I’m not dismissing any potential bad conduct by McDowell, but I’d bet 10 minutes with Gloria Allred will mess up those kids a lot worse than ANYTHING McDowell might have said or done.

I wouldn’t punish Roger, I think an apology would be fine. Everyone blows gay-slurs out of proportion these days. Its offensive just like anything else, but not really punishable by a fine or suspension. Apologize and move on. I’m sure whoever he said it to was saying offensive remarks as well.

Both cases. Need to move on. This isn’t big news. I’ve met McDowell and I’ve seen him up close and personal with fans during Spring Training. He’s a nice guy. I’m sure he was being heckled relentlessly by some idiots and lost his cool. Sit him for 2-3 and move on.

Derek. If I had that car, his job and that money…I’d be in the same situation. Could’ve been 3 beers people. Sit him out a start (will probably do good from his 3 day rest start last week) and move on.

DAP and Arkansas Transplant, Berkman is still going to cost the Cardinals with his defense, before all is said and done. That was still kind of a weird move, unless Berkman continues to lead the league in slugging and is 3rd in on-base all season, which doesn’t seem very likely.

@Jeff R’s 1237: No I don’t want to declare Roger guilty without a trial…but dude, he’s already apologized…so it’s not like there’s a question of whether or not he acted inappropriately…it is never appropriate for someone on the field to engage a fan that way. I’m just suggesting that the Braves don’t have to have Roger resign as I feared at first…but to keep Roger and minimize further controversy they are going to have to do something more than slap him on the wrist.

A refusal to take a breathalyzer test in GA results in an automatic suspension 10 days after arrest. HOWEVER if you file a request for an administrative hearing like any good lawyer would then the administrative hearing is postponed until after you go to court on the DUI charge. It is therefor very important to hire an attorney before the ten days are up otherwise they can suspend your license even before trial. Yes your blood could be taken by court order but that is extremely rare. Plus since most DUIs occur after 11:00 pm it is even more challenging to find a judge to sign such an order before the test becomes moot. Remember the alcohol does not stay in your blood forever. Breathalyzers are unreliable so it is wise to refuse. The cops will tell you it is an automatic suspension however they neglect to tell you that if you file an intent to appeal within 10 days your license will not be automatically suspended.

The “values” of many on this blog are laughable. If Lowe had been arrested this time last year for DUI, many on here would have been calling for him to be suspended, possibly having his contract terminated due to the “player’s conduct” part of his contract.

However, this year, no one is calling for such draconian actions. In fact, many of you are making light of it.

What’s the difference? This time last year, Lowe pretty much SUCKED on the mound. This year, he’s pretty much dealing on the mound.

However, Jose Reyes would not be a “good fit” for the Braves (according to many of you), lol! Please!

What gets me is that many of you who claim to be Braves fans actually have the nerve to say “this would have never happened under Bobby “I make Ike Turner look weak” Cox….that our players behaved under Cox. I guess that happens when ADD affects your long term memory.

No they cannot. That clause refers to injuries or actions that would cause a player to be unable to play for the team. For example, the motorcycle accident Ron Gant had when he was with the team that caused him to miss, what, a full season? That is something that could cause a voided contract. The Auto Racing wording, I suspect, would mean organized racing as at any level.

Carol: Thanks for a good report! I do suggest that you check out the difference between “diffuse” and “defuse.” Those two words are confused frequently.

Both these incidents will fade into the past, as they should, but first the club has to make a point with both McDowell and Lowe that professionals, who are paid obscenely large amounts, must behave in a manner that is appropriate to their public and role model status. In both cases, it’s clear that no rational thought was taking place.

Won’t presume Lowe guilty until facts are known, but 2 things come to mind: the Nick Adenhart tragedy. And the incident in January, 2000 in which 2 Charlotte (then the Hornets) players were drag racing. Bobby Phills was killed when his car rolled racing against David Wesley. This is serious stuff.
