Attorney General Eric H. Holder Jr. is leaning toward appointing a criminal prosecutor to investigate whether CIA personnel tortured terrorism suspects after Sept. 11, 2001, setting the stage for a conflict with administration officials who would prefer the issues remain in the past, according to three sources familiar with his thinking.
Naming a prosecutor to probe alleged abuses during the darkest period in the Bush era would run counter to President Obama’s oft-repeated desire to be “looking forward and not backwards.” Top political aides have expressed concern that such an investigation might spawn partisan debates that could overtake Obama’s ambitious legislative agenda.
The White House successfully resisted efforts by congressional Democrats to establish a “truth and reconciliation” panel. But fresh disclosures have continued to emerge about detainee mistreatment, including a secret CIA watchdog report, recently reviewed by Holder, highlighting several episodes that could be likened to torture.
Holder’s decision could come within weeks, around the same time the Justice Department releases an ethics report about Bush lawyers who drafted memos supporting harsh interrogation practices, the sources said. The legal documents spell out in sometimes painstaking detail how interrogators were allowed to subject detainees to simulated drowning, sleep deprivation, wall slamming and confinement in small, dark spaces.

One thing for certain, apart from the reprehensible waste of taxpayer dollars and the needless distraction from the Obumbler depression, Prsident Bush, Vice President Cheney, and Rummy would welecome an investigation.
An open investigaqtion would should just how ridiculous the looney left’s claims are. At my college fraternity we had an initiation right, which I have come to learn, that was waterboarding. It was painful, but we used to have contests to see who could last the longest. So, if war crimes included waterboarding, loud music at all hours of the day, bud infested rooms, then all the parents of my fraternity brothers should be in prison. To allege that our administration was on a par with Hitler or Stalin is preposterous.
One of two things are happening, a) either Obumbler’s own people hold in the same disregard world leaders do and don’t car what he thinks, or b) since Soros won’t let his lapdog, Obumbler, start a new this investigation is a “wag the dog” attempt to take the public’s eye off the ever worsening Obumbler depression and Obumbler’s failure to do anything beyond making matters worse.
Either way, Mr Holder and the nation would be better served with a special prosecutor invesitgating the Rich pardon payola.

What about this possible — possible — investigation has gotten our friends Dusty, et.al. all worked up? IF there is some kind of investigation – and let’s face it, there ought to be one – witnesses will be called, questions will be asked, the principals will be required to answer – under oath – and then, and only then, will a decision be made whether, and who, to prosecute. If none of the Bush officials did anything wrong, well, then a bunch of rich lawyers get richer, and no harm done. But if it’s determined that laws were broken, then justice, and the rule of law — not to mention what America is supposed to be all about — demands the appropriate action. And if that results in the “perp walk” for Bush, Cheney, Gonzalez, and the rest, then so be it.

The key word is “owe.” It wil never have to be repaid, altho it will have to be serviced. Much of that too will be on paper, no actual money changing hands. Most of the government loans to corporations will be repaid. That said, I don’t like it either, but I don’t think you appreciate the crisis that faced the Bush administration, and to be honest, I don’t either.

Yes, Andy. People who are far-right-of-center refer to the NYT as the “treason times.” That was the point I was making–it is an article of faith among conservatives that the NYT is really really liberal, and that the farther from the center you get to the right, the crazier they get in their descriptions of the Gray Lady.

I am not sure if the Uppity One is just lacking a backbone or has no stomach for such quaint notions like the rule of law, being aboveboard and justice.
I think you’re leaving out that far more likely third option–it’s just not something Obama thinks is worth the hassle considering all that needs to get done. You pick your battles, yadda yadda yadda.
It’ll come as no surprise that I think it’s well worth the hassle.

If only one tenth of the empathy was shown for 100,000 black teenagers getting raped in our prisons EVERY day than for a few dozen Islamic prisoners, the world would be a better place.

Sure Byll, we absolutely should investigate the “pay for play” of slick willie… problem is that nothing illegal happened there. The president has the authority to pardon anyone for any reason, or no reason.
I guess we need to look into scooter libby’s pardon as well… although that will lead to the same legal issues, that being it was within W’s rights to do so. Same with the DOJ lawyers…

If you’re waiting for that, you’re going to wait a long time. People who are going to break serious laws never think they will get caught. Deterence only works for people who are essentially law-abiding already.

I wonder how quick this torture issue would go away if each detainee/torture victim was
A) Accused of Domestic Violence
B) Owed several thousand dollars in back child support
C) Regularly attended dog-fights
D) Smoked un-filtered cigarettes in cars with children.
