That doesn’t mesh very well with the popular view of things but it’s the way things have always looked to me.

If we forget for one minute that this quarter of the country was burned to the ground for little other reason than “to make them howl” to the jubilation in the streets by their enemies, if we forget that one of every three white males of breeding age died, and another one of every three was permanently incapacitated, the we loose sight of just what such human folly can lead to. If we forget that we held one segment of our population in human bondage for two centuries, that we uprooted and practiced blood genocide against the original inhabitants, then we are doomed to repeat it…

9/11 should never be forgotten, but in the scope of our domestic national history, it is but a blip on the screen for destruction and loss of life…

As you know, I’ve been paying attention to Monds and education is one of my key issues. He impressed the hell out of men when he said that “people forget that education and schooling are not the same thing.” My Uncle Ralph, the leprachaun of the hedge school, was recognized by all who ever met him as one of the best educated people they had met. He was a 4th grade dropout..the story of why, itself quite the tale…and yet he spoke French and German, read Hebrew, Greek and Latin, could count angels on the head of a pin with the cabbalists, built a helicopter that flew (well, got off the ground!), made a fine distilled spirit, and could perform the most sophisticated mathematical procedures, and knew history like the back of his hand…I could go on and on…but he was not at all unusual in his generation in time and place…ask him, and he would tell you that he left school because it got in the way of his education…

Just a heathen talking here, josef, but I think the Bible hit the nail on the head in Acts 17:24-25:

“God, who created the universe and everything in it, even He who is Lord of heaven and earth, does not dwell in temples our hands have made, nor is He ministered to by the hands of men (as if He needed anything from us) – [on the contrary], He is the One who gives life and breath and everything else to us all.”

It seems like when we lose sight of that, bad things happen.

I imagine there’s an example or two from the right but it sure seems like the left are masters of word manipulation even though they try to claim they have the correct side of the argument. Makes one wonder why they do that word thingy if they really believe their argument. For instance in this debate embryonic seems to go missing as they try to imply that it’s all stem cells and then they try to claim a federal funding ban is a ban on research completely.

It never fails, or at least in my own studies I have found, that when we look at our homo sapiens descent into massive self slaughter and repression, it comes when we get arrogant in assuming that we CAN find all the answers and one or the other faction comes up with the nifty little idea that it has a patent on “the truth” and brand as heresy any who don’t agree. You see a lot of that around here.

Which is why I can’t behind Scout’s crusade to label all Muslims evil. There’s probably something we can learn from them, though I’m not sure what that is yet. The name “Islam” itself means “submission or surrender”, which is the same message I heard from many here (HD led the way) in response to my question about what being a Christian meant to them.

I don’t even know the total count of innocents killed between 1861-1865. As I’ve said before, everything is relative based on your personal perspective. That’s why I somewhat tend to look past those who make comments like “this is the worst thing ever” because what may be the worst for that person could be the best thing for me.

And that’s why *I* can’t get all worked up to be anti-abortion or anti-embryonic stem cell research. Because we don’t KNOW…maybe never being a living, breathing human being might be the best thing that could happen to that developing embryo.

Then he instructed me in what 1492 was “to our people” and then the lesson in unintended consequences to the native inhabitants and the sons of Africa…a glorious page in the great sweep of our common human story, but for you and me, a dark page of pain…

One last point, @@, one that RW probably needs to hear as well. There are a lot worse ways of hurting someone then by simply calling them a name. Name-calling can be easily excused by the recipient. Personally, I would put your earlier statement to Bosch “Oh, and Bosch. I have no desire to continue making you feel relevant thru exchanges or interactions” in that category.

But don’t listen to me, because for every finger I point at someone, I’ve probably got 5 or 6 pointing back.

My only suggestion to you is that if you are going to make a point of calling yourself a Christian, then you might want to follow the advice of Ephesians 5:19-20 “Speak to one another with psalms, hymns and spiritual songs. Sing and make music in your heart to the Lord, always giving thanks to God the Father for everything, in the name of our Lord Jesus Christ.” Otherwise, you’re opening yourself up to being called a hypocrite. Christian is as Christian does.
