Georgia Tech NCAA appeal denied

Georgia Tech’s appeal to the NCAA over sanctions handed out last July has been denied. The school will be required to return its 2009 ACC football championship trophy to the league office, one of the penalties for NCAA findings of failure to cooperate and failure to meet the conditions and obligations of membership in an investigation into possible impermissible benefits violations to former football players Demaryius Thomas and Morgan Burnett.
“In its appeal, Georgia Tech asserted the vacation of records penalty was not warranted based on its contention that it did not gain a competitive advantage, among other factors,” the NCAA wrote in a release. “After a comprehensive review of the case, the Infractions Appeals Committee found the facts of the case did support the findings of violations. The Infractions Appeals Committee also found it speculative to state a competitive advantage was not gained and the penalty was appropriate in this case.”
The verdict of the infractions appeals committee is final. The school has no other legal recourse on the appeal. The investigation began in November 2009 when an NCAA investigator learned of possible impermissible benefits, which turned out to be $312 worth of clothes given to Thomas by his cousin’s roommate. Burnett was not found to have violated NCAA rules.
The school faced significant odds for an overturn of any of the two findings or the revocation of the football championship. Since the NCAA toughened standards for appeal in 2008, only one out of at least 14 appeals has been granted.

“We are disappointed with the ruling of the NCAA appeals committee, but respect the process and the NCAA’s decision,” Georgia Tech president G.P. “Bud” Peterson said in a statement. “We felt we owed it to the Georgia Tech community and to our student-athletes to exercise the appeals process provided by the NCAA in order to defend the integrity of Georgia Tech and to reaffirm our commitment to the principles and obligations of the NCAA.”

Peterson was out of the country and unavailable for comment, according to a school spokeswoman. Athletic director Dan Radakovich declined comment.

In its appeal, the school conceded it had made mistakes during the investigation, but argued that the indiscretions didn’t want warrant a finding of improper conduct or the removal of the ACC title. Tech argued that the title removal was inappropriate and an abuse of discretion, one criterion for an overturn of an appeal. The school claimed that none of the factors typically associated with a penalty of vacated wins, including academic fraud and serious intentional violations, were met.

“The vacation penalty punishes an entire team of student-athletes by taking away a championship because of decisions made in good faith by institutional staff members,” the school contended in a written appeal filed last September.
To lodge the appeal, the school retained the services of the Birmingham-based law firm of Lightfoot, Franklin & White, including Gene Marsh, the former chair of the NCAA’s infractions committee. As of December, the school had paid $93,000, nearly all of it to Lightfoot, Franklin & White, for counsel.
A school statement released last July noted Tech’s “unwavering commitment to the integrity of its athletics program” and that “we feel that we owe it to the institution” and the football team to appeal.
In addition to the return of the trophy, Tech must vacate the win from coach Paul Johnson’s records and remove any public references to the ACC title.

This is the NCAA telling us that they will over-correct for what they view as rampant rule breaking among member institutions. The penalty makes no sense.

I am angry with the Institute for even suggesting that playing by the NCAA’s rules equates to playing with integrity. Real integrity would be to pay these players an actual salary rather than a pittance for the “full cost of attendance.” The NCAA will rake in billions for their tournament but the people on the floor will receive nothing.

Forgive me if applaud Bay Bay for getting $312 (assuming he did) worth of clothing. My only regret is that he didn’t get more.

The NCAA says don’t take free stuff…unless you go to a Bowl game…then you can take all the free stuff you want.

The NCAA couldn’t control the rampant greed, corruption, and extortion in the Fiesta Bowl Committee and John Junker.

Ohio State and Miami to date have not vacated any wins even though there is documented proof of receiving tens of thousands of dollars of benefits.

Seems petty, and correct me if I’m wrong, but the punishment is so harsh not because of what Thomas did but because Tech knew Thomas was ineligible and played him anyway in the championship game and did not fully abide by the terms of the investigation. In other words, they talked about it with people involved which could lead to a cover up. If they had followed the proper procedures Tech would still be 2009 ACC Champs.

The root of the harshness of the infractions was the communication between DRad and 2009 ACC Champion CPJ informing him of NCAA investigators were planning on interviewing Morgan Burnett, Demaryius thomas, and a few others.

Somehow, the NCAA got a tip that some players were involved with an employee of an agent. That person was Calvin Booker. They informed Radakovich of the investigation with instructions to tell no one. He told Johnson about the investigation, and Johnson asked the players (Burnett and Thomas). During their interviews with the NCAA, they gave unclear answers. The NCAA contends that by Radakovich telling Johnson about the interviews (and Johnson speaking to them about it), they made it harder for the NCAA to get the truth. That’s the abbreviated version.

The NCAA bases its punishment just like the US Courts do. If you are a nobody, you get killed. If you are important, you get your wrist slapped. This is similar to a minority indigent who get 20 years for stealing $100 while a CEO who steals $1B of shareholder and government money gets a $10K fine. This is just the way it is, its the way it has always been and its the way it will always be. There is no use in crying about it. If you want better treatment you have to become important. Just ask Ohio State, North Carolina and Miami.

Just glad this is over with. We should not have played the in question athletes in the ACC Championship game since it was apparent that potential violations had occurred. We pride ourselves on doing things the right way…and in this specific incident we did not. Kuddos to the NCAA for getting it right. The problem is so few rule breakers get just penalties but are let off easy because of national recognition (Ohio State, UNC and UM will likely all get minor penalties and yet the crimes they committed make Tech look angelic in comparison).

How in the H___ is it not a conflict of interest for the NCAA to send a former player from a competitive conference school to investigate Tech? Don’t they have enough staff to at least have impartial investigators? This entire mess stinks!!

Really, when you stand back and look at it…they are a bunch of bullies. Probably the very ones we all saw in middle school – except they are all grown up and found jobs at the NCAA. FL Jacket, I believe that all members involved must have the title ‘2009 ACC Champion’ added to their name, similar to being knighted.

On another note, no legal battle is over until one side is tired of spending money. We may not be able to battle with the NCAA committees anymore, but this blatant abuse of power has real emotional and monetary impacts on the institution and its players. Whenever this occurs, there are grounds for civil and legal cases to right what is wronged. Asking the NCAA Infractions Appeals Committee to overturn a penalty handed down by the NCAA Infractions Committee is kind of like asking Dad if you can not be grounded when Mom has already grounded you. It is a conflict of interest at best.

I say we go after the NCAA as a whole. I bet we can get some other institutions on board.

The NCAA has become an prime example of how to abuse the power invested in them by the membership of institutions they represent. Clearly – the rules by which they govern are applied in such an inconsistant way – not to fairly punish the guilty based on the severity of the infraction – but as to allow those administrators in the penality process to make decisions on personal feelings rather than facts, strike fear in all institutions, give lessor punishment for more severe infractions – and above all maintain the “power” invested in them at all costs – without question and without meaningful recourse beyond the token appeal which has been reversed only once in fourteen times. The NFL, MLB and other professional sports authorities have recognized to importance for independent arbritration to remove any doubt of partiality in the decision making process used by the commissioners of these professional sports. It’s time to bring back the honor which was once unquestioned within the NCAA – but is now questioned with each decision and compared to offenses of the past. Little consistancy between penalties for similar offenses – and endless explainations to the the public why that difference exists – while an edict is delivered to the institution is reason enough to demand accountability of all NCAA administrators – not just those who sit on the rules / infractions committee – as well as adapt a position of openess with regards to an independant counsel as a “last resort” appeal – outside the NCAA – a decision by which all would abide.

I know I’m grasping at straws here in a comical way, but I wish there was some way to make the NCAA pay for this travesty.

A class action lawsuit should be filed against the NCAA by the players who have been impacted due to the ruling and this should become a test case in the court system. The players have now had an ACCChampionship stripped because their AD and Coaches followed the advice of their attorneys when they allowed the players in question to participate in the game(s) and have the meetings with the players, and the NCAA investigator took offense to the actions as a personal affront (a UNC alum no less, who had his own personal agenda).

The NCAA arbitrarily hands out punishments and is failing to monitor its own personnel from following its own rules as they conduct investigations, and has no governing body to regulate it; this is the only way to reel them in.

How would you feel, if one school had enough donors to buy any athlete it wanted. Come to our university and you will geta nice new SUV and be part of the championship team we are buying to attend school. That’s what you would end up with, if giving gifts is none of the NCAA’s business. The Competitive edge should not be able to be bought. Miami would have had the number one team in the country if this were the accepted way to lure athletes to a school, and was not considered wrong by the NCAA.

I hate when people bring up that lawsuit. The size of the lawsuit had nothing to do with her frivolity…it everything to do with forcing McDonald’s to put a label on their coffee because it was a burn hazard.

George, are you an attorney? I’ve heard recently about a documentary regarding the mcd’s coffee suit that really shows the truth. It seems to point towards McDonald’s being at greater fault than public opinion seemed to indicate originally and that they may have waged a war against the woman that led to her being portrayed in a really negative light, ie frivolous lawsuit etc. have you seen this or heard of it?

DRad was told by the NCAA investigator to “not tell” coach PeeJay anything about the upcoming interrogation or warn his players in any way.

DRad ignored the NCAA Investigator’s EXPLICIT instructions, therefore this led to GT getting an unecessary hit from the NCAA, this is the NCAA’s version of “obstruction of justice”.

GT should have just let it play out and taken the slight “hit” for the $312 worth of stuff, INSTEAD they got all panicky because they thought they had a chance to beat UGA in addition to going on to the ACC-CG.

When AJ Green for Muttville got involved in Jersey-gate CMR immediately sat him down and held him out until the NCAA got back with UGA, even though CMR’s job was on the line and he was clearly on the hot seat.

GT should/could have answered the NCAA’s allegation much better like other schools, but GT didn’t want to sit the players for the UGA game and hope they would be re-instated in time ala Cam Newton in time for the SEC-CG.

For all the claims of Academic Eliteness and being the “smartest guys in the room”, the GTAA sure does handle their business of NCAA Athletics much WORSE than most colleges that they accuse of being “dumber than them”.

This is clearly the fault of DRad, and although I don’t have proof, I feel that CPJ prodded Drad to find out what the NCAA wanted since having any players sit out ofr the UGA would have impacted his ability to win that game, which GT went on to LOSE ANYWAY.

We could have sat the players, avoided the NCAA Probation, and then lost the UGA Game anyway and still have a clean program.

Now we/GT have to worry how this Probation will affect “Text-Gate” with coach Spencer, and I have a feeling that the way GT & CPJ scape-goated Junior Gnonkonde that they will be very helpful IF the NCAA asks them about any illegal texts that were sent.

FL-Jacket. Ohio State vacated ALL wins for the year, including BCS bowl victory, returning their share of the bowl earnings for the Conf for the year and renouncing their share of the Conf Championship for the year. They suspended all players involved, fired the head coach.
Further they have received a bowl ban for the next season and a reduction of scholarships for several seasons.

But I am with you on the GT issue. Vacating that season and conf championship is much too severe for such a minor issue.

Paraprhase, you obviously know nothing at all about football. The complete lineup is different in the wishbone than it is in the triple option. The wishbone is called that because of the way the backfield lines up on the field….it sort of looks like a wishbone. The line up for the triple option doesn’t look like that at all.

Ken, you state that the appeal was Georgia Tech’s last legal recourse. I would love to know if GT could file a class action suit for arbitrary and capricious behavior with other member institutions that have been on the wrong end of the NCAA stick. FL jacket said it all when you compare all the recent publicly advertised indiscretions, GT is damn near the bottom of the list.

We are a voluntary member of the NCAA and agree to abide by whatever nonsense they make up. There is nothing legally we could do about it. The worst we could do is leave the NCAA which would crush pretty much all of our athletic programs. As someone said above, the NCAA is one of the worst organizations in the United States and there is little that could be done to change them.

If you can live by the sword, you can die by the sword, if you can take CHEAP SHOTS at Tuitt’s Mom for trying to “control her son’s life” (VL’s own words), then you can’t get mad when otehr voice their opinions in the same medium.

But you are wrong High Text, Stein had the correct 12 tweets that I SENT to VL, what you pulled up weren’t “sent” to anyone.

I don’t back off from anything that I have done, and I won’t be silenced about Coach Kung Fu Panda and GT FB just like I was back in Dec. 2007 & before.

If you read all the reports, it wasn’t just Radakovich telling his head football coach. He also — despite multiple warnings from his compliance director about not telling others– called in other members of his staff to begin mapping out a plan for dealing with the situation. I have no problem with players endorsing a product, but the dumb NCAA thinks it robs the schools of revenue, even if the kid doesn’t wear his uniform and doesn’t say the name of his school. They say, he wouldn’t be in a position to do endorsements, if not for the team they played for. I guess they also might think that a one school could offer more endorsing deals in a big TV market or something, and this would give that school a competitive advantage. I believe since they are making millions out of these kid playing sports for them, then the kid needs to make some money as well. I know there are those, that say a free education is the pay check, but if that is all these kids have and they don’t have any pocket money, they get into trouble, and end up messing up their lives far too often. You can’t expect young folks to play a major sport, get some type of education, and stay in the dorm and out of mischief’s way, 365 days a year. I think the 2 grand for an athlete is a small price to pay, to insure these kids have a little cash and freedom. They might just find out that there would be a lot of trouble less for some of these kids.

Now compare that to “we’ll play for MNCs in his 3rd, 4th, & 5th seasons”, this is what GT fans were saying after 20-wins-in-2-years.

Now they’re saying that 8-win seasons are OK and that he’s the best we can hope for at GT.

Keep in mind we are complaining about an institution (the NCAA) who found five players at Ohio State were ineligible but still allowed them to play in their bowl game. Their penalty was not to be administered until the following season. Of course they all subsequently turned professional thus, paying no penalty at all. At Tech we had a player who WAS NOT deemed ineligible but the school was stripped of a conference championship.

All hail the NCAA – the institution that is all about fairness and integrity in intercollegiate competition.

Just my opinion, but tech got hosed. The problem was this came out during the time that Ohio State scandal came out. The NCAA acted like a bunch of babies and decided to make a nothing incident into a major issue to show their butts.
Yes, it was a secondary violation, but compared to other things going on at the time and what they did not do to some of these other violators… This sucks!
Of curse we all know that according to the NCAA, that $312 worth of clothing was the reason why tech won the ACC Championship….. Absurd!

If the reinstatement doesn’t come through, break the bad news to CPJ right before the UGA Game,a game which we lost anyway and AVOID FOUR YEARS PROBATION.

Because of the FOUR YEARS PROBATION, we now have to sweat the Todd Spencer Text-gate situation because IF we caught there we will considered REPEAT OFFENDERS BY THE NCAA.

None of the above is worth damaging the long term viability of the FB Program just to play 2 guys vs. UGA no matter how good they are.

If DRad were worth his fat salary, he would handled thing like I outlined above and let the players continue to practice while pursuing everything administratively behind the scenes without CPJ knowing and then making a decision by game time based on whether or not the players were cleared by the NCAA.

What would YOU have done, the exact same thing as DRad and risk 4 yrs. of probation?

Given hindsight, I feel pretty confident that if he thought that there was even a chance of a loss of a title, probation, fine etc, he would have been more conservative in his decision making. DRad was given explicit instructions by the NCAA, an organization that severely punishes non-cooperation, given the NCAA’s history, IMO he had no choice other than to not tell CPJ anything and to try to get the players cleared before the next game.

You never want the NCAA to think that you purposely didn’t cooperate.

Nowhere in my reply did I say that DRad should tell CPJ until the time came to hold the players out of the game, I think that by that time the NCAA had already interviewed the players.

The critical part was to not talk to the players or HC before the NCAA interview.

Not true.

The NCAA cleared Cam Newton in time for the SEC title game, I think the School Auburn declared him ineligible on Tues. or Wed. and by Friday before the SEC CG he was cleared to play.

Better to roll the dice with that than to deal with 4-years Probation and now having to sweat out Text-gate and run the risk of being a repeat offender in the same sport, FB.

There are times during the day when a SA has breaks in their schedule, all DRad had to do was tell the NCAA investigator that you have to schedule your meeting(s) with the SA during a break in his Academic schedule but before meals or Practice so the HC would not know and that would prove that DRad was a making a good faith effort to follow the NCAA’s instructions.

Going and telling CPJ and IGNORING the explicit instructions of the NCAA was clearly the worse possible decision that DRad could make.

The email from the NCAA saying Student Athlete No. 1 MAY have jeopardized his eligibility was sent at 8:18 AM on November 24, 2009. That was the Tuesday before Thanksgiving. The school consulted the ACC immediately and were told to allow Student Athlete No. 1 to play. Let’s consider what options Radakovich had. He could have:

1) declared Student Athlete No. 1 ineligible and sought reinstatement – unlikely given the timing
2) declared Student Athlete No. 1 ineligible and given no reason – explain to me how that makes sense
3) consulted the conference and take their counsel

This entire “process” started on NOV. 11 that’s a good 13 days before what you wrote in that post above about that E-mail.

GT knew these at least ONE SA was on the NCAA’s radar by Nov 11th they would have had plenty of time to get their eligibility restored.

GT broke the NCAA’s instructions by talking to or prepping the SAs on Nov. 16th , AFTER FIVE DAYS OF DELIBERATION on how to handle this situation.

Please tell me how your time line is different from mine.

The first interview was with SA #2 on Nov 18, 2009. They found no evidence of impropriety. They got another tip on Thursday, November 19, 2009. They conducted the interview with SA #1 the same day. The details of that interview are found in the link I provided but you were too lazy to read. Tech heard back from the NCAA on Nov 24, 2009.

The compliance director was clearly instructed that the information could be shared with only the institution’s president and the director of athletics. Arrangements were made to interview student-athlete 2.
On November 18, during an interview with both the NCAA and institution, student-athlete 2 denied that he was given any impermissible benefits. Subsequently, it developed that the institution, acting contrary to the explicit instructions of the AGA staff, had questioned student-athlete 2 on two occasions prior to his interview and had disclosed to him specific information, which was the subject of the interview. This information had been told to the institution’s compliance officer by the AGA staff during the November 11 telephone call. The meetings involving student-athlete 2 and institution officials occurred on November 16, 2009, after the NCAA’s warning and before the NCAA’s interview with him. This series of events forms the foundation of Finding B-2.
On November 19, the AGA staff received additional information indicating that impermissible benefits had also been provided to student-athlete 1. As a result, student-athlete 1 was interviewed on November 19, the day after the interview of student-athlete 2.

The NCAA gave the compliance director & DRad the opportunitly to logistically set-up the interviews so that they SAs could be interviewed WITHOUT the HC or anyone from GT legal dept. prepping them.

But GT didn’t listen to the NCAA and instead that prepped the SAs on Nov. 16th AFTER FIVE DAYS of deciding how they were going to handle the NCAA allegations.

School was right in their argument that penalizing all of Tech’s players for the mistake of a few players was not fair at all.
My thoughts are why take back a conference title that nobody else is going to get? Lets face it, the NCAA’s not going to award the ACC title to the runner up of the 2009 championship game. Why not leave it with Tech?
The person who should be held most responsible for this is whoever made the decision to let the 2 players play in a game of this magnitude knowing they were under investigation.

Sautee Dawg, I agree that the team as a whole should not be forced to pay, but in this particular case, Tech ASKED for clearance on the players because the school didn’t find any impropriety. Based on the interviews which apparently had already been conducted, both ACC AND NCAA officials ok’d it. As I said, that wasn’t the problem; it was that DRad told CPJ what was going on after having been told not to. The question all Tech fans is how could he NOT tell him. As I also typed earlier imagine a similar scenario happening at UGA (just for example, not to slam UGA) —

UGA AD to CMR — I am suspending A J Green for the Tech game
CMR to UGA AD — OK, boss (no questions asked or anything)

Can you really imagine that playing out like that? HELL NO!!! ANY coach in the country would want to know why (and DESERVE to know why), as would the players on the team.

No further recourse? How about a civil suit? The NCAA has become a joke, or they would have given life-time bans to dozens of coaches and shut down several major sports programs. Vacating a title that was won legitimately on the playing field (and done so with players who weren’t illegally recruited, thank you) over a handful of T shirts from someone’s cousin? Others get to sit someone for a couple of games over infractions over the summer and that is fine. That’s OK, the NCA can’t take the feeling I had or the answer to the taunting of the Clemson and auburn fans that night.

They really have no handle on anything anymore. Players get paid with lots more than a couple of shirts. What about NC and what happened there. You know why othng got passed down there? Or at UGa when AJ Green made thousands? Because their teams sucked at the time and didn’t win anything anyway.

I remember reading an editorial by Terence Moore (fortunately no longer with the AJC) after Calvin Booker’s lone start of his career, against Gardner-Webb, in which the only offense he could muster the whole game was an 80-yard screen pass to Jonathan Dwyer, in which Moore stated that he had so much respect for Calvin because he was just a great kid and was going to be a great man as well. I haven’t read all of the comments, but this guy needs to be called out. Thanks for absolutely NOTHING, Mr. Booker. The one chance you got to play, you stunk it up, and then to put the cherry on top, you also caused us to get some NCAA sanctions. I hope you’re proud of yourself, young man… I bet Mr. Moore has not changed his tune, though; then again, we don’t get a chance to see any more opinion pieces from him.

Some chatter about moving to the big 10 in a couple of year. Just keep in mind with the b10 network
3/4 of the games will be at noon. Last year, 5 of 7 were at 3:30 or later. one was at 1 and the uga game which was at noon last year, is usually a 330 or night game. Move to the big 10 and assume a 9 game conference, 7 of those will be noon, plus 2 ooc games which will most likely be noon since it will probably be cupcakes and then uga which could be 12, 330 or 7. So those who complain about noon games, if you gt moves to the big 10, expect 2-3 more noon games per year or about 3/4 of the games.

Looks like the problem here is the NCAA, not the school or the kids, who as far as I can tell did very little wrong and a whole lot right.
