
Alabama uber-fan Harvey Updyke is awaiting trial on charges he poisoned the oak trees at Toomer's Corner.
A new report by Auburn University says the famed oak trees at Toomer’s Corner, allegedly poisoned by Updyke two years ago, are probably doomed and will need to be replaced, the Associated Press reports.
The report says the trees’ branches will continue to die, leaving them “aesthetically dead if not actually dead,” AP said.
Updyke, the rabid Alabama fan who allegedly boasted of his deed on a radio talk show — under the name “Al from Dadeville” — after Auburn defeated the Tide in 2010, is awaiting trial on charges of criminal mischief and desecrating a venerable object. He has pleaded not guilty by reason of mental disease or defect. His trial is scheduled for Oct. 1, although his attorneys are seeking a change of venue.
The study, which was conducted by experts after a recent pruning, says a preservation committee will report soon to the university president on whether to continue efforts to save the trees or replace them, but concluded that “the long-term outlook for the trees is not good.”

Certainly hate to hear that the trees will ultimately die due to this low brow’s actions. Gotta respect the traditions of each school even if you don’t like their football team and fanbase. You look at that guys picture and it just screams “I’m a dumba**!”. Although this guy may represent a portion of the Bama fan base including the first poster here I don’t think he represents the majority. They need to remove this guy from society and use him for fertilizer to grow the new trees that will take the place of the dead trees. If you’ll watch closely, everytime a story about the trees comes out, it was either immediately preceded or immediately followed by bad news about the football program. The latest bad news is the Jovon Robinson story. Before Robinson there was the Reuben Foster stuff. Auburn officials and fans refuse to admit that the constant rolling and pressure washing of these trees has already caused irreparable harm to them, all Harvey Updyke did was speed up the process. Harvey Updyke is an idiot for doing what he did. Should he go to jail and live on the taxpayers’ dime? Of course not. Sentence him to probation, community service, and a fine. I talked to someone close to the situation yesterday. He said the trees are done and that the big decision to come is what organization gets the proceeds from the sale of the wood. That wood cut up into small pieces, plaques or whatever, will probably bring a large sum of money.

Tommer’s Corner refers to the intersection of Magnolia and College Streets. Toomer’s Drugs is on one corner, a bank is across Magnolia, a bar (used to be a bank, I guess, since its called “The Vault”) is across College, while the trees are on the corner of the intersection that is a part of the Auburn campus. Kinda like the Arch is across Broad Street from what used to be the Varsity (now a Five Guys?)

@Never Been There – the oaks are physically located on the ground of the University at main entrance to the campus. The street intersection is affectionately called Toomer’s Corner because of the long-running soda fountain/drug store (named Toomers Drugs, open since 1896) diagonally across from the entrance.

Its just a dang tree for crying out loud, there are thousands of tree cutting services everyday hacking trees down. whats the big deal?!?!?
The guy doesnt deserve any jail time, folks do a lot worse things than this and get 30 days probation which is what Im thinking he’ll get. Maybe a fine which of course will get paid by any one of the larger Bama boosters.

this senseless act deserves some form of retribution or karma if you will and I’m betting that when ‘ole Harvey boy does his 90 or 180 days or whatever he gets (misdemeanor is punishable by $1000 and up to 12 months in jaiil and there ain’t no way he’s staying out of jail) his celly — cellmate — is a rather large ex-Auburn football player in the Black Gorilla prison gang. I certainly feel bad for the trees themselves; that’s an awful way to get wiped out after spending a lifetime getting degraded by Auburn fans themselves.
Good ol’ Auburn; must be the only place in America where “adults” take something majestic and proud like some 130-year old oaks, and reduce them to a childish pre-teen prank by littering them with the same stuff you use to clean feces off your behind.
I’m not sure they ever fully grasped what rolling was designed for… back when I was a kid, the little neighborhood vandals walked the streets looking to roll the trees and houses of people they HATED, not the ones they liked or respected.

One of the sadder facts is that this moron Harvey Updike was an active Alabama state trooper! Now, imagine getting pulled over late at night on the highway and having someone this unhinged wearing a sidearm and a fullsilade of lawful authority standing by your window! Should give everyone reason for concern!
The level of unbridled hatred over something as insignificant as university rivalry is truly alarming and all citizens of Alabama should be ashamed of it. ESPN even did a hour long documentary on the situation — that’s how stupid and out of hand it has gotten.
