Thomas, Burnett at heart of NCAA investigation at Tech

Georgia Tech was fined $100,000 by the NCAA, stripped of its 2009 ACC championship in football and placed on four years of probation on Thursday for failure to cooperate with its investigation into the football and men’s basketball programs.

Those weren’t the only penalties, which stemmed from what the NCAA described as an isolated instance of former standout  wide receiver Demaryius Thomas allegedly receiving $312 in impermissible gifts, and grew to Morgan Burnett allegedly taking gifts and misleading NCAA investigators. Both have denied taking improper benefits.

In addition, more penalties were self-imposed and accepted by the NCAA:

  • Public reprimand and censure.
  • Four years of probation from July 14, 2011 through July 13, 2015. The public report further details the conditions of this probation.
  • A reduction of two men’s basketball recruiting days during the 2011 summer evaluation period (self-imposed by the university).
  • A limit of 10 official visits for men’s basketball for the 2011-12 and 2012-13 academic years.
  • A vacation of all contests won by the football team during the 2009 season after November 24. The ACC said Tech must return the trophy. No champion for the season will be named.

The committee stated in its report, “This case provides a cautionary tale of conduct that member institutions should avoid while under investigation for violations of NCAA rules.” It said Tech’s previous history of violations factored into its punishment decisions. After receiving penalties for the 2005 and ‘06 seasons for infractions that occurred in the 1990s, the NCAA said that if Tech committed another major infraction before Nov. 17, 2010, it would be subject to added penalties as a repeat violator.

Within the investigation, the NCAA noted the combative and confrontational attitude of general counsel, Randy Nordin. He retired in December. Paul Parker, formerly the assistant athletics director at compliance, left in April to take a job with Auburn.

The case started when Tech learned that Thomas, received clothing from a friend of someone who worked for an sports agent. Burnett and former player Calvin Booker attended the meeting when Thomas received the clothing. Burnett didn’t receive anything.

Athletics Director Dan Radakovich told coach Paul Johnson about the investigation into Thomas receiving improper benefits, but didn’t inform him that he shouldn’t talk to Burnett about the investigation. The NCAA said that conversation hindered its investigation.

The NCAA noted that Tech continued to allow one of the players to compete in the final three games of the 2009-10 football season, in which Tech won the ACC and played in the Orange Bowl, despite the NCAA notifying the school that it had questions about the eligibility of that player. Dennis Thomas, the head of the Infractions Committee, said Tech had enough information to warrant not using the player until it could investigate the players’ eligibility. Tech President Dr. G.P. “Bud” Peterson made the decision to allow both to play.

“It appeared to the committee that the institution attempted to manipulate the information surrounding potential violations involving (the student-athlete) so there would be enough doubt about its validity to justify the decision not to declare him ineligible,” the NCAA said in its report.

The committee also noted “the university took these actions despite information reported by the student-athlete, another football student-athlete and an assistant football coach regarding the potential agent involvement in preferential treatment benefits.” Tech barred Booker from the university’s training facilities and denied him access to complimentary tickets to athletic contests.

Thomas denied that he was one of the reasons for the investigation. In a text message, Thomas said he was offered things by people not affiliated with Tech, but never accepted. Burnett, a safety and third-round pick, also denied the report, texting that he “did not knowingly or unknowingly receive any gifts from any agents … These reports are baseless and false.”

Thomas and Burnett signed with Tech when Chan Gailey was the coach. Paul Johnson, who led Tech to the ACC title in 2009, was hired after Gailey was fired by Radakovich after the 2007 season after five years at the helm.

It is the second time in six years that Tech has been penalized by the NCAA. It learned in 2003 that it had been misapplying an NCAA eligibility rule and worked with the NCAA to investigate the nature and results of the error. They learned that 17 athletes, including 11 football players, who were academically ineligible were allowed to compete during the 1998 and ‘99 seasons.

As a result, Georgia Tech was on a two-year probation that resulted in self-imposed scholarship cuts (from 85 to 79) and a reduction in signing classes (from 25 to no more than 19) in 2005 and 2006. In addition to those penalties, the NCAA infractions committee added a limit of 79 total football scholarships for the 2006 and 2007 teams, six below the normal maximum.

The infractions committee also recommended that Tech vacate wins from seasons, 1998-2002, plus 2004, which were all winning seasons that ended in bowl trips. Tech appealed and the NCAA appeals committee agreed, allowing the results of those seasons to stand.

The NCAA has been in what appears to be a testy mood regarding alleged violations and lack of cooperation in wake of scandals at Ohio State, Southern California and North Carolina, among other places. The Trojans were forced by the NCAA to forfeit their 2004 national championship and the Buckeyes voluntarily forfeited 12 wins and their 2010 Sugar Bowl victory in an attempt to appease the infractions committee. Penalties against North Carolina’s program haven’t been announced. However, numerous players were suspended for all or parts of last season.

SAD!!!!!!!!!!! I think they did this on purposed to make it look bad. The coach and staff knew it and yet didn’t care about a thing and all they was doing get $$$$$$$$$$$$$ to support their family. I would suggest that all of the coach and staff to repay the money back and be strict on all the staff. It make me mad now because they are doing this over and over and yet no one seem to care if it UGA Or GT but it’s not fair that UGA doesn’t have to do anything. I hope that player and sport agency get some probation time and learn to stop play around expect for that Sport Agency guy (he or she was the one did this on purposed to make it look bad)

NCAA allows felons to run the Fiesta Bowl and control millions of dollars each year after investigating it. Colonial bank failure is tied to Auburn alum who pays players, Victory land casino fraud/politaical payoffs tied to Bama booster, South Carolina players living in Columbia’s version of the Ritz and riding limos to class.

Ohio State, Southern California, Tennessee and most recently North Carolina all have massive cheating scandals.

All this and Tech gets the hammer, sounds like thUGA grads running the NCAA just like Atlanta Public Schools.

Tech won’t be worth a darn this year but it won’t be because of any violations. It will be because CPJ can’t recruit. As for the Bulldogs, their talent level is near the bottom of the SEC now. I’ll be interested to hear what Peterson and Radakovic have to say about this. Bradley says no one’s getting fired, but, if the persons involved in covering this up are still at Tech, they should be shown the door immediately. Maybe we wouldn’t have won the ACC title, but that’s better than winning it and having it vacated and getting 4 years of probation.

Part of the big “debate” is the fact that GA Tech had the conversation with the player.

Could have there been a potential legal liability had they NOT informed the player yet an NCAA violation if they had? THIS was the quandary the AA was in.

Obviously they chose to err on the side of caution and fairness to the student athlete.

Stinger, what part of ineligible players do you not understand? You cheated and played players that shouldn’t have been on the field. So you didn’t win anything. There is no 2009 championship, get used to it. While UGA and UNC were holding players out of games due to eligibility issues, you were snickering at them. All the while playing players that your administration knew had issues. How do we know the admin. knew? Because they warned the players about the NCAA and coached them on what to say.

It’s never the violation, it’s the cover-up. Tech Alum are going to be after some heads.

We need to know who ‘coached’ the player(s) before the NCAA investigator interegation. This individual needs to be fired NOW. I would be surprised if Coach Johnson knew about this, but if Coach Johnson knew about it, he should resign now before being fired. We don’t need the Ohio State situation. Winning is important, but playing inside the rules is more important.

Also, need to put stop payment on that last paycheck to Blewitt. He knowly allowed the basketball event with GT BB involvement. About the only silver lining to this disaster. Glad he brought is attorney to the meeting, he is going to need him to get the rest of his contract.

Given the penalties, there’s more to this story than is being presented at this time. Either the NCAA found much more but couldn’t quite put it together, GT serioulsy stonewalled things, Fish Fry had some major involvement in a coverup, or there’s more to come. When you void a season, pay a fine, take 4 yrs probation, that’s some serious stuff.

If the AJC had been doing their job and requesting information via the Open Records Law, as they do almost weekly with the Georgia Athletic Dept, we may have learned of this earlier. However, the AJC’s beat writers covering GT are little more than cheerleaders, both of them. It will be interesting to see if DR and KS trade in their cheerleader skirts and pom poms for big boy journalist clothes and delve into what is really going on over on North Avenue. Inquiring minds want to know. What did Fish Fry know, when did he know it, why did he hide it, and how will GT discipline the man in charge of its football program for misleading and lieing to NCAA investigators? What did Hewitt do for basketball to be hit?

SEC: Yes, a player was suspended four games. The difference? Neither the player nor the school lied or tried to hide the facts from the NCAA. Also, UGA was not on probation at the time. We have to take our lumps on this one, I’m afraid. NCAA is not in a jovial mood right now, with two of their “signature” programs (OSU and USC) in deep trouble, and both teams from last yea’rs championship game under heavy scrutiny. We may just be collateral damage! Bad time to trip up.

As a UGA fan, I’m tired of hearing about the NCAA imposing penalties to a whole program for the mistakes made by a few. I understand the, “you win and lose as a team”, but these infractions are becoming comical. The NCAA governs themselves and makes millions off these kids and programs all while preventing everyone else from earning a penny. Did receiving $312 change the players age or performance? No. The team won and that can’t be changed. Reggie Bush won the Heisman. USC won the National Championship and OSU won the Sugar Bowl. Players and coaches move on after being caught and the only ones penalized are the ones which played by the rules. That’s screwed up. Additionally, what is so wrong with a player selling his jersey if someone wants to buy it? The NCAA sells thousands without penalty.

Wow, so much punishment over such a small amount? And it sounds like there was probably an easy opportunity for confusion…a kid got “clothing from a friend of someone who worked for a sports agent”? I wonder if GT was one of the “premier” athletic schools if the punishment (if any) would have been the same…

I see the repeat offense thing… but most people do fail to realize that Tech is strenuous academic school, meaning that for an athlete to remain academically eligible isn’t quite as easy at Tech as at many of our athletic competitors. So, it’s no surprise that this has been a repeat issue in the past… but it looks like the NCAA was just looking for one final slip-up from Ga Tech. Very unfortunate…

I would bet the Farm, that if we were to do a complete investigation on the members of the NCAA governing board (much less the deans of all the NCAA schools) we would unearth a mountain of moral violations and lavish spending, along with drug deals with sponsors and book makers.

is mostly right, the 312$ violation is a minor violation, if Tech had declared the players ineligible, they would probably been reinstated somewhat quickly. The failure to cooperate, and completely ignore the Compliance directive of how to handle the interview of player #2, is what became a more serious issue, and the fact that they were already on probation… you add all that up, and Tech is getting what they asked for.

ATLANTA – The National College Athletic Association (NCAA) Division I Committee on Infractions has found the Georgia Institute of Technology men’s basketball and football programs have committed violations of NCAA regulations.

The Institute was cited for a lack of cooperation during the investigation, a failure to meet the conditions and obligations of membership and preferential treatment violations. There were additional violations in the men’s basketball program related to rules stemming from a nonscholastic basketball tournament conducted on the Institute’s campus, which the public report further details.

“Georgia Tech is committed to the integrity of its athletics program, including full cooperation and support of the NCAA,” said Georgia Tech President G.P. “Bud” Peterson. “Given the information we had at the time, I believe we took reasonable and appropriate steps to determine the proper course of action and acted in good faith. Looking back, there are things we could have done differently. Because of our unwavering commitment to NCAA compliance, we have already taken a number of steps to address perceived shortcomings, hopefully ensuring that our programs remain beyond reproach.”

After being notified of the allegations in November 2009, Georgia Tech conducted its own internal investigation, forming a committee made up of faculty, staff and external counsel that made recommendations based on available information and the internal investigation findings.

As a result of this exhaustive review process and because of Georgia Tech’s steadfast commitment to compliance, the Institute completely revamped and enhanced its athletic compliance operation and staffing. Changes include a greater investment in experienced staff, training and awareness among staff and student athletes.

Penalties include:

• Public reprimand and censure.
• Four years of probation from July 14, 2011, through July 13, 2015. The report further details this probation.
• A $100,000 financial penalty.
• A reduction of two men’s basketball recruiting days during the 2011 summer evaluation period (self-imposed by the Institute).
• A limit to 10 official visits for men’s basketball for the 2011-12 and 2012-2013 academic years.
• A vacation of all contests won by the football team during the 2009 season after November 24, which is when the university was alerted to the potential eligibility issues.

The Institute is considering options including whether to appeal the NCAA decision.

“I want to reemphasize Georgia Tech’s unwavering commitment to compliance and our commitment to the conditions and obligations of membership of the NCAA,” said Peterson

Hairy Dawg- I agree that Ohio State will get same punishment as USC, Auburn will get worse. The problem is the NCAA waits two – three years later before they bring down the hammer. I believe they do this with programs like AU, Ohio State, and USC, because they generate so much money for the NCAA. A program like Georgia Tech or North Carolina football does not.

As far as the death penalty, the NCAA will never give another prominent program the death penalty. They learned their lesson(s) from SMU death penalty (watch ESPN 30 / 30 program on SMU) and lost way too much money. At any rate, the NCAA is a joke who sells out to the highest bidder!

As a recent Tech graduate, it is pretty funny to see all of the UGA fans hating on us. Oh well, we lost our title but I still had a great time during the 09 season and you can’t take that away. And for everyone calling us “nerds”, enjoy living the rest of your life cheering for a jersey. I am pretty happy kicking it back with my 6 figure starting salary.

It’s sad that two formers players do this to the team, and they’re no longer playing for the team. But, it’s also the coaches responsibility to take care of these issues. It seems that a lot of the colleges and teams are being stupid and not realizing what opportunities they have. I am still a die heart tech fan, and that will never change!!

Unlike, the UGA fans I am not going to throw my team to the side and decide to rooting them on when I feel like it. And, I love how UGA acts like everything is perfect with them.

Just sayin’… give up the excuses and figer pointing. Your athletic department turned some minor violations into a major problem by trying to lie and cover up. Don’t try to turn this around. This could have been very similar to the AJ Green issue from last year if GT had just been honest and sat the players out while cooperating with the investigation.

You got the Thomas part right, but Burnett did not play a large role in this. His name is just mixed in. The other main player was Derrick Morgan, but his cell phone bills were straightened out when he was able to produce evidence that he had personally paid them. This refuted a claim that was made to the NCAA, which stated that an agent had given Morgan a cell phone and paid for it.

Ever consider he spoke with a coach or his Son in the NFL about it and they told him he could damage Cam’s career? Head coach at Oklahoma and UT said $$ never came up during Cams recruitment from juco. Is it possible Cam saw AU’s Sr. offensive line and felt that his best chance to succeed was at AU? These silly gift rules have got to be changed. I have given people that I barely know things that might be valued at $312. If someone owns a jersey or ring, why can’t they sell it? Why do NCAA athletes have to give up their rights to their personal property just to play for free and make some other people tons of money?

As for playing an athlete that the NCAA is investigating, I say bring the case. It should be up to the NCAA to decide eligible/ineligible. If the school plays an athlete that they clearly know to be ineligible that should be a penalty but don’t tell the school that their player is being investigated (and presumed innocent) and then trump up the penalty later if they decide to play him.

The NCAA is a cabal of politicians and monopolists masquerading as an amateur athletics sanctioning body. I say it is time to create a rival organization with transparent rules, player stipends, and a football playoff.

The issue is not only the way Tech acted with not cooperating, it’s also the issue with them allowing the athlete in question to continue to participate. People may get all over Mark Richt, but he did the right thing in not allowing AJ Green to play the first game of the season. If you all remember the NCAA didn’t hand down any rulings until after the first game of the season.

College athletics, primarily football and basketball, are a moral and ethical cesspool. I attended my first Georgia Tech football game over over 50 years and ago. Whenever my career allowed I bought season tickets, and had been a season ticket holder over the past 10-15 years. Even before this story broke, I made the decision to not purchase season tickets. I will continue to be a Yellow Jacket fan. My only connection to the team will be through watching the games on tv, when it is convenient. I have also supported other colleges in the past, but, from this point further will no longer be spending anymore of my radpidly shrinking budget, thanks to the government, on college athletics.

Sadly, I’m not suprised by GT’s lack of cooperation and/or cover-up. I feel sorry for the hard-working players on the team that haven’t done anything wrong.

I was a life-long GT fan and former student (and season-ticket holder), and GT chose to lie and try to cover-up an incident that occurred at a football game last season. Instead of apologizing for their actions up-front, they’d rather end up getting taken to court. I don’t think I’ll ever return to Bobby Dodd.

IMO, integrity is worth more than wins (I still supported them when they stunk).

First, telling one of your student athletes that he’s “being investigated” by the NCAA, and explaining to him what the meaning of an investigation is, and what to expect during the investigation, should NOT constitute manipulating a witness in any sense of the meaning. These kids are being brought onto campus straight from high school and put under the coaches care as their guardians. NOT talking to them would be an issue.

Second, if the kids are denying getting any perks,and the only perks that are being alleged are less than $400 (so small, how can anyone even notice them – these kids can buy a watch and a shirt with their own money, this isn’t like it was a Rolex, a car, or a trip somewhere), how in the heck did they expect GA Tech to be able to find out so quickly during the season and take the players out of commission “just in case”?

Now we have to throw in the fact that there wasn’t even an agent directly involved in this matter, but a friend of an agent, and the mess is even more complicated

What if there WASN’T any truth to the allegation? Then the ENTIRE team would have been punished for NO reason over this piddly amount.

This kind of stuff is the exact reason plyers should be comp’ed in some way. The NCAA, as it was over A.J. Green’s issue, is so worried that congress is going to take their money pie that they are penalizing players and institutions over $312 worth of clothing. If a monetary value was placed on the time students give to each member school and therefore the NCAA, the NCAA would be billions in debt. As long as the NCAA allows schools to sell tickets to any sporting event, musical event or play which is performed by a student they are defining the word hypocrite.

Making billions on the efforts of students and then punishing them for taking clothing is so typical of our society as a whole. Do as I say not as I do is not the proper thing to tech our youth nor is it a moral position which should be defended.

I wonder has a student at UGA ever used a tractor owed by a farmer. Has NASA ever given a patch to an engineering student, I am sure they have, if I am right then where is the NCAA and thier rules commitee ?

I was Tech class of 1962 and I have always been proud to say that Tech is different in the quality of kids, and the way things are handled in the athletic department. Unfortunately, despite all of you who just sail along, seeing everything with rose colored glasses, Tech is not so different now, and there have been many of the same problems (maybe not as many, but more than enough) at Tech, in the last 7-8 years, that you holier-than-thou crowd like to laugh about when pointing your fingers at other schools. I’m fed up with the problems, and I’m fed up with you!

i really don’t hate tech. i was at UGA when tech was our bitch late 70’s early 80’s. But my dad … he was at UGA in the 50’s during the drought. He hated the mistique “the tech man.” ( this was before rich atlanta kids started going off to school.)

Dallas Jacket, even though today was kind of rough GT is different and rational fans of any rival recognize that. Someone earlier posted that it is impossible to know what kids between the ages of 18-23 are doing all the time and it is true.

Did the administration mishandle parts of the investigation? Sure, but with the NCAA, no administration ever knows quite what to do. The rules are arcane in many instances and communication is not always clear either.

In hindsight I’m glad CMR chose to hold AJ Green out of game one last year before the NCAA finally got around to it’s ruling. To be fair, though, the GT athletic department wasn’t specifically told to hold the players in question out of the bowl game. What do you do? The NCAA is so unpredictable, you’re kind of darned if you do and darned if you don’t. Just last December, they allowed the OSU players to compete in the Sugar Bowl while they continued to investigate…I think you see what I mean.

I don’t know why ANY school cooperates with them. They are going to do what they want regardless. Every institution out there should fight them every step of the way.

For all those who are unfamiliar with college athletics: If you believe that $312 of gifts deserves punishment, then there is not a single team in any major conference who should not be placed on probation.

The NCAA is a joke. Let’s think long and hard about this one. A friend of a friend who works for an agent. That means agent>friend>friend>BeyBey. That is three degrees of separation. So if anyone of us who knows a sports agent gives something to a college athlete, does that mean it is an improper benefit?

Let’s change the scenario: If a student is on an academic scholarship, but receives any assistance from an individual (e.g. friend of the family, “friend of a friend of a family member), should there be consequences?

Seriously wrecked, the NCAA never expressed a cover-up; their claim was that the discussions between Paul Johnson, BeyBey, and Morgan caused a manipulation of information that could possibly interfere with the investigation. It was shown that Morgan definitely did not receive anything.

Again I ask: where was the cover up? Was the Auburn situation a “cover-up” because they chose to play Cam? And why were Ohio State players allowed to play when the NCAA had already confirmed the wrongdoing? To all Ohio St. and Auburn fans, I do not have anything against those teams, nor do I support any punishments of those universities. I am just pointing out the inconsistencies.

What’s even more pathetic about this story is this: nobody really cares. We all know who won the 2009 ACC championship, and who cares about vacating wins from 2009. It’s sad that none ot his matters, but it is a statement as to how meaningless the NCAA is. I suspect if this is what happens to GT, then let’s be honest, OSU and UNC should get the death penalty. Otherwise, it has nothing to do about the infraction, but rather how it’s handled?? Are you serious? You can commit a serious infraction but as long as you report it and cooperate with the NCAA it’s tolerable? who cares about the titles and records, it’s about the money and $100k is nothing and certainly neither USC or OSU will have to return any money. Until this stuff starts hitting the financial coffers, noone really cares. 2009? That was an eternity ago in college athletics. Let’s just go win it in 2011.. And BTW, I feel the same way about UGA’s minor infractions, Auburn, Oregan, USC, OSU – who cares about vacating past stuff? nonone that’s who.

While the initial violations were relatively innocuous, the Institute was ill served by its Athletic Director who made a bad decision in passing along information on the pendency of the NCAA investigation to CPJ after being told not to share the information with anyone else at the Institute other than the President. Additionally, the decision by President Peterson to permit the implicated players to play the last three games, undoubtedly played a major role in the severity of the sanctions.

It’s not the $312.00 that got tech. in trouble, it is the fact that they hindered the investigation. You can also add in the fact that this is the second time in the last 10 years that tech. has been found guilty of violating NCAA by laws. Spin it all you want, but they did it and now have to pay for it. Learn from it, and insure it doesn’t happen again.

These make no difference – AJ Green, the OSU mess, the UNC case, the USC dethroning! What does count? – GT’s allegedly adult athletic and academic leadership tried to mislead the NCAA and deliberately violated an order to refrain from telling CPJ and the involved players about the investigation. All that said, the guilty parties go free while not guilty players are punished. It is obvious that $100,000 means nothing to Tech, check the Hewitt settlement. It seems to me that the NCAA would be better served to have a table of penalties since the case by case method now in use causes too many undefensable penalty decisions. Georgia Tech may have deserved censure and some punishment but this is off the wall!

Screw the NCAA!! High school players are paid, transferred and given gifts all the time. Why stop it when they get to the college level. The real issue here is the Tech did not pay enough under the table to the NCAA and got hit hard. I think a school should be able to do whatever is necessary to get the best players available. The entire system is corrupt from the NCAA on down.
