Ga.’s sex-offender laws an injustice themselves

You know, it takes a lot to generate sympathy for a sex offender. But Georgia’s draconian laws about where sex offenders can live are doing the trick. It’s downright ridiculous.

“A group of homeless sex offenders who had been living in tents in the woods behind an office park near Marietta were told they had to leave the land by Tuesday.

“We don’t want to allow anyone to live on our property for liability issues,” said Mark McKinnon, a spokesman for the Georgia Department of Transportation, which owns the wooded land where the sex offenders had taken residence.

Several men said their probation officers had told them about the encampment as a kind of last resort for homeless sex offenders trying to meet the strict residency requirements of their probation.

Georgia’s law prohibits the state’s 16,000 sex offenders from living, working or loitering within 1,000 feet of schools, churches, child care facilities and other areas where children gather. It limits the locations where they can live….

William Hawkins, 34, a registered sex offender living in the camp, gathered his belongings Tuesday.

He’s not sure where he’s going to go.

When Hawkins was 15 years old, he had sex with a 12-year-old in Florida and received two years of house arrest and 10 years’ probation. “I have a 19-year-old case. Technically, I don’t think I have to be on it,” Hawkins said of the sex offender registry.”

The law hounding those people has no real purpose but to, well, hound them. As experts have testified to the Georgia Legislature, it serves little or no protective function. A sexual predator intent on finding victims will do so, regardless of where he (or occasionally she) is forced to live. Furthermore, unlike many states, Georgia law makes no distinction between somebody like Hawkins and somebody who has a history of true predation.

An even better example is Wendy Whitaker, who as a 17-year-old was caught performing oral sex on a 15-year-old classmate. That incident back in 1996 put her on the same sex offender list as a multiple rapist, As The Economist recently pointed out in an article featuring Whitaker as an example:

“The Georgia Sex Offender Registration Review Board, an official body, assessed a sample of offenders on the registry last year and concluded that 65% of them posed little threat. Another 30% were potentially threatening, and 5% were clearly dangerous.”

Given that reality, throwing them all into the same bag and forcing them to live together in surreptitious little communities helps no one. If serious threats must be freed, restrict their movements and track them closely. But don’t pretend that they’re all the same. Law enforcement officials have already told legislators that the law is overly strict, forcing officers to spend precious time tracking low-risk offenders that could better be spent elsewhere. But politicians passed the law as an act of grandstanding, and so far they haven’t summoned the courage to correct it.

Of course, much of the rest of the world is more intrigued by the case of Roman Polanksi, who hasn’t exactly been living in a tent city in the 32 years since he drugged and raped a 13-year-old girl. Ann Woolner, a columnist for Bloomberg, explores that case and reaches what I think is the right conclusion:

“The shame is that it has taken this long to sort everything out. The blame for that lies with Polanski for refusing to answer for evading the law.

Celebrate the man’s talent, honor his contributions to filmmaking. However gifted he is, Polanski’s art can’t serve as a reason to ignore his terrible crime or his refusal to answer for it.”

The injustice done to the Wendy Whitakers of the world, and maybe to the William Hawkins, far outweigh any alleged unfairness to Polanski.

UPDATE: I should note that my colleague Cynthia Tucker has also weighed in on the Polanski case, reaching a verdict similar to Woolner’s.

“It’s important for Polanski to face the bar of justice, even thirty years late. His appearance would serve as an example to others among the wealthy and glamorous that they are not above the law. Neither money, fame, connections nor artistic achievement should excuse you from facing up to your crimes. Forcing Polanski into court, in a case which will receive lots of media attention, might also stiffen the resolve of other victims of sexual violence who are trying to find the courage to face their abusers.”

A smaller decline in business investment on equipment and software than previously estimated also contributed to the improved reading on GDP, the report said. Such spending fell at a 4.9 percent annual pace, compared with the 8.4 percent decline announced last month.

Inventories Plunge

Today’s report showed the record drop in stockpiles in the second quarter was even larger than previously estimated, paving the way for gains in manufacturing in the second half of the year. Automakers General Motors Co. and Ford Motor Co. are among firms boosting production in coming months.

If you are sick of these laws, which are STUPID and eating up your tax dollars paying the judicial system and prisons, take a stand and push these lawmakers to make some changes. Pentagon has a type of funds called Operations and Maintenance. Used for daily operations, training, supplies, that kind of stuff. Seems Congress wants to cut about 4 BILLION from what the President wants for O&M and use it to force the Air Force to buy more cargo planes it doesn’t need and for pet projects by influential (guess which party has the influence?) lawmakers.

Sen McCain’s leading a valiant effort to shut it down but he’ll likely go down in flames.

The Pres isn’t threatening a veto over this. I wish he would.

I wouldn’t count the chickens too early. I’ve read many an economist that are predicting a W-shaped recovery, meaning a double bottom, and with the current un-expected drop in consumer confidence, the upcoming holiday season should give us a good indicator. I’m not seeing it around me, as more and more small businesses continue to close as they have hung on as long as they could and no help in sight. Unemployment still rising, many have given up all together, and foreclosures backlogged in the system. The housing maket must clear inventory, and with the foreclosures looming, look for standing inventory to increase.

With that in mind, I tend to think the W is more likely than the U.

See, that’s where I take what might be respectful issue on a fairly serious issue.

My beef with KISS is that it seemed a hopelessly reactionary outfit. They hopped aboard something that was already so over it wasn’t funny–crunch-guitar glam rock, out of T.Rex and Bowie’s Ziggy phase–and stripped it of any kind of liberating social context it might’ve had. While they might’ve had a few punk fans back in the day, if I remember right, mostly they were beloved by the dopier hard-rock/metal guys, the sort of louts who had just figured out in ‘79 that “DISCO SUCKS!”

That said, I don’t think I’ve ever heard more than a few actual tracks of theirs in their entirety, so maybe as Turd claimed there was something there in the albums. (and the solo spinoff tune “New York Groove” is actually a pretty good song). But I stand by my assertion that KISS sucked because they were fundamentally conservative.

Anyone who derides the concerns expressed by Jay and others as defending sex offenders is missing the point. It’s not about their “rights.” The real problem is that Georgia’s system allows the truly dangerous, vicious predators to avoid the law enforcement attention and social stigma they deserve by mixing in with the much larger herd of lesser offenders and non predators. By applying justice with more intelligent and discriminating intent instead of with punitive mass hysteria, the citizens of Georgia could help the justice system and society focus on those criminals who SHOULD face ongoing scrutiny, punishment and separation from the community. The way the laws are now, we can’t even tell who the really scary predators are…

As has been pointed out countless times, the morons in the JawJaw legislature are afraid to make granular laws that would not lable two kids within 2 or 3 years of each other as well as the age of consent “sex offenders.” Or to satisfy their sense of hypocritical self-righteousness where they make laws in one hour and go see their hooker-mistress the next, they could make consensual sex a misdemeanor not subject to any of the sex-offender lables and laws.

These tent cities have sprung up all over the country, under viaducts with no sewage or electricity and are a testamant to stupidity.

Naturally, these are laws written by Repubozos, and typical.

Our current sex offender registry laws are doing nothing to protect our children. In fact, in a lot of cases, it is our children ending up on the registries, some for life. There are too many non-violent crimes that are landing people on the registries, with restrictions that are not only unreasonable but unconstitutional. How is someone supposed to have any type of a future with this label? What about the teenagers on the list for consensual sex? I dont think a 19 year old who has consensual sex with his 16 year old girlfriend should be considered a sex offender. What about the dumb teens posting nude pictures of themselves on MySpace? Do you think these teenagers and young adults should be categorized as child molesters? Well, they are. Our laws need reform and they need it now – before we are all sex offenders.

I’m not too sure the investors are looking at the entire painting. Even as job loss slows and consumer confidence picks up, people’s spending philosophy has changed. Those that have it are thinking twice before using it, and those that don’t have it can not get the credit they once did. All that points to decreased spending in a consumer driven economy. And as you said, they banks are hoarding what they have in fear of going under. I also see commercial real estate about to blow up as they too have held on about as long as they could, but with each closing business, they can no longer make their payments. “For lease” signs don’t exactly pay the rent.

Hef: If you really want to help your kid, let me offer a possible solution. But I warn you to use it will take self control and constantly telling yourself it the right thing to do. When my children, the older ones were almost teens, I started a family method of solving problems by instituting “Truce and Truth”. The program was only for the kids and could not be used by the parents, but it gave the kids a way to break the ice without fear of reprisal if they had a problem they needed to work out. It went like this. One would come in and say, Dad, I need to declare Truce and Truth. At that time, the TV went off, and the child, my wife and I would retire to my office, or go to the kitchen table if the child said the family could hear. The main thing is that since the Truce was called, nothing the child said could be punished. The purpose of this exercise was not to punish but to find solutions to problems that were upsetting them. I will tell you again that no matter what you heard, you had to take it. Many times I wanted to spin up and throttle the kid, but you have to keep your cool because they have to trust you enough to keep coming back with more problems. It was the best way I could think of to keep an open line of communication with my kids. Did it work? Overall yes. But there were times when I wished it hadn’t…but I have good kids and they use the same method with theirs. Try it if you dare, but never, ever, renege because it will distroy any trust they ever had in you.

Truce and truth – glad it worked for you, but I could see that one abused easily for a more caniving child. Actions have consequences, and what is the child learning if they can nullify the consequences by declaring a truce. I’m guessing others not so disciplined could use that as the ultimate out.

I always told ours that actions have consequences and the consequences were always reduced if I heard it from them. If they hid it and we found out, consequences doubled. I’m sure they got away with plenty, but there were many times when they came to us and took their lumps , especially after they suffered the double wammy a few times.
