One must be ignorant of American history to claim that secession is treason. See http://www.youtube.com/watch?v=-Kuvj6FIefo and http://www.daveblackonline.com/was_secession_treason.htm

Dave R and Chuck: Unfortunately for you, the courts disagree. The 'equal protection' clause has been used over and over again to assert the supremacy of the federal government over the states in pretty much EVERY aspect of law. Commerce, civil rights, criminal justice, safety and health... you name it, the federal level has authority over the states in it.

But maybe you can go start your own country with no strong federal government: some sort of loose "confederation" of mostly-white Southern states.

Oh, wait. That was already tried....

And interesetinly enough, it was Bush who trampled on the rights of states to do what they want, and Obama who is returning things to their proper balance.

copyleft, It's not a matter of overlooking them or "skipping over" them. They just are not relevant to this .discussion. The 10th amendment is VERY SPECIFIC. The 13th, 14th, and 15th amendments did NOT REPEAL it.

>>>>The Tenth Amendment is similar to an earlier provision of the Articles of Confederation: "Each state retains its sovereignty, freedom, and independence, and every power, jurisdiction, and right, which is not by this Confederation expressly delegated to the United States, in Congress assembled."<<<<

In other words, the federal government has only those powers given to it by the WRITTEN Constitution. Your argument that the stated amendments somehow change that is false. It just adds 3 more expressed powers of the federal government.

Dave R. and ResacaReb, Good posts.

If you're willing to engage in treason, the legality of it should be the least in your mind. Indeed, if the legislature of Georgia is in such agreement on the issue why not just go ahead and do it? Or is this just another political waste of our time?

We need to remember that the Federal Government is a creature of the States and not the reverse. Three quarters of the States, if they choose, can call a Constitutional Convention to completely redo our Federal Government as was done to the Articles of Confederation by the Convention of 1787. There is no law prohibiting secession! Virginia and New York both joined the 1789 Union with provisions to secede if they so choose. How ironic that our country has gone all over the world advocating self-determination for all peoples except for those within its on borders.

Copylefty, why do YOU keep insisting on pointing out the obvious, when it DOESN'T APPLY?

Yes, we get it, copylefty. Those amendments DO give the Federal government supremacy over the states - FOR THOSE SPECIFIC ACTIONS!

That DOES NOT give the federal government supremacy over every other aspect of government.

God, you can be so dense sometimes.
