This was bound to happen, and it has. From the Associated Press:
“Massachusetts, the first state to legalize gay marriage, sued the U.S. government Wednesday over a federal law that defines marriage as a union between a man and a woman.
The federal Defense of Marriage Act interferes with the right of Massachusetts to define and regulate marriage as it sees fit, Massachusetts Attorney General Martha Coakley said. The 1996 law denies federal recognition of gay marriage and gives states the right to refuse to recognize same-sex marriages performed in other states.
The lawsuit, filed in federal court in Boston, argues the act “constitutes an overreaching and discriminatory federal law.” It says the approximately 16,000 same-sex couples who have married in Massachusetts since the state began performing gay marriages in 2004 are being unfairly denied federal benefits given to heterosexual couples.
Besides Massachusetts, five other states — Connecticut, Vermont, New Hampshire, Maine and Iowa — have legalized gay marriage. Gay marriage opponents in Maine said Wednesday that they had collected enough signatures to put the state’s new law on the November ballot for a possible override.”
The question, if not this particular case, is probably headed to the Supreme Court, and it will be interesting to see how the conservatives twist and turn on it. They have been advocates of federalism and states’ rights, and honoring that philosophy would require them to support the right of states to determine for themselves what marriage means.
In a little-noted change last month, the State Department also said it would issue passports to gay couples using their married names, in effect a federal recognition of their status almost certain to be cited in the court arguments. So change is coming, it’s just taking time, and it’s actually taking a lot less time than I would have thought say, five or ten years ago.

Ways and Means Chairman Charles Rangel, D-N.Y., has said his committee needs to come up with $600 billion in new taxes to deliver on President Barack Obama’s goal of sweeping changes to the nation’s health care system….

Conservatives are still for states’ rights; the problem in this situation lies with one state trying to infringe on the rights of citizens in another. For instance, Georgia does not allow gay “marriage” and its citizens have voiced that opinion just as they have in California. DOMA ensures that our state does not have to recognize the actions of those couples in Massachusetts. What they ultimately want is for every state to have to enforce gay “marriage rights” whether every state wishes to or not. This is an instance where a federal law such as DOMA helps ensure that states’ rights are not infringed upon.
So let the states determine how they want to go about this matter; let’s hope the court has enough sense not to force this upon the many, many states that do not want it.

Well, you might of knowed we’d get states suing to make the rest of us treat gay marriage like it’s a normal thing. Well, it ain’t. It’s against the Bible. No offense to Josef or any of the other gays on this blog, but it’s just Sin. And we all know where you go when you Sin.
Next thing we know every state will be forced to treat gays that marry just like reglar people that marry. Our health insurance will go up because so many of them have AIDS. We won’t even be able to get a divorce on time because the gay couples will be clogging up the courts. I read somewhere that red states have a higher divorce rate than blue states, so us people in the South will have longer lines to get unhitched. We’ll be forced to live in Sin with somebody that ain’t our wife, it will take so long. The gays will be making a lot of us normal people go to You Know Where when we die.
And the worst part is all the gay marriages will just cancel reglar marriages. That’s what the preachers say and I beleive it. One night you go to bed married. In the morning you’ll wake up with somebody you ain’t married to no more and be living in Sin.
Anyhow, I been giving some thought to what will happen to me when my marriage gets cancelled by the gays. Do I re-up with the missus or should I look around to see what’s out there? Right now, it don’t look too good, judging by the women on this blog. This Midori is a sassy little thing and has been broke in already, but she would go and cancel my vote at the polls. I reckon @@ would be single too by then and is a good Conservative, but that’s the kind of woman that would pump about five bullets into your head while you were trying to get some sleep.
So it seems to me we need a amendment right fast to keep the rest of the states from recognizing gay marriage. If we don’t do it fast we will all be in big-time trouble. Have a good day everybody.

On that note, I heard on NPR that a group of Gay and Straight service men and women have formed a group called Voices Of Honor and are going around touring the country trying to get DADT overturned in the Services. The main point here is that these are all pretty much 20 somethings. Their generation is more diverse. Yes, change will come.

Reality check: read the 14th Amendment.
From Section 1: “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”
The SCOTUS has held that marriages — and contracts — legally entered into in one state are valid in ALL states.
It’s only a matter of time until a case gets to the court and they have to recognize this for what it is: a contract law situation that demands equal protection in all states.

High Hopes seems to be about unwise and unnecessary distruction of worthwhile structures that generally benefit the people. Productive rubber trees. Dams that provide electricity and other benefits to the community.
Jay may have hit on a just comparision. A few states pass a law. They demand that Federal Courts force other states to abide by that law. And Oops there goes a billion kilowatt dam.
I support each state making its own law, with voters consent, about this and other controversial issues.

I’m a democrat, but believe marriage should be between a man and a woman. IMO, its the equivalent of giving equal rights to illegal immigrants. Gay marriage just opens up a whole new can of worms in our society that shouldn’t be opened. Will respect the law if it passes, but won’t be out promoting gay marriage.
