
Atlanta Falcons defensive tackle Jonathan Babineaux will miss the season opener against Pittsburgh. (Curtis Compton,ccompton@ajc.com)
FLOWERY BRANCH – Falcons defensive tackle Jonathan Babineaux was suspended for one game by the league office on Tuesday for violating the NFL’s policy and program for substance abuse.
Babineaux was also fined an additional game check. He will miss the season opener against the Pittsburgh Steelers and will be eligible to return to the team on Sept. 13.
He will be allowed to practice with the team and play in all of the exhibition games before his suspension takes affect on Sept. 4.
Babineaux reached plea deal and avoided jail time in a drug related case on July 14.
Babineaux’s felony charge of marijuana possession was reduced in Gwinnett County Court to three misdemeanor counts of marijuana possession, according to his agent Jack Bechta and his attorney Patrick McDonough.
Bechta, in an e-mail to the Atlanta Journal-Constitution, said Babineaux pled no contest and was sentenced to 12 months of probation and a $1,500 fine on one count. The other two counts were suspended and will not be prosecuted if Babineaux completes the probation.
“He pleaded no contest, was direct, forthcoming and cooperative with the DA’s office,” Bechta said. “Jon, told me that he ‘was embarrassed’ by the incident, it was a bad decision and that he will become a better person for it. He said he will accept the consequences, move on and that he’s ready to focus on the season.”
Babineaux is believed to be a first time offender under the league’s substance abuse policy.
Babineaux was arrested in December on charges of possession of marijuana during a routine traffic stop.
Babineaux, 28, was with another man, 25-year-old Aaron Robinson of Minneapolis, who also was arrested. Robinson was charged with possession of marijuana, a felony.
Gwinnett Police originally stated both men would be charged with intent to distribute, but later released a statement clarifying the charges. Babineaux and Robinson were charged with possessing more than an ounce of marijuana, but not with intent to distribute. The charges are still felonies.
Babineaux and Robinson were stopped as they drove north on I-85 in Babineaux’s 2005 Cadillac Escalade EXT.
“It’s cut and dry,” Gwinnett police spokesman Cpl. David Schiralli told the AJC. “He was stopped for a traffic violation.”
Schiralli said the officer searched the SUV because he smelled marijuana. The officer found three bags containing a total of 40 grams of marijuana, Schiralli said.
In addition to the possession charges, Babineaux is charged with having no tag light and driving without a license and with an expired tag. He also was charged with tinting his car windows too much.
The Falcons drafted Babineaux in the second round out of Iowa in 2005.
He signed a five-year, $25 million contract extension with the team in November 2008. One game check for his $2.2 million base salary is $275,000.

I was really surprised, compared to the current commissioners penalties for other players in the league, it is a slap on the wrist. I am glad it is only one game. Another thing, I wonder what Goddell’s thoughts are on the nations marijuana laws. I think they’re insane. I heard once that the cotton industry, a long time ago, fought for stiff laws against hemp and marijuana because they feared the competition. If I ever get in front of an impaired driver, I hope he’s impaired by marijuana and not alcohol. The whole thing makes no sense to me.

I’ve never been clear on this. The officer said he smelled marijuana, but does that necessarily mean they were smoking it or high when they were pulled over? To me that makes a difference. What a man does on his own time is his own business as far as I’m concerned. But if he was under the influence and driving, well that puts others at risk and now you’ve crossed a line.

HIRAMSAINT-It’s called CAUSE AND EFFECT, read up on it, please. Last yr, the AINTS had the better OFF, but we had the better DEF. We’ve made tremendous DEF improvements, while your AINTS DEF has taken a step or 2 backwards. Your OFF isn’t likely to improve much, if at all, but the return of last yrs injured OFF players will provide a major improvement to our OFF. If both teams are healthy, the Falcons are the better team.
THERE’S NO WAY YOUR AINTS ARE GOING TO DEFEAT THE FALCONS THIS SEASON.

Seems to me I read that Babs dog was attacking his daughter he hit the dog in the head and it died. KEITH MERCER-This country went through prohibition, which posed a legal and moral quandary similar to our current drug situation. Since legalizing its sale and use, all alcohol related mafia and gang shootings, murders and deaths have all but ceased. Our jails, prisons and law enforcement are no longer being burdened by having to deal with people for illegally selling and using alcohol.
This country is now collecting revenue from the legal sale and taxation of alcohol, rather than wasting tax dollars fighting it’s illegal sale and use. The question isn’t whether the sale of certain drugs should be legalized or not, but who should profit from its sale. Because no matter what anyone’s opinion is on the matter, morally of otherwise, certain drugs will continue to be sold in this country one way or the other, regardless.
The question is, do we want tax paying citizens to benefit and profit from the legal sale of these drugs, or the drug dealers selling these drugs illegally. It’s not a moral issue, but an economic one.

I will BET a weeks pay that if you posted a police crusier outside any nightclub that serves alcohol..and made each person as they leave the club blow in to a breath or take a test any 80% would fail especially holiday weekend, fri sat and sun over along weekend..You can NOT tell me that folks are only going to have one beer. and leave the club. your stupid if you think folks are not drunk leaving establishments that serve alcohol. What about the ones who dont Do weed but Drink Daily/ I know i have friends that drink daily..I myself when I was clubbing ALways had at least 3 to four beers. I dont club anymore that was over 15yrs ago. If I drink get high its at my HOUSE. I dont even walk to the mail box when I am stoned. I stay in my HOUSE. but as I stated I did drink and drive. And NEVER got into an accident. or pulled over. I stopped on my own and cut back on the drinking because I didnt want to be responsible for that one time having to much and killing some one. the fact is I STILL drove. and others are doing the same. @TheMan, your lawyer wasn’t as good as you thought he was. I got off with a lighter sentence than Babs and had much more weed. Not bragging but it’s the truth. None of you seem to really understand the criminal justice system. People who can afford good representation typically get better results. That’s not justice, but that is the way it works and nobody complains until it’s a rich black athlete getting the breaks.
Falcons are a better team with Babs and I for one am very happy that he will be with the team for 15 regular season games and a long playoff run.
