Alabama football fan sentenced to two years in prison

Alabama football fan Brian Downing was sentenced to two years in a prison on Thursday.

Downing, 33, put his private parts on a drunken LSU fan after last year’s national championship game in front of a crowd of spectators at a Krystal Burger fast-food chain. The whole event was caught on video.

Downing had pled guilty last month to two obscenity counts last month, avoiding the original charge of sexual battery – and a possible 10-year sentence and registration as a sex offender, according to Nola.com.

The sentencing judge had some stern words for Downing, calling him a “bully” on Thursday. “You chose, wisely to enter into this plea bargain. The actions that you took on Jan. 9 of this year were morally reprehensible, there’s no way around it,” said the judge, Karen Herman, reported Nola.com

ESPN The Magazine wrote a 7,000-word story on Downing and his victim that you can read by CLICKING HERE – with the warning that the story contains mature subject matter and language.

This is one of those sad scenarios where there’s really nothing gained to put an otherwise law-abiding citizen in jail for two years, but you also can’t just let him walk. Substantial retribution to the victim (which will also be forthcoming) would have made a lot more sense.

This is yet another example of why the rest of America considers the Bama fan base the absolute worst in the sport.

He’s an ex-jock in his 30’s who was a manager in a sports store when not teabagging unconscious guys. I’m pretty sure society won’t collapse without his valuable contribution.

Where's my hope and change?

2 yr sentence?! WTF?!………. a “bully”?!
harmless prank by a drunk idiot. no more harmful than the idiot who shutdown Hartsfield a few yrs back because he went through an exit door while headed to a UGA game. …what did that fool get sentenced to? probation and a fine….this is another case of liberal activist judges. this is political correctness run amok. i suppose Harvey Updyke will be sent to guillotine for poisoning a few trees.

What is it with SEC fans and outward homophobia that only shows its true self as actual homosexuality when they are drunk?

Where’s my hope and change? Would it be a “prank” if it was your face all over the internet with another guy’s johnson on it? Is it going to be a prank when the Bama guys is getting the same treatment in that Louisiana jail over the next two years?

Gotta laugh at people who think sexual offenses are harmless. And this was a sexual offense in public no less. There was plenty of damage done with this acts. Hope you don’t pass on that ignorant thinking to your children.

Do the crime, do the time.

chuck – I doubt that the SEC fan base has cornered the market on homophobia. You don’t think that the Rutgers fan base wouldn’t sound the same?

I will say this though. I played football for a very affluent Atlanta high school in the early 80’s. I am mortified quite honestly about how often the hazing of younger players turned to forced acts of simulated sex and nudity. I never attributed that to it being southern kids doing it as much as it being perverted rich kids doing it.

Dude got convicted of obscenity in New Orleans. OBSCENITY IN NEW ORLEANS?!!!! AND THEN GOT TWO YEARS FOR IT!!! You could convict a tomato of sexual battery in Louisiana the way the law is written. A judge is supposed to have a better grasp on reality and apply the sentence accordingly. If the Saints or LSU is invloved, don’t count on it. Pathetic. Convicted armed robbers spend less time in jail in Louisiana. The judicial system is a joke here.

It is truly sad when people don’t take the time to read an article before they rumble on these blogs…

He going to have to serve a minimum of 10 months before he can be considered for early release.

The pure immaturity of people who attach themselves to the athletic feats of 18-22 year olds (or secondary students) is beyond contemptible!

He deserves the time, every second!

That asinine mindset is making pro football nearly as spectator unfriendly, especially for families and mere visitors…

Calm down people. This was a silly yet stupid harmless drunken prank. Should we burn the man at the stake for this? Last time I checked nobody died, nobody was injured. Is this worth two years in the slams? I think not. George Bush sent thousands to die in harms way. Yet he walks his ranch everyday one state over from Louisiana having never spent a day in jail.

What makes it worse is that a group of Bama fans watched and cheered as it happened. No one stopped it, They just took out their phones and recorded it.

Other than embarrassment I do not see any harm done to the passed out drunk person. Let me repeat that, passed out drunk person. Make him pay the guy $10,000 and 1 year probation. We do not need to ruin a guy’s life over one stupid act.

It will cost him a lot more than $10,000. This is the end of the criminal case. The Civil case will probably cause him to
file bankruptcy to have anything. A lot of the Civil judgment will not be dischargable in bankruptcy.
