A lesson for tenthers in the Arizona ruling

On the angry end of the political spectrum, secession is in the air and a narrow reading of the US Constitution — with severely limited powers for the federal government — is all the rage. But the Constitution is interpreted by federal courts (according to the Constitution), and an Arizona federal judge has delivered a blow to tenthers who believe that the federal government should be allowed to do very little.
In rejecting key parts of the Arizona immigration law, U.S. District Judge Susan Bolton agreed with the Obama administration’s views on “pre-emption,” a belief that states cannot usurp important federal powers.

From the WSJ:

A judge’s ruling blocking major portions of Arizona’s immigration law strengthened the Obama administration’s hand in a battle over states rights that appears destined for the Supreme Court.

The ruling from U.S. District Judge Susan Bolton in Phoenix sided with the Justice Department on the most important federal arguments accusing the state of crossing a constitutional line with a law aimed at curbing illegal immigration.

Several other states are considering similar laws, amid broad anti-immigration sentiment, and the ruling likely will contribute to deterring some of them. Underscoring the political implications of the legal fight, Arizona Republican Gov. Jan Brewer used her gubernatorial-campaign website to vow an appeal of the ruling, and the Republican Governors Association sent out a fund-raising letter from Ms. Brewer seeking donations. . .
Federal courts have given the federal government wide latitude over immigration laws, dating to 1880s laws aimed at limiting Chinese migrants. But in recent decades, courts have also allowed state laws that rely on federal law for their force.

Jonathan Benner of Reed Smith LLP said the judge’s ruling was “surgical” in carving out areas where he believed the state clearly crossed the line. “She’s dealing with an area that’s suffused with federal authority,” he said.

An analysis in the NYT agrees that the ruling will likely deter other states from adopting a harsh law similar to Arizona’s:

Although Judge Bolton’s ruling is not final, it seems likely to halt, at least temporarily, an expanding movement by states to combat illegal immigration by making it a state crime to be an immigrant without legal documents and by imposing new requirements on state and local police officers to enforce immigration law.

“This is a warning to any other jurisdiction” considering a similar law, said Thomas A. Saenz, president of the Mexican American Legal Defense and Educational Fund , which brought a separate suit against the law that is also before Judge Bolton.

I doubt if the ruling will serve to deter many states from similar laws. There may be a few governors and state legislatures who have the good sense — in these times of gaping state budget deficits — to refrain from engaging in expensive lawsuits they are unlikely to win. But most will not.
After all, governors and legislatures are endorsing such laws strictly for political reasons — to appease a nativist constituency that is angry over immigration. That backlash won’t be halted by common sense.

Why doesn’t our government enforce the current Federal law? While they are at it, arrest and heavily fine any individual or business who hires an illegal worker. The present law needs to be reviewed, but enforce it now! My grandfather came to this country illegaly many years ago; he became a citizen soon thereafter. Why do these illegals come to this country and not become citizens? Those who have and will do nothing need to leave. The decision is yours!

As for the Repubs whining about Obama’s stance, where is your proposed legislation? Didn’t McCain work with Kennedy and develop a bill? Now he says it’s Obama’s fault. John, now try to remember that 1. You are a maverik, 2. You are a senator, and 3. YOU can draft legislation for the Senate to consider. Oh, and it can be bipartison, something you claim Obama hasn’t done…but that YOU and the rest of the Repubs can put your ideas on paper. Get to work!……that’s what you are being paid with tax dollars to do! Oh and how do we pay for it?

Might be a good time to review the Obama Administrations actions on immigration:

the federal government under President Obama has steadily increased the deportation of illegal immigrants., The Immigration and Customs Enforcement (ICE) agency says it’s on track to expel some 400,000 people this year, 8 percent more than 2008 — the last year of the Bush administration.”

The Obama administration is also targeting employers who hire illegal immigrants. But instead of conducting a few high-profile raids and hauling workers away in handcuffs, the government is auditing the working papers filed at hundreds more companies. And there’s been a nearly six-fold increase in the past two years in employer fines.”

Obama admin. has increased the number of Border Patrol agents. PolitiFact has noted that Obama has been “increasing the number of border patrol officers.” The Arizona Republic reported on May 26 that “[t]he Border Patrol today has more than 20,000 agents nationwide, more than 16,000 of whom are assigned to the U.S.-Mexican border”

Obama admin. significantly expanded Border Enforcement Security Task Forces. Politico reported on May 6 that “[u]nder the Southwest Border Initiative, the Obama administration has doubled agents assigned to the Border Enforcement Security Task Forces.” According to Immigrations and Customs Enforcement (ICE), these teams “incorporate personnel from U.S. Customs and Border Protection and other key federal, state, local and foreign law enforcement agencies” to “collaborate and share information to fulfill the overarching goal: to interrupt the flow of cash, weapons and ammunition that fuel the illicit trade of the drug cartels.”

Obama admin. increased number of intelligence analysts on border. Politico stated that the Obama administration “tripled the number of intelligence analysts along the southwest border” and “sent in new canine teams.” The Department of Homeland Security announced these increases in March 2009.

Obama admin. began screening “100 percent of southbound rail shipments.” Testifying before the Senate Judiciary Committee on April 27, Homeland Security Secretary Janet Napolitano stated that “for the first time ever, the Border Patrol is screening 100 percent of southbound rail shipments for cartel-related contraband. This practice augments the longstanding practice of screening 100 percent of northbound rail shipments.”

Recovery Act included funding for Border Security projects. According to DHS, the Recovery Act provided funding for Customs and Border Protection and Immigration and Customs Enforcement.

Seizures of contraband increased under Obama administration. In her April 27 Senate testimony, Napolitano stated:

Since March 2009, CBP and ICE have seized $85.7 million in illicit cash along the Southwest border, an increase of 14 percent over the same period during the previous year. This includes more than $29.7 million in illicit cash seized heading southbound into Mexico — a 39 percent increase over the same period during the previous year.

During the same period, CPB and ICE together seized 1,425 illegal firearms, which represent a 29 percent rise over the same period in the previous year. At the same time, CBP and ICE seized 1.65 million kilograms of drugs along the Southwest border, an overall increase of 15 percent.

Additionally, the San Diego DHS Maritime Unified Command — comprised of U.S. Coast Guard, CBP, ICE and other law enforcement partners — saw a more than six-fold increase in maritime drug interdictions in the Pacific waters extending from the Southwest border. The Command seized more than 26,000 kilograms of drugs in fiscal year 2009, compared to 4,029 kilograms seized in fiscal year 2008.

Good morning, Miss Cynthia,

The fact that Georgie Bush failed and Barry Obama is failing to enforce the United States immigration laws is not without precedent. Presidents, on occasion, choose to not carryout acts of Congress and decisions of the Supreme Court at least in a timely fashion.

Of course, Barry will have no problem carrying out the decision of U.S. District Court Judge Susan Bolton, which, as much as I would like to see it differently, is the correct decision under our Constitution.

History, however, has a way of diminishing the legacy of such shirkers, and, methinks, come November 2, 2010 and, again, November 6, 2012, the electorate may have a way of dealing with it as well.

Then what you are saying is that the Federal Government has a responsibility to enforce immigration laws, and not only are they not doing so, but they are actively fighting against any possibility of doing so, and further are seeking ways to get rid of those very laws (or gut them through amnesty).

I wouldn’t go so far as to call it treason, but a government that refuses to enforce laws it doesn’t like at the very least is no longer legitimate. I may not have voted for him, but Obama is still my President, and I expect him to enforce the law. That includes immigration laws. If he won’t, then he needs to step down and allow someone who will do the job get things done.

Here is the basic question.

I the Constitution, one of the powers of Congress is to – “To establish an uniform Rule of Naturalization…” Article I, Sec 8. Also in the same Article I, there are powers denied the states. The Constitution does not forbid the States regarding immigration.

If anyone can show me where the states do not have the duty to enforce immigration law, please point it out to me.

And being a tenther, I guess I should say, I believe n all the amendments, I am just asking someone to point out where in the Constitution it lays out that only the feds can enforce immigration laws.

Immigration and Customs Enforcement will deport approximately 400,000 illegal aliens in fiscal year 2009, up 10% from 2008 and 25% from 2007 – the last two years of the Bush Administration. The majority of the illegal aliens deported are criminal offenders who were identified through ICE’s Secure Communities program.

“We’re trying to put our money where our mouth is,” ICE Director John Morton said in an interview with the Washington Post. “You’ve got to have aggressive enforcement against criminal offenders. You have to have a secure border. You have to have some integrity in the system.”

Jimmy, I am sure you made the same cry for resignation of Bush and Cheney right.

But of course what you mean: Is the fed enforcing the law to your satisfaction and with the appropriate resources. Of course to have that discussion, you have to discuss the resource allocation, the efforts being made and decide what the issues are. In addition you have to discuss what the problems are with current enforcement efforts, fixes and to deal with the difficult issues that arise in enforcement. Allocate to the court system and immigration system resources….

Of course, at the same time, fight 2 wars, provide tax cuts for the rich, etc, etc. Its a complicated world and all the parts have to be looked at in the totality and not just your little isolated demands. There are nuances.

We can agree there needs to be a fix. AZ however should not be trying to drive that fix with a law that is unconstitutional.

Obama really did not want to have the radical Clinton appointed judge come down the way she did. He wanted to file suit and for everything to move along how it was, just so he could say he tried. Now with this TEMPORARY injunction, it’s only going to fire up the country even more. All this did was speed up the inevitable, which is getting the case before the supreme court. This judge’s explanations are idiotic and clearly biased. Sound like something you’d say. The Supreme Court will most definitely come down on Arizona, and America’s favor.

This whole deal could be solved in a few short weeks. Earlier there was a guest worker program, this allowed worker to cross the border, work and return to their homeland. Everyone was happy, until the Unions stepped in and killed it. Bring it back.

Giving workers a legal avenue to work her, pay taxes and not steal or fake id would ease the strain on LEO’s and other agencies. Some updating might be needed, but I am sure our benevolent dictator would agree.

Just for those in mid-town, it was called the “Bracero Program”. It was killed by organized labor in ‘64.

The MOA changes, however, undercut the motivation of jurisdictions to participate in the program by forcing prosecutors and law enforcement to prosecute illegal immigrants for the underlying crime instead of simply processing them for removal. Furthermore, they limit the ability of law enforcement officers to check immigration status to that of only minor offenses. Essentially, without saying so, they gut the force-multiplier purpose of 287(g). These changes are driven entirely by political special interests and are not representative of the positive contribution section 287(g) makes toward enforcing immigration laws. The Obama Administration should not move forward with these changes, and it should instead promote the expansion of section 287(g) and similar programs.

No doubt about it…the “under the radar” labor force has been a boon to the “corporatist” interests over the past two decades, but it has also helped Uncle Fudd keep his lawn mowed and his construction projects on track, and it has helped Auntie Em keep her laundry, ironing, and cleaning up-to-snuff. (Wonder how many of you know what “snuff” is?…but I digress).

Georgie and Barry realize that the illegals provide a much needed resource (cheap labor) and, if amnesty can be achieved, perhaps a new and more powerful Latino voting block.

I wonder…could it be that some of our other minorities might need to be concerned about that new voting block and the influence it might come to exert on policymakers?!?

Many people are saying that the AZ law is violating the civil rights of the illegals in this country. I thought civil rights are defined as:

Many want illegal immigrants out, many want them in, and some of us just want a Comprehensive Immigration Reform together with closed borders and illegal employment enforcement. If we take illegals out little by little you will notice that the consequences will be an even worse economy. Yes, there will be fixes to health care and public education expenses but that wont stop many businesses from closing or slowing their growth. Path for legal status with fines and penalties I say.

Word of advice to my many Georgia peach citizens and residents, stop believing all the so called “conservative” extremist right wing radio talk shows and media say to us. There’s nothing wrong to listen to their arguments, but we should look at the other side of the coin as well. Most people in the media only work for their party’s agenda. When was the last time that you were stopped by a policeman and NOT asked for your DL, Registration and Proof of Insurance? Illegals call having to show ID “racist”.

One liberal judge made a ruling…so this is not over by any means…it will go to the supreme court where there are more conservative judges 5-4…so this could get overturned. But here’s another case where a liberal judge rules based on her own liberal doctrine and in her mind, that outweighs the will of the people. We see this all the time in gay marriage, where people vote it down, liberal judges rule in favor of it. For this AZ case, if the feds won’t enforce the federal laws that are on the books, states should have a right to enforce those same laws.

There are over 400K unaccounted for illegals with outstanding deportation orders. One fourth of these are hard core criminals

80 to 100K illegals who have been convicted of serious crimes are walking the streets. They will commit 13 more serious crimes/illegal before being caught.

Illegals are involved in serious crimes at 3-5X their proportion of the population.

About 267K illegals are in Federal or State prisons at a cost of about 6.8B/yr.

56% if illegals charged with a re-entry felony offense have previously been convicted of a felony offense on 5 previous occasions.

Illegals commit from 770K to 1.289K crimes/yr.

Illegal sex predators commit 130K sex crimes/yr.

Nearly 240K illegal sex predators walking the streets will commit 8 sex crimes each before being caught.

The brutal M-13 gang has over 15K members and chapters in 33 states, all illegals.

Overall financial impact on this country for illegals is estimated at 60-80B/yr. Factor in cocaine and it soars to close to 150B.

Bottom line…… all of the above and you do gooders are still hung up on not offending someone. This problem is squarely on the lawn of 1600 Pennsylvania Avenue, more so now than ever before. You can make excuses for this clown’s inability to solve problems all day long but the fact still remains that he is so inept that he is an embarrassment to this country and to it’s citizens. He refuses to enforce our laws, he turns his head the other way when confronted with this problem and has his chin in the air so far as to feel that all of these “common” problems are just an annoyance. Fully 2/3 of the population supports the Arizona law. You do realize she did nothing of the sort, don’t you? Rather, she said the courts should resolve the issue and the law shouldn’t go into effect until that issue is resolved. That it will be resolved by her does not indicate which way she will rule, only that she believes the issue of sufficient importance to block application of the law until it is resolved.

That doesn’t mean she WON’T in the end agree with the Obama administration’s view of pre-emption, only that she has not yet.

General Motors and other manufacturers skipped their traditional summer shutdowns, which led to fewer layoffs and unemployment claims. But the impact of that distortion has largely faded from the data, a Labor Department analyst said.

The four-week average of claims, which smooths fluctuations, dropped to 452,500, the lowest level since May. Economists say jobless claims need to fall to at least 425,000 to signal sustained job growth.

Last week, Virginia Democrats made gains in state and local elections even though the state has been embroiled in fiery debate over illegal immigration. As an analysis by the Washington Post concluded, voting trends didn’t benefit “those who campaigned the loudest for tough sanctions against illegal immigrants.”

Let Republicans take the low road. It doesn’t end in a place the rest of the country wants to go.

I do expect this case to at least land in the 9th Circuit and believe they will find along similar lines as the District Court. The question will then be whether Arizona wants to gamble on taking this to the Supreme Court. Every step in this process is expensive.

I think the Supreme Court would re-iterate that matters of Immigration are solely vested in the Federal Government. They might remand back to the lower court on certain findings of fact but will underscore federal pre-emption.

As several have pointed out here the current Administration is actually doing more to enforce current law than recent previous administrations. Until we find a way to dis-incentify businesses (large and small) from employing those here illegally, this wave of illegal immigrants will be very difficult to stop. And mass deportations is a very difficult matter to undertake.

Liberals, at least myself and others I know, do not support the rights of illegals to enter and stay in this country. But what we recognize is the problem is so immense that a simple nab and deport strategy is doomed to failure. We need some form of comprehensive reform. I for one would prefer we craft a calm period during which we allow those here illegally to return voluntarily to their home countries or for those who are here for humanitarian reasons (persecution, etc.) to seek assylum. Once back in their home countries they could apply for a guest worker program or participate in the current legal immigration process. Once the calm period is over then the nab and deport should be vigorously pursued.

I agree that legal action by the state is costly. However, state unemployment (of citizens), crime (whether decreasing or not), and the total disregard for laws that break our hearts is even more
costly.

As for preemption this already occurs with other federal laws. The National Minimum Drinking Age Act of 1984 is a federal law but is enforced by state and local Police. This is why preemption will not hold up in the Supreme Court.

As for solutions. What is America to expect from Liberals? The Party of “NO” seems to fit democrats more these days as Democrats have not come up with one comprehensive piece of legislation for immigration reform. All we hear is “Path to Citizenship” and nothing about control the boarder. Additionally, SB 1070 has in it more pressure on those who hire illegals.

The Drinking Age Act you reference requires states to pass legislation making purchase and possession of alcohol by anyone under age 21 illegal and for enforcement. The federal government’s only recourse against the states, however, is in the Federal Highway Act that claws back a percentage (believe up to 20%) of a state’s federal highway funds if they don’t comply.

Federal pre-emption still applies. A state cannot unilaterally say it is going to enforce federal law. The federal government can prescribe, as they did with the Drinking Age Act, the states to do this but that authority is nebulous. The real power with the DAA is the gotcha with federal highway funds.

The actual authority, however, for making and enforcing immigration policy lies at the federal level. That federal pre-emption is clearly embodied in the Constitution and case law.

As for the party of “No” I have to laugh. This Administration has tackled some very tough issues including the Federal Stimulus Act, Healthcare reform, Financial Services reform. All 3 of those are interrelated regarding the state of the economy. They were priorities. Whether you agree with those policies or not they were intended to address the acute needs to keep the economy from sliding further toward recession, reform a healthcare system that works for few and protect the economy from the excesses of the free market.

Immigration Reform isn’t something the Democrats have said No to. They simply haven’t taken it up yet. You can’t say No to something that hasn’t even been placed on the agenda. The President has called for Congress to begin work on this.

Obviously in an election year this kind of issue will not be tackled until after the elections and likely until the new Congress is seated in January.

2) As a child of the 60’s raised in Alabama, the term “states rights” or “state authority” just sends shivers down my spine.

3) I have among my circle of friends several hispanic legal immigrants. In my observation, they are the ones most riled up by illegal immigration. One is a hispanic female who fled Cuba and was shot while she was escaping, but it still took her five years to get asylum. She says, “why didn’t I just go to Mexico and walk in”.

Just as my friends and coworkers from Vietnam, Russia, Slovakia, Mexico, Kenya, India and El Salvador have done:

Apply for a visa and visit legally. If you decide you want to stay, apply for a work permit and get a job and an extension to your visa. If you want to stay, apply for citizenship. It may be hard work and take a while, but IT’S WORTH IT!

My friend from Russia left his practice as a doctor to come here and deliver pizzas for a living. He worked six and seven days a week, lived in a small apartment and worked his way up. Now he’s a citizen, has his family here and owns a nice home. He’s a role model not just for immigrants, but for all Americans. He made the American dream a reality, LEGALLY.

If Arizona doesn’t get to deal with the laws as they propose, there will be vigilantes out there who take law into their own hands. Yay. Violence! Way to go…

This blog is about Arizona. No, I would not have favored Jim Crow laws. I think I also mentioned in a later post about several of my immigrant friends. Some are white. Some are not. I have learned a lot from them and appreciate what it took for them to come here and become Americans. I did however forget to include my Canadian friends. I have several of those too. None of them are here illegally. A Mexican friend of mine was detained for six days last year because he could not prove that he was here legally. He’s been here since he was six years old. He agrees it sucked, but was his own fault for not keeping up his documentation. He’s not yet a citizen, but has since fixed the situation and feels the police did no wrong in doing their jobs. He’s on the path to becoming a citizen.

So in short, no is your answer. I’m not pro-white. I’m pro-legal. Guess what, I’m mult-racial, so your presumptions are as racist as Cynthia and Granny’s.

To answer your last question. I think that in Arizona, if a Latino person breaks the law and is caught, he or she can be asked for proof of citizenship. Arizona is on the Mexican border. Based on geographical fact, it makes sense that there’s a possibility he or she may not be documented.

When I apply for credit, passports, jobs, etc… I’m asked for proof of citizenship. I’m not mad. I comply. It’s part of the process. Why should EVERYONE else, including Latinos not have to do the same? If I commit a crime, they’re surely going to run a background check to see if I have any outstanding warrants or prior arrests. If I’m Latino and have no records in the system at all, the cop should be allowed to ask me for proof.

It appears that it will go next to the Ninth Circuit which is one of the most liberal organizations on the planet. They will no doubt uphold what this liberal judge had to say, then on to the SCOTUS where it will turn into a battle for who has the right to tell the states what to do. It will change from an immigration issue to one which will question the rights of states to challenge or to trump Federal law. I think that that is what Holder had in mind all along. They knit picked the case to hide the real issue from the start. The original issue was immigration but that will soon change.

This issue is FAR from resolved; as long as the two major political parties perceive illegal immigrants as a potential voting bloc this issue will not go away and will NOT fade into the background. This legal ruling will likely find its way to the Supreme Court in time, if another legal front doesn’t preempt it.

The underlying issue is the legal citizens of this country are being sold out for the benefit of the elite. You expect to change my mind, or my neighbor’s? Ha. Just thought I should point out that Ms. Tucker made a major constitutional error in the introduction to her article. The decision that the Constitution was to be interpreted by the court as a final arbitor came through Marbury vs. Madison. The role of the court was originally to judge cases through statutes and the Constitution, however its “veto” power- by declaring them unconstitutional- over laws was not established until Marbury.

I grew up in Texas, it’s the same in all border states. There are now and always has been a large percentage of citizens who have spanish names. Any police force is going to have lots of officers with hispanic heritage.

From the “The Constitution of the United States”:

“Article 6….

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.”

It is called the Supremacy Clause and the Supreme Court has always enforced it.

The question is whether the Arizona law and the police enforcement mandates in that law in any way conflict with Federal law or enforcement activity. If there is a conflict the State must give way to the Federal activity.

Had Arizona simply passed a law with no enforcement mandates there would probably not have been a case brought by the Justice Department.
But Arizona passed the law for political reasons as much as enforcement reasons. And the Justice Department brought suit for political reasons as much as constitutional reasons.

If this reaches the Supreme Court I will predict today that Roberts & Alito will side with Kennedy and the 4 liberal justices to bring in a 7 – 2 opinion siding with the Justice Department. Both Roberts & Alito tend to lean to the side of a big central government. Scalia & Thomas both tend toward the State side. (I am assuming, I believe with good reason, that Kagan will be confirmed by the Senate).

Those who entered the country illegally have used our hospitals, school systems and countless city/county resources for free, yet have paid no taxes to help support such resources. Bush and his buddy John McCain had no problems with open borders and Amnesty. Obama pretty much agreed with them. Now that he is putting more resources on the Border than Bush did, he is suppossed to be credited with closing the border. I don’t think so. It is like a bucket with hundreds of holes in its bottom. Barry dropped some caulk over two of the holes and he is to be celebrated. He knew the bucket would still leak enough undeocumented democrat voters to help him.

If he refuses to enforce laws the congress passed, he should be impeached for failing to fulfill his oath of office. I believe he is sworn to protect us from all enemies foreign and domestic.

The major elements of federal health care reform become effective in 2014.

The peak savings for the state take place in fiscal year 2016, when the state will save an estimated $250 million. But the savings begins dropping off in the next fiscal year to $145 million, then to $80 million in fiscal year 2018 and $46 million in fiscal year 2019.

Maryland currently has between 700,000 and 800,000 uninsured residents, according to state health department estimates. The report notes that after the federal law is fully implemented, that number will be cut in half.

The reason it will only reduce the rate by half is largely because the law doesn’t apply to people who are not citizens and because not everyone who is eligible for Medicaid applies for it.

The report points out that federal health care reform will have unique effects in Maryland. That’s because the state in recent years extended coverage to more than 200,000 people by expanding Medicaid eligibility to low-income adults. Maryland also has helped small employers offer coverage. In 2003, Maryland formed a high-risk pool for people barred from insurance for health reasons.

What Maryland is saying is that it will adjust during the time frame prior to takeover to insure that “the state must focus on bending the cost curve early in order to improve the outlook at the end of the decade.”

It’s better than what else that has been proposed!!

Read “Nullification” by Thomas Woods and see if you don’t agree that Nullification of unconstitutional federal legislation is not only allowed, but is a functional, necessary, and well-established mechanism that has been used successfully to push back the overreach of the federal government. Those of us who understand the limits the constitution was supposed to put on the federal government recognize that something must be done to reign the beast in. Nullification is the peaceful approach that states must ALL be willing to take.

It was used by Wisconsin to nullify the Fugitive Slave Act (yes, you black racists, it is not just for upholding slavery), and it has most recently been used to nullify the Real ID act, and federal anti-marijuana laws (medical marijuana). When California legalizes marijuana outright in November, hopefully another unconstitutional federal ban will begin to fall and the rest of the country can begin the road to freedom from the totalitarian war on drugs and financially destructive war on hemp.

8th Amendment
To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies (btw GM’s restructuring violated this one) throughout the United States;

VS.

8th Amendment
To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;

10th Amendment
No State shall, without the Consent of Congress, lay any duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.

If I were Arizona, I would declare that they are iminent Danger (from drug lords), being invaded, and that the Feds are delaying. Would be interesting to see how the courts would rule. The Fed would have to put forth that their uniform Naturalization policy is non-enforcement.

Ohio May Need $1 Billion More Next Year For Medicaid.
The Columbus Dispatch (7/21, Siegel) reports that “unless Ohio gets more federal stimulus help, state leaders will have to spend $1 billion more next year on Medicaid just to keep the same level of coverage that’s in place today.” The “sobering statistic” was one of “many relayed during a four-hour hearing today of the Budget Planning and Management Commission,” the bipartisan legislative panel that is examining ways “to deal with a future budget shortfall that could reach $8 billion.” The hearing focused on Medicaid because it is the “single-largest area of spending in the budget and has grown fast – an estimated 30 percent in three years by the end of June 2011.” Some have “proposed ideas such as capping hospital payments” and cutting “the 12.5 percent administrative allowance for HMOs.”

In all of my travels, I have never been to a country with more lax immigration laws than the U.S. In other countries, I am expected to have my passport and visa with me at all times. I have been profiled and asked for my documentation mulitple times. Each time, I produce the documents without a fuss; I have nothing to hide when I’m in a country legally. I EXPECT to be profiled when I am the only gringo for miles; whatever. If you are in this country illegally, it is apparently an infringement of someone’s rights to require them to have documents with them. WTF? The immigrants from Mexico and other latin American countries are some of the nicest, hardest working people you can meet. Can’t we find a way to speed up and streamline our immigration system so we can make it easier to become a law-abiding, TAX PAYING, citizen?

“In rejecting key parts of the Arizona immigration law, U.S. District Judge Susan Bolton agreed with the Obama administration’s views on “pre-emption,” a belief that states cannot usurp important federal powers.”

It is interesting how a state can pre-empt federal powers by re-stating a federal law that the federal government will not enforce, and then enforcing it. The question begs a million other questions: Can the feds pass, say, a federal tax law and then either not enforce it or enforce it on a subset of people? And more specifically, if Congress (at some point) passed a law, they EXPECTED it to be enforced, and it is the PRESIDENT (OBAMA, BUSH, CLINTON, BUSH) who are directly responsible for enforcement. It means that any single law that a President doesn’t like can be selectively ignored. So if a PRESIDENT selectively refuses to protect any (or all) state from foreign invasion, the state or it’s citizens are not allowed to protect themselves? 10 million illegal immigrants IS a foreign invasion. The President takes an oath:

“I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”

If Arizona is preempting federal law because the Federal government reserves the right to regulate naturalization via the Constitution, then the President has failed to defend the Constitution as prescribed in his oath.

For those of you who are celebrating Obama’s “stepped up efforts” in this area:

Every illegal alien is a criminal based on the common definition of a criminal as being someone who has broken the law, be it entering our country illegally, jaywalking, drunken driving, speeding, battery, breaking and entering, rape, etc. Some may be more heinous than others but they all represent some manner of behavior that is prohibited and that has consequences as defined by the law. Illegal entry by a citizen of another country shows that the person has no regard for the laws of our country and their first act in our country is to break our laws. Hardly the mark of a fine upstanding character. And I really don’t care what happened 150 years ago, as the times and circumstances have changed dramatically. If you disagree with that then stop reading because you are an elitist bleeding heart and feel that laws may be applied selectively unless it’s a law you support. We can’t be selective in our reading of the law, that’s why it’s called a law. Now to cast some light on your “Facts”:

If we ignore the influx of new illegals because they secure the border, or the economy stinks and no one wants to come here anymore, our currency gets so diluted by the continued deficit spending that the Mexican Peso becomes more stable that our dollar or if we make illegals so unwelcome that it is not an attractive option, then it will take the Feds a minimum of 25 – 30 years at the current pace to get rid of the criminal element if you accept that there are 10 – 12,000,000 illegals here. If you accept the higher numbers, then these numbers grow to 50 – 60 years to just rid ourselves of those who choose to ignore our laws.
If you don’t stop illegal entry and use a hopefully high end number of 1,000,000 new illegals each year, the current rate of deportation will NEVER solve the problem. If you reduce the entry population by half to 500,000, you will NEVER solve the problem. If you reduce the entry rate to 200,000, you will NOT eliminate the illegal population in the lifetimes of anybody reading this column, nor their childrens lifetimes. Those are some calculations based on differing estimates of the number illegals here and entering.

So Cynthia, while you are busy heaping praise on Obama and his “crackdown”, take a dose of reality and understand it is a drop in the bucket. It is a token move designed for political impact so that he can claim he is tough and not a policy move that defines a new direction (CHANGE, you remember that word, don’t you) that will solve the problem.

Congratulations on not hiring ILLEGALS, all employers should be required to request a birth certificate or passport. In previous hires, I have had to do so.
In my travels in Asia I have always been required to have my passport with me, no problem if you have it.

I think you missed the point Cynthia. The law is intended to aid the federal government in enforcing Federal immigration law.

If anything, Latino voters should be crying out against the Democratic-controlled Congress and the Obama Administration for not fixing the flawed federal immigration laws. They definitely have the votes, Cynthia… Why doesn’t Congress do something? If they would just make it easier for people to come here legally, the AZ law wouldn’t be so bad.

How about this idea: create a Georgia law that only requires any business licensed in Georgia to utilize the federal E-verify program for any new hires AND require the screening of all current employees through the E-verify program. Then businesses could not claim they did not know their employees were illegal (for those of you who are unclear – the law says businesses may not KNOWINGLY hire those without proper documents – that keeps most businesses within the law while hiring illegals). This would, in my opinion, be a perfectly sound STATE regulation which would cause mayny illegal aliens to self-deport or go to another state. Of course, expect the costs of Vidalia onions, chicken, carpet, and houses to go up – that is just the price you have to pay to WHAT PART OF ILLEGAL DON’T YOU UNDERSTAND! enforce the law.

Also, it was interesting to see on the news that lots of crew members of boats working in the Gulf couldn’t get BP to pay them because they were paid under the table and did not file their taxes.
