Iphone maker Apple Computer wants eight Samsung mobile phone devices banned from sale in the U.S. immediately, days after winning a $1 billion patent infringement lawsuit. But its South Korean rival vows to take “all necessary measures” to prevent that from happening.
Apple’s request is expected to be considered by a federal judge Sept. 20 in California. At the same time Samsung is going to ask that the potentially crippling verdict be thrown out due to lack of evidence. Apple is expected to ask that damages be tripled to more than $3 billion.
The models Apple wants removed are among more than 20 Samsung devices a San Jose jury said infringed on Apple’s software and hardware designs for the iPhone and iPad. The jury ruled Samsung copied innovations such as scrolling and zooming in on a screen by double tapping, and Apple’s setup for displaying icons.
The immediate Samsung list includes older devices and those sold mainly online, including the Galaxy S 4G, Galaxy S2 AT&T, Galaxy S2, Galaxy S2 T-Mobile, Galaxy S2 Epic 4G, Galaxy S Showcase, Droid Charge and Galaxy Prevail. The list doesn’t include the new Galaxy S III and Galaxy Note. The U.S. District Court judge hearing the case had already banned Samsung’s Galaxy Tab 10.1 from the U.S. market.
It could be months or even years, however, before the dispute is finally resolved. Samsung plans to appeal.
“We will take all necessary measures to ensure the availability of our products in the US market,” Samsung Electronics said in a statement carried by Dow Jones News Service. Samsung also said it would consider “workarounds” to devices “as a last resort” to get around the patent concerns.
Since Samsung relies on Google’s Android operating system, the big question is whether Apple now will go after Google and its hardware partners with patent infringement suits. Google maintains that most of the infringement and patent claims do not relate to the core Android operating system.
It is said that imitation is the best form of flattery. Is Apple being unrealistic to think that it can prevent its technology from being imitated?

It is called product branding. Even if the product is a year or two old, in order to maintain their trademarks they need to pursue these things. Xerox has been fighting the rights to its name as a verb for many years and no deemed generic making the brand blend into its competitors. Ipad name verses a tablet is going to be about the same war.

What really scares me is how much my nieces desire only apple products. Everything else lis like vegetables to them. They are 18 12 and 8 and you cannot convince them that anyone makes anything better than an apple. The level of marketing (brainwashing) that has occured goes beyond anything I have seen since the good old days of Coke and Marlboro. Apple just owns these kids. Maybe I am the one who is nuts but I would not trade my Razr Max for any iphone.

I have personally used droids & the Samsung S III…went to the Samsung to see what the fuss was about but the email is terrible, getting music on the phone takes hours (using Google Music) and the battery life was laughable. Talk all you want about Apple and the users, the product is SOUND!
Be honest, I bet all you Samsung / Droid lovers had to plug your phone in by lunch.

My wife has a Mac and I phones 4s and an Ipad…. Like I said, I don’t get it. My Razr Max has as much processing power as a Mac. I can’t use the Mac to do any type of hard processing or gaming. My Alien will run circles around the mac for the same $. My Razr has a 22 hour talk time. I charge it every few days and can watch hours and of movies on it between charges. Unlike most spyder webbed iphone screens the gorrilla glass on my phone is tough as nails. Had it 6 months without a case and it looks brand new. The camera takes better pictures. I swap out micro usb memory cards and can carry my entire music and movie collection in a case the size of a cigarette lighter. It plays all files. Again, tell me how these apple products are better? Is it the sticker you put on your car? The ipad is pretty slick but does not have any feature that makes it better than the competition. Itunes is a horrible mistake. Why are you standing in line again?

Someone get this apple tool off here. Head and shoulders above??.. Apple can’t even figure out the notification system that android has had for years. Have a text or email, Google will tell you right at the top of your phone, while in apple you have to open up the app or program just to see what new messages or email you have. Put that on top of faster os and cheaper phones and it really isint a contest, its just tools like you who have extreme brand loyalty. the only thing apple has ever had is better apps and that is slowly going away. Almost 60% of new smart phones purchased are google’s os, and if it wasn’t for U.S. consumers, which in most cases are retarted, that number would probably be close to 70%.

The innovation required to patent something must be awfully low when the indicated items are even patentable in the first place. Shouldn’t double tapping to scroll and zoom be something so obvious that it shouldn’t even be eligible for a patent? Reminds of the “one-click ordering” that somebody went after Amazon over several years ago. I think they decided that “one-click ordering” was so obvious that it should never have warranted a patent in the first place.
The patent system has totally run amok when (1) obvious things are allowed to be patented, (2) the patent system stifles innovations for numerous reasons, (3) there are companies and individuals who exist solely to patent certain obvious things so that they can later go after big companies when they incorporate these obvious things in to products (i.e. patent trolls), (4) companies spend billions to buy other companies solely to use their patents in defense of potential litigation (i.e. Google – Motorola Mobility), (5) companies start spending more effort litigating patents than developing new technology.
Apple is doing a great job competing the old fashioned way. Why do this and potentially turn people away from them. Is this what you start doing when you’ve run out of credible ideas. Also, how do you put this before a San Jose jury? How can Samsung get a fair trial in Apple’s back yard.

Most people that speak down on Apple products have never used one. People love the products cause 1. the products are head and shoulders above the rest 2. The customer service is head and shoulders above the rest. 3. If you do have a legitimate issue with one of the products (in some cases not even legitimate) they do whats in the best interest of the customer, not the bottom line. 4. Although they incourage you to purchase the new products (iphones & ipads) when they are released. They still give users of the old ones free upgrades so you get most of the new features! They are one of the only companies left in this country that still shows an appriciation for the person who’s paying the bills, THE CUSTOMER!!!!

I chose a long time ago (1989) to pay umore for the superior technology and products that Apple manufactures. I have never had a virus, never had to find a “work around”, never had to get a patch for a new OS and have always enjoyed having the benefit of the latest technology months or sometimes years before my friends & coworkers could get on their PC’s and Droids. I was an Apple hater until the company switched to the iPhone from the Crackberry. Just a bit of a jump in technology there. Then came the iPads. Now I love Apple (although not necessarily iTunes).
My neighbor has a Galaxy s III and I love that as well.
Unfortunately for customers this lawsuit will only serve to slow down the pace of innovation a bit.

From what I’ve observed from you, it’s bad that Samsung copied some ideas from the iphone, but it’s perfectly fine that Apple stole the same ideas from other companies and just happen to have a silly piece of paper that says they own the idea (even though they stole it). Yeah. About a year late on offering dual core phones.
Another year late on offering quad core phones (assuming the iphone 5 gets it).
Package up Siri like the killer app so the apple sheep eat it up, when droid had a FREE app in 2010 that did the same thing.
Make up some marketing BS called “retina display”, which basically is the same number of pixels as my Samsung but on a tiny lil 3.5″ screen. I.e., pay more for the same pixels and smaller screen. THANKS!
Oh yeah, charge me $700 plus for a year old phone unlocked (iphone 4S). When every other phone that is a year old is maybe $200. THANKS!

I\’ll tell you why I don\’t like Apple……Steve Jobs. He took simple devices(iPod), jacked the price up and marketed them so most everyone wanted one. Not bad, but he made it all proprietary with iTunes and the cords and plugs and locked everything down so no one could get to it which meant he made even more money. All of those cords and chargers are licensed so he(Apple now) gets a cut of the action…..Almost like organized crime.
The MP3 player(less expensive) was around long before the iPod. The smart phone long(less expensive) before the iPhone. The computer(less expensive) before the Mac……Nothing new here. However, just reading some of the Apple fan boys remarks, you would think Jobs was Jesus himself.

The iphone only became popular because it wasn’t available to everyone. You had to have AT&T or a jailbroken phone to use on Tmobile. Kudos to Google for coming up with the Android OS. Made tablets more widespread than that bland ipad (ipod touch maxi) The iphone created innovation. We all agree. We got tired of flip phones, clam shells or those ugly sidekicks. Keep your Mercedes(iphone) while I blow pass you in my Audi and BMW (Droid phones). So did anyone notice the jury found the Samsung Tab didn’t infringe (the one that the judge banned before the trial)? Or that they basically came up w/ a number they liked and backed into the per device charges with the expectation of sending a punitive message (against jury instructions)?
Not that Samsung didn’t chase Apple for a while but the jury didn’t exactly go by the book on this case which may have just opened up a years long appeal process. Apple didn’t do itself any favors when it copied Android’s notification swipe down so this likely won’t be the end of the story.

Longtime Apple user here, and while I still prefer the Mac OS to Windows (pry it from my cold dead fingers if you must), I have seen a disappointing decline in Apple’s customer service and ‘out-of-the-box’ usability over the last 8 years. I’m all for protection of intellectual property, but as Chip noted at 2:13 pm, the patent system is out of what when things like shapes and microbes can be patented (as some pharmaceutical companies have tried to do). How in the heck does one justify patenting a shape? I liked Apple a lot better when it was the underdog; now it’s positioned to become the new dark overlord.

What jobs did it cost here? Android is developed up the street from Apple and all of the devices are built in China from chips Samsung builds. They might as well be built in the same factory. Apple has a fairly small engineering group compared to the rest of Silicon Valley and their R&D budget is minuscule.
Samsung skinned Android w/ a few icons that looked very similar to Apple ones and they stuck w/ the chrome trim + glass look which is where it went wrong for them. They’ve moved past it and are innovated faster than Apple (see Galaxy SIII). $1B which is likely to be reduced or overturned won’t necessarily change anything.

Patents ripoffs have always existed and will contine to exist for as long as there is competition. The problem with Samsung though is that with there latest set of products they went a little too far and tipped the proverbial glass. Is this lawsuit best for the Market? Of course not, but it is necessary. It’s probably not good for Apple either since between an appeal and they next they will rip no benefits. But this will hopefully make Samsung think twice before they make their phones look like an overgrown Apple product.
As far as which technology is best, it’s a silly argument. They both have their advantages and trade offs. iPhones are great for their ease of use and content, while Android based phone have almost infinite flexibility. Each technology has its nich in the market, but there is no need to make one look a smacked copy of the other.

The patents delt with technology. The newer Galaxy probably is a workaround for the technology in question, which is why it’s not part of the injunction. You won’t have to get rid of your phone, but if the Court allows the injuction, Samsung won’t be able to sell that phone going forward. And Samsung wants the case overturned so they don’t have to pay $ for infringing on Apple’s rights as the patent owner.
The case has nothing to do with marketing. The cos use very similar technology and have lots of patents. They’re suing and being sued regularly – to keep their products at the top of the heap and to keep competition from using the technology they patented.
And this is the largest jury award in the history of the U.S. It’s billion – with a ‘b’ – and the judge can triple (treble) the damages portion of that jury decision, if Apple can show that Samsung infringed willfully.
It’s high stakes, but don’t feel sorry for either co. Both have over 100 lawsuits they’re involved in at the moment and are spending lots of $ to make sure they stay on top of technology, patenting it and keeping the $ those patents acrue, if prosecuted wisely.

I’m typing on a Macbook Air here surrounded by an GSIII(personal), Droid X2(firm’s), and iPhone4S (client’s). My firm owned iPad3 is here as are my 2 Windows 7 laptops while my personal iPad and Asus Transformer are at home. I also pay for a family plan for my parents, brother, and g/f w/ 4 more Android phones. If I didn’t need to crank up the iOS simulator on occasion, I’d be working from the much more comfortable Windows machines. Battery life is good but the screen isn’t that good and my watch chewed up the front edge. This is my 2nd Mac but I’ve owned the several thin and lights (Dell Adamo, Thinkpad X220). The Dell was a squared MBA clone but the X220 was a beast compared to this fragile toy.
Other than battery life (GSIII still lasts 24hrs), the iPhone lags on everything I use phones for. I briefly considered swapping the X2 to the next iPhone but came to my senses when I saw that the next version is still gimped compared to my old HTC Evo. Obviously I’ve been impressed by the standby time on the iPhone (8 days one time) but that’s b/c I find no reason to ever actually use it despite having ~4+yrs of app purchases(owned the original iPod Touch) and paid unlimited internet.
Outside of the Air, I have a pretty low opinion of Apple devices. The fact that Cut/Paste doesn’t exist and folder management it atrocious in OSX makes the Mac painful to use sometimes when I can’t find stuff. I have iOS6 Beta 4 running on my iPad and it’s exactly the same as before minus Google Maps and Youtube (really annoying) w/ Siri added. I’ve also enjoyed the wonderful 2hr wait at the Apple Store to get my 35 day old iPad3 replaced ($350 + tax w/ AppleCare) at Lenox when it slipped from my lap, slid down my leg, and cracked like an egg. First time I’ve ever broken a device and didn’t really enjoy amazing CS everyone raves about.
What exactly is better on any of these products?

I bought the Apple 4S at launch, but the whole battery drain fiasco was so annoying and discouraging, I returned it ASAP. Didn’t want to wait for Apple to fix their product; should have been fixed before launch, but my guess is Apple needed to put it on the market as Christmas was approaching. GREED ahead of QUALITY. Picked up the 3D HTC Evo, WAY snappier!

I got into computers early on and worked with both Apples and PCs – even taught community college computer information systems classes. I am retired now. Graduated with an engineering degree from the University of Illinois.
I never could understand people’s fascination with Apple products. They are more expensive and very proprietary (Apple’s monopolistic tactics go back a long way). PCs are less expensive and anyone can make a PC. Installing them, fixing them, and teaching people how to use them, I decided early on that Apple wasn’t the way to go for the ordinary person. Sure, Microsoft has a virtual monopoly on the OS but that’s it. I would like to see that change. There’s lots of open source software for PCs including all the new versions of Linux and OpenOffice. We’re finding virtually the same to be true when you compare iphones with Android phones.
Apple doesn’t create anything new. It copied the concept of the GUI OS from Xerox. The computers Jobs and Wozniak first created where based on already existing technology.
Steve Jobs was a good marketer. He knew how to make people believe that owning an Apple was cool. As someone who has worked extensively with both Apples and PCs, I can say without a doubt the PCs are the way to go for most people.

Roughly half of district court patent decisions are reversed in whole or in part on appeal to the Court of Appeals for the Federal Circuit (’Fed Circuit”). Either the Fed Circuit or the U.S. Supreme Court will have the final word on this. In the meantime it still can be messy with injunction issues, etc.

It’s hilarious the extent that one fan base will go to praise a device vs the other. As it is now obvious both technologies have their pros and cons. If I was one of those techies that loved to spend hours playing around with my phone and explore the zions of the android market for decent apps.I would go a Samsung. Unfortunately I am a training athelte with a day job and as such I prefer the ease of use on an iphone. I don’t have all the bells and whistles that android provides but who cares. I have no time to use them or learn how to use them.
One thing that Android lovers can’t defend is the fact that apple invented the modern smartphone and paved the road for the android operating systems. Without apple paving the way, the first few versions of the android OS would have frustrated users to the point that the entire concept would have been a failure from the start.

Apple is just attempting to monopolize the market (what many Mac fanboys ranted about Microsoft doing years ago when it became a monopoly). Apple fans will always be obsessive Apple fans. Samsung (and similar) users are less obsessively loyal because there have typically been choices between multiple available products using similar interface/OS as one another.
Apple fans get one product at a time, so they feel the need to upgrade each time a new one comes out because it’s the one new version of the one they previously used. That creates loyalty (and obsession, IMO). Unfortunately, most Mac fanboys have never tried anything other than Apple products long enough to see that Apple isn’t a divine gift from God!
As a Samsung user, I tried out the iPhone for 2 years. I liked it, but when the Galaxy S2 came out, I knew a superior product when I saw one. I made the switch… don’t regret it at all. This whole mess has only guranteed that I am probably not even going to consider an iPhone in my next round of upgrades… petty companies don’t get my support.

As for me, I’ve already been down that road with Apple and would never even consider buying ANY of their products — especially an iPhone. It is amusing though, that Apple has attempted this same garbage all over the world and has lost every single lawsuit — until they filed a suit in their home area where the judge would be terrified of ruling against them because so many of the constituency are Apple employees or related to Apple employees. That’s sort of like GM suing Toyota in Detroit. You think an elected official would go against GM there? of course not! Samsung will just appeal this to a higher court (where the judge isn’t effectively bought and paid for) and will have the ruling reversed. It’s nothing but a legal shellgame between the 2 companies right now, but Samsung has additional support from Google and other tech companies, so Apple needs to be careful. Plus, sooner or later all of the little teenyboppers who buy Apple’s junk will grow up and realize how poorly constructed are in general (that’s what happens when you use what is effectively slave labor to build your products) and how unsuitable they are for real world business purposes. I would feel safe in predicting that Apple will not be one of the big players in the personal electronics industry 10 years from now. Too many people are seeing through the smoke & mirrors and the shady (to put it kindly) business tactics employed by Apple.

There’s good reason to suspect that some of the patents/claims will be invalidated on appeal. If Apple wants that injunction, let them put up a bond that will cover the damages resulting from lost sales of products that would be deemed as non-infringing by the appellate court.

Yes, an iPhone is good if you can’t think for yourself and want to throw money in the garbage.I had an iPhone for two weeks and an iPod since middle school. I dumped it as soon as I found out there was no flash player it was jail broken all I wanted to do was watch an hour show I could if I bought it, I got my android and boom I got it streaming to my tv in HD for free, I can put all my music on my phone and expand the memory instead of having to buy a whole new phone, and all the charging cords are universal!! You know you can lead a horse to water but you can’t make it drink. A mind unused is a mind wasted learn to think for yourself people, unless you don’t have common sense, then stick to your iPhone and next time you see a garbage can throw your money in it.

The bottom line is that in a competitive market no companies becomes a global leader by playing the nice guys games. They all steal, pillage and backstab. Someone just happens to it better than others and they become the lions.
Apple products, like all others, are not perfect. They have some traits that appeal to the mass market and it just so happens that Apples knows how to capitalize on them. If you think that Apple products will not find commercial success, it is obvious that you have no idea what you are talking about. The iPad is light years more business ready than any comparable product working on Android. Every company that has implemented any successful business application has done so on an iPad or an iPhone, except for maybe those companies (see Dell) that have vested interests in the Android platform.

There is no comparison between apple and samsung. Samsung is far superior and works nothing like an apple. My kids iphone and ipods are junk, that breaks easily and they love their samsungs now, easier to use, bettergraphics and free apps. That’s what chaps apple. They want to control the world, and everything you do, and they didn’t mind stealing IBMs, linux and xerox’s ideas to do it. They even used microsoft to do it and now use intel, pc chips in their products.
They discust me and are complete hypocrites. Their products are for people that will stand in line and follow them around blindly, thinking it makes them cooler, and as far as user friendly products, android and windows have got it.
I know, because I have owned both. In a Steve Jobs world, he would have been a complete dictator, controling all music, apps and everything else for that matter.
Why would apple sue the company (samsung) that makes most of their small internal parts for apple’s devices?
Apple as a company SUCKS, and I hate their itunes store and the controled environment it puts you in, as it is hard to use and complicated. I won’t allow, my kids to use it any more. We now always use devices that are all easy and compatible to use now. My blackberry’s, droids and pcs all communicate easily and i don’t need a Nazi store to let me do it.
All of my friends that have an apples have just as many problems as pc and droid owners, but the pcs will help you fix it. Apples won’t. And yes!, apples crash and have viruses too.

From the comments here, Apple fans and Samsung fans feel that their products are completely different. Samsung would be wise to make the court aware of this on appeal.

Samsung people are blinded by their own stupidity…enjoy going from charger to charger during your day and being able to watch Star Trek vids on your 40 inch LCD Samsung phone.

rumor has it Samsung is going to release Galaxy S-V in October to punch away the market from iphone “5″
. leaks say it is still the same processor but with 2GB ram, amazing graphics and o guess what >8MP camera featuring the biggest sensor size on a smartphone. and one feature i shouldn’t forget way longer battery life than even the S3.please let it be true pleaseeeeeeeee so that i can get rid of my iphone

Kind of makes you wonder if there’s not some backlash heading Apples way. When Microsoft starting pushing other smaller companies around it became the target of a lot of negative press & attention. Its very fashionable now for folks to hate Microsoft & root for its demise. Apple could very easily be next. Just my .02

Patient crap aside…
I have to profess I’m a gadget freak… Smart phones in particular are a passion of mine. I own Samsung’s, iPhones, Nokia’s Moto’s and Palms. They all have their pro’s and con’s.
Nokia’s N9 has by far the cleanest OS and hardware lines. The hardware is under powered, but with superb battery and features the other OS’s will never have.
The Samsung S III just rocks with and great hardware and a mostly stable OS.
The iPhone 4s is an extremely stable piece hardware and OS out date but extremely stable. Although I have designed hardware for Palm, WINMO, and Nokia. Note Apple…
I have an appreciation and passion for Nokia hardware. No one I mean no one did it better than the Finns. My $ 0.02

there is no comparison between samsung S III and I phone the samsung is way ahead I use both these phones but its also true that the battery life of samsung is very poor… its like race car with a very small fuel tank they need to look into this
