Breaking: Perdue will sue feds over health care on his own

Gov. Sonny Perdue said Thursday he will appoint a “special attorney general” to challenge federal health care legislation signed into law this week by President Obama.

Perdue made the announcement a day after state Attorney General Thurbert Baker, a Democrat running for governor, told Perdue, a Republican,  he would not pursue a lawsuit.

“He’s refusing to do that and I can’t force him to do that,” Perdue said of Baker.

Meanwhile, Georgia Democratic Party chairwoman Jane Kidd this morning sent Perdue a lengthy Open Records Act request, demanding copies of correspondence between his office and Republican organizations around the country.

The governor said the state constitution gives him the leeway to appoint a special attorney general if the elected attorney general fails to carry out the wishes of the governor.

Perdue said several groups of attorneys have volunteered to handle the state’s lawsuit for free. He said he expects to make a decision on a team as soon as possible, but did not set a deadline. Perdue  has the support of Lt. Gov. Casey Cagle and the Senate Republican Caucus, all of whom said late Wednesday the support the governor’s efforts.

The governor said the state will probably go it alone on the suit to avoid any costs. If Georgia joined with the other 14 state challenging the health legislation, it would incur some legal costs, Perdue said. One of Baker’s objections to filing a suit was its possible financial impact on the state during a time of withering revenues.

When asked if Baker broke the law by refusing to carry out his instructions to initiate a lawsuit, the governor said,  “I think the (state) Constitution is is clear. I think the people of Georgia can make their own determination about that.”

Asked about talk in the state Legislature that Baker should be impeached, the governor said impeachment is a legislative perrogative and declined further comment.

Perdue appeared at a Buckhead press conference with former U.S. House Speaker Newt Gingrich.

Gringrich condemned attacks on Democratic congressman who support the health care bill, and urged voters to funnel their outrage toward the ballot box in the November elections.

The former congressman said “there’s no place in America” for political violence, threats or intimidation.

However, he said Democratic leaders must take some responsibility for the recent outbursts of anger. He blamed Democrats in Washington of using “corrupt tactics” and of “bullying”

He accused some Democrats of being “disingenuous.”

“This is a game they are playing,” Gingrich said.

The Democrats’ Open Records request to Perdue is for all documents “between the office of the governor and the Republican National Committee, the Republican Governors Association, Republican Attorneys General Association, FreedomWorks, American Solutions, National Republican Congressional Committee, National Republican Senatorial Committee, Republican National Conservative Caucus and insurance companies related to opposition to the federal health care reform legislation signed by the president on March 23.”

Perdue is embroiled in a showdown with Georgia Attorney General Thurbert Baker over Baker’s refusal to sue the federal government to block implementation of the national health care overhaul. Perdue wanted Baker to either sue on his own or join 14 other attorneys general in the country in their joint lawsuit.

Baker, a Democratic candidate for governor, said in a letter to Perdue Wednesday that the lawsuit is almost surely to fail and would be costly in a time of plunging state revenues.

“Georgia citizens have a right to know about Perdue’s motivations for overturning legislation that will assist 1.7 million uninsured state residents from obtaining affordable health insurance,” said Kidd. “We believe that Perdue is pursuing this strategy as a purely political calculation, and ignoring the needs of 2.6 million children in Georgia who are protected from insurance denial due to pre-existing conditions by this legislation.”

In response to the Democrats’ request, Perdue spokesman Bert Brantley said the governor’s office will “be glad to search for documents and respond, but given that many, many attorneys have offered to take up this case pro bono, which means free of charge for any Democrats who are reading this, we do not expect any state resources to be spent in this effort.”

Let Perdue and the others pay for the lawsuit from their own pockets if they feels so strongly about it. Perdue has embarrassed this state one too many times. He hasn’t exhibited to me that he cares one whit about the citizens of Georgia. And let me make it clear, I am a Moderate Independent. I’ve always voted for the candidate not the party, however, the antics of the GOP are pushing me toward the Democrats. Until I see some common sense from the GOP I personally will not cast another vote in their direction no matter how qualified the candidate.

The open records act is grossly wrong if it allows for these kinds of emails/letters to be obtained. How is he supposed to do his job if he can’t obtain information from other republicans in peace? I hope he has the right to tell “Georgia Democratic Party chairwoman Jane Kidd” where she can stick that kind of request. If not, this is a law that needs to be rewritten. Only official government records should be available in such a manner.

For those of you carping about wasting taxpayer money, if you had actually paid attention, you’d know that several attorneys have offered to work this case pro bono. That means they’ll do it for free.

Even if the taxpayers of Georgia were paying for it, it would be far cheaper to defeat this monstrosity of a power grab now than to end up with all the taxes and fees in the new healthcare bill. This is not about healthcare, it’s about CONTROLLING YOU. If they control your access to physicians, hospitals, treatment and medicine, they control YOU and you have little or no recourse. This is the government folks, and you know how it is to have a complaint or problem and be forced to deal with any government body or pin-headed bureaucrat. I’d rather deal with an insurance company any day.

It angers me that Gov. Perdue assumes that all Georgia residents disagree with this healthcare reform bill. I support it, and am glad that it passed. It will make a difference for many people and is a step in the right direction. I do not feel that our great state should be added to the list of other states who are fighting this. I do not care if there are attorney’s who are willing to do it for free. Sonny, just finish out your term so we can elect someone else who will represent ALL of Georgia.

Folks, read the article again. It says that there are attorneys available that will handle the case for FREE and if GA joined the other 14 states there would be incurred costs. Also, our tax money will now have to pay employee’s of the state to look through records and copy and supply the Democratic Party the Open Records request that they have filed.

Go Sonny! I can’t believe what happened up on Capitol Hill this last week is going unanswered, and I’m glad someone is fighting against it. Obama signing executive orders just to get a single vote, come on. The list of tactics the Democrats did last week are appalling. If anyone has done any research on Universal Healthcare would know that it’s an absolutely horrible thing. Look at what it did with a country like Germany. Anyone that is hard working, gone to school and has a respectible job will end up paying twice as much for healthcare, while the rest pay nothing. Generating a sub par system that will have the below average doctors serving the unemployed and non residents, because we will give everyone free healthcare. While the educated hard workers get screwed and pay for everyone else.

Just curious…If a law is passed that requires citizens to purchase a product or face a penalty/fine and nothing in the law specifies which agency is responsible for collecting the penalty/fine money, is this law enforceable? I have a strong feeling that no agency has been specified to collect this money (the so called fine if a citizen doesn’t purchase health insurance)so, therefore, it doesn’t affect the commerce clause.

Purdue will spend less money on this lawsuit then this state will lose when employeers start laying people off (to get below the 50 employee mark to avoid paying fines or insurance) and less revenue is generated…hence this will save money in the long run

We’ve come to a point in Politics where misinformation has become the norm. There are some good provisions and some bad provisions in this bill. But our lawmakers are acting like childrena nd from reading this post has seeped into the community as well. Perdue is finally getting off the high horse and doing something but again it’s too late. Sure it will be free to conduct the research but the trial itself will have to entail travel expenses on private jets back and forth from Georgia to Washington, expert witnesses, traveling back and forth for various face to face meetings with other AGs and we all know Sonny is going to jump in and go on them too so more expense. Nothing is free in this country especially healthcare. We need a 3rd party that can actually do something and challenge this fools.

I have my doubts on the implications of the word “free” in this case. Costs WILL be incurred … is the governor going to pay them out of his own pocket? That’d be great. But if he is going to circumvent an elected official by appointing someone else (democracy, what?!), that “special” AG will be given a place (however undeserved) in the state government, and the taxpayers will be forced to pick up the tab. For all that feel this will not cost the state money, you have no idea how the courts work. There are charges to the state if we sue. The cost of the lawyer maybe free but other cost in connection with a lawsuit will cost the citizens of Georgia. Take out your wallett or layoff another teacher just to to lose a stupid lawsuit. The other hidden cost is time spent trying to stop the bill which could be spent by getting this states educational program back in financial balance.

The great irony is that the insurance mandate was a Republican idea.

A free ride on government is not libertarian.” Similarly, both John McCain and even Tommy Thompson, the HHS secretary under George W. Bush.

Obama was opposed to the mandate, but the alternative was stronger requirements on employers to provide insurance, which business leaders opposed.

So Perdue is suing to block the one part of the health bill that Republicans support…the mandate.

Alright, first of all you friggin ignorant rednecks, just because there are no attorneys fees does not mean there are no COURT fees, i.e. costs of the judge running the trial, wasting time on this b.s. instead of on something that is actually worth litigating. Those fees come from taxpayer dollars, so yes, this will cost the state money even though there may be no attorney fees.

Secondly, what exactly are you fighting against here? Are you for pre-existing conditions? Do you support children being denied insurance? Every independant panel that has reviewed this bill says it WILL NOT cost what the republicans say it will, WILL NOT do what the replublicans say it will, but still you fall for the same b.s. every friggin time.

How insensitive? Most people don’t know that their child will be born with a heart problem, a liver problem, cancer, etc. And it isn’t fair for insurance to stop paying for those children’s medical needs. Insurance is for medical emergencies and necessities. I have insurance and if my child got sick and my insurance stopped paying or would only pay for certain things I would be furious. That is why the bill is needed.

If the state doesn’t heave money for a transportation bill, where is all this money going to come from after we pick up the medical tab for the 1.7m deadbeats without insurance that was just forced down our throats?

If we cut taxes, people would have jobs and could buy their own healtcare. Work to fix the problems, not just give the government the right to take over more of our lives.

People naturally want to help other people. But bigger government is the problem not the solution. It’s not charity when you are forced to give.

The Red Cross uses 94% of every dollar given to help the people in Haiti. The Government uses 34%. Who does the better job of helping those in need?

If your complaining about Perdue wasting money on one law suite after what just passed in Washington?

Half of the 32 million Americans who would gain coverage under health care reform would be pushed into Medicaid, nearly 60 million people already using it and it killing our state already.

Under the bill, the bill requires the federal government to pick up the entire cost of new Medicaid patients through 2016. But then the states start to pick up more and more, first by 5 percent, then it rises year-by-year to 10 percent.

plus Perdue said people are willing to do this for free.
plus the healh-care bill is uncontitutional and needs to be challanged. Govt has no right to tell me I have to “buy” insurance or be fined. not only that but the insurance must meet their standards.

I support what Sonny is doing and had requested for him to do so. Baker’s refusal is purely political and predictable. It is unthinkable that Georgia would not join other states in filing suit, either together or separately.

This is not about healthcare, depriving children, etc. Those are progressive talking points. This is about State’s Rights, liberty versus tyranny. It is disappointing that so many who post here can’t see that.

I hope he’d fight as hard or harder to get the auto insurance mandate over turned. I used health insurance when I had it more than I ever used my auto insurance. In my 30+ years of driving, I have never filed a claim on my auto insurance but I still have to have it to operate my car legally but, when I had health insurance, I used it 6 times for hospital stays and numerous times for doctor visits. Purdue, you want to give people and option on whether or not they can afford something or not, be able to get it or not or can do without it if we can’t and still be able to survive? Take the mandate off of auto insurance and let us decided if we can afford it or not, can get it or not or can do without it if we can’t and still be able to survive.

It is about time that someone is willing to stand up for the U.S. Constitution. I have one at my desk and the U.S. Congress has violated our constitution with the Health Care Bill. There are things that need to be fixed and can be, but not by the government taking over healthcare and enforcing illegal rules. In fact, the IRS has been tagged to manage the Healthcare compliance, which includes leveling fines for those who have a better health plan that what the government wants provided. The GOP in Ga and in Washington have done nothing but try to kill the bill. Are they for denying coverage to people with preexisting conditions and allowing insurance companies to cap the insurance coverage of sick people? That is what it sounds like to me. This is definitely a political battle for the GOP. The party is encouraging violence and racism. In the ’90’s, a family had to put their child up for adoption because the insurance was capped at a million. The child was had a birth defect that cost more than a million to keep him alive. This is just cruel and inhuman to suggest that this bill does not help people in similiar situations. Shame on Ga legislators.

Everybody and their grandma knows that it will be thrown out. The majority of the states that are filing lawsuits all have attorneys general that are candidates for governor. It is all for political reasons.

My husband had a colonoscopy and his health insurance refused to cover it because they had some rule about not covering things like this because he didn’t have health insurance the year before. So we had to pay $2500 out of pocket for the procedure. So even if you have insurance, your insurance company might try and pull some mess

It somehow isn’t enough for elected officials to waste time making guns legal in churches and other such nonsense. Now we’ve got to suck media attention into this dark hole. It’s a continual embarrassment to be a native of this state lately. I probably wouldn’t vote for Baker, but he’s gone up in my estimation for saying no to this blatant political ploy. Hey, y’all, George Bush here. Lots of you folks seem to forget that I passed the largest expansion of govament run health care in 40 years back in 2003…it was called Medicare Part D. It cost a nickle or two less than this bill, but it got herded thru congress like a long-horn with the runs. Even my sun-tanned buddy John Boehner voted for it (look it up), as did Newt Gingrich. Medicare Part D over ten years costs over $700 billion and most of that is a big fat gift to the drug companies.

But let’s all just forget about the two wars I started that cost this country more than $300 billion a year…..

Go ahead and file lawsuits. Republicans think they will benefit in November because Democrats voted for this Healthcare Reform, but I think the benefit is actually going to be for Democrats. All the while leading up to these votes, polls consistently showed that on the individual merits of the reform, people supported them overwhelmingly (like protecting pre-existing conditions, creating exchanges for people who don’t have insurance to buy into like group coverage, fixing the donut hole in the Medicare prescription drug program, lowering the deficit, etc.) but it was only when asked about healthcare reform in a generic question were they skeptical or unsupportive. That shows there is a disconnect between the facts of the reform and what the Republican spin machine (otherwise known as Fox News) is spitting out. What does that mean? That the more time that goes by where Democrats can tell people what’s been passed in the reform the more support it will get and then it will be Republicans having to answer for THEIR votes against these important issues, not Democrats.

And Republicans only exacerbate this problem by filing lawsuits on the matter of mandating people acquire health insurance. An idea that was created by Republicans, by the way, you know the party of personal responsiblity. Why wouldn’t Republicans support a mandate, because it means people can’t leave the goverment or the insured with the tab if they use emergency services without paying for them? Republicans are going to be buried by this issue and it will be a boon for Democrats just like they can point to social security, medicare and civil rights as historic reforms they supported. Republicans have been beat over the head with social security for 75 years because they opposed it and Democrats could take full credit for the system.

How dumb can redumblicans be? Very, apparently.

If attorneys offered to sue Obama over his birth certificate for free on behalf of the state of Georgia, would Sunny take them up on it? I’m not concerned about costs, I’m concerned about the nature of the lawsuit.

I understand having problems with a couple parts of the health care bill and looking to have a few things repealed, but the vast majority of this bill is very helpful and are very necessary changes to our national health insurance system.

Does Sonny want to repeal the 50% reimbursement of health care costs for small businesses? Does Sonny want insurance companies to drop coverage of entire families because their child has a pre-existing condition like asthma? Does Sonny want insurance companies to charge vicitims of domestic abuse more because they can legally consider domestic abuse a pre-existing condition?

Sonny is completely misjudging the opinions of the residents of Georgia. Like I said, certain aspects of the bill are controversial, but they are very small parts and should be handled on a case by case basis without repealing all the good and bipartisan items that a vast majority of Americans were hoping to get out of health insurance reform.

Even if the legal services are “free” which I sincerely doubt, the waste of time, energy and public resources on this, is coompletely disgusting…especially when there are so many other issues that need our attention ( note: those low reading scores). Further, the fact that the Governor wants to side step the authority granted to AG Baker by the VOTERS of Georgia because he can’t get his way is the real tragedy here!

Here’s a thought! Since liberals and conservatives are so divided on major issues, let’s conduct a test. Let’s split the country down the middle and have citizens pick their side; liberal or conservative. After about a ten year period we then take at look at the results to determine which society actually has it better. It is of my opinion that during this ten year test period, the conservatives would have to build a wall and man it with guns to keep the fleeing liberals from crossing back over illegally. Like I said, just a thought!

I have had enough of the republicans, if they actually cared about anyone other than themselves they would have done something about health care all the George Bush years. They did not because their own healthcare was never in question. They like Perdue have done nothing but serve a small elitist base and what i do not get is how any normal average person can even possibly support these guys. Wake up!!! If you do not like health care reform than ask your self what is so great about a system that currently cost nearly 3 times what it cost in most of the third world, THE THIRD World! and at least most of their citizens have access. You people need to grow up and see change must be made. If you want to keep your head in the sand about this issue at least shut up about it and let those that see the need go about their business. Republicans have ruled the state for the past several years and our taxes have gone up, car insurance legislature passed that allows them to raise rates at will, etc and they pull the okie doke on you by shouting The Government is taking over Healthcare. What the hell does that mean anyway? Is it the government that paves the streets you drive on, or maybe the schools your children attend, or maybe the military that protects us. What part of the government do you hate so much but in turn love American so much and express so much Patriotism. Patriotism for what……the flag? Republicans depend on people staying ignorant in order to stay in power and Georgia supplies plenty of idiots for the picking. Please realize you WILL pay for health care regardless of this bill. My doctor told me that one Aspirin pill at a hospital costs about $5. I can get five bottles of Aspirin for $5. Health care costs are over inflated and if you ever go to a doctor’s office or hospital, you are paying the cost anyway, because Hospitals are required to treat emergencies (even ifs not a real emergency) even if a person doesn’t have insurance. So who pays for those uninsured person’s at the hospital, INSURED people do.

Looking into my crystal ball, I predict that the “several groups of attorneys” that “have volunteered to handle the state’s lawsuit for free” will do the initial paperwork, prepare a few filings and then at the first sign of any progress inform the governor’s office that they cannot continue due to a lack of funding.

There is NO WAY that any notable attorney group is going to deprive themselves of an opportunity to pursue costly legal filings between a state and the federal government. That particular bit of jurisprudence is too much of a “cash cow” to pass up.

Do you really think that state funds would never be spent if the Governor’s Office thought that they were making progress?

I’m sorry, I just cannot believe it.

“The dogfighter returns” I was thinking it was the IRS also, but last night I heard something that made me question if the wording in the health reform Bill didn’t actually require the IRS to penalize someone if they cannot prove they have health insurance. I don’t trust the authors nor the sponsors of this Bill and could visualize them pulling a slick one so that a court challenge would be a moot point.

I’m sorry folks – I paid for my education, my home, my vehicle, my right to live in this country …through hard work. I have never taken anything from our government in the way of “free” anything. In fact, my entire family has given more through service to this country during war and peace time wearing the uniform of the Armed Services. So, if Obama Care is what you want – and you want ME to pay for it – then YOU can pay too – through lawsuits and anything else that will level the playing field. In fact – why don’t all the dems who voted for this administration pay for healthcare – and the rest of us will be glad to pay the legal fees for a lawsuit againt it!!! That should make you all happy. Pay for what you are getting. Distribution of wealth is unconstitutional unless you or Obama want to pay me back for all the money I put into my education and my success. It is mine – and you or no one else in this country has a right to it. Go earn your own! There are parts of the healthcare bill that are good for many – and that’s not what the fight is about. Many of those same items were included in the Republicans proposals for healthcare. It is how this trillion dollars (trillion today – 2 trillion in a couple of years) will be paid for. Thanks to the Dems, (Johnson Administration) it’s broke. 2) Community Reinvestment Act (under the Carter Admin. and amended by Clinton.) This is why the housing market is in the shape that it is in now causing our economy to be the shape that it is in now. 3) The Stimulus Bill (Obama) has not created any new jobs of significance. Unemployment went from 8% to over 10% since Obama has become President. Where are the jobs that the stimulus bill was suppose to create? 4) Obama has spent more money in his first year in office than Bush did in his entire two terms in office. So far nothing that Obama has done has improved the economy or put people back to work. So thus the lesson on Democrats. History will repeat itself on the Healthcare bill as a failure also.
Now for the Perdue and Baker issue. I think they are both politically motivated. The majority of the people did not want this particular Healthcare reform bill. For Perdue to do nothing would be hurtful to not only him but the party. Baker on the other hand, argues the point of the costs. With the state in it’s budget crisis, this makes for a good political argument. Obama being a black man has nothing to do with it. This is an argument that you use simply because you cannot argue the real facts. It is his socialist policies that are not for the good of this country that we are outraged over.

You’re absolutely right. Barack Obama ran his presidential campaign (especially his primary campaign) on healthcare reform (and beat a huge healthcare champion, Hillary, in the process) and won just short of an electoral landslide (and considering he was an African American, it was a landslide).

The people voted for someone who would enact this reform. He did what he promised he would do. There is no backlash to be had in November, because a majority wanted this in the first place.

I’ve been a moderate for my entire llife and have voted the person. I will say the way the dems have handled this entire process with the back door deals, the bullying and breaking of promises I am definitely moving toward the conservative party. It seemed to be apparent that the majority was against this bill. I believe everyone should have access to health care but all know whenever you have the government run something…. well, let’s just say look at history.

Rory, excellent points and I agree with you whole heartedly!!!! Something does need to happen and fixes need to be made to the health care system. But there is something rotten in Denmark when you see these Democratic Congressman strongly disagree with the bill for months and then turn their vote to “yes” after a closed door meeting. It just isn’t right and my heart is broken that the Administration would stoop this low to help Obama possibly get re-elected for a 2nd term.

@We’ve reverted back to the 50’s–Are you really calling RACE a factor in the passionate anger over the healthcare? Please, Pelosi is not black, and neither are a lot of the congressional “leaders” that voted for the healthcare system. Obama may have signed the papers to make it law, but it was still Congress that created the law. I for one am not opposed to a healthcare reform especially as insurance companies decline certain medicines/procedures that many people need because they are deemed to expensive than other “cheaper” treatments. However, I am strongly opposed to the federal government “taking over”–as a democrat may have said, “…control of the people”. We are quickly losing the Republic that has stood strong as a democratic government for over 200 years. The federal government was never intended to be a limited government. Instead, we now have a government that continues to push forward ideas of entitlement and inequality instead of independence and equality. The “Truth” is that all of humanity were created “EQUAL”–that is to say that we all have some basic emotions, thoughts, capabilities; however, we are not all equal in how we pursue our lives–and this issue becomes clouded with fairness. Some people work hard. Some people are lazy. Some people are fat. Some people are thin. Some are heathly, some not so healthy. Some people make minumum wage, some make millions of dollars. Some are law-abiding, others are criminals. Life is not fair. If life was fair, teachers, cops, and firefighters would make millions of dollars while professional athletes and celebrities would make $30,000 a year. If life was fair, we would all live in 4 bedroom homes, with 2 children, a dog, a cat, and a two-car garage with a luxury car parked on both sides. Fairness does not mean Equality. The sad thing about this whole situation is that people are overlooking the most important thing…the children. How dare the gov. even attempt to block legislation that could help that millions of children here in GA that are without health insurance. I think the people that have focused on the ‘FREE’ statement should get a clue. Yes, lawyers have volunteered to do it for free, but this is only AFTER SONNY TRIED AND FAILED TO GET OUR STATE ATTORNEY’S TO DO IT AT COST TO THE STATE. Furthermore, he just stated today that he will appoint a Special Attorney General to pursue the case, AGAIN, THAT’S NOT FREE!!

Now, if by chance, Sonny does take these free lawyers ( which are about as real as unicorns) up on their offer, understand that they lawyers won’t be collecting a fee for their services, but filing a lawsuit is NOT FREE. All court costs, private jets to Washington, along with the hotel and strip club travel upgrades ARE NOT FREE!!!

Seriously, is this really that hard to understand? Remove your partisan blinders and look at the issue rationally.

It is illegal in this country for any ER to refuse to treat someone. All of the people who have no job, no insurance or want a free ride are getting it now. They go to the ER and never pay the bill. Those costs are passed on to us working stiffs via increased premiums, etc.

This bill will require everyone to put some skin in the game. If everyone is required to have basic coverage, then that will end the “free” ER visits. They will have coverage that they either paid for totally out of pocket, or subsidised by the government. But they will be paying something for their care instead of relying on ER services. I like this approach.

Years ago there was another president that offered change. The Government will wipe out poverty and welfare system was born. 50 years later there is still poverty and a larger percentage of people in the US are on the welfare system. Poverty was not wiped out so government experiment didn’t work. The government says SSI, Medicaid, Medicare, and the post office are going broke. The government is taking money from SSI, Medicaid and Medicare to help pay for the new healthcare. They are taking money from entities that are already going broke, I guess that means they will go broke faster or we better offer up more taxes. Welfare has proved that taking care of people that refuse to help themselves will not eliminate poverty. It’s up to the people themselves to move on and learn personal responsibility. I’m all for helping the sick, the disabled, and even helping people get back on their feet, but living on government assistance as a way of life should not be tolerated. I had some one tell me ( and they are on gov assistance and shouldn’t be ) that the world would be better off if all conservatives would die. My question back was “ then who would support you, who do you think pays taxes so you can hang out and party and get tattoos” .

States should have the right to opt of a bill like this just like individuals should be able to make their own decisions on whether or not to buy health insurance! This bill does not help me in the least bit, because it does not affect employer sponsored plans. My health insurance premium for myself and my daughter is over $600/month. It jumped $175.00 from Jan 09 to Jan 10. That being said, if this bill helps people who have been repeatedly turned down for insurance because of pre-existing conditions, then it is worth it. In the end, I am sure of two things, (1) my premiums would have continued to rise regardless of whether or not this bill passed and (2) this lawsuit is going to go no where fast. When in fails, which I am sure it is, I am just waiting on the knuckleheads to start yelling about state’s rights and seceding from the Union…LOL!

One last question, for the people screaming they do not have health insurance and do not want to be forced to purchase it…..exactly what is your plan in the event that you are in a bad accident, you are diagnosed with cancer or some bad ailment, or require a major surgery? How do you plan to cover the cost? I just want to know.

I have a son with congential heart disease. Under the previous law, if I changed/lost my job, my son would be uninsured and could be denied coverage and create a financial disaster in our lives just for his normal check ups, and especially if God forbid he had a problem. Now my son will always be guaranteed coverage (under my insurance unti he’s 26 or after that when he gets his own plan). So I take all this Republican opposition very personally.

I currently have health insurance thru my employer. I don’t have it because of a mandate, I have it because it helps me when my family has need of healthcare.

It does not infringe on my constitutional rights to make it legally required to have health insurance, especially when my premiums can be affected by unpaid costs passed on for services used, but not paid for by uninsured people. I think this mandate will bring costs down by bringing people into the system. There are always two sides to a story. They talk about helping the uninsured get affordable insurance, which I support, but the flip side is there are people who don’t have insurance by choice who leave us insured holding the bag. This reform bill fixes both sides of that story.

For those who say its unconstitutional, where in the constitution does it say that the government will provide suitable roads for us to travel on and that it will be paid for with taxes on me? It doesn’t say that, but we all accept this responsibility as a community because we know as a whole we all benefit from it. The same can be said for everyone acquiring health insurance. It strengthens the system for everyone by keeping costs down.

People who oppose these things are fools who can’t see past the “R” on their registration card.

The problem with Bush was he tried to be bipartisan and kept giving the Democrats what they wanted. Yes, he screwed up alot.

He let Ted Kennedy write the education bill(which he then denounced a month later).

He passed the prescription drug fiasco because he wanted to take that issue away from the democrats.

He started the bailout fiasco with AIG.

For all the bad things President Bush did, obama has now come in a quadrupled them. Bush had room to make some mistakes because the country was still in good shape from the Reagan era. Then the Dems took over congress in 2006 and things started going downhill.

Now our country is in poor shape and our “leader” is a rule by opinion pole socialist who has never created a job in his life. We are living off credit cards(China). The government used to be the backstop for companies “too big to fail”(there is no such thing). Now the government is playing in the market and buying crap it can’t afford. What happens when China decides not to be our backstop anymore?

For all of you who think that this lawsuit will be “free” just because attorneys are volunteering to take up the case, please think again. Even if the legal fees won’t exist, there will still be hours spent by government employees on research, compiling of data, and any other thing requested by the attorneys. They can’t just walk in the door and figure it all out by themselves. Also, this yet another example of a party doing things their own way for eight years and now they can’t handle not having the power in their hands.

Mr. Obama took an oath to protect and defend the Constitution of the United States. The Constitution is all about freedom and liberty. Everyone’s freedom and liberty. The recently signed into to law healthcare reform bill requires that everyone must purchase under penalty of law. That clearly means that the Federal government is stepping beyonds its limits set forth in the Constitution and forcing citizens to purchase a product from a private company. Regardless of your socio-political philosophy (unlesss you’re a communist/socialist/dictator) this is WRONG. This is a vulgar act. This is an act that flies in the face of Americans who believe in the principles of freedom and liberty. It must be challenged, period.

It is Mr. Perdue’s job to protect and defend the citizens of Georgia. In asking Mr. Baker to file suit (and join with other states) he is carrying out his lawful duties. Mr. Baker’s actions sends us (the citizens of Georgia) the message that either he does not believe in protecting (or at least attempting to protect) the freedoms and liberties of Georgians or that his alliance with his political party is far more important than that of all the citizens that he serves as attorney general of the state of Georgia.

The United States Constitution is clear, and there is no precedent for the lawsuit, Baker was correct in his statement.

But here’s what really gripes me. This is a political fight without one whit of care about the citizens of the Great State of Georgia and their economic needs in hard times. Furlough teachers to fund a political dog fight?!?!??!?! Wake up, Georgia. Perdue does NOT represent us. Perdue represents himself and his party. Although not overwhelming %, Gallup shows that the majority (over the cutoff of half) approve of the healthcare package. Perhaps a citizen’s arrest of the Governor of Georgia for squandering our tax monies for personal and party gain is in order.

I think if most of you took a walk down to your HR office, you’d most likely be told that you HAVE to have the companies health insurance option (and yes, pay for it too) unless you have health insurance from another source, such as a spouse’s job, a previous job, the military, etc. The reason for this is the more people on the plan, the lower the cost per person. This new situation with the federal plan is the exact same thing.

Most of you nuts are already forced to pay it and our to stupid to realize it.

Another puzzling question…

How is it that you’re upset that you will have to pay for the healthcare of the ‘deadbeats’ yet you’re equally upset that this bill is forcing those very same deadbeats to PAY FOR THEIR OWN CARE SO YOU WON’T HAVE TO?

Massachusetts is the test program for this. Yes, it was set up by a Republican. 4 years later they are now broke. The only reason it didn’t go broke sooner is because congress keeps throwing them money because they want to program to look like it works.

So once again the Democratic solution is to take a failed program and expand it.

Social security is backrupt. Democratic solution: let’s not change anything.

Medicare is bankrupt. Democratic solution: put 16m more people in the program, cut funding in half.

Socialized medicine bankrupting countries worldwide. Democratic solution: Take the greatest healthcare system in the world and change it to like others. (we don’t want to show up those other countries by showing we have superior technology)

The government is simply pooling people together in order to be able to get costs lowered for those participating in the pool. What’s your gripe with that?

Your freedoms are being taken away? What freedoms are those? The freedom to pay your high dollar premium for years only to be denied coverage the moment you get sick? The freedom to be fleeced by the insurance carrier? The freedom to be denied coverage for the unpardonable sins of having a c-section, being a battered woman, having acne, being a firefighter or policeman? The health care program that was passed was not read my a majority of those that voted for it to begin with. As I read some of the comments, a majority of the complaints are about cost. If you read the article, there are a number of volunteers for this. No cost to the state.

Before you complain, actually read and understand what you are complaining about. Common sense people. At least when things go to litigation, attorneys will actually research the topic of the suit.

Forest Gump once stated: “stupid is as stupid does…” Regardless of where you stand on this issue, at least read the article and learn about the health care reforms and what that actually handle prior to speaking about it.

The Governor has very little choice in this matter given what ObamaCare will require financially from this state’s taxpayers. The compliance mandate for Medicaid will financially strap taxpayers for the rest of our lives. One estimate I saw said the Democrat Healthcare mandates would cost the State of Georgia over $1 billion per year within 6 years simnply to comply wiht the funding required by the State.

It seems many posters to this site and elsewhere have no clue about the financial requirments imposed upon the states. The Democrats ObamaCare plan REQUIRES the states to pay a sizeable and growing portion of both Medicaid and Medicare. That portion MUST COME FROM SOMEWHERE, that somewhere is the Taxpayers of each state. You supporters need to quit being such blind and loyal followers and delve into what is mandated. By some estimates our Legislature will be required to increase the State Income Tax rates by as much as 3% points to meet the state funding requirement. That is in addition to the increased Federal Personal Income and Soc Security Taxes the Democrat Bill imposes on each Taxpayer.

Fight ‘em Governor, the legal bills to fight this Federally imposed mandate will be much less than the tax bill Obama and the Democrats in Washington will be sending us in the near future.

Let’s clarify what free means in this context: The attorney(s) who participate may or may not submit charges for their time on the case. What won’t be free are the hours of staff time, research, writing, interviews, travel, court time, witnesses, expert opinion, etc. This won’t be free, it will cost the state plenty unless Gov Purdue means he will pocket all expenses personally. If the states or federal govt can mandate auto liability insurance, there is nothing unconstitutional about mandating health insurance. Get over it, move on, find solutions to the real issues and please stop wasting time fighting health care.

First, Mr. Brantley some Republicans as well as some Democrats did not know the meaning of pro bono. Secondly, the Governor asked the Attorney General to file suit first which would have cost the state money. Only after the Attorney General refused did the Governor decide to appoint a “special attorney general” and at that time some attorneys agreed to file the suit pro bono. Would the citizens that are pleased about the suit still be happy go lucky if the Attorney General would have filed suit and cost them money?

I was listening to a caller on a radio show the other day that opposes the bill. He stated he should be able to opt out if he can prove that he has $250,000 set aside in savings to cover his medical. So naive. $250,000 didn’t even cover one of my surgeries. Go back to the drawing board with that defense.

He resigned from office just 3 days after the state of Ga re elected him because he got caught doing the very same thing he accused Clinton of and demanded Cilnton be impeached and thrown out of office. Rather than face the music and commit to his promises like Clinton did he quit, citing he wanted to spend time with his family. if he wanted to spend time with his family he shouldnt have run for re election. Perdue took the Fed stimulus $ after saying he wouldnt because he didnt think it was a good way to help rebuild Ga infrastructure. I guess he can use that Fed money that he said he woudnt take to pay for the resources that all these “pro bono” lawyers in this bogus law suit will have to pay out of pocket. Either that or have state patrol hand out more speeding tickets ( his original strategy to come up with more $ to help Ga infrastructure). If you and the rest of the GOP do somehow squash the fed Health Care Plan Sonny, you can tack on some more speeding tickets to pay for the Ga voters medical bills that cant afford a health care plan. As for Perdue’s statement that he has several attorneys who have volunteered to do this litigation for free – please be aware that there is much more that goes into a case costwise other than just a particular lawyer’s fees. There are court costs, costs associated with drafting documents (called costs and expenses which are seperate from attorneys fees), witness fees, depostition cost, travel expenses, expert fees…and last but not least – if the suit is unsuccessful for Georgia, the US governement can request payment of all their fees. Nothing is free folks.

I love all the “pro bono = FREE, idiots!” posts.

Does anyone actually think that the only reason anyone would like the health care bill is because we believe we will get “free” health care? Um, no. Nor do we WANT free health care. We all pay, and as many have pointed out, mandating insurance simply means forcing individuals to pay for the health care that they will, at some point, receive, rather than relying on the government to pay them as we have been.

Do those of you against the mandates not have health insurance? Then YOU are the ones driving up costs. What’s that? You DO have health insurance? The “I want it, and I have it, but I don’t want anyone to tell me I’m right” argument against mandates is a little ridiculous.

So no, we don’t think this bill will give us free healthcare, nor is that what we’re advocating. We understand cost. Obviously those of you who believe that lawyer fees are the only costs incurred during a lawsuit do not.

AS governor of this state (Georgia), he should want his state and its tax paying citizens to have some form of health care! What will it hurt?
Georgia needs to get out of the Old South Civil Rights Hating on its people; we all nedd to move forward and create an environment where we all can live among each other. We are and have been divided on equal pay, jobs, health care and so meany other things. It is ugly and it is a bad reflection on this state as a whole. Who would benefit by sueing the federal government, he is part of that system because he pay taxes into it. Hearing him doing this kill my vote to elect him for another term and while he is moving forward, he can’t change what has already been done and health care has been done! All I can say is, Governor Purdue, you really dissapoint me as an elected leader and I am deeply sad of this decision you are making and it reflects on all of us!

I find it amazing that many of these comments state that it will be free to pursue this lawsuit – really??!!! What about the people who will have research and pull information – what about the governors contributions….if the governor is adding any insight into this lawsuit…then it’s not FREE…because last time I checked – I PAY his salary – his and his staff’s salaries….so while the paper the lawsuit is written on is free…this effort is still going to cost us taxpayers!!! That’s interesting. Republicans are arguing that the healthcare bill is unconstitutional and want to fight it in court. They say, “What part of the US Constitution says I have to have healthcare?”

Well, show me what part of the Georgia state constitution gives the Governor authority to appoint a “special attorney general”? http://www.sos.ga.gov/elections/GAConstitution.pdf Read it. There is no mention of any kind of authority ANYWHERE in that document that gives the Governor the ability to appoint a person other than the Attorney General to do the Attorney General’s job.

The Attorney General is an elected constitutional officer of the State. He has specific responsibilities–the people of the state selected him to handle all the State’s legal issues. The Governor doesn’t get to simply ignore the Attorney General when he disagrees with him and appoint someone else to do his job. THAT, my friends, is unconstitutional. Thurbert Baker was elected to make the legal decisions for our state—Not Sonny Perdue. If we don’t like that, we the people have the authority to elect someone else. The Governor, however, does not have the power to simply appoint someone else.

His determination not to file a lawsuit as suggested by the governor was supported by the facts contained within his letter of denial. I keep hearing “Nothing is free” What do you think this healthcare bill is all about? People thinking they are going to get another “free” handout from the government.

The problem is people don’t understand what things cost anymore. People are complaining about the price of insurance but they don’t even understand what that really costs because your employer pays a big chunk of it for you.

Fix tort reform and open competition with insurance companies. Forcing tax payers to pick up a bill forcing 32 million people into a broken system doesn’t solve anything.

When has anything that goes to court and stays there for years – whatever the outcome, the losing side will appeal it – not end up costing everybody involved a bunch of money? If you feel so strongly about this health bill that you want to waste our money to sue the Fed, just be honest about the fact that you place a higher priority on defeating this bill than you do on funding schools or any of the other fiscal crises facing our state. Sonny is not jaded. He’s more of an idiot. I find it real funny that anyone cannot understand that the Federal Government has to step in when the State shows complete negligence. The only state that has really shown any effort to providing healthcare to its people is Massachussetts. Why would we not have any real support to an already state mandated Auto Insurance (an example)? The potential result, which can lead to serious injury and huge medical bills. This is almost laughable that the idiots of this state are arguing the issue of choice when choice has not been lost. You can still choose your insurance plan and not have to worry about being priced out in the future.

What’s more, you won’t have to worry about the value of your plan being compromised. And to those who are still receiving coverage from your employer, I long for the day you ever have to take COBRA and find out the true cost of your insurance plan if these idiots get what they want. But I already know that’s not going to happen. And you can forget about Sonny giving you a refund on the wasted tax payer dollars this asinine decision will cost this state.

It’s high time to kick the Republican bums and two Reps who voted against the HRC bill out of Federal Office. Sonny can’t get out soon enough.

Nothing is free. Time is money. In addition, there are administrative costs to any lawsuit. This is a publicity stunt by the governor and his allies. With double-digit unemployment in Georgia, where are the jobs the governor’s office has brought to the state? Perdue needs to focus on serving the citizens of the state and not his own selfish interests. And Ginghrich left office in disgrace but he is always around for a photo oppportunity. I’m ashamed to be in the republican party. A healthy debate on any issue is all that’s needed. Let the vote stand on healthcare. These backhanded tactics are a waste of time. Couple things: Perdue says that several lawyers have volunteered their service, but he doesn’t say that he is going to choose only free lawyers in his “team” – most likely some of his team will be paid using our taxes. Second, there are costs associated with a lawsuit other than attorney’s fees- the taxpayers are going to end up paying these other costs, not the “free legal team.” Also, your federal taxes (to the extent Georgia even pays any taxes since we get back more in federal dollars than we pay out collectively) WILL be used to defend the lawsuit.

Sorry….but I am one of the 80% of Americans with insurance and I am NOT happy with it…especially since I only go to the doctor for preventive care – this year along my insurance jumped 23% – really??!!! I’m paying for all the individuals who don’t have insurance…who go to the ER because they cannot get seen by a doctor without upfront payment….since you conversatives don’t seem to understand what has been happening for years….check this out: WE ARE ALREADY PAYING FOR THE UNISURED’s HEALTHCARE!!! This bill will get them into doctor offices…which are less expensive than ER’s – saving us all money….it’s not rocket science!!

Free my ***! Nothing is free…. They’ll get their money some how. Besides, the Health Care Bill is a “Big F******* Deal!” Even as we speak some illegal alien, U.S. Citizen, or person visiting the U.S. on a Visa is going to the emergency room right now. For instance, my neice just had an accident on her bicycle and had to go to the emergency room for cuts, scraps, and bruises. Her mother (who was living with me for the past 6 months rent free) doesn’t have health care for her. Who in the world do you think pays for that? We do! So, I don’t see what all the fuss is about if the U.S. is now making it mandatory for these people to get insurance. What don’t we understand about that. We are paying for everyone! Make them get it and the costs will go down. Everything will go down because the majority is not paying for the minority. If anything is considered socialized, it should be the lottery. The GA Lottery takes money from the poor, hopeful, and down and out, and redistributes it to the wealthy via education…. Hope Scholarships… And who are the recipiants of most of those Scholarships… Mostly students that come from the best schools in the state… Now if you want to talk reality…or common sense… Let’s go!

My guess is that most of the people making comments on this story have that great Georgia education. The attornies are willing to do it for free because they don’t believe in this either. I agree we need a change in our state leaders in Georgia. So, next elections, vote Independants or someone that is not a life long politician. Also, there are only 2.4 million kids (under 18 years of age) that live in Georgia. I guess Kidd wants us to insure the all the illegals and there kids too.

Not a fan of Sonny, but he is right on this one. The federal government has to respect the limits placed on it by the US Constitution. Despite all of the good intentions behind its creation, the new health care law is not based on powers we as free people and the fifty states within the union have delegated to the federal government – period. This is not about health care or political party affiliation, IT IS ABOUT PRESERVING THE FREEDOM OF EACH AND EVERY ONE OF US (WE THE PEOPLE). Leagally Confused,

The law requires you to have insurance if you drive an automobile. The law does not require you to purchase an automobile. If you don’t plan on driving an automobile, you don’t need and are not leagally required to purchase auto insurance. Got it???

The young-non-tax-paying northerns won the election for Obama. It was an excellent strategic move to steals votes in 2008. We’ll see if those same young northerns return to the polls when a “health surcharge” is taking away from their tips to help fund their co
